	<LawNum>Order of the Ministry of International Trade and Industry No. 64 of December 1, 1949</LawNum>

		<LawTitle>Regulations for Export Trade Control</LawTitle>
		<EnactStatement>Regulations for Export Trade Control are established as follows for the purpose of implementing the provisions of the Cabinet Order on Export Trade Control (Cabinet Order No. 378 of 1949).</EnactStatement>

			<Article Num="1" id="en_at1">
				<ArticleCaption>(Procedures for Applying for Permission, etc.)</ArticleCaption>
				<ArticleTitle>Article 1</ArticleTitle>
				<Paragraph Num="1" id="en_at1cl1">
					<ParagraphNum>(1)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>A person listed in any of the following items must submit the written application listed in those respective items to the Minister of Economy, Trade and Industry:</Sentence>
					</ParagraphSentence>
					<Item Num="1">
						<ItemTitle>(i)</ItemTitle>
						<ItemSentence>
							<Column Num="1">
								<Sentence>a person who intends to apply for export permission pursuant to the provisions of Article 48, paragraph (1) of the Foreign Exchange and Foreign Trade Act (Act No. 228 of 1949; hereinafter referred to as the "Act") to the Minister of Economy, Trade and Industry:</Sentence>
							</Column>
							<Column Num="2">
								<Sentence>two sets of a written application for export permission following the format prescribed in Appended Table 1;</Sentence>
							</Column>
						</ItemSentence>
					</Item>
					<Item Num="2">
						<ItemTitle>(ii)</ItemTitle>
						<ItemSentence>
							<Column Num="1">
								<Sentence>a person who intends to apply for export approval pursuant to the provisions of Article 2, paragraph (1) of the Cabinet Order on Export Trade Control (hereinafter referred to as the "Cabinet Order") to the Minister of Economy, Trade and Industry:</Sentence>
							</Column>
							<Column Num="2">
								<Sentence>three sets (or, if it is specified separately by the Minister of Economy, Trade and Industry, two sets) of a written application for export approval following the format prescribed in Appended Table 1-2 (or, if it falls under item (ii) of the same paragraph, of a written application for approval of export conducted on a contract for trade under a processing deal which follows the format prescribed in Appended Table 2); and</Sentence>
							</Column>
						</ItemSentence>
					</Item>
					<Item Num="3">
						<ItemTitle>(iii)</ItemTitle>
						<ItemSentence>
							<Column Num="1">
								<Sentence>a person who applies for export permission under Article 48, paragraph (1) of the Act and for export approval under Article 2, paragraph (1) of the Cabinet Order (except for that which pertains to item (ii) of the same paragraph) simultaneously to the Minister of Economy, Trade and Industry:</Sentence>
							</Column>
							<Column Num="2">
								<Sentence>three sets of a written application for export permission/approval following the format prescribed in Appended Table 1-3.</Sentence>
							</Column>
						</ItemSentence>
					</Item>
				</Paragraph>
				<Paragraph Num="2" id="en_at1cl2">
					<ParagraphNum>(2)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>The applicant must attach a document stating the reason for the application and a document evidencing the relevant facts to the written application set forth in the preceding paragraph.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="3" id="en_at1cl3">
					<ParagraphNum>(3)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>In giving export permission for goods listed in row 2 (i), (iii), (iv), (ix), (xviii) through (xxvi), (xxxiii), (xlvii), or (l); row 3 (ii) or (iii); row 4 (vi) or (xv); row 5 (i) through (iii), (v), or (vii) through (xix); row 6 (i); row 7 (xviii) through (xxi); row 9 (iii); row 10 (iii) or (xiv); row 14 (i) or (ii); or row 15 (i) through (iii) of Appended Table 1 of the Cabinet Order, or export approval for goods listed in the middle columns of row 19, 20, or 35-2 of Appended Table 2 of the Cabinet Order, the Minister of Economy, Trade and Industry may request a person who intends to apply for that permission or approval to submit two sets of a list of ingredients or two sets of a chemical analysis report signed by a representative of a laboratory or research institute regarding those goods and that person.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="4" id="en_at1cl4">
