Implementation of Container Inspections, etc. 高圧ガス保安法（昭和２６年法律第２０４号。以下「法」という。）第４４条第１項の容器検査及び法第４９条の２第１項の附属品検査並びに法第４９条の２１第１項の容器又は附属品（以下「容器等」という。）の型式の承認（以下容器検査及び附属品検査と合わせ「容器検査等」と総称する。）において、法に基づき容器保安規則（昭和４１年通商産業省令第５０号。以下「容器則」という。）で定める技術上の基準のうち別表第１第１項から第５項まで、第１０項及び第１１項に掲げる機能性基準に適合することについての評価にあたっては、個々の事例ごとに判断することとなるが、別表第２第１項右欄及び第２項右欄に掲げる例示基準（以下「容器検査等に係る例示基準」という。）のとおりである場合には、当該機能性基準に適合するものとする。 In the course of the container inspection referred to in Article 44, paragraph (1) of the High Pressure Gas Safety Act (Act No. 204 of 1951); hereinafter referred to as the "Act") and the accessories inspection referred to in Article 49-2, paragraph (1) of the Act, as well as the type approval of containers or accessories (hereinafter referred to as "Containers, etc.") referred to in Article 49-21, paragraph (1) of the Act (hereinafter the container inspection, accessories inspection, and type approval are collectively referred to as "Container Inspection, etc."), the assessment of conformity with the functionality standards set forth in rows (1) to (5), (10) and (11) of Appended Table 1 among the technical standards provided by the Ordinance on Safety of Gas Containers (Ordinance of the Ministry of International Trade and Industry No. 50 of 1966; hereinafter referred to as the "Container Ordinance") pursuant to the Act is to be made on a case-by-case basis. Implementation of Registration 法第４９条の５第１項の容器等製造業者の登録（法第４９条の８第１項の協会等の調査を含む。以下同じ。）において、容器則で定める技術上の基準のうち別表第１第７項から第９項までに掲げる機能性基準に適合することについての評価にあたっては、個々の事例ごとに判断することとなるが、別表第２第４項右欄に掲げる例示基準のとおりである場合には、当該機能性基準に適合するものとする。 In the course of the registration of manufacturers of containers, etc. referred to in Article 49-5, paragraph (1) of the Act (including the investigation by the Institute, etc. referred to in Article 49-8, paragraph (1) of the Act; the same applies hereinafter), the assessment of conformity with the functionality standards set forth in rows (7) to (9) of Appended Table 1 among the technical standards provided by the Container Ordinance is to be made on a case-by-case basis. (4) is attached: イ　当該登録において適用する詳細基準 (a) specific standards to be applied to the registration; ロ　イに掲げる詳細基準が機能性基準に適合することを証する資料（例えば、登録に係る容器等の製造の方法、規格及び検査の方法を記した資料） (b) materials evidencing that the specific standards set forth in (a) conform with the functionality standards (e.g. documents describing the manufacturing method, specification, and inspection method of the Container, etc. for which registration is sought); and ハ　当該登録に係る容器等の製造の方法、規格及び検査の方法が機能性基準に適合することを証する資料（例えば、３．（６）の容器検査等事前評価書） (c) materials evidencing that the manufacturing method, specification, and inspection method of the Container, etc. for which registration is sought conform with the functionality standards (e.g. a preliminary assessment report for container inspection, etc. referred to in 3. (6)). ３．　協会による事前評価 3. Preliminary Assessment by the Institute （１）　例示基準に基づく容器検査等以外の容器検査等又は例示基準に基づく登録以外の登録において、適用する詳細基準が別表第１第１項から第５項まで、第１０項及び第１１項又は別表第１第７項から第９項までに掲げる機能性基準に適合することに関し、協会による事前評価を受けようとする者（（２）に掲げるものを除く。）は、協会が別に定める「詳細基準事前評価実施要領」（以下「要領」という。）に基づき、容器検査等事前評価申請書又は登録事前評価申請書を協会に提出するものとする。 (1) A person who intends to undergo a preliminary assessment by the Institute in the course of a Container Inspection, etc. other than a Container Inspection, etc. based on Exemplified Standards or registration other than Registration based on Exemplified Standards, with regard to the conformity of the specific standards applied thereby with the functionality standards set forth in rows (1) to (5), (10), and (11) of Appended Table 1 or rows (7) to (9) of Appended Table 1 (excluding the person set forth in (2) below), is required to submit an application for preliminary assessment for container inspection, etc. or application for preliminary assessment for registration to the Institute according to the Guidelines for Preliminary Assessment of Specific Standards provided for separately by the Institute (hereinafter referred to as the "Guidelines"). この場合において、同一の仕様について、一定期間内に反復して申請を行う場合は、包括して申請をすることができるものとする。 