        <seg>「公益通報者保護法の一部を改正する法律」（令和２年法律第５１号）により改正された公益通報者保護法（平成１６年法律第１２２号。以下「法」という。）では、通報対象事実について処分又は勧告等をする権限を有する行政機関に対し、外部通報に応じ、適切に対応するために必要な体制の整備その他の必要な措置をとることを義務付けている（法第１３条第２項）。</seg>

        <seg>Under the Whistleblower Protection Act (Act No. 122 of 2004; hereinafter referred to as the "Act"), as amended by the "Act Partially Amending the Whistleblower Protection Act" (Act No. 51 of 2020), an administrative organ that is authorized to impose dispositions, issue recommendations or take other measures with respect to reportable facts is required to establish a necessary system or otherwise take necessary measures to respond to and appropriately handle external reports (Article 13, paragraph (2) of the Act).</seg>

        <seg>地方公共団体が国の行政機関との連携を図りつつ、外部の労働者等からの通報に対応する仕組みを整備し、これを適切に運用することは、事業者に対する行政の監督機能の強化並びにそれを契機とした事業者における内部通報制度の整備及び改善に向けた自主的な取組の促進に寄与するなど、事業者の法令遵守の確保につながるものである。</seg>

        <seg>The local governments' establishment and appropriate operation of mechanisms for handling reports from external workers or corresponding persons in collaboration with the national administrative organs will contribute to the reinforcement of the governmental supervisory function over enterprises and to the promotion of enterprises' voluntary efforts to establish and improve their internal reporting system prompted by such government supervision, and will otherwise lead to the ensuring of compliance with laws and regulations by enterprises.</seg>

        <seg>In addition, the local governments' appropriate law enforcement through early detection of information by actively utilizing reports from external workers or corresponding persons will contribute to the stabilization of the daily lives of the local residents and to the sound development of society and the economy.</seg>

        <seg>本ガイドラインは、以上の意義も踏まえて、地方公共団体において、外部の労働者等からの法に基づく公益通報及びその他の法令違反等に関する通報を適切に取り扱うため、各地方公共団体において取り組むことが求められる基本的事項等を定め、もって通報者の保護を図るとともに、事業者の法令遵守を推進することを目的とし、各地方公共団体においては、本ガイドラインを踏まえながら、各地方公共団体の実情等も勘案し、法が求める措置を講ずる必要がある。</seg>

        <seg>Based on the above significant objectives, among other things, these Guidelines intend to ensure the protection of whistleblowers and to promote compliance with laws and regulations by enterprises, by stating basic approaches and measures that are expected to be used by each local government, in order for the local governments to appropriately deal with whistleblowing disclosures received under the Act from external workers or corresponding persons, as well as other reports received from them concerning violations of laws and regulations and other misconduct. Each local government must take the measures required by the Act based on these Guidelines, while taking into account the actual circumstances of each local government.</seg>

        <seg>なお、本ガイドラインは、地方自治法（昭和２２年法律第６７号）第２４５条の４第１項の規定に基づく技術的な助言として位置付けられるものであり、各地方公共団体において一層充実した通報対応の仕組みを整備及び運用すること、又は各地方公共団体の規模等の実情に応じた適切な取組を行うことを妨げるものではない。</seg>

        <seg>These Guidelines constitute technical advice under the provisions of Article 245-4, paragraph (1) of the Local Autonomy Act (Act No. 67 of 1947), and do not preclude a local government from establishing and operating more advanced mechanisms for handling reports or from taking appropriate approaches according to the size and other conditions of the local government.</seg>

        <seg>①　各地方公共団体は、外部の労働者等からの通報事案への対応を、通報に関する秘密保持及び個人情報の保護に留意しつつ、迅速かつ適切に行うため、その幹部を責任者とし、部署間横断的に通報に対応する仕組みを整備し、これを適切に運用する。</seg>

        <seg>(i) Each local government will establish and appropriately operate mechanisms that handle reported cases from external workers or corresponding persons n a cross-functional manner and for which the local government's executive officials are appointed as responsible persons, in order to promptly and appropriately handle reported cases while giving consideration to the confidentiality of reports and the protection of personal information.</seg>

        <seg>③　支庁、地方事務所、支所、出張所等（以下「出先機関等」という。）を置いている地方公共団体にあっては、当該通報対応の仕組みの下で、各出先機関等においても適切に通報対応を行うための周知、体制整備その他必要な措置をとる。</seg>

        <seg>(iii) Each local government with sub-prefecture offices, local offices, branches, sub-branches, etc. (hereinafter collectively referred to as "local agencies") will disseminate information, establish systems and take other measures necessary to appropriately handle reports at each of its local agencies under the mechanisms for handling reports described above.</seg>