					<ParagraphNum>(4)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>A person who intends to apply for export approval for goods listed in the middle column of row 1 of Appended Table 2 of the Cabinet Order must submit two sets of an export confirmation following the format prescribed in Appended Table 1-4, in addition to those specified in the provisions of paragraph (1), to the Minister of Economy, Trade and Industry.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="5" id="en_at1cl5">
					<ParagraphNum>(5)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>In granting permission or approval to an application filed in accordance with paragraph (1), the Minister of Economy, Trade and Industry is to indicate to that effect in the written applications and deliver one set thereof to the applicant as a certificate of export permission or as a certificate of export approval.</Sentence>
					</ParagraphSentence>
				</Paragraph>
			</Article>
			<Article Num="1_2" id="en_at2">
				<ArticleCaption>(Procedures for Applying for Permission by Using an Electronic Data Processing System)</ArticleCaption>
				<ArticleTitle>Article 1-2</ArticleTitle>
				<Paragraph Num="1" id="en_at2cl1">
					<ParagraphNum>(1)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>Notwithstanding the provisions of paragraph (1) of the preceding Article, in filing an application using an electronic data processing system (meaning an electronic data processing system as prescribed in Article 2, item (i) of the Act on the Utilization of Electronic Data Processing System for the Processing and Other Handling of Import and Export-Related Business (Act No. 54 of 1977) which is deemed to be the electronic data processing system pursuant to the provisions of Article 6, paragraph (1) of the same Act; the same applies in the following Article) as prescribed in Article 3, paragraph (1) of the Act on the Promotion of Utilizing Information and Communications Technology in Administrative Procedures (Act No. 151 of 2002), a person listed in any of the following items must enter the particulars to be specified in an application form referred to in the relevant item through the input-output device (limited to that which conforms to the standards, as publicly notified by the Minister of Economy, Trade and Industry; hereinafter referred to as the "specified input-output device") which that applicant referred to in the respective item uses:</Sentence>
					</ParagraphSentence>
					<Item Num="1">
						<ItemTitle>(i)</ItemTitle>
						<ItemSentence>
							<Column Num="1">
								<Sentence>a person who intends to apply for export permission pursuant to the provisions of Article 48, paragraph (1) of the Act to the Minister of Economy, Trade and Industry:</Sentence>
							</Column>
							<Column Num="2">
								<Sentence>particulars to be specified in an application form for export permission available from a file stored in a computer (including an input and output device; hereinafter referred to as a "special-purpose computer") used by Nippon Automated Cargo and Port Consolidated System, Inc.; and</Sentence>
							</Column>
						</ItemSentence>
					</Item>
					<Item Num="2">
						<ItemTitle>(ii)</ItemTitle>
						<ItemSentence>
							<Column Num="1">
								<Sentence>a person who intends to apply for export approval pursuant to the provisions of Article 2, paragraph (1) of the Cabinet Order (except for that which pertains to item (ii) of the same paragraph) to the Minister of Economy, Trade and Industry:</Sentence>
							</Column>
							<Column Num="2">
								<Sentence>particulars to be specified in an application form for export approval available from a file stored in the special-purpose computer.</Sentence>
							</Column>
						</ItemSentence>
					</Item>
				</Paragraph>
				<Paragraph Num="2" id="en_at2cl2">
					<ParagraphNum>(2)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>In filing an application set forth in the preceding paragraph, the applicant must enter information confirming the relevant facts through the specified input-output device and record it in a file stored in the special-purpose computer, or submit a document evidencing the relevant facts to the Minister of Economy, Trade and Industry.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="3" id="en_at2cl3">
					<ParagraphNum>(3)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>If a person who files an application as prescribed in paragraph (1) has entered information in accordance with the preceding paragraph, the Minister of Economy, Trade and Industry may have that person submit a document evidencing the facts in relation to the relevant information as necessary, during the period from the date on which the applicant has filed the application to the date on which the applicant is notified of whether their application has been accepted or denied.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="4" id="en_at2cl4">
