出入国管理及び難民認定法(昭和26年政令第319号。以下「法」という。)第2条の4第1項の規定に基づき、農業分野における特定技能の在留資格に係る制度の適正な運用を図るため、農業分野における特定技能の在留資格に係る制度の運用に関する方針(以下「運用方針」という。)を定めているところ、運用方針に係る運用要領を以下のとおり定める。
Based on the provisions of Article 2-4, paragraph (1) of the Immigration Control and Refugee Recognition Act (Cabinet Order No. 319 of 1951; hereinafter referred to as the "Act"), the policy on the operation of systems related to the residence status of the "specified skilled worker" in the agriculture sector (hereinafter referred to as the "operation policy") was established for proper operation of systems related to the residence status of the "specified skilled worker" in the agriculture sector. In accordance with the operation policy, the operation guidelines are established as follows.
第1 特定産業分野において認められる人材の基準に関する事項
I. Matters related to the standards of human resources recognized in the specified industrial sector
1.技能水準及び評価方法等(特定技能1号)
1. Skill level and evaluation method (specified skilled worker (i))
ア 技能水準及び評価方法
(a) Skill level and evaluation method
当該試験は、①栽培管理、安全衛生等について基本的な知識を有しており、また、各種農作業について、安全の確保を図りつつ、一定時間内に正しい手順で確実にできるレベルであること、②日本語で指示された農作業の内容等を聴き取り、理解できることを認定するものであり、この試験の合格者は、運用方針5(1)アの業務区分において、一定の専門性・技能を用いて即戦力として稼働するために必要な知識や経験を有するものと認める。
This examination certifies that (1) the applicant has basic knowledge on cultivation management and on safety and health, and is able to reliably carry out agricultural work within a certain period of time following correct procedures while ensuring safety, and (2) the applicant is able to hear and understand instructions on agricultural work given in Japanese. A successful applicant is recognized to have the knowledge and experience necessary for starting work immediately by using a certain level of expertise and skills in the category of work in the operation policy 5. (1) (a).

イ 試験の適正な実施を担保する方法
(b) Method to secure the proper implementation of the examination
同試験は、試験実施に必要な設備を備え、国外複数か国で大規模試験の実施実績があり、かつ、替え玉受験等の不正受験を防止する措置を講じることができる試験実施団体に、試験実施主体から業務委託することで適正な実施が担保される。
The proper implementation of the examination is secured by delegating the work from the implementing organization to a test implementing organization that has facilities necessary for conducting the examination, has conducted large-scale examinations in more than one foreign country, and can take measures to prevent applicants from improperly taking the examination (using a stand-in, etc.).
ア 技能水準及び評価方法
(a) Skill level and evaluation method
当該試験は、①飼養管理、安全衛生等について基本的な知識を有しており、また、各種農作業について、安全の確保を図りつつ、一定時間内に正しい手順で確実にできるレベルであること、②日本語で指示された農作業の内容等を聴き取り、理解できることを認定するものであり、この試験の合格者は、運用方針5(1)イの業務区分において、一定の専門性・技能を用いて即戦力として稼働するために必要な知識や経験を有するものと認める。
This examination certifies that (1) the applicant has basic knowledge on animal feeding management and on safety and health, and is able to reliably carry out agricultural work within a certain period of time following correct procedures while ensuring safety, and (2) the applicant is able to hear and understand instructions on agricultural work given in Japanese. A successful applicant is recognized to have the knowledge and experience necessary for starting work immediately by using a certain level of expertise and skills in the category of work in the operation policy 5. (3)国内試験の対象者
(3) Eligibility for domestic examinations
国内で試験を実施する場合、①退学・除籍処分となった留学生、②失踪した技能実習生、③在留資格「特定活動(難民認定申請)」により在留する者、④在留資格「技能実習」による実習中の者については、その在留資格の性格上、当該試験の受験資格を認めない。
When an examination is conducted in Japan, the following persons are not eligible for the examination because of the nature of the person's status of residence: (1) a student from overseas who has been removed or expelled from school, (2) a technical intern who went missing, (3) a resident under the status of residence of "designated activities (application for refugee recognition)," and (4) a person currently engaged in a technical intern program under the status of residence of "technical intern training."
