農業分野における特定技能の在留資格に係る制度の運用に関する方針 Policy on the Operation of Systems Related to the Residence Status of the "Specified Skilled Worker" in the Agriculture Sector 農業分野における特定技能の在留資格に係る制度の運用に関する方針 Policy on the Operation of Systems Pertaining to the Status of Residence of Specified Skilled Worker in the Agriculture Sector 法務大臣 Minister of Justice 国家公安委員会 National Public Safety Commission 外務大臣 Minister of Foreign Affairs 厚生労働大臣 Minister of Health, Labour and Welfare 農林水産大臣 Minister of Agriculture, Forestry and Fisheries 「経済財政運営と改革の基本方針2018」(平成30年6月15日閣議決定)を踏まえ、出入国管理及び難民認定法(昭和26年政令第319号。以下「法」という。)第2条の4第1項の規定に基づき、法第2条の3第1項の規定に基づき定められた「特定技能の在留資格に係る制度の運用に関する基本方針」(以下「基本方針」という。)にのっとって、農業分野における特定技能の在留資格に係る制度の運用に関する方針(以下「運用方針」という。)を定める。 Based on the "Basic Policy on Economic and Fiscal Management and Reform 2018" (cabinet decision on June 15, 2018), pursuant to the provisions of Article 2-4, paragraph (1) of the Immigration Control and Refugee Recognition Act (Cabinet Order No. 319 of 1951; hereinafter referred to as the "Act"), the policy on the operation of systems related to the residence status of the "specified skilled worker" in the agriculture sector (hereinafter referred to as the "operation policy") is hereby established, according to the basic policy on the operation of systems related to the residence status of the "specified skilled worker" (hereinafter referred to as the "basic policy") established in accordance with the provisions of Article 2-3, paragraph (1) of the Act. 1 人材を確保することが困難な状況にあるため外国人により不足する人材の確保を図るべき産業上の分野(特定産業分野) 1 Industrial fields in which it is difficult to secure human resources and therefore foreign human resources should be secured (specified industrial sector) 農業分野 Agriculture sector 2 特定産業分野における人材の不足の状況(当該産業上の分野において人材が不足している地域の状況を含む。)に関する事項 2 Matters related to the situation of the shortage in human resources in the specified industrial sector (including the situation of areas where there is a shortage of human resources in the relevant industrial sector) (1)特定技能外国人受入れの趣旨・目的 (1) Outline and purpose of the acceptance of specified skilled workers 農業分野において深刻化する人手不足に対応するため、専門性・技能を生かした業務に即戦力として従事する外国人を受け入れることで、本分野の存続・発展を図り、もって我が国の経済・社会基盤の持続可能性を維持する。 In order to cope with a serious labor shortage in the agriculture sector, competent foreign nationals who can be engaged in work as an immediate manpower by making use of their expertise and skills are accepted to sustain and develop the sector and thereby maintain the sustainability of Japanese economic and social infrastructure. (2)生産性向上や国内人材確保のための取組等 (2) Efforts to improve productivity and secure domestic human resources 関連業界では、生産性の向上や国内人材の確保の取組として、農作業機械化への取組やインターンシップの推進、新規就農者の定着支援に取り組んでいる。 For improving productivity and securing domestic human resources, related industries have made efforts to mechanize agricultural work, promote internship programs, and support the retention of new farmers. (生産性向上のための取組) (Efforts to improve productivity) 農林水産省では、「農は国の基」であり、農業振興が国の基本的施策として重要であることから、補助事業等により業界の取組を支援するとともに、生産性向上のための取組として、①農地中間管理機構等を通じた農業の担い手への農地の集積・集約化、②ロボット技術、ICT等の先端技術の活用によるスマート農業の実現等を推進し、省力化による生産性の向上に取り組んでいるところ、全耕地面積に占める担い手の利用面積のシェアは、平成25年の48.7%から平成29年には55.2%に増加、担い手がデータを使って生産性向上や経営改善に挑戦できる環境をつくるため、データの連携や提供機能を持つ「農業データ連携基盤」のプロトタイプを平成29年に構築するなどの成果を挙げている。 