鯨類の持続的な利用の確保に関する法律 Act for Ensuring Sustainable Use of Whales 平成二十九年法律第七十六号 Act No. 76 of 2017 令和元年法律第七十三号 Act No. 73 of 2019 鯨類の持続的な利用の確保に関する法律（平成二十九年六月二十三日法律第七十六号） Act for Ensuring Sustainable Use of Whales (Act No. 76 of June 23, 2017) 第一条　この法律は、鯨類は重要な食料資源であり、他の海洋生物資源と同様に科学的根拠に基づき持続的に利用すべきものであるとともに、我が国において鯨類に係る伝統的な食文化その他の文化及び食習慣を継承し、並びに鯨類の利用に関する多様性が確保されることが重要であることに鑑み、鯨類の持続的な利用の確保に関し、基本原則を定め、及び国の責務を明らかにするとともに、基本方針及び鯨類科学調査計画の策定、鯨類科学調査の実施体制の整備、捕鯨業の適切かつ円滑な実施のための措置、妨害行為の防止及び妨害行為への対応のための措置その他の必要な事項を定め、もって水産業及びその関連産業の発展を図るとともに、海洋生物資源の持続的な利用に寄与することを目的とする。 Article 1 The purpose of this Act is to ensure the development of the fishery sector and its related industries and to contribute to sustainable use of marine living resources by establishing the fundamental principles and clarifying the responsibilities of the State for ensuring sustainable use of whales, and by providing for the development of the basic policy and scientific whale research programs, establishment of a system for conducting scientific whale research, measures for the appropriate and smooth operation of whale fishery, measures for the prevention of and addressing acts of interference, and by setting forth other requirements, in light of whales being an important food resource which should be used in a sustainable manner based on scientific evidence as is the case with other marine living resources, and of the importance in Japan of succession of the traditional culinary and other cultures and dietary practices involving whales, and of ensuring the diversity in the use of whales. 第二条　この法律において「鯨類の持続的な利用」とは、鯨類を適切な水準に維持するようにその保存及び管理を行いながら持続的に利用することをいう。 Article 2 (1) The term "sustainable use of whales" as used in this Act means using whales in a sustainable manner through conservation and management to maintain their populations at appropriate levels. ２　この法律において「鯨類科学調査」とは、鯨類の持続的な利用のための科学的情報を収集することを目的として行う鯨類に関する科学的な調査をいう。 (2) The term "scientific whale research" as used in this Act means scientific research on whales conducted for the purpose of collecting scientific information for sustainable use of whales. ３　この法律において「捕鯨業」とは、鯨類を捕獲する漁業をいう。 (3) The term "whale fishery" as used in this Act means the fishery involving catching of whales. ４　この法律において「妨害行為」とは、鯨類科学調査又は捕鯨業の操業を妨害する行為をいう。 (4) The term "acts of interference" as used in this Act means acts that interfere with scientific whale research or operation of whale fishery. 第三条　鯨類の持続的な利用の確保は、次に掲げる事項を基本として行われるものとする。 Article 3 Sustainable use of whales is to be ensured based on the following: 一　鯨類科学調査が、次に掲げる事項を旨として実施されること。 (i) scientific whale research will be conducted based on the following principles: イ　主として捕鯨業を鯨類の持続的な利用が確保されるように実施するために必要な科学的知見を得ることを目指して実施されること。 (a) scientific whale research will be conducted with the primary aim of obtaining scientific knowledge necessary to operate whale fishery in a manner that will ensure sustainable use of whales; ロ　我が国が締結した条約その他の国際約束及び確立された国際法規に基づき、かつ、科学的知見を踏まえて実施されること。 (b) scientific whale research will be conducted in accordance with treaties and other international agreements concluded by Japan, as well as in accordance with established international law, and based on scientific knowledge; ハ　必要な研究成果が得られるよう、調査の結果については十分な分析及び研究が行われるとともに、それにより得られた研究成果については、広く公表され、かつ、その提供等により鯨類の持続的な利用の確保に係る国際協力が推進されること。 (c) research results will be fully analyzed and studied so that necessary research findings will be obtained, and these research findings will be made available to the public widely, promoting international cooperation for ensuring sustainable use of whales through their provision, etc.; ニ　必要に応じて国内外の鯨類に関する調査研究機関と連携を図りながら実施されること。 (d) where necessary, scientific whale research will be conducted in cooperation with research institutions in Japan and abroad. 二　捕鯨業に関する施策が、次に掲げる事項を旨として講じられること。 (ii) measures pertaining to whale fishery will be taken based on the following principles: イ　捕鯨業が、捕獲可能量（鯨類の持続的な利用のため、鯨類科学調査の結果その他の科学的根拠に基づき、捕獲の対象とする鯨類の種類ごとに一年間に捕獲することができる頭数の最高限度として算出される頭数をいう。以下同じ。）の範囲内で実施されること。 (a) whale fishery will be operated within the catch limits ("catch limits" means the number of whales calculated for each species of target whales as the maximum number of whales that can be caught in one year for sustainable use of whales, based on findings of scientific whale research and other scientific evidence; the same applies hereinafter); ロ　捕鯨業が、我が国が締結した条約その他の国際約束及び確立された国際法規に基づき実施されること。 (b) whale fishery will be operated in accordance with treaties and other international agreements concluded by Japan, as well as in accordance with established international law; ハ　捕鯨業を取り巻く状況に鑑み、適切な支援により、捕鯨業が円滑に実施されるようにすること。 (c) whale fishery will be operated smoothly with appropriate support, considering the circumstances surrounding whale fishery. 第四条　国は、前条に定める鯨類の持続的な利用の確保に関する基本原則（次条第一項において「基本原則」という。）にのっとり、鯨類の持続的な利用の確保のための施策を総合的に策定し、及び実施する責務を有する。 Article 4 The State will have the responsibility for comprehensively developing and implementing measures for ensuring sustainable use of whales in accordance with the fundamental principles for ensuring sustainable use of whales set forth in the preceding Article (hereinafter referred to as the "fundamental principles" in paragraph (1) of the following Article). 第五条　政府は、基本原則にのっとり、鯨類の持続的な利用の確保のための基本的な方針（以下「基本方針」という。）を定めなければならない。 Article 5 (1) The Government must establish the basic policy for ensuring sustainable use of whales in accordance with the fundamental principles (hereinafter referred to as the "basic policy"). ２　基本方針においては、次に掲げる事項を定めるものとする。 (2) The basic policy sets forth the following matters: 一　鯨類の持続的な利用の確保のための施策の基本的な方向 (i) basic orientation of measures for ensuring sustainable use of whales; 二　鯨類科学調査の意義に関する事項 (ii) matters on the significance of scientific whale research; 三　鯨類科学調査により収集する科学的情報に関する目標 (iii) objectives of scientific information collected through scientific whale research; 四　前号の目標を達成する上で特に重要と認められる鯨類科学調査の実施に関する基本的事項 (iv) basic matters on the conduct of scientific whale research that are considered particularly important in achieving the objectives mentioned in the preceding item; 五　鯨類科学調査の実施体制に関する基本的事項 (v) basic matters on the system for conducting scientific whale research; 六　捕獲可能量の算出等に関する基本的事項 (vi) basic matters concerning the calculation, etc. of the catch limits; 七　捕鯨業の円滑な実施の支援に関する基本的事項 (vii) basic matters on support for the smooth operation of whale fishery; 八　妨害行為の防止及び妨害行為への対応に関する基本的事項 (viii) basic matters on prevention of and for addressing acts of interference; 九　鯨類の持続的な利用の確保に係る国際協力の推進等に関する基本的事項 (ix) basic matters on the promotion, etc. of international cooperation for ensuring sustainable use of whales; 十　鯨類の適正な流通の確保等に関する基本的事項 (x) basic matters on ensuring the appropriate distribution of whales, and other related matters; and 十一　その他鯨類の持続的な利用の確保に関する重要事項 (xi) other important matters for ensuring sustainable use of whales. ３　農林水産大臣は、あらかじめ法務大臣、外務大臣、海上保安庁長官その他の関係行政機関の長（当該行政機関が合議制の機関である場合にあっては、当該行政機関。第十五条第一項において同じ。）と協議して、基本方針の案を作成し、閣議の決定を求めなければならない。 (3) The Minister of Agriculture, Forestry and Fisheries must formulate a draft basic policy by consulting in advance with the Minister of Justice, the Minister for Foreign Affairs, the Commandant of the Japan Coast Guard, and the heads of other relevant administrative organs (or, if any of such administrative organs is based on a council system, the administrative organ itself; the same applies in Article 15, paragraph (1)), and seek the decision of the Cabinet. ４　農林水産大臣は、前項の規定による閣議の決定があったときは、遅滞なく、基本方針を公表しなければならない。 (4) When a Cabinet decision is made pursuant to the provisions of the preceding paragraph, the Minister of Agriculture, Forestry and Fisheries must make public the basic policy without delay. ５　政府は、情勢の推移により必要が生じたときは、基本方針を変更しなければならない。 (5) The Government must change the basic policy if deemed necessary following the changes in circumstances. ６　第三項及び第四項の規定は、前項の規定による基本方針の変更について準用する。 (6) The provisions of paragraphs (3) and (4) apply mutatis mutandis to any change of the basic policy made pursuant to the provisions of the preceding paragraph. （鯨類科学調査計画） (Scientific Whale Research Program) 第六条　農林水産大臣は、基本方針に即して、農林水産省令で定めるところにより、特に重要と認められる鯨類科学調査の実施に関する計画（以下「鯨類科学調査計画」という。）を策定するものとする。 Article 6 (1) The Minister of Agriculture, Forestry and Fisheries is to develop a program for conducting scientific whale research which is considered particularly important, in accordance with the basic policy and as prescribed by Order of the Ministry of Agriculture, Forestry and Fisheries (hereinafter referred to as a "scientific whale research program"). ２　鯨類科学調査計画においては、前項の鯨類科学調査について、次に掲げる事項を定めるものとする。 (2) A scientific whale research program is to set forth the following matters concerning the scientific whale research mentioned in the preceding paragraph: 一　当該鯨類科学調査の目的 (i) the purpose of the scientific whale research; 二　当該鯨類科学調査の実施海域 (ii) the sea areas in which the scientific whale research will be conducted; 三　当該鯨類科学調査の方法 (iii) the methods of the scientific whale research; and 四　その他当該鯨類科学調査の実施に関し必要な事項 (iv) other matters necessary for conducting the scientific whale research. ３　農林水産大臣は、鯨類科学調査計画を策定したときは、遅滞なく、これを公表しなければならない。 (3) Upon development of a scientific whale research program, the Minister of Agriculture, Forestry and Fisheries must publish the program without delay. ４　農林水産大臣は、鯨類科学調査計画に係る鯨類科学調査の実施の状況等を勘案して、適宜、鯨類科学調査計画に検討を加え、必要があると認めるときは、これを変更しなければならない。 (4) The Minister of Agriculture, Forestry and Fisheries must consider the status, etc. of implementation of the scientific whale research pertaining to the scientific whale research program, and, after review of the scientific whale research programs, as appropriate, must modify each program if deemed necessary. ５　第三項の規定は、前項の規定による鯨類科学調査計画の変更について準用する。 (5) The provisions of paragraph (3) apply mutatis mutandis to any modification of the scientific whale research program made pursuant to the provisions of the preceding paragraph. （指定鯨類科学調査法人） (Designated Scientific Whale Research Corporation) 第七条　農林水産大臣は、一般社団法人又は一般財団法人であって、次項に規定する業務を適正かつ確実に行うことができると認められるものを、その申請により、指定鯨類科学調査法人として指定することができる。 Article 7 (1) The Minister of Agriculture, Forestry and Fisheries may designate a general incorporated association or general incorporated foundation which is considered to be capable of appropriately and reliably performing the service set forth in the following paragraph as a designated scientific whale research corporation, in response to an application by a general incorporated association or general incorporated foundation. ２　指定鯨類科学調査法人は、鯨類科学調査計画に係る鯨類科学調査の実施（第十一条の捕獲可能量の算出についての協力を含む。次条及び第九条において同じ。）をすることを業務とする。 (2) The duty of the designated scientific whale research corporation is the conduct of the scientific whale research pertaining to the scientific whale research program cooperating in the calculation of the catch limits mentioned in Article 11; the same applies in the following Article and Article 9). ３　指定鯨類科学調査法人は、農林水産省令で定めるところにより、農林水産大臣に、鯨類科学調査計画に係る鯨類科学調査の実施の状況を報告しなければならない。 (3) The designated scientific whale research corporation must report to the Minister of Agriculture, Forestry and Fisheries the status of implementation of the scientific whale research pertaining to the scientific whale research program, as prescribed by Order of the Ministry of Agriculture, Forestry and Fisheries. ４　農林水産大臣は、指定鯨類科学調査法人が第二項に規定する業務を適正かつ確実に実施していないと認めるときは、指定鯨類科学調査法人に対し、その業務の運営の改善に関し必要な措置を講ずべきことを命ずることができる。 (4) If the Minister of Agriculture, Forestry and Fisheries finds that the designated scientific whale research corporation has not appropriately and reliably performed any of the duties set forth in paragraph (2), the Minister of Agriculture, Forestry and Fisheries may order the designated scientific whale research corporation to take measures necessary to improve the conduct of its duties. ５　農林水産大臣は、指定鯨類科学調査法人が前項の規定による命令に違反したときは、その指定を取り消すことができる。 (5) If the designated scientific whale research corporation violates the order mentioned in the preceding paragraph, the Minister of Agriculture, Forestry and Fisheries may revoke its designation. ６　第一項の指定の手続その他指定鯨類科学調査法人に関し必要な事項は、農林水産省令で定める。 (6) The procedures for the designation set forth in paragraph (1) and other matters necessary in relation to the designated scientific whale research corporation are prescribed by Order of the Ministry of Agriculture, Forestry and Fisheries. 第八条　政府は、指定鯨類科学調査法人に対し、予算の範囲内において、鯨類科学調査計画に係る鯨類科学調査の実施に要する費用の一部を補助するものとする。 Article 8 The Government is to, within the limits of its budget, assist the designated scientific whale research corporation with part of the costs incurred in conducting the scientific whale research pertaining to the scientific whale research program. （国立研究開発法人水産研究・教育機構による鯨類科学調査の実施） (Conduct of Scientific Whale Research by the Japan Fisheries Research and Education Agency) 第九条　農林水産大臣は、国立研究開発法人水産研究・教育機構に、鯨類科学調査計画に係る鯨類科学調査の実施に関する業務（指定鯨類科学調査法人が行うものを除く。）を行わせることができる。 Article 9 The Minister of Agriculture, Forestry and Fisheries may have the Japan Fisheries Research and Education Agency perform services related to the conduct of the scientific whale research pertaining to the whale research program (excluding those duties to be performed by the designated scientific whale research corporation). （鯨類科学調査の実施体制の整備） (Development of a System for Conducting Scientific Whale Research) 第十条　政府は、鯨類科学調査を安定的かつ継続的に実施するため、鯨類に関する科学的な調査研究を行う人材の養成及び確保、鯨類科学調査の実施に当たっての捕鯨業者の協力の確保その他鯨類科学調査の実施体制の整備に必要な措置を講ずるものとする。 Article 10 In order to conduct scientific whale research in a stable and continuous manner, the Government is to foster and secure human resources for conducting scientific research and studies on whales, secure the cooperation of whale fishery managers in conducting scientific whale research, and take other measures necessary to develop a system for conducting scientific whale research. （捕獲可能量の算出等） (Calculation of Catch Limits) 第十一条　政府は、鯨類の持続的な利用が確保されるように捕鯨業が実施されるようにするため、捕獲可能量の算出、当該捕獲可能量の範囲内で捕鯨業者が一年間に捕獲することができる頭数の設定、これを超える捕獲が行われないことを確保するための措置その他必要な措置を講ずるものとする。 Article 11 In order to ensure that whale fishery is operated in a manner that will ensure sustainable use of whales, the Government is to calculate the catch limits, set the numbers of whales that whale fishery managers can catch in one year within the catch limits, take measures for ensuring that no whales will be caught beyond such numbers, and take other necessary measures. （捕鯨業の円滑な実施の支援） (Support for Smooth Operation of Whale Fishery) 第十二条　政府は、捕鯨業の円滑な実施を支援するため、捕鯨業の実施のための船舶及びその乗組員の確保の支援、鯨類の捕獲、解体及び保蔵に係る技術の開発及び普及の促進その他必要な措置を講ずるものとする。 