2.日本語能力水準及び評価方法等(特定技能1号)

当該試験は、本制度での受入れに必要となる基本的な日本語能力水準を判定するために国際交流基金が開発・実施する試験であるところ、これに合格した者については、ある程度日常会話ができ、生活に支障がない程度の能力を有するものと認められることから、基本的な日本語能力水準を有するものと評価する。
The examination is developed and conducted by the Japan Foundation to judge whether an applicant has a basic Japanese language ability required for being accepted under the system. A successful applicant is recognized to have a certain level of ability to engage in daily conversation and have no difficulty in living, and therefore the applicant is evaluated as a person having a basic Japanese language ability.

ア 日本語能力水準及び評価方法
(a) Japanese language level and evaluation method

当該試験に合格した者については、「基本的な日本語を理解することができる」と認定された者であることから、ある程度日常会話ができ、生活に支障がない程度の能力を有するものと認められ、本制度での受入れに必要となる基本的な日本語能力水準を有するものと評価する。
A successful applicant is found to have a certain level of ability to engage in daily conversation and have no difficulty in living since the applicant is recognized as having the ability to understand the basic Japanese language, and therefore the applicant is evaluated as a person having a basic Japanese language ability required for being accepted under the system.

Implementing organization: The Japan Foundation (an incorporated administrative agency) and the Japan Educational Exchanges and Services

イ 試験の適正な実施を担保する方法
(b) Method to secure the proper implementation of the examination
同試験は30年以上の実績があり、また、国外実施における現地の協力団体は各国の大学や日本語教師会といった信頼性の高い団体であり、主催団体が提供する試験実施マニュアルに即して、試験問題の厳重な管理、試験監督員の研修・配置、当日の本人確認や持ち物検査の実施等、不正受験を防止する措置が適切に講じられている。
The examination has been conducted for more than 30 years. When the examination is conducted overseas, highly reliable organizations, such as local universities and Japanese-language teachers' associations, etc., become a local cooperating organization. In accordance with the implementation manual provided by the organizer, appropriate measures are taken to prevent applicants from improperly taking the examination, such as, among other things, strict control of examination questions, training and assignment of examination supervisors, and identity verification and inspection of personal belongings on the day of the examination.
(3)業務上必要な日本語能力水準
(3) Japanese language level required for work
上記1(1)又は(2)の試験に合格した者については、業務上必要な日本語能力水準を満たすものと評価する。
A person who has passed the examination provided in 1. (1) or (2) above is evaluated to satisfy the Japanese language level necessary for work.
第2 法第7条の2第3項及び第4項(これらの規定を同条第5項において準用する場合を含む。)の規定による同条第1項に規定する在留資格認定証明書の交付の停止の措置又は交付の再開の措置に関する事項
II. Matters related to measures to suspend or resume the issuance of the certificate of eligibility provided in Article 7-2, paragraph (1) of the Act under the provisions of paragraphs (3) and (4) of the same Article (including cases in which these provisions are applied mutatis mutandis pursuant to paragraph (5) of the same Article)
1.農業分野をめぐる人手不足状況の変化の把握方法
1. Method to detect changes in the situation of labor shortage in the agriculture sector
農林水産大臣は、以下の指標をもって人手不足状況の変化を的確に把握する。
The Minister of Agriculture, Forestry and Fisheries detects changes in the situation of labor shortage accurately, by using the following indicators:
(1)農業分野の1号特定技能外国人在留者数(3か月に1回法務省から農林水産省に提供)
(1) The number of specified skilled workers (i) in the agriculture sector (provided by the Ministry of Justice to the Ministry of Agriculture, Forestry and Fisheries once every three months);
(3)就業者数、雇用農業者数、新規就農者数
(3) The number of workers, employed farmers, and new farmers;
(4)「農業特定技能協議会(仮称)」による特定技能所属機関等からの状況把握等
(4) Finding out the situation from organizations to which specified skilled workers belong through the "Specified Agricultural Skilled Worker Council (tentative name)."
