労働基準法(昭和二十二年法律第四十九号)第十四条第二項の規定に基づき、有期労働契約の締結、更新及び雇止めに関する基準を次のように定め、平成十六年一月一日から適用する
The standards on the conclusion, renewal, and termination of a fixed-term labor contract shall be provided for as follows and apply as of January 1, 2004, based on the provision of paragraph (2), Article 14 of the Labor Standards Act (Act No. 49 of 1947).

(雇止めの予告)
(Previous Notice of Termination of Employment)
第一条 使用者は、期間の定めのある労働契約(当該契約を三回以上更新し、又は雇入れの日から起算して一年を超えて継続勤務している者に係るものに限り、あらかじめ当該契約を更新しない旨明示されているものを除く。次条第二項において同じ。)を更新しないこととしようとする場合には、少なくとも当該契約の期間の満了する日の三十日前までに、その予告をしなければならない。
Article 1 If an employer shall not renew a fixed-term labor contract (an employee limited to a person who has renewed the said labor contract three times or more, or has continuously worked for more than one year from a date of employment, the employee to the effect that the employee who doesn't renew the said contract beforehand is expressly indicated is excluded. The same as in the second item in the next Article.), the employer shall previously notify the employee of the non-renewal of the fixed-term labor contract 30 days at least prior to a day on which the said contract expires.

(Clear Description of Reasons for Termination of Employment)
第二条前条の場合において、使用者は、労働者が更新しないこととする理由について証明書を請求したときは、遅滞なくこれを交付しなければならない。
Article 2 In the preceding Article, the employer shall issue a certificate for reasons where the employer doesn't renew the said contract without delay if the employee claims it.
2 期間の定めのある労働契約が更新されなかった場合において、使用者は、労働者が更新しなかった理由について証明書を請求したときは、遅滞なくこれを交付しなければならない。
(2) If the fixed-term labor contract is not renewed, the employer shall issue a certificate for reasons where the employer has not renewed the said contract without delay if the employee claims it.
(契約期間についての配慮)
(Consideration of Contract Term)
第三条使用者は、期間の定めのある労働契約(当該契約を一回以上更新し、かつ、雇入れの日から起算して一年を超えて継続勤務している者に限る。)を更新しようとする場合においては、当該契約の実態及び当該労働者の希望に応じて、契約期間をできる限り長くするよう努めなければならない。
Article 3 If an employer shall renew a fixed-term labor contract (an employee limited to a person who has renewed the said labor contract once or more, or has continuously worked for more than one year from a date of employment), the employer shall endeavor to extend a contract term as long as possible in response to the actual situations of the said contract and the hopes of the said employee.

平成二十年三月一日から適用する。
The revised sentence shall apply as of March 1, 2008.