Article 12 In order to support the smooth operation of whale fishery, the Government is to support the securing of vessels and their crews for operating whale fishery, promote the development and dissemination of technologies for catching, dissecting and preserving whales, and take other necessary measures. （妨害行為への対応等のための支援） (Support for Addressing Acts of Interference) 第十三条　政府は、鯨類科学調査を実施する者又は捕鯨業者が、妨害行為を防止し若しくは妨害行為に対応するために必要な船舶、設備若しくは装備を備え、又は船舶の乗組員その他の関係者に妨害行為を防止し若しくは妨害行為に対応するために必要な知識及び技能の習得若しくは向上のための訓練を行うため、必要な情報の提供、助言その他の必要な支援を行うものとする。 Article 13 The Government is to provide necessary information, advice, and other necessary support in order for entities conducting scientific whale research or whale fishery managers to prepare vessels, equipment or appurtenances necessary for the prevention of or addressing acts of interference, or to provide vessel crews and other relevant persons with training for them to acquire or improve knowledge and skills necessary for the prevention of or addressing acts of interference. （妨害行為への対応等のための政府職員の派遣等） (Assignment of Government Officials to Address Acts of Interference) 第十四条　政府は、妨害行為の防止又は妨害行為への対応のため、必要に応じ、水産庁の職員その他その職務に従事する政府職員（以下この条及び次条第一項において単に「政府職員」という。）又は政府職員が乗り組む船舶を鯨類科学調査の実施又は捕鯨業の操業に係る海域その他の場所に派遣し、当該政府職員に法令の規定に基づき必要な措置を講じさせるものとする。 Article 14 For the prevention of or addressing acts of interference, the Government is to, where necessary, dispatch officials of the Fisheries Agency or other government officials who are engaged in the aforementioned duty (hereinafter simply referred to as "government officials" in this Article and paragraph (1) of the following Article) or a vessel boarded with government officials to the sea area or any other area in which scientific whale research is conducted or whale fishery is operated, and have those government officials take necessary measures pursuant to laws and regulations. （妨害行為への対応のための関係行政機関の情報共有） (Sharing of Information among Relevant Administrative Organs to Address Acts of Interference) 第十五条　農林水産大臣、内閣総理大臣、法務大臣、外務大臣、海上保安庁長官その他の関係行政機関の長は、必要に応じ、鯨類科学調査又は捕鯨業に係る船舶の乗組員（前条の規定により派遣される政府職員及び同条の規定により派遣される船舶に乗り組む政府職員を含む。次項において同じ。）その他の関係者が妨害行為に対応してとることができる措置の具体的内容について、あらかじめ情報を共有することにより、相互の緊密な連携を確保するものとする。 Article 15 (1) The Minister of Agriculture, Forestry and Fisheries, the Prime Minister, the Minister of Justice, the Minister for Foreign Affairs, the Commandant of the Japan Coast Guard, and the heads of other relevant administrative organs are to ensure close cooperation with each other by sharing information in advance on the specific details of the measures that crew members (including government officials who are dispatched pursuant to the provisions of the preceding Article or who board a vessel dispatched pursuant to the provisions of the same Article; the same applies in the following paragraph) and other relevant persons of a vessel engaged in scientific whale research or whale fishery are allowed to take to address acts of interference where necessary. ２　前項の情報の共有は、想定される妨害行為の類型ごとに、我が国が締結した条約その他の国際約束及び確立された国際法規並びに法令に照らし、鯨類科学調査又は捕鯨業に係る船舶の乗組員その他の関係者が妨害行為に対応してとることができる措置について、鯨類科学調査を安定的かつ継続的に実施し、及び捕鯨業が円滑に実施されるようにする観点からできる限り具体的に行われるものとする。 (2) The sharing of information required by the preceding paragraph is to be done for each type of foreseen acts of interference, regarding the measures that crew members and other relevant persons of a vessel engaged in scientific whale research or whale fishery are allowed to take to address the act of interference in light of treaties and other international agreements concluded by Japan, established international law, and applicable laws and regulations, as concretely as possible from the viewpoint of ensuring the stable and continuous conduct of scientific whale research and the smooth operation of whale fishery. （妨害行為への対応等のためのその他の措置） (Other Measures Taken to Address Acts of Interference) 第十六条　政府は、外国船舶による妨害行為の防止又は外国船舶による妨害行為への対応のため、外交上適切な措置を講ずるものとする。 