Given that "agriculture is the basis of the country" and the agricultural promotion is important as one of the basic policies of the country, the Ministry of Agriculture, Forestry and Fisheries has supported efforts of the agriculture sector through subsidized projects, and has promoted the following efforts for improving productivity by labor saving: (1) concentration and intensification of agricultural land for farmers through Farmland Intermediary Management Institution, etc., and (2) realization of smart agriculture by using advanced technology such as robotics technology, ICT, etc. As a result of these efforts, there have been some achievements as follows: the proportion of farming areas cultivated by farmers in the total farming area increased from 48.7% in 2013 to 55.2% in 2017, and a prototype of the "Agricultural Data Coordination Platform" with the function of coordinating and providing data was established in 2017, in order to create an environment in which farmers can use data for productivity and management improvements. (国内人材確保のための取組) (Efforts to secure domestic human resources) また、国内人材の確保に関しても、①新規就農者に対する資金の交付や無利子融資による支援、②女性の活躍支援や農福連携の推進等により、若者・女性・高齢者等の多様な国内人材の確保にも努めているところであり、49歳以下の新規就農者が4年連続で2万人を超えるなどの成果を挙げている。 In addition, in order to secure various domestic human resources, including young people, women, and the elderly, efforts are made through (1) provision of support to new farmers through funds and interest-free loans, and (2) provision of support for participation by women and promoting collaboration between agriculture and welfare. These have resulted in things such as an increase in the number of new farmers aged 49 or younger to over 20,000 for four consecutive years. (3)受入れの必要性(人手不足の状況を判断するための客観的指標を含む。) (3) Necessity of acceptance (including objective indicators for assessing the situation of labor shortage) 農業分野における雇用労働力は、平成17年に13万人であったものが、平成27年には22万人と、この10年で1.7倍に増加しているほか、平成29年の農業分野の有効求人倍率は1.94倍(農耕作業員1.71倍、養畜作業員2.80倍)となっている。また、「新たな外国人材の受入れ制度に関する基本的考え方(平成30年9月農業労働力支援協議会)」において、雇用就農者数は現時点で約7万人不足しているとされているなど、深刻な人手不足の状況にある。 The employed workforce in the agriculture sector increased 1.7 times over the past ten years, from 130,000 people in 2005 to 220,000 in 2015, and the ratio of job offers to applicants in the agriculture sector was 1.94 (1.71 for agricultural workers and 2.80 for livestock workers) in 2017. In addition, the "Basic concept on the new system for acceptance of foreign human resources (Agricultural Labor Force Support Council in September 2018)" states that, currently, there is a shortage of approx. 70,000 employed farmers, which indicates a serious labor shortage in the sector. 農業就業者の世代間バランスは、現時点で基幹的農業従事者の68%が65歳以上、49歳以下は11%となっており、農業就業者の減少・高齢化を背景として経営規模の拡大や雇用労働力の増加が進展していること等に鑑みると、今後も農業分野で必要となる雇用労働力は増加するものと見込まれ、これら要因による人手不足が早急に改善できる見通しは立っていない。 As for the intergenerational balance of agricultural workers, 68% of core agricultural workers are aged 65 or older and 11% are aged 49 or younger. Considering the expansion of the scale of farm management and the increase in the employed workforce with the decline in and aging of agricultural workers, it is expected that the employed workforce needed in the agriculture sector will continuously increase in the future, and the situation of labor shortage caused by these factors will not be improved quickly. また、農村地域においては、人口が全国を超えるペースで減少が進み、高齢化率は都市を上回る水準で推移してきており、平成27年の高齢化率は都市部の24.5%に対し、農村地域は31.2%になっている。今後も農村地域では全国を超える減少率で人口が推移すると見込まれている。 In rural areas, the population has been decreasing at a rate higher than the national rate, and the aging rate has been exceeding that of urban areas. In 2015, the aging rate in rural areas was 31.2%, compared to 24.5% in urban areas. It is expected that the population in rural areas will continuously decline at a rate higher than the national rate. 