        <seg>①　各地方公共団体は、外部の労働者等からの通報を受け付ける窓口（以下「通報窓口」という。）及び通報に関連する相談に応じる窓口（以下「相談窓口」という。）を、通報者及び相談者（以下「通報者等」という。）に明確になるよう設置する。</seg>
      </tuv>

        <seg>(i) Each local government will establish a point of contact to receive reports from external workers or corresponding persons (hereinafter referred to as a "contact point for reporting") and a point of contact to provide consultation on reports (hereinafter referred to as "contact points for consultation"), in a manner that makes these contact points clear to whistleblowers and consulters (hereinafter collectively referred to as "whistleblowers or the like").</seg>

        <seg>②　人員、予算等の制約により専用の通報窓口又は相談窓口を設置することが困難な地方公共団体にあっては、通報に関する秘密保持及び個人情報の保護に留意した上で、当該地方公共団体に設置された総合窓口、公聴窓口、消費生活センター又は消費生活相談窓口等を通報窓口又は相談窓口として活用することができる。</seg>

        <seg>(ii) If it is difficult for a local government to establish a dedicated contact point for reporting or contact point for consultation due to personnel, budgetary or other constraints, after giving consideration to the confidentiality of reports and the protection of personal information regarding reports, the local government may utilize a comprehensive contact point, a contact point to collect public opinion, a consumer center, or a consumer consultant service, etc. established at the local government as its contact point for reporting or contact point for consultation.</seg>
      </tuv>
    </tu>

        <seg>③　人員、予算等の制約により単独で通報窓口又は相談窓口を設置することが困難な地方公共団体にあっては、通報に関する秘密保持及び個人情報の保護に留意した上で、他の地方公共団体と連携及び協力して事務を行う仕組み（例えば、協議会の設置、機関等の共同設置、事務の委託又は代替執行等）を活用して通報窓口又は相談窓口を設置することができる。</seg>

        <seg>(iii) If it is difficult for a local government to independently establish a contact point for reporting or a contact point for consultation due to personnel, budgetary or other constraints, after giving consideration to the confidentiality of reports and the protection of personal information regarding reports, the local government may establish a contact point for reporting or contact point for consultation by utilizing a mechanism to perform functions in coordination and cooperation with other local governments (e.g., such as establishing a council, jointly establishing an agency or other organization, or delegating services to or having services performed on behalf of the local government by other local governments).</seg>
      </tuv>

        <seg>④　通報を受け付ける部局と通報に基づく調査や法令に基づく措置をとる部局等が異なるときは、通報者との連絡が円滑に行われるような措置をとる。</seg>

        <seg>(iv) If one department is in charge of receiving reports and separate departments are in charge of conducting investigations based on reports or taking measures under laws and regulations, the local government will take measures to ensure smooth communication with whistleblowers.</seg>
      </tuv>

        <seg>（３）担当者の配置及び育成</seg>

        <seg>各地方公共団体は、当該地方公共団体の関係する部局に、通報対応に必要な適性及び能力を有する担当者を配置（当該部局の職員を担当者として指定することを含む。）し、所要の知識及び技能の向上を図るための教育、研修等を十分に行う。</seg>

        <seg>Each local government will assign to each of its relevant departments responsible persons who have the required aptitudes and abilities to handle reports (including appointing personnel at each of these departments as responsible persons) and will provide these persons with sufficient education, training, etc. to improve their required knowledge and skills.</seg>

        <seg>（４）秘密保持及び個人情報保護の徹底</seg>

        <seg>(4) Thorough Protection of Confidentiality and Personal Information</seg>
      </tuv>

        <seg>①　通報又は相談への対応に関与した者（通報又は相談への対応に付随する職務等を通じて、通報又は相談に関する秘密を知り得た者を含む。以下同じ。）は、通報又は相談に関する秘密を漏らしてはならない。</seg>
      </tuv>
      <tuv xml:lang="en-US">
        <seg>(i) The persons involved in the handling of a report or in the provision of consultation (including all persons who learned of secrets related to the report or consultation through duties incidental to the handling of the report or to the provision of consultation or under similar circumstances; hereinafter the same applies) must not breach the confidentiality of the report or consultation.</seg>
      </tuv>

        <seg>②　通報又は相談への対応に関与した者は、知り得た個人情報の内容をみだりに他人に知らせ、又は不当な目的に利用してはならない。</seg>

        <seg>(ii) Without good reason, the persons involved in the handling of a report or in the provision of consultation must not disclose to others the details of any personal information learned or use such information for any wrongful purpose.</seg>
      </tuv>
    </tu>