					<ParagraphNum>(4)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>Having granted permission to an application filed in accordance with paragraph (1), item (i), the Minister of Economy, Trade and Industry is to record particulars to be specified in a certificate of export permission following the format prescribed in Appended Table 3 into a file stored in the special-purpose computer; and having granted approval to an application filed in accordance with item (ii) of the same paragraph, the Minister is to record particulars to be specified in a certificate of export approval following the format prescribed in Appended Table 4 into a file stored in the special-purpose computer.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="5" id="en_at2cl5">
					<ParagraphNum>(5)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>Notwithstanding the provisions of the preceding paragraph, in granting permission for an application filed in accordance with paragraph (1), item (i), the Minister of Economy, Trade and Industry is to indicate to that effect in a certificate of export permission following the format prescribed in Appended Table 3, and deliver it to the applicant, if the applicant requests the Minister to do so; and in granting approval for an application filed in accordance with item (ii) of the same paragraph, the Minister is to indicate to that effect in a certificate of export approval following the format prescribed in Appended Table 4, and deliver it to the applicant, if the applicant requests the Minister to do so.</Sentence>
					</ParagraphSentence>
				</Paragraph>
			</Article>
			<Article Num="1_3" id="en_at3">
				<ArticleCaption>(Applicant's Notification)</ArticleCaption>
				<ArticleTitle>Article 1-3</ArticleTitle>
				<Paragraph Num="1" id="en_at3cl1">
					<ParagraphNum>(1)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>An applicant that has filed advance notification by submitting a written applicant notification using Appended Table 6 and a document evidencing the relevant facts to the Minister of Economy, Trade and Industry must be the one to enter the information prescribed in paragraph (1) of the preceding Article.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="2" id="en_at3cl2">
					<ParagraphNum>(2)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>If there are any changes to the particulars of which a person has made a notification in accordance with the preceding paragraph or they intend to stop using an electronic data processing system (meaning an electronic data processing system connecting the special-purpose computer and the specified input-output device through a telecommunication line; the same applies in the following paragraph), they must enter to that effect in an applicant notification form following the format prescribed in Appended Table 6 and notify the Minister of Economy, Trade and Industry of it promptly.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="3" id="en_at3cl3">
					<ParagraphNum>(3)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>On finding it not appropriate for a person who has made a notification in accordance with paragraph (1) to continue to use an electronic data processing system, the Minister of Economy, Trade and Industry may suspend that person's use of the electronic data processing system.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="4" id="en_at3cl4">
					<ParagraphNum>(4)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>A notification submitted pursuant to the provisions of Article 2-3, paragraph (1) of the Regulations for Import Trade Control (Order of the Ministry of International Trade and Industry No. 77 of 1949) or a notification submitted pursuant to the provisions of Article 1-3, paragraph (1) of the Ministerial Order on Invisible Trade Connected with Visible Trade (Order of the Ministry of International Trade and Industry No. 8 of 1998) is deemed to be a notification submitted pursuant to the provisions of paragraph (1).</Sentence>
					</ParagraphSentence>
				</Paragraph>
			</Article>
			<Article Num="2" id="en_at4">
				<ArticleTitle>Article 2</ArticleTitle>
				<Paragraph Num="1" id="en_at4cl1">
					<ParagraphNum>(1)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>A person who intends to apply for export approval for goods for which the authority to grant export approval is delegated to the Directors-General of Customs-Houses pursuant to the provisions of Article 12, item (i), and item (ii), (a) and (b) of the Cabinet Order, must submit two sets of a written application for export approval prescribed in Article 1, paragraph (1), item (ii) to the Directors-General of Customs-Houses.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="2" id="en_at4cl2">
