（趣旨）
(Purpose)
第一条　この法律(ほうりつ) : Act[原則], Code[いわゆる法典]法律は、外国(がいこく) : foreign state / 外国において外国刑の確定裁判を受けその執行として拘禁されている日本国民等, foreign country / 外国の法令外国等に対して我が国(くに) : the State[原則], national government[地方公共団体と比較する場合]国の民事裁判権(さいばんけん) : jurisdiction裁判権（裁判権(さいばんけん) : jurisdiction裁判権のうち刑(けい) : punishment刑事に係る(にかかる) : pertaining to / 当該届出に係る事項に係るもの以外のものをいう。第四条(じょう) : Article / 第１条: 第１条の２, Art. / 第１条: 第１条の２条において同じ。）が及ぶ範囲及び(および) : and及び外国(がいこく) : foreign state / 外国において外国刑の確定裁判を受けその執行として拘禁されている日本国民等, foreign country / 外国の法令外国等に係る(にかかる) : pertaining to / 当該届出に係る事項に係る民事の裁判手続(さいばんてつづき) : court decision proceeding, court decision proceedings裁判手続についての特例を定めるものとする(とする) : shall beとする。

(Definitions)
第二条　この法律(ほうりつ) : Act[原則], Code[いわゆる法典]法律において「外国(がいこく) : foreign state / 外国において外国刑の確定裁判を受けその執行として拘禁されている日本国民等, foreign country / 外国の法令外国等」とは、次に掲げるもの（以下「…」という(いか「…」という) : hereinafter referred to as "…"以下「国等」という。）のうち、日本国(くに) : the State[原則], national government[地方公共団体と比較する場合]国及び(および) : and及び日本国(くに) : the State[原則], national government[地方公共団体と比較する場合]国に係る(にかかる) : pertaining to / 当該届出に係る事項に係るものを除くものをいう。
Article 2　In this Act : 法(ほう)[法律名に使う場合の原則] / Trademark Act, 法律(ほうりつ)[原則]Act, a "Foreign State, etc." shall : しなければならない(しなければならない), するものとする(するものとする)shall mean the : 当該(とうがい)the entities listed : 上場(じょうじょう), 上場された(じょうじょうされた)listed in the : 当該(とうがい)the follow : 付和随行(ふわずいこう), 付和随行する(ふわずいこうする)following item : 号(ごう)[原則] / item 3items (hereinafter referred to as a "State, etc."), excluding Japan : 本邦(ほんぽう)Japan and : 及び(および), かつ(かつ), 並びに(ならびに) / A and B, C, and Dand any entity which pertains to Japan : 本邦(ほんぽう)Japan:
一　国(くに) : the State[原則], national government[地方公共団体と比較する場合]国及び(および) : and及びその(その) : his/her[人を指す場合]その政府(せいふ) : government政府の機関
(i)　A State and : 及び(および), かつ(かつ), 並びに(ならびに) / A and B, C, and Dand the : 当該(とうがい)the governmental institution : 提起(ていき)[刑事手続等] / institution of prosecution, 施設(しせつ)institutions thereof;
二　連邦国(くに) : the State[原則], national government[地方公共団体と比較する場合]国家の州その(その) : his/her[人を指す場合]その他これに準ずる(にじゅんずる) : equivalent[形容詞（同等の、類似の）] / これに準ずる方法, shall be dealt with in the same manner as[動詞（同様に扱う）] / 正犯に準ずるに準ずる国(くに) : the State[原則], national government[地方公共団体と比較する場合]国の行政(ぎょうせい) : administration行政区画であって、主権的な権能を行使(こうし) : use, exercise, uttering[偽造文書等の場合]行使する権限(けんげん) : authority / その権限は、…と解釈してはならない, power / 最高裁判所は、この法律に定めるものの外、他の法律において特に定める権限を有する。, jurisdiction / 裁判所の権限権限を有するもの
(ii)　A state : 状態(じょうたい) / state of insanitystate within a federal state : 状態(じょうたい) / state of insanitystates and : 及び(および), かつ(かつ), 並びに(ならびに) / A and B, C, and Dand any other : 別段の(べつだんの)other administrative : 行政の(ぎょうせいの)administrative division : 分割(ぶんかつ)[原則]divisions of a State equivalent : 同等の(どうとうの), に準ずる(にじゅんずる)[形容詞（同等の、類似の）] / equivalent methodequivalent thereto having the : 当該(とうがい)the authority : 職権(しょっけん), 権限(けんげん) / the authority shall not be construed as …, 権原(けんげん) / within the scope of authority acquired through such transactionauthority to exercise : 行使(こうし)exercise sovereign power : 権限(けんげん) / The Supreme Court shall have powers specially provided for by other laws in addition to those provided for in this Act.power;
三　前二号(ごう) : item[原則] / 第３号, (i)(ii)(iii)[見出しとして用いる場合]号に掲げるもののほか(にかかげるもののほか) : in addition to what is listed inに掲げるもののほか、主権的な権能を行使(こうし) : use, exercise, uttering[偽造文書等の場合]行使する権限(けんげん) : authority / その権限は、…と解釈してはならない, power / 最高裁判所は、この法律に定めるものの外、他の法律において特に定める権限を有する。, jurisdiction / 裁判所の権限権限を付与された団体（当該(とうがい) : said / 当該書面, such, that, the, referenced, relevant当該権能の行使(こうし) : use, exercise, uttering[偽造文書等の場合]行使としての行為(こうい) : act, conduct行為をする場合に限る(にかぎる) : limited to / 第１項の資格（政令で定めるものに限る。）: ただし、第５条に規定する場合に限るに限る。）