農業の持続的な発展を図るためには、農業について基本的な知識・技能を有し、現場の状況に応じて作業手順を自ら考え、自ら栽培管理や飼養管理、収穫・出荷調製等の作業を行うことができる即戦力の外国人を受け入れることで、農業の成長産業化につなげることが、当該分野の基盤を維持し、今後も発展させていくために必要不可欠である。 In order to achieve sustainable development of agriculture, it is essential to develop the agriculture sector by accepting competent foreign nationals who have basic knowledge and skills on agriculture, can think by themselves about how work procedures should be adapted to each situation, have the ability to engage in cultivation management, rearing management, harvesting, and shipping preparation, etc., and can be engaged in work as an immediate manpower, so as to maintain the foundation of and further develop the sector. 農業分野における向こう5年間の受入れ見込数は、最大3万6,500人であり、これを向こう5年間の受入れの上限として運用する。 The prospective number of foreign workers to be accepted in the agriculture sector in the next five years is 36,500 at a maximum, which is the upper limit of the number of foreign workers to be accepted in the next five years. 向こう5年間で13万人程度の人手不足が見込まれる中、今般の受入れは、年1%程度の必要労働者数の効率化(5年で1万1,000人程度)及び追加的な国内人材の確保(2023年までに40歳代以下の農業従事者を8万人程度確保)を行ってもなお不足すると見込まれる数を上限として受け入れるものであり、過大な受入れ数とはなっていない。 A shortage of approx. 130,000 workers is expected in the next five years. In these circumstances, the upper limit described above is not excessive because it was set based on the number of workers still required even after the streamlining in a point of the number of required workers by about 1% per year (about 11,000 workers in five years) is made and additional domestic human resources (about 80,000 agricultural workers aged 49 or younger by 2023) are secured. 3 特定産業分野において求められる人材の基準に関する事項 3 Matters related to the standards of human resources required in the specified industrial sector 農業分野において特定技能1号の在留資格で受け入れる外国人は、以下に定める試験に合格した者又は農業分野の第2号技能実習を修了した者とする。 A foreign national who is accepted in the agriculture sector as having the status of residence of specified skilled worker (i) is a person who has passed the following examinations or has completed technical intern training (ii) in the agriculture sector. ア 「農業技能測定試験(仮称)(耕種農業全般)」 (a) "Agricultural skill assessment test (tentative name) (general crop farming)" イ 「農業技能測定試験(仮称)(畜産農業全般)」 (b) "Agricultural skill assessment test (tentative name) (general livestock farming)" (2)日本語能力水準 (2) Japanese language level 「日本語能力判定テスト(仮称)」又は「日本語能力試験(N4以上)」 "Test for Basic Japanese (tentative name)" or "Japanese-Language Proficiency Test (N4 or higher)" 4 法第7条の2第3項及び第4項(これらの規定を同条第5項において準用する場合を含む。)の規定による同条第1項に規定する在留資格認定証明書の交付の停止の措置又は交付の再開の措置に関する事項 4 Matters related to measures to suspend or resume the issuance of the certificate of eligibility provided in Article 7-2, paragraph (1) of the Act under the provisions of paragraphs (3) and (4) of the same Article (including cases in which these provisions are applied mutatis mutandis pursuant to paragraph (5) of the same Article) (1)農林水産大臣は、有効求人倍率等の公的統計等の客観的指標等を踏まえ、人手不足の状況の変化に応じて運用方針の見直しの検討・発議等の所要の対応を行うとともに、上記2(4)に掲げた向こう5年間の受入れ見込数を超えることが見込まれる場合には、法務大臣に対し、受入れの停止の措置を求める。 (1) Based on objective indicators of the ratio of job offers to applicants and other official statistics, the Minister of Agriculture, Forestry and Fisheries takes necessary measures, such as considering and proposing the amendment of the operation policy, etc., according to changes in the situation of labor shortage. If the actual number of foreign workers to be accepted in the next five years described in 2. (4) above is expected to exceed the prospective number of them, the Minister requests the Minister of Justice to suspend acceptance. (2)受入れの停止の措置を講じた場合において、当該受入れ分野において再び人材の確保を図る必要性が生じた場合には、農林水産大臣は、法務大臣に対し、受入れの再開の措置を求める。 (2) If there is a need to further secure human resources in the sector where measures to suspend acceptance have been taken, the Minister of Agriculture, Forestry and Fisheries requests the Minister of Justice to resume acceptance. 5 その他特定技能の在留資格に係る制度の運用に関する重要事項 5 Other important matters related to the operation of systems pertaining to the status of residence of specified skilled worker (1)1号特定技能外国人が従事する業務 (1) Work in which a specified skilled worker (i) is engaged 1号特定技能外国人が従事する業務区分は、上記3(1)に定める試験区分に対応し、それぞれ以下のとおりとする。 The categories of work in which a specified skilled worker (i) is engaged are as follows, corresponding to the examination categories provided in 3. (1) above. 耕種農業全般(栽培管理、農産物の集出荷・選別等) General crop farming (cultivation management and collection, shipment, and selection of agricultural products, etc.) 畜産農業全般(飼養管理、畜産物の集出荷・選別等) General livestock farming (animal feeding management, collection, shipment and selection of livestock products, etc.) (2)特定技能所属機関等に対して特に課す条件 (2) Specific conditions imposed on organizations to which specified skilled workers belong ア 直接雇用形態の場合、特定技能所属機関となる事業者は、労働者を一定期間以上雇用した経験があること。 (a) In case of direct employment, a business that becomes an organization to which specified skilled workers belong must have employed workers for a certain period or longer. イ 労働者派遣形態の場合、次の要件を満たすこと。 (b) In case of staffing, the following requirements must be satisfied: (ア)特定技能所属機関となる労働者派遣事業者は、農業現場の実情を把握しており特定技能外国人の受入れを適正かつ確実に遂行するために必要な能力を有していること。 (A) a staffing provider that becomes an organization to which specified skilled workers belong must be familiar with the actual agricultural situation and have abilities necessary for properly and steadily carrying out the acceptance of specified skilled workers; (イ)外国人材の派遣先となる事業者は、労働者を一定期間以上雇用した経験がある者又は派遣先責任者講習等を受講した者を派遣先責任者とする者であること。 (B) a business to which foreign workers are dispatched must have employed workers for a certain period or appoint a person who has attended a training course for responsible persons acting for the client as a responsible person acting for the client. ウ 特定技能所属機関は、「農業特定技能協議会(仮称)」(以下「協議会」という。)の構成員になること。 (c) An organization to which specified skilled workers belong must be a member of the "Specified Agricultural Skilled Worker Council (tentative name)" (hereinafter referred to as the "Council"). エ 特定技能所属機関及び派遣先事業者は、協議会に対し必要な協力を行うこと。 (d) An organization to which specified skilled workers belong and a business to which specified skilled workers are dispatched must cooperate with the Council as necessary. オ 特定技能所属機関は、登録支援機関に1号特定技能外国人支援計画の実施を委託するに当たっては、協議会に対し必要な協力を行う登録支援機関に委託すること。 (e) When delegating the implementation of a specified skilled worker (i) support plan to a registered support institution, the organization to which specified skilled workers belong must delegate it to a registered support institution that cooperates with the Council as necessary. (3)特定技能外国人の雇用形態 (3) Form of employment of specified skilled workers ア 雇用形態 (a) Form of employment 農業分野の事業者を特定技能所属機関とする直接雇用形態及び労働者派遣事業者を特定技能所属機関として外国人材を農業分野の事業者に派遣する労働者派遣形態とする。 