In this case, if the person is to file applications repeatedly within a certain period with regard to the same specification, the person may file a comprehensive application. （２）　例示基準以外の詳細基準（容器検査等に係るものに限る。）について、別表第１第１項から第５項まで、第１０項及び第１１項に掲げる機能性基準に適合することに関し、当該詳細基準の公開を目的に、協会による事前評価を受けようとする者は、要領に基づき、公開詳細基準事前評価申請書を協会に提出するものとする。 (2) A person who intends to undergo a preliminary assessment by the Institute with regard to the conformity of specific standards applied thereby (limited to those concerning Container Inspection, etc.) other than exemplified standards with the functionality standards set forth in rows (1) to (5), (10), and (11) of Appended Table 1, for the purpose of publishing said specific standards, is required to submit an application for preliminary assessment for publication of specific standards to the Institute according to the Guidelines. （３）　（１）に係る容器検査等事前評価申請書には次の①及び②に掲げる資料を、（１）に係る登録事前評価申請書には次の③から⑤までに掲げる資料を、又は（２）の公開詳細基準事前評価申請書には次の⑥から⑧までに掲げる資料を添付するものとする。 (3) The materials set forth in (i) and (ii) below are required to be attached to an application for preliminary assessment for container inspection, etc. prescribed in (1), the materials set forth in (iii) to (v) below are required to be attached to an application for preliminary assessment for registration prescribed in (1), and the materials set forth in (vi) to (viii) below are required to be attached to an application for preliminary assessment for publication of specific standards prescribed in (2): ①　当該容器検査等において適用する詳細基準 (i) specific standards to be applied to the Container Inspection, etc.; and ②　①に掲げる詳細基準が機能性基準に適合することを証する資料（例えば、安全性を立証するための論文、規格、解析結果及び試験データ） (ii) materials evidencing that the specific standards set forth in (i) conform with the functionality standards (e.g. papers, specification, analysis results, and test data proving safety); ③　当該登録において適用する詳細基準 (iii) specific standards to be applied to the registration; ④　③に掲げる詳細基準が機能性基準に適合することを証する資料（例えば、登録に係る容器等の製造の方法、規格及び検査の方法を記した資料） (iv) materials evidencing that the specific standards set forth in (iii) conform with the functionality standards (e.g. documents describing the manufacturing method, specification, and inspection method of the Container, etc. for which registration is sought); ⑤　当該登録に係る容器等の製造の方法、規格及び検査の方法が機能性基準に適合することを証する資料（例えば、（６）の容器検査等事前評価書） (v) materials evidencing that the manufacturing method, specification, and inspection method of the Container, etc. for which registration is sought conform with the functionality standards (e.g. a preliminary assessment report for container inspection, etc. referred to in 3. (6)); ⑥　公開する詳細基準 (vi) specific standards to be published; ⑦　⑥に掲げる詳細基準が機能性基準に適合することを証する資料（例えば、安全性を立証するための論文、規格、解析結果及び試験データ） (vii) materials evidencing that the specific standards set forth in (vi) conform with the functionality standards (e.g. papers, specification, analysis results, and test data proving safety); and ⑧　⑥に掲げる詳細基準が公開に適することを証する資料（例えば、当該詳細基準に係る容器等の使用実績、実証データ及び（６）の容器検査等事前評価書） (viii) materials evidencing that the specific standards set forth in (vi) are appropriate to be published (e.g. the use records, empirical data, and a preliminary assessment report for container inspection, etc. referred to in (6) with regard to the Container, etc. to which the specific standards pertain). （４）　（１）及び（２）に係る事前評価の厳正な処理を図ることを目的として、協会に学識経験者からなる詳細基準事前評価委員会（以下「事前評価委員会」という。）を設置する。 (4) A Committee for Preliminary Assessment of Specific Standards consisting of persons with relevant knowledge and experience (hereinafter referred to as the "Preliminary Assessment Committee") is established within the Institute for the purpose of ensuring that the preliminary assessments referred to in (1) and (2) will be conducted strictly. 事前評価委員会は、協会が別に定める「詳細基準事前評価委員会規程」に基づき運営する。 The Preliminary Assessment Committee is operated based on the Rules of the Committee for Preliminary Assessment of Specific Standards provided for separately by the Institute. （５）　協会は、（１）及び（２）に係る事前評価を行うときは、事前評価委員会に諮るものとする。事前評価委員会は、要領に基づき、（１）に係る事前評価にあっては機能性基準に適合すること、（２）に係る事前評価にあっては機能性基準に適合すること及び公開に適することについて評価を行う。 (5) When conducting the preliminary assessments prescribed in (1) and (2), the Institute is to consult with the Preliminary Assessment Committee. The Preliminary Assessment Committee makes an assessment according to the Guidelines with regard to the conformity with the functionality standards as a preliminary assessment prescribed in (1) and the conformity with the functionality standards and appropriateness of publication as a preliminary assessment prescribed in (2). （６）　協会は、（１）に係る事前評価を行ったときは、要領に基づき、事前評価申請を行った者に対し、速やかにその結果を容器検査等事前評価書又は登録事前評価書により通知しなければならない。 (6) If the Institute makes a preliminary assessment prescribed in (1), it must promptly notify the applicant for preliminary assessment of the assessment results by way of a preliminary assessment report for container inspection, etc. or preliminary assessment report for registration according to the Guidelines. （７）　協会は、（２）に係る事前評価を行ったときは、要領に基づき、事前評価申請を行った者に対し、速やかにその結果を公開詳細基準事前評価書により通知しなければならない。 (7) If the Institute makes a preliminary assessment prescribed in (2), it must promptly notify the applicant for preliminary assessment of the assessment results by way of a preliminary assessment report for publication of specific standards according to the Guidelines. この場合において、当該詳細基準が機能性基準に適合し汎用性を有する等公開に適すると認められるときは、協会は、遅滞なく、当該公開詳細基準事前評価書を公開しなければならない。 In this case, if the specific standards are found to be appropriate to be published for reasons such as they are in conformity with the functionality standards and versatile, the Institute must make public the preliminary assessment report for publication of specific standards without delay. （８）　例示基準に基づく登録以外の登録が申請される場合には、（１）及び（２）における容器検査等に係る事前評価等において、当該登録に係る容器等の製造の方法、規格及び検査の方法の詳細基準が機能性基準に適合することが確認されていることを前提とする。 (8) Registration other than Registration based on Exemplified Standards may be applied for on the assumption that it is confirmed in the preliminary assessment report for container inspection, etc. or other report that the specific standards for the manufacturing method, specification, and inspection method of the Container, etc. for which registration is sought, etc. conform with the functionality standards. ４．　その他の機能性基準の運用 4. Operation of Other Functionality Standards 別表第２第３項の中欄に掲げる機能性基準への適合性評価に当たっては、個々の事例ごとに判断することとなるが、同表同項右欄に掲げる例示基準のとおりである場合には、当該機能性基準に適合するものとする。 The assessment of conformity with the functionality standards set forth in the middle column of row (3) of Appended Table 2 is to be made on a case-by-case basis. Examination of General Specific Standards by the Institute （１）　一般に広く活用することを目的とした詳細基準（以下「一般詳細基準」という。）が別表第１に掲げる機能性基準に適合することについて、協会による一般詳細基準審査を受けようとする者は、協会が別に定める「詳細基準審査規程」に基づき、一般詳細基準審査申請書を協会に提出するものとする。 (1) A person who intends to undergo an examination by the Institute of specific standards designed for the use by the general public (hereinafter referred to as the "General Specific Standards") with regard to the conformity of the General Specific Standards with the functionality standards set forth in Appended Table 1 is required to submit an application for preliminary assessment for general specific standards to the Institute according to the Rules for Examination of Specific Standards provided for separately by the Institute. （２）　協会による一般詳細基準審査の厳正な処理並びに例示基準の時宜を得た適切な改正及び追加を図ることを目的として、協会に学識経験者等からなる高圧ガス容器規格検討委員会（以下「規格検討委員会」という。）を設置する。 (2) A High Pressure Container Specification Review Committee consisting of persons with relevant knowledge and experience, etc. (hereinafter referred to as the "Specification Review Committee") is established within the Institute for the purpose of ensuring that the Institute will conduct an examination of General Specific Standards strictly and making timely and appropriate revision and addition to the exemplified standards. 規格検討委員会は、協会が別に定める「高圧ガス容器規格検討委員会規程」に基づき運営する。 The Specification Review Committee is operated based on the Rules of the High Pressure Container Specification Review Committee provided for separately by the Institute. （３）　協会は、（１）に係る一般詳細基準審査を行うときは、規格検討委員会に諮るものとする。規格検討委員会は、詳細基準審査規程に基づき、機能性基準に適合することについて審査を行う。 (3) When conducting an examination of General Specific Standards referred to in (1), the Institute is to consult with the Specification Review Committee.