2.人手不足状況の変化等を踏まえて講じる措置
2. Measures to be taken based on changes in the situation of labor shortage
(1)農林水産大臣は、上記1に掲げた指標及び動向の変化や当初の受入れ見込数とのかい離、就業構造や経済情勢の変化等を踏まえ、人手不足の状況に変化が生じたと認める場合には、それらの状況を的確に把握・分析を加えた上で、変化に応じた人材確保の必要性を再検討し、状況に応じて運用方針の見直しの検討・発議等の所要の対応を行う。
(1) If the Minister of Agriculture, Forestry and Fisheries finds a change in the situation of labor shortage, in light of changes in indicators and trends set forth in 1. above, gaps with the initial prospective number of foreign workers to be accepted, and changes in employment structures and economic conditions, the Minister identifies and analyzes the situation accurately, re-examines the necessity of securing human resources in response to the change, and takes necessary measures, such as considering and proposing the amendment of the operation policy, etc., according to the situation.
また、向こう5年間の受入れ見込数を超えることが見込まれる場合には、法務大臣に対し、受入れの停止の措置を求める。
If the actual number of foreign workers to be accepted in the next five years is expected to exceed the prospective number of them, the Minister requests the Minister of Justice to suspend acceptance.
(2)上記(1)で受入れの停止の措置を講じた場合において、当該受入れ分野において再び人材の確保を図る必要性が生じた場合には、農林水産大臣は、受入れの再開の措置を講じることを発議する。
(2) If there is a need to further secure human resources in the sector where measures to suspend acceptance have been taken based on (1) above, the Minister of Agriculture, Forestry and Fisheries proposes to resume acceptance.
第3 その他特定技能の在留資格に係る制度の運用に関する重要事項
III. Other important matters related to the operation of systems related to the residence status of the "specified skilled worker"
1.1号特定技能外国人が従事する業務
1. Work in which a specified skilled worker (i) is engaged
農業分野において受け入れる1号特定技能外国人が従事する業務は、運用方針3(1)に定める試験区分及び運用方針5(1)に定める業務区分に従い、上記第1の試験合格又は下記2の技能実習2号移行対象職種・作業修了により確認された技能を要する業務(栽培管理、飼養管理、農畜産物の集出荷・選別等の農作業)をいう。
The work to be engaged in by specified skilled workers (i) accepted in the agriculture sector means the work requiring skills confirmed by passing the examination described in I. above or completing the approved occupations/operations for transfer to technical intern training (ii) described in 2. below (cultivation management, animal feeding management, and collection, shipment and selection of agricultural and livestock products), according to the examination categories provided in the operation policy 3. (1) and the categories of work provided in the operation policy 5. (1).
あわせて、当該業務に従事する日本人が通常従事することとなる関連業務(例:農畜産物の製造・加工、運搬、販売の作業、冬場の除雪作業等)に付随的に従事することは差し支えない。
In conjunction with this, it is permissible to additionally engage in related work in which Japanese nationals who are engaged in the work are usually engaged (e.g. manufacturing, processing, transportation, and sale of agricultural and livestock products and snow removal work in winter, etc.).
なお、農業分野の対象は日本標準産業分類「01 農業」に該当する事業者及び当該事業者を構成員とする団体が行う業務とする。
Work in the agriculture sector is work performed by a business whose work falls under the Japanese Standard Industrial Classification "01 Agriculture" and by a organization composed of those businesses.
2.従事する業務と技能実習2号移行対象職種との関連性
2. Relationship between work to be engaged in and approved occupations for transfer to technical intern training (ii)
農業分野において受け入れる1号特定技能外国人が、必要な技能水準及び日本語能力水準を満たしているものとして取り扱う場合における業務内容と技能実習2号移行対象職種において修得する技能との具体的な関連性については、次のとおりとする。
When a specified skilled worker (i) accepted in the agriculture sector is treated as having satisfied the required skill level and Japanese language level, the relationship between the details of work and skills learned in approved occupations for transfer to technical intern training (ii) is as follows.