Forms of employment are direct employment in case in which a business in the agricultural sector serves as an organization to which specified skilled workers belong, and staffing in case in which a staffing provider serves as an organization to which specified skilled workers belong and dispatches foreign workers to businesses in the agriculture sector. イ 労働者派遣形態により受け入れる必要性 (b) Necessity of acceptance in the form of staffing 農業分野においては、①冬場は農作業ができないなど、季節による作業の繁閑がある、②同じ地域であっても、作目による収穫や定植等の農作業のピーク時が異なるといった特性があり、農繁期の労働力の確保や複数の産地間での労働力の融通といった農業現場のニーズに対応するため、農業分野の事業者による直接雇用形態に加えて、労働者派遣形態により1号特定技能外国人を受け入れることが不可欠である。 The agriculture sector has the following characteristics: (1) agricultural work has a peak and an off-season (e.g.: cannot work in the winter season), and (ii) the peak season of harvesting and planting, etc. varies according to crops even in the same area. (4)治安への影響を踏まえて講じる措置 (4) Measures to be taken based on the impact on public security 農林水産省は、基本方針を踏まえつつ、所掌事務を通じて治安上の問題となり得る事項を把握するために必要な措置を講じるとともに、把握した事項について制度関係機関と適切に共有する。 Based on the basic policy, the Ministry of Agriculture, Forestry and Fisheries takes necessary measures to identify matters that may pose security problems through the function under the jurisdiction of the Ministry, and shares those matters appropriately with organizations related to the system. また、深刻な治安上の影響が生じるおそれがあると認める場合には、基本方針を踏まえつつ、農林水産省及び制度関係機関において、共同して所要の検討を行い、運用方針の変更を含め、必要な措置を講じる。 If the Ministry of Agriculture, Forestry and Fisheries finds that there is a risk of serious security impact, the Ministry and organizations related to the system coordinate in conducting necessary deliberations and taking necessary measures, including changes in the operation policy, while taking into account the basic policy. (5)特定技能外国人が大都市圏その他の特定の地域に過度に集中して就労することとならないようにするために必要な措置 (5) Measures for preventing specified skilled workers from being excessively concentrated in metropolitan areas and other specified areas for working 農業の特性に鑑み、かつ、豪雪地域等年間を通じた農業生産が維持できない農村地域の事情を考慮し、特定技能外国人が従事可能な農業関連業務の範囲について柔軟に対応する。 In view of the characteristics of agriculture and the situation of heavy snowfall areas and other rural areas, where agricultural production cannot be maintained throughout the year, flexible measures are taken with regard to the scope of agricultural-related work in which specified skilled workers are able to engage. 農林水産省は、本制度の趣旨や優良事例を全国的に周知するとともに、協議会を組織し、協議会において、外国人材が不足している地域について、外国人材不足の状況及び課題の把握並びに対応方策の検討、外国人材の適正な受入れに資する取組等の協議を行う。 The Ministry of Agriculture, Forestry and Fisheries disseminates the outline and best practices of this system on a nationwide basis, and organizes a council to conduct deliberations on areas that have a shortage of foreign human resources, in order to identify the situation of labor shortage and issues, examine countermeasures, and consider measures that contribute to the proper acceptance of foreign human resources, etc. 協議会の構成員は、協議の結果に基づき、外国人材の適正な受入れに資する取組や関係する制度関係省庁等に対する働きかけを行う。 Based on the results of the deliberations, the members of the council make efforts for the proper acceptance of foreign human resources and ask ministries and agencies related to the system for proper acceptance. さらに、農業の次世代を担う人材の確保・育成、スマート農業の推進等による生産性の向上等の施策を通じて、農業を就業者にとってやりがいのある魅力的な産業とし、農村地域の維持発展を図る。 In addition, the members make efforts to make agriculture an attractive industry that is worthwhile for workers and to maintain and develop rural areas, through measures such as securing and developing human resources who will be engaged in the next generation of agriculture and improving productivity by, among other things, the promotion of smart agriculture.