四　前三号(ごう) : item[原則] / 第３号, (i)(ii)(iii)[見出しとして用いる場合]号に掲げるものの代表者(だいひょうしゃ) : representative, representative person代表者であって、その(その) : his/her[人を指す場合]その資格(しかく) : qualification[能力・免許としての資格] / 原資格国, status[地位としての資格] / 在留資格, capacity[法定資格]資格に基づき行動するもの
(iv)　A representative : 代表者(だいひょうしゃ), 代理委員(だいりいいん), 代理人(だいりにん)[法定代理も含む場合]representative of an entity listed : 上場(じょうじょう), 上場された(じょうじょうされた)listed in the : 当該(とうがい)the previous three item : 号(ごう)[原則] / item 3items acting : 代行の(だいこうの)[一時的・暫定的な場合]acting based on : に基づく(にもとづく)[原則] / opinion based on expert knowledgebased on its qualification : 資格(しかく)[能力・免許としての資格] / country of primary qualificationqualifications.

第三条　この法律(ほうりつ) : Act[原則], Code[いわゆる法典]法律の規定(きてい) : provision規定は、条約(じょうやく) : convention, treaty条約又は(または) : or又は確立(かくりつ) : establishment確立された国(くに) : the State[原則], national government[地方公共団体と比較する場合]国際法(ほう) : Act[法律名に使う場合の原則] / 商標法, Code[いわゆる法典] / 民法: 刑法: 商法: 民事訴訟法: 刑事訴訟法, Law[いわゆる一般名称や科目名としての法律]法規に基づき外国(がいこく) : foreign state / 外国において外国刑の確定裁判を受けその執行として拘禁されている日本国民等, foreign country / 外国の法令外国等が享有する(きょうゆうする) : enjoy享有する特権又は(または) : or又は免除(めんじょ) : immunity免除に影響(えいきょう) : influence / 化学物質が労働者の健康に与える影響についての調査, effect / 海洋環境に対する悪影響, impact / その利用が地域及び地球の環境に大きな影響を及ぼす, prejudice[悪影響の意味の場合]影響を及ぼすものではない。
Article 3　The provision : 規定(きてい), 支給(しきゅう)[物], 条項(じょうこう)provisions of this Act : 法(ほう)[法律名に使う場合の原則] / Trademark Act, 法律(ほうりつ)[原則]Act shall not : してはならない(してはならない) / the authority shall not be construed as …: no person shall …shall not affect : 影響する(えいきょうする)affect the : 当該(とうがい)the privileges or : 又は(または), 若しくは(もしくは) / A, B, or C, D or Eor immunities enjoy : 享有する(きょうゆうする)enjoyed by a Foreign State, etc. based on : に基づく(にもとづく)[原則] / opinion based on expert knowledgebased on treaties or : 又は(または), 若しくは(もしくは) / A, B, or C, D or Eor the : 当該(とうがい)the establish : 確立する(かくりつする), 設定する(せっていする), 制定する(せいていする), 成立させる(せいりつさせる), 形成する(けいせいする), 策定する(さくていする)established international law.
第二章　外国等に対して裁判権が及ぶ範囲