耕種農業に関連する第2号技能実習(耕種農業職種3作業:施設園芸、畑作・野菜又は果樹)を修了した者については、当該技能実習で修得した技能が、1号特定技能外国人が従事する業務において要する技能と、作物の栽培管理、安全衛生等の点で、技能の根幹となる部分に関連性が認められることから、修得した技能が耕種農業の職種に属する作業のいずれに係るものであっても耕種農業の業務で必要とされる一定の専門性・技能を有し、即戦力となるに足りる相当程度の知識又は経験を有するものと評価し、上記第1の試験を免除する。
With regard to a person who has completed the technical intern training (ii) related to crop farming (three operations in crop farming: greenhouse horticulture, vegetable production, or fruit production), skills learned in the technical intern training are considered to be related to the basis of skills required for the work in which specified skilled workers (i) are engaged, in terms of crop cultivation management and of safety and health, etc., and therefore, the person is evaluated as having a certain level of expertise and skills required for the work in crop farming and having sufficient knowledge or experience for starting work immediately regardless of which operation of crop farming the learned skills are related to, and is exempted from the examination described in I. above.
畜産農業に関連する第2号技能実習(畜産農業職種3作業:養豚、養鶏又は酪農)を修了した者については、当該技能実習で修得した技能が、1号特定技能外国人が従事する業務において要する技能と、家畜の飼養管理、安全衛生等の点で、技能の根幹となる部分に関連性が認められることから、修得した技能が畜産農業の職種に属する作業のいずれに係るものであっても畜産農業の業務で必要とされる一定の専門性・技能を有し、即戦力となるに足りる相当程度の知識又は経験を有するものと評価し、上記第1の試験を免除する。
With regard to a person who has completed the technical intern training (ii) related to livestock farming (three operations in livestock farming: pig farming, chicken farming, or dairy farming), skills learned in the technical intern training are considered to be related to the basis of skills required for the work in which specified skilled workers (i) are engaged, in terms of animal feeding management and of safety and health, etc., and therefore, the person is evaluated as having a certain level of expertise and skills required for the work in livestock farming and having sufficient knowledge or experience for starting work immediately regardless of which operation the learned skills are related to, and is exempted from the examination described in I. above.
3.分野の特性を踏まえて特に講じる措置
3. Particular measures to be taken in consideration of the characteristics of the sector
(1)労働者を一定期間以上雇用した経験(運用方針5(2)ア及びイ(イ)関係)
(1) Experience of having employed workers for a certain period or longer (related to the operation policy 5. (2) (a) and (b) (B))
労働者を少なくとも6か月以上継続して雇用した経験をいう。
This refers to the experience of continuous employment of workers for at least six months.
農林水産省は、農業分野の特定技能所属機関、業界団体その他の関係者により構成される「農業特定技能協議会(仮称)」(以下「協議会」という。)を組織する。
The Ministry of Agriculture, Forestry and Fisheries organizes the "Specified Agricultural Skilled Worker Council (tentative name)" (hereinafter referred to as the "Council"), which is composed of organizations to which specified skilled workers belong, industry associations, and other persons concerned in the agriculture sector.
協議会は、その構成員が相互の連絡を図ることにより、外国人の適正な受入れ及び外国人の保護に有用な情報を共有し、その構成員の連携の緊密化を図るとともに、以下の事項について協議を行う。
The Council shares information useful for the proper acceptance and protection of foreign nationals and endeavors to maintain close coordination among its members through mutual communication with each other, and also conducts deliberations on the following matters:
① 外国人の受入れ状況及び課題の把握並びに対応方策の検討
(1) Finding out the situation of acceptance of foreign nationals and issues, and examination of countermeasures;
② 不正行為に対する再発防止策
(2) Measures to prevent the recurrence of fraudulent acts;
③ 構成員に対する必要な情報の提供その他外国人材の適正な受入れ及び外国人の保護に資する取組
(3) Efforts to provide necessary information to its members and to contribute to the proper acceptance and protection of foreign nationals.