					<ParagraphNum>(2)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>The provisions of Article 1, paragraph (3) applies mutatis mutandis to cases in which the Directors-General of Customs-Houses grants approval pursuant to the provisions of Article 12, item (ii), (a) or (b) of the Cabinet Order.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="3" id="en_at4cl3">
					<ParagraphNum>(3)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>In granting approval to an application filed in accordance with paragraph (1), the Directors-General of Customs-Houses is to indicate to that effect in the relevant written applications and deliver one set thereof to the applicant as a certificate of export approval.</Sentence>
					</ParagraphSentence>
				</Paragraph>
			</Article>
			<Article Num="2_2" id="en_at5">
				<ArticleCaption>(Procedures for Applying for Special Permission and Approval)</ArticleCaption>
				<ArticleTitle>Article 2-2</ArticleTitle>
				<Paragraph Num="1" id="en_at5cl1">
					<ParagraphNum></ParagraphNum>
					<ParagraphSentence>
						<Sentence>Notwithstanding the provisions of this Ministerial Order, the Minister of Economy, Trade and Industry may provide a special procedure for those set forth in the following items, if necessary:</Sentence>
					</ParagraphSentence>
					<Item Num="1">
						<ItemTitle>(i)</ItemTitle>
						<ItemSentence>
							<Sentence>a procedure for obtaining permission from the Minister of Economy, Trade and Industry pursuant to the provisions of Article 48, paragraph (1) of the Act or for obtaining approval from the Minister of Economy, Trade and Industry pursuant to the provisions of Article 2, paragraph (1) of the Cabinet Order; and</Sentence>
						</ItemSentence>
					</Item>
					<Item Num="2">
						<ItemTitle>(ii)</ItemTitle>
						<ItemSentence>
							<Sentence>a procedure for making a notification to the Minister of Economy, Trade and Industry pursuant to the provisions of Article 1-3.</Sentence>
						</ItemSentence>
					</Item>
				</Paragraph>
			</Article>
			<Article Num="3" id="en_at6">
				<ArticleCaption>(Designated Processing Works and Raw Materials)</ArticleCaption>
				<ArticleTitle>Article 3</ArticleTitle>
				<Paragraph Num="1" id="en_at6cl1">
					<ParagraphNum></ParagraphNum>
					<ParagraphSentence>
						<Sentence>Processing works and raw materials to be specified by the Minister of Economy, Trade and Industry pursuant to the provisions of Article 2, paragraph (1), item (ii) of the Cabinet Order are to be the processing works listed in the following items as well as raw materials in accordance with a category of the processing works as listed in the respective items:</Sentence>
					</ParagraphSentence>
					<Item Num="1">
						<ItemTitle>(i)</ItemTitle>
						<ItemSentence>
							<Sentence>deleted;</Sentence>
						</ItemSentence>
					</Item>
					<Item Num="2">
						<ItemTitle>(ii)</ItemTitle>
						<ItemSentence>
							<Column Num="1">
								<Sentence>manufacturing of leather, fur skins and leather products (including fur products; the same applies hereinafter), and of semi-finished products thereof:</Sentence>
							</Column>
							<Column Num="2">
								<Sentence>skins and leather (including raw fur skins and dressed fur skins), and semi-finished leather products.</Sentence>
							</Column>
						</ItemSentence>
					</Item>
				</Paragraph>
			</Article>
			<Article Num="4" id="en_at7">
				<ArticleCaption>(Information from Customs to the Minister of Economy, Trade and Industry)</ArticleCaption>
				<ArticleTitle>Article 4</ArticleTitle>
				<Paragraph Num="1" id="en_at7cl1">
					<ParagraphNum></ParagraphNum>
					<ParagraphSentence>
						<Sentence Num="1" Function="Main">Customs is to notify the Minister of Economy, Trade and Industry promptly of particulars listed in the following items for the goods specified by the Minister of Economy, Trade and Industry by public notice, pursuant to the provisions of Article 5, paragraph (2) of the Cabinet Order;</Sentence>
						<Sentence Num="2" Function="Proviso">provided, however, that if the Minister of Economy, Trade and Industry finds it unnecessary to be notified about the particulars listed in those items, customs may be allowed to omit notification on particulars for which notification is found unnecessary:</Sentence>
					</ParagraphSentence>
					<Item Num="1">
						<ItemTitle>(i)</ItemTitle>
						<ItemSentence>
							<Sentence>name and address of the exporters of the goods;</Sentence>