        <seg>③　各地方公共団体は、通報又は相談に関する秘密保持及び個人情報保護の徹底を図るため、通報対応の各段階（３．に規定するもののほか、相談及び通報対応終了後の段階を含む。以下同じ。）において遵守すべき事項をあらかじめ取り決めて、通報又は相談への対応に関与する者に対して十分に周知する。この場合、以下に掲げる事項については、特に十分な措置をとる。</seg>

        <seg>(iii) In order to thoroughly ensure the confidentiality of a report or consultation and the protection of personal information, in advance, each local government will formulate rules to be complied with at each stage of handling a report (including the stage after completion of the provision of consultation or the handling of a report, in addition to the stages set forth in 3. below; hereinafter the same applies) and will make these rules fully known to the persons who will be involved in the handling of reports or in the provision of consultations. In doing so, each local government will take sufficient measures particularly with respect to the matters listed below.</seg>

        <seg>a. The scope of information sharing and the scope of information to be shared should be limited to the minimum necessary.</seg>
      </tuv>

        <seg>イ．通報者等の特定につながり得る情報（通報者等の氏名、所属等の個人情報のほか、調査が通報を端緒としたものであること、通報者等しか知り得ない情報等を含む。以下同じ。）については、調査等の対象となる事業者に対して開示しないこと（通報対応を適切に行う上で真に必要な最小限の情報を、ウ．に規定する同意を取得して開示する場合を除く。）</seg>

        <seg>b. Any information that may lead to the identification of the whistleblower or other information providers (including but not limited to the name, affiliation, and other personal information of the whistleblower, the fact that the investigation was triggered by a report, and any information that only the whistleblower or other information providers would know; hereinafter the same applies) should not be disclosed to the enterprise that is the subject of the investigation or other measures (excluding cases where minimum information truly necessary to appropriately handle the report is disclosed after obtaining the consent as set forth in c. below).</seg>

        <seg>ウ．通報者等の特定につながり得る情報を、情報共有が許される範囲外に開示する場合には、通報者等の書面、電子メール等による明示の同意を取得すること</seg>

        <seg>c. If any information that may lead to the identification of the whistleblower or other information providers is to be disclosed to any party outside the scope of permitted information sharing, the express consent of the whistleblower or other information providers should be obtained in writing, via e-mail or otherwise.</seg>

        <seg>エ．ウ．に規定する同意を取得する際には、開示する目的及び情報の範囲並びに当該情報を開示することによって生じ得る不利益について、明確に説明すること</seg>

When obtaining the consent as set forth in c. above, the whistleblower or other information providers should be clearly informed of the purpose for which the information is disclosed, the scope of information to be disclosed, and any disadvantages that may be suffered by the whistleblower or other information providers as a result of disclosure of the information.</seg>

        <seg>オ．通報者等本人からの情報流出によって通報者等が特定されることを防ぐため、通報者等に対して、情報管理の重要性について十分に理解させること</seg>

In order to prevent the whistleblowers or other information providers from being identified due to leakage of their own information from the whistleblower or other information providers, the whistleblower or other information providers should be given a full understanding of the significance of information management.</seg>

        <seg>①　各地方公共団体の職員は、自らが関係する通報事案への対応に関与してはならない。</seg>
      </tuv>

        <seg>(i) None of the personnel of a local government may be involved in the handling of a reported case in which they are involved.</seg>
      </tuv>

        <seg>②　各地方公共団体は、通報対応の各段階において、通報事案への対応に関与する者が当該通報事案に利益相反関係を有していないかどうかを確認する。</seg>

        <seg>(ii) At each stage of handling a report, the local government will check whether or not any of the persons involved in the handling of the reported case have a conflict of interest relationship with the reported case.</seg>
      </tuv>

        <seg>（６）通報対象の範囲</seg>

        <seg>(6) Scope of Reports to Be Received</seg>
      </tuv>

      <tuv xml:lang="ja-JP">
        <seg>通報窓口では、法第２条第３項に規定する通報対象事実（以下「通報対象事実」という。）が生じ、又はまさに生じようとしている場合における通報のほか、（８）に規定する通報を受け付ける。</seg>

        <seg>The contact point for reporting will receive reports that a reportable fact as referred to in Article 2, paragraph (3) of the Act (hereinafter each referred to as a "reportable fact") has occurred or is about to occur, as well as the reports listed in (8) below.</seg>