(3)「農業特定技能協議会(仮称)」に対し必要な協力を行うこと(運用方針5(2)エ及びオ関係)
(3) Providing required cooperation for the "Specified Agricultural Skilled Worker Council (tentative name)" (related to the operation policy 5. (2) (d) and (e))
協議会は、外国人の適正な受入れ及び外国人の保護を図るため、特定技能所属機関、登録支援機関又は派遣先事業者に対し、情報の提供、意見の聴取、現地調査の実施その他の必要な協力を求めることができる。
In order to ensure the proper acceptance and protection of foreign nationals, the Council may request organizations to which specified skilled workers belong, registered support institutions, or businesses to which specified skilled workers are dispatched to provide information, hear opinions, conduct on-site inspections, and provide other necessary cooperation.
(4)和牛遺伝資源の輸出に対する不安の払拭のための措置
(4) Measures to eliminate anxiety about exports of Japanese cattle genetic resources
農林水産省は、諸外国との人の往来が増加することにより、和牛の精液、受精卵等が海外に輸出されることに対する不安を、関係者に与えることがないよう必要な措置を講じる。
The Ministry of Agriculture, Forestry and Fisheries takes necessary measures so that relevant persons do not worry about exports of semen and fertilized eggs, etc. of Japanese cattle due to an increase in the traffic of people between Japan and other countries.
(5)家畜の伝染性疾病の侵入防止に必要な措置
(5) Measures to prevent the invasion of domestic animal infectious diseases
農林水産省は、諸外国からの入国者が増加し、家畜の伝染性疾病が持ち込まれる可能性が高まるおそれがあることから、侵入防止に必要な措置を講じる。
The Ministry of Agriculture, Forestry and Fisheries takes necessary measures to prevent the invasion of domestic animal infectious diseases since the diseases may be brought into Japan with an increase in people entering Japan from other countries.
4.治安への影響を踏まえて講じる措置
4. Measures to be taken based on the impact on public security
(1)治安上の問題に対する措置
(1) Measures against security problems
農林水産省は、農業分野における特定技能外国人が関わる犯罪、行方不明、悪質な送出機関の介在その他の治安上の問題を把握した場合には、事業者、業界団体等に対して助言・指導を行うなど、必要な措置を講じる。
If the Ministry of Agriculture, Forestry and Fisheries identifies crimes, missing persons cases, intervention of malicious dispatching organizations, and other security-related problems involving specified skilled workers in the agriculture sector, the Ministry gives advice and guidance to businesses and industry associations and takes other necessary measures.
(2)治安上の問題を把握するための取組
(2) Efforts to identify security problems
農林水産省は、上記(1)の治安上の問題について、所掌事務を通じ、事業者、業界団体等から把握するために必要な措置を講じる。
The Ministry of Agriculture, Forestry and Fisheries takes necessary measures to obtain information on the security problems described in (1) above from businesses and industry associations, etc. through the function under the jurisdiction of the Ministry.
(3)把握した情報等を制度関係機関等と共有するための取組等
(3) Efforts to share information obtained with organizations related to the system
農林水産省は、上記(1)の治安上の問題について、制度関係機関等との間で適切に共有するため、情報共有の手続を定めるなど、必要な措置を講じる。
The Ministry of Agriculture, Forestry and Fisheries develops procedures and takes other necessary measures to appropriately share information on the security problems described in (1) above with organizations related to the system.
また、深刻な治安上の影響が生じるおそれがあると認める場合には、法第2条の3第1項に規定する特定技能の在留資格に係る制度の運用に関する基本方針及び運用方針を踏まえつつ、農林水産省及び制度関係機関において、共同して所要の検討を行い、運用要領の変更を含め、必要な措置を講じる。
In addition, if the Ministry of Agriculture, Forestry and Fisheries finds that there is a risk of causing serious security impact, the Ministry and organizations related to the system coordinate in conducting necessary deliberations and taking necessary measures, including changes in the operation guidelines, based on the basic policy on the operation of systems related to the residence status of the "specified skilled worker" provided in Article 2-3, paragraph (1) of the Act and the operation policy.