Article 16 (1) The Government is to take appropriate diplomatic measures for the prevention of or addressing acts of interference by foreign vessels. ２　政府は、妨害行為の発生の防止のため、妨害行為を行うおそれがある外国人について、上陸の拒否その他の入国、上陸及び在留の管理に関する必要な措置をとるものとする。 (2) In order to prevent acts of interference, the Government is to deny permission to land and take other measures necessary for the management of the entry, landing, and stay of, any foreign nationals who are likely to commit any act of interference. （鯨類の持続的な利用の確保に係る国際協力の推進等） (Promotion of International Cooperation for Ensuring Sustainable Use of Whales) 第十七条　政府は、鯨類科学調査により得られた科学的知見及び我が国における鯨類の持続的な利用の確保に関する情報の関係する国際機関への提供その他の鯨類の持続的な利用の確保に係る国際協力の推進に努めるとともに、当該科学的知見の国内外における普及及び活用並びに鯨類科学調査の意義に関する国内外における理解の増進のために必要な措置を講ずるものとする。 Article 17 (1) The Government is to strive to provide relevant international organizations with scientific knowledge obtained through scientific whale research and information regarding the ensuring of sustainable use of whales in Japan and to promote other types of international cooperation for ensuring sustainable use of whales, and take necessary measures to disseminate and utilize such scientific knowledge in Japan and abroad and promote the understanding of the significance of scientific whale research in Japan and abroad. ２　政府は、鯨類に係る伝統的な食文化その他の文化及び食習慣の継承並びに鯨類の利用に関する多様性の確保に関する国内外の理解と関心を深めるため、鯨類に関する文化及び食習慣並びに鯨類の利用についての広報活動の充実、学校給食等における鯨類の利用の促進その他の必要な措置を講ずるものとする。 (2) In order to deepen understanding and interest in Japan and abroad in the succession of Japan's traditional culinary, its related cultures and dietary practices involving whales, and the ensuring of diversity regarding the use of whales, the Government is to enhance public relations activities related to Japan's culture and dietary practices involving whales and the use of whales, promote the use of whale in school lunches, etc., and take other necessary measures. ３　政府は、捕鯨を取り巻く国際環境の改善を図るため、関係国との連携及び関係国への働きかけの強化その他必要な外交上の措置を講ずるものとする。 (3) In order to improve the international circumstances surrounding whaling, the Government is to enhance cooperation with and approaches to relevant countries and take other necessary diplomatic measures. （鯨類の適正な流通の確保等に関する措置） (Measures for Ensuring the Appropriate Distribution of Whales) 第十八条　政府は、法令の規定に違反して捕獲された鯨類の流通を防止するため、捕獲された鯨類の個体の識別のための情報の適正な管理、流通に関する調査その他必要な措置を講ずるものとする。 Article 18 (1) In order to prevent the distribution of whales caught in violation of provisions of laws and regulations, the Government is to manage information for identifying individual whales that have been caught appropriately, conduct research on their distribution, and take other necessary measures. ２　政府は、鯨類の加工、販売等を行う事業者その他の関係者に対しその事業等を妨害されることについての不安を生じさせることがないよう必要な措置を講ずるものとする。 (2) The Government is to take necessary measures with respect to business enterprises engaged in the processing and sale, etc. of whales and with respect to other relevant persons to prevent insecurity about potential interference with their businesses, etc. （財政上の措置等） (Financial and Other Measures) 第十九条　政府は、第八条に定めるもののほか、鯨類科学調査の実施体制の整備、捕鯨業の円滑な実施の支援、妨害行為への対応、鯨類の持続的な利用の確保に係る国際協力の推進その他鯨類の持続的な利用の確保のための施策の実施のため必要な財政上の措置その他の措置を講ずるものとする。 Article 19 In addition to the measures set forth in Article 8, the Government is to take financial and other measures necessary to develop a system for conducting scientific whale research, to support the smooth operation of whale fishery, to address acts of interference, to promote international cooperation for ensuring sustainable use of whales, and to implement other measures for ensuring sustainable use of whales.