						</ItemSentence>
					</Item>
					<Item Num="2">
						<ItemTitle>(ii)</ItemTitle>
						<ItemSentence>
							<Sentence>name of the consignee of the goods;</Sentence>
						</ItemSentence>
					</Item>
					<Item Num="3">
						<ItemTitle>(iii)</ItemTitle>
						<ItemSentence>
							<Sentence>place of shipment and place of destination of the goods;</Sentence>
						</ItemSentence>
					</Item>
					<Item Num="4">
						<ItemTitle>(iv)</ItemTitle>
						<ItemSentence>
							<Sentence>name or registration number of the ship or airplane on which the goods are to be loaded;</Sentence>
						</ItemSentence>
					</Item>
					<Item Num="5">
						<ItemTitle>(v)</ItemTitle>
						<ItemSentence>
							<Sentence>name, quantity and price of the goods;</Sentence>
						</ItemSentence>
					</Item>
					<Item Num="6">
						<ItemTitle>(vi)</ItemTitle>
						<ItemSentence>
							<Sentence>any terms and conditions of the contract which may affect determination of the price set forth in the preceding item;</Sentence>
						</ItemSentence>
					</Item>
					<Item Num="7">
						<ItemTitle>(vii)</ItemTitle>
						<ItemSentence>
							<Sentence>type of currency representing the charges for the goods; and</Sentence>
						</ItemSentence>
					</Item>
					<Item Num="8">
						<ItemTitle>(viii)</ItemTitle>
						<ItemSentence>
							<Sentence>beyond the particulars listed in the preceding items, particulars specified by the Minister of Economy, Trade and Industry by public notice.</Sentence>
						</ItemSentence>
					</Item>
				</Paragraph>
			</Article>
			<Article Num="4_2" id="en_at8">
				<ArticleCaption>(Person Specified by Order of the Ministry of Economy, Trade and Industry as Prescribed in Article 53, Paragraph (4) of the Act)</ArticleCaption>
				<ArticleTitle>Article 4-2</ArticleTitle>
				<Paragraph Num="1" id="en_at8cl1">
					<ParagraphNum></ParagraphNum>
					<ParagraphSentence>
						<Sentence>A person specified by Order of the Ministry of Economy, Trade and Industry as prescribed in Article 53, paragraph (4) of the Act is one that plays the leading role in performing any of the businesses prohibited under paragraph (1) or (2) of the same Article.</Sentence>
					</ParagraphSentence>
				</Paragraph>
			</Article>
			<Article Num="4_3" id="en_at9">
				<ArticleCaption>(Persons Equivalent to Those Managing Operations)</ArticleCaption>
				<ArticleTitle>Article 4-3</ArticleTitle>
				<Paragraph Num="1" id="en_at9cl1">
					<ParagraphNum></ParagraphNum>
					<ParagraphSentence>
						<Sentence>A person specified by Order of the Ministry of Economy, Trade and Industry as prescribed in Article 10, item (i) or (ii) of the Cabinet Order is one who is in a position to regularly take on duties of a person who manages the operations prescribed in these items or any other person who takes on those duties to a substantial extent, irrespective of being a department manager, assistant manager, section chief or having any other title.</Sentence>
					</ParagraphSentence>
				</Paragraph>
			</Article>
			<Article Num="5" id="en_at10">
				<ArticleCaption>(Letters of Inquiry)</ArticleCaption>
				<ArticleTitle>Article 5</ArticleTitle>
				<Paragraph Num="1" id="en_at10cl1">
					<ParagraphNum>(1)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>If it is necessary to do so in order to conduct an examination pursuant to the provisions of Article 7 of the Cabinet Order, the Minister of Economy, Trade and Industry may send a letter of inquiry on necessary particulars to a person who intends to export or has exported goods, the manufacturer of those goods, or any other person concerned, and request them to respond thereto.</Sentence>
					</ParagraphSentence>
				</Paragraph>
				<Paragraph Num="2" id="en_at10cl2">
					<ParagraphNum>(2)</ParagraphNum>
					<ParagraphSentence>
						<Sentence>A person who has received a letter of inquiry as prescribed in the preceding paragraph must make a response to the Minister of Economy, Trade and Industry in writing without delay.</Sentence>
					</ParagraphSentence>
				</Paragraph>
			</Article>
		</MainProvision>
		<SupplProvision id="en_s1">
			<SupplProvisionLabel>Supplementary Provisions</SupplProvisionLabel>
			<Paragraph Num="1" id="en_s1cl1">
				<ParagraphNum></ParagraphNum>
				<ParagraphSentence>
					<Sentence>This Ministerial Order comes into effect as of the date of promulgation.</Sentence>
				</ParagraphSentence>
			</Paragraph>
		</SupplProvision>
		<SupplProvision AmendLawNum="Order of the Ministry of International Trade and Industry No. 57 of June 30, 1950" id="en_s2">
			<SupplProvisionLabel>Supplementary Provisions</SupplProvisionLabel>