第一節　免除の原則
Section 1 Principle of Immunity
第四条　外国(がいこく) : foreign state / 外国において外国刑の確定裁判を受けその執行として拘禁されている日本国民等, foreign country / 外国の法令外国等は、この法律(ほうりつ) : Act[原則], Code[いわゆる法典]法律に別段の定めがある場合を除き(べつだんのさだめがあるばあいをのぞき) : unless otherwise provided for別段の定めがある場合を除き、裁判権(さいばんけん) : jurisdiction裁判権（我が国(くに) : the State[原則], national government[地方公共団体と比較する場合]国の民事裁判権(さいばんけん) : jurisdiction裁判権をいう。以下同じ(いかおなじ) : the same shall apply hereinafter以下同じ。）から免除(めんじょ) : immunity免除されるものとする(とする) : shall beとする。
Article 4　A Foreign State, etc., except : を除くほか(をのぞくほか)[例外を示す場合] / except when special measures are takenexcept as otherwise : 別段の(べつだんの)[副詞] / provided, however, that, this shall not apply in the case where it is otherwise provided in the articles of incorporationotherwise provide : 規定する(きていする), 供する(きょうする) / document provided for use of the public office, 支給する(しきゅうする), 提供する(ていきょうする)provided by this Act : 法(ほう)[法律名に使う場合の原則] / Trademark Act, 法律(ほうりつ)[原則]Act, shall be : とする(とする)shall be immune from jurisdiction : 管轄(かんかつ), 管轄権(かんかつけん), 裁判権(さいばんけん), 所管(しょかん), 権限(けんげん) / jurisdiction of the courtjurisdiction (meaning the : 当該(とうがい)the civil jurisdiction : 管轄(かんかつ), 管轄権(かんかつけん), 裁判権(さいばんけん), 所管(しょかん), 権限(けんげん) / jurisdiction of the courtjurisdiction of Japan : 本邦(ほんぽう)Japan; the same shall apply hereinafter : 以下同じ(いかおなじ)the same shall apply hereinafter).
第二節　裁判手続について免除されない場合

（外国等の同意）
(Consent of a Foreign State, etc.)
第五条　外国(がいこく) : foreign state / 外国において外国刑の確定裁判を受けその執行として拘禁されている日本国民等, foreign country / 外国の法令外国等は、次に掲げるいずれかの方法(ほう) : Act[法律名に使う場合の原則] / 商標法, Code[いわゆる法典] / 民法: 刑法: 商法: 民事訴訟法: 刑事訴訟法, Law[いわゆる一般名称や科目名としての法律]法により、特定の事項(こう) : paragraph[原則] / 第２項, para.[原則] / 第２項, (2)(3)(4)[見出しとして用いる場合], row[法令の表・別表中において、縦の線で区画されている区切りを指す場合] / 第２項項又は(または) : or又は事件(じけん) : case事件に関して裁判権(さいばんけん) : jurisdiction裁判権に服することについての同意(どうい) : consent同意を明示(めいじ) : clear indication明示的にした場合には、訴訟手続(そしょうてつづき) : court proceeding, court proceedings訴訟手続その(その) : his/her[人を指す場合]その他の裁判所(さいばんしょ) : court裁判所における手続(てつづき) : procedure, proceeding / 略式手続, proceedings / 略式手続手続（外国(がいこく) : foreign state / 外国において外国刑の確定裁判を受けその執行として拘禁されている日本国民等, foreign country / 外国の法令外国等の有する財産(ざいさん) : property / 出資は、金銭以外の財産ですることができない, assets / 抵当不動産以外の財産からの弁済財産に対する保全処分(ほぜんしょぶん) : temporary restraining order保全処分及び(および) : and及び民事執行(みんじしっこう) : civil execution民事執行の手続(てつづき) : procedure, proceeding / 略式手続, proceedings / 略式手続手続を除く。以下この節(せつ) : Section / 第１節節において「裁判手続(さいばんてつづき) : court decision proceeding, court decision proceedings裁判手続」という。）のうち、当該(とうがい) : said / 当該書面, such, that, the, referenced, relevant当該特定の事項(こう) : paragraph[原則] / 第２項, para.[原則] / 第２項, (2)(3)(4)[見出しとして用いる場合], row[法令の表・別表中において、縦の線で区画されている区切りを指す場合] / 第２項項又は(または) : or又は事件(じけん) : case事件に関するものについて、裁判権(さいばんけん) : jurisdiction裁判権から免除(めんじょ) : immunity免除されない。