        <seg>通報窓口では、通報対象事実又はその他の法令違反等の事実に関係する事業者に雇用されている労働者又は通報の日前１年以内に当該労働者であった者、当該事業者を派遣先とする派遣労働者又は通報の日前１年以内に当該派遣労働者であった者、当該事業者の取引先の労働者又は通報の日前１年以内に当該労働者であった者、当該事業者の役員のほか、当該事業者の法令遵守を確保する上で必要と認められるその他の者からの通報を受け付ける。</seg>

        <seg>The contact point for reporting will receive reports from: workers who are employed by the enterprise involved in a reportable fact or in other facts of violation of laws and regulations or other misconduct, and persons who were workers employed by such enterprise at any time within one year preceding the date of report; dispatched workers who are dispatched to the enterprise, and persons who were dispatched workers dispatched to the enterprise at any time within a one-year period preceding the date of report; workers who are employed by a business partner of the enterprise, and persons who were workers employed by the business partner at any time within a one-year period preceding the date of report; any of the officers of the enterprise; and other persons considered necessary to ensure compliance with laws and regulations by the enterprise.</seg>

        <seg>①　各地方公共団体は、法に基づく公益通報以外の通報であっても、以下に掲げる場合には、法に基づく公益通報に準ずる通報として、法第１３条第１項に規定する必要な調査を行い、通報対象事実又はその他の法令違反の事実があると認めるときは、法令に基づく措置その他適当な措置をとる。</seg>

        <seg>(i) Upon receipt of a report that is not a whistleblowing disclosure under the Act but falls under any of the following, the local government will deem the report equivalent to a whistleblowing disclosure under the Act, will conduct necessary investigations as set forth in Article 13, paragraph (1) of the Act, and will take measures under laws and regulations and/or other appropriate measures if the local government finds that a reportable fact or other facts of violation of laws and regulations exist.</seg>

        <seg>(ii) Upon receipt of the report, the local government will collect the name and contact details of the whistleblower (unless the report is made on an anonymous basis) and information on the facts constituting the reported matter, while giving consideration to the confidentiality of the report and the protection of personal information, and will also explain to the whistleblower that the confidentiality of the report will be protected, the whistleblower's personal information will be protected, the flow of the procedure after receipt of the report, and other matters. Provided, however, that the abovementioned explanations do not apply if the whistleblower does not wish to receive the explanations or if it is difficult to provide the explanations to the whistleblower because the report is made on an anonymous basis or if there is any other compelling reason not to provide the explanations (hereinafter the same applies to the notification as referred to in (1) (iii) and (v), (2) (iv), and (5) (i) and (ii) below, the provision of information as referred to in (1) (iv) below, and the provision of information and documents as referred to in (3) below).</seg>

        <seg>(v) Following receipt of the report, the local government will sufficiently consider the necessity for handling the report based on the purpose of the Act and these Guidelines as well as on the local government's legal authority and administrative functions under its legal jurisdiction, and will notify the whistleblower, without delay: (a) to the effect that the report has been accepted, if the local government has accepted it as a whistleblowing disclosure under the Act or another corresponding report; or (b) to the effect that their report is not accepted, together with the reason, if the local government has not accepted it (including accepting it as provision of information).</seg>

        <seg>(i) Each local government will endeavor to disseminate information on the content of the Act, the "Guidelines Necessary for the Appropriate and Effective Implementation of the Measures to Be Taken by Enterprises Pursuant to Article 11, Paragraphs (1) and (2) of the Whistleblower Protection Act" (Cabinet Office Notification No. 118 of August 20, 2021; hereinafter referred to as the "Cabinet Office Guidelines"), and the "Commentaries on the Guidelines under the Whistleblower Protection Act (Cabinet Office Notification No. 118 of 2021)" (published by the Consumer Affairs Agency on October 13, 2021; hereinafter referred to as the "Commentaries on the Cabinet Office Guidelines"), as well as on matters such as the contact point for reporting and the mechanisms for handling reports at the local government, by conducting publicity activities towards, holding information sessions for and using other appropriate approaches to enterprises and workers or corresponding persons within the territory of the local government.</seg>

        <seg>(iii) If a local government has delegated or otherwise assigned its authority to impose a disposition, issue recommendations or take other measures with respect to facts constituting a violation of certain laws and regulations to any other administrative organ, and if a report is received regarding a fact of violation of the laws and regulations, then the local government will provide the other administrative authority with cooperation, support, etc. necessary to ensure appropriate law enforcement (in the case the delegating local government has the authority to provide guidance and supervision to the delegated administrative organ, appropriate exercise of such authority), by such means as sharing information on the report and its handling with the delegated administrative authority and providing the delegated administrative authority with advice on the handling of the report, while giving consideration to the confidentiality of the report and to the protection of personal information.</seg>