(i)　Treaties or : 又は(または), 若しくは(もしくは) / A, B, or C, D or Eor any other : 別段の(べつだんの)other international agreement : 国際約束(こくさいやくそく)international agreements;
二　書面による契約(けいやく) : contract契約
(ii)　Written contract : 契約(けいやく), 契約書(けいやくしょ), 約款(やっかん), 締結(ていけつ), 締結する(ていけつする)contracts;
三　当該(とうがい) : said / 当該書面, such, that, the, referenced, relevant当該裁判手続(さいばんてつづき) : court decision proceeding, court decision proceedings裁判手続における陳述(ちんじゅつ) : statement陳述又は(または) : or又は裁判所(さいばんしょ) : court裁判所若しくは(もしくは) : or / Ａ、Ｂ又はＣ、Ｄ若しくはＥ若しくは相手方(あいてがた) : opponent[対審手続の場合] / 検察官、被告人又は弁護人が証人、鑑定人、通訳人又は翻訳人の尋問を請求するについては、あらかじめ、相手方に対し、その氏名及び住居を知る機会を与えなければならない, the other parties[一般的な場合] / 委任は、当事者の一方が法律行為をすることを相手方に委託し、相手方がこれを承諾することによって、その効力を生ずる, the other party[一般的な場合] / 委任は、当事者の一方が法律行為をすることを相手方に委託し、相手方がこれを承諾することによって、その効力を生ずる, opposite party[一般的な場合] / 差止請求に係る相手方の債務の履行, counterparty[契約などの相手方] / 代理権を有しない者がした契約は、本人が追認をしない間は、相手方が取り消すことができる, adverse party[対立当事者の場合] / 特許権又は専用実施権の侵害に係る訴訟において、当該特許が特許無効審判により無効にされるべきものと認められるときは、特許権者又は専用実施権者は、相手方に対しその権利を行使することができない相手方に対する書面による通知(つうち) : notice通知

２　外国(がいこく) : foreign state / 外国において外国刑の確定裁判を受けその執行として拘禁されている日本国民等, foreign country / 外国の法令外国等が特定の事項(こう) : paragraph[原則] / 第２項, para.[原則] / 第２項, (2)(3)(4)[見出しとして用いる場合], row[法令の表・別表中において、縦の線で区画されている区切りを指す場合] / 第２項項又は(または) : or又は事件(じけん) : case事件に関して日本国(くに) : the State[原則], national government[地方公共団体と比較する場合]国の法令(ほうれい) : laws and regulations法令を適用する(てきようする) : apply適用することについて同意(どうい) : consent同意したことは、前項(ぜんこう) : immediately preceding paragraph, the preceding paragraph前項の同意(どうい) : consent同意と解してはならない(してはならない) : shall not / その権限は、…と解釈してはならない: 何人も…してはならないしてはならない。

第六条　外国(がいこく) : foreign state / 外国において外国刑の確定裁判を受けその執行として拘禁されている日本国民等, foreign country / 外国の法令外国等が次に掲げる行為(こうい) : act, conduct行為をした場合には、前条(ぜんじょう) : immediately preceding article, the preceding article前条第一項(こう) : paragraph[原則] / 第２項, para.[原則] / 第２項, (2)(3)(4)[見出しとして用いる場合], row[法令の表・別表中において、縦の線で区画されている区切りを指す場合] / 第２項項の同意(どうい) : consent同意があったものとみなす(みなす) : shall be deemedみなす。
