預金保険機構に交付される国債の発行等に関する省令 Ministerial Ordinance on Issuance of National Government Bond for Delivery to Deposit Insurance Corporation 平成十年大蔵省令第六号 Ordinance of the Ministry of Finance No. 6 of 1998 平成十二年政令第五十五号 Cabinet Order No. 55 of 2000 預金保険機構に交付される国債の発行等に関する省令（平成十年二月十八日大蔵省令第六号） Ministerial Ordinance on Issuance of National Government Bond for Delivery to Deposit Insurance Corporation (Ordinance of the Ministry of Finance No. 6 of February 18, 1998) 国債に関する法律（明治三十九年法律第三十四号）第一条第一項及び第二項、預金保険法（昭和四十六年法律第三十四号）附則第十九条の四第五項並びに金融機能の安定化のための緊急措置に関する法律（平成十年法律第五号）第三十一条第五項の規定に基づき、預金保険機構に交付される国債の発行等に関する省令を次のように定める。 The Ministerial Ordinance on Issuance of National Government Bond for Delivery to Deposit Insurance Corporation is established as follows based on Article 1, paragraphs (1) and (2) of the Act on National Government Bond (Act No. 34 of 1906), Article 19-4, paragraph (5) of the Supplementary Provisions of the Deposit Insurance Act (Act No. 34 of 1971), and Article 31, paragraph (5) of the Act on Emergency Measures for the Stabilization of Financial Functions (Act No. 5 of 1998). （国債の名称） (Name of National Government Bond) 第一条　預金保険法附則第十九条の四第一項の規定により発行する国債は、預金保険機構特例業務基金国庫債券（以下「国債」という。）とする。 Article 1 The national government bond issued pursuant to the provisions of Article 19-4, paragraph (1) of the Supplementary Provisions of the Deposit Insurance Act shall be national treasury bonds for the Deposit Insurance Corporation fund for specially permitted business (hereinafter referred to as "National Government Bond"). 第二条　国債規則（大正十一年大蔵省令第三十一号）の規定は、国債については適用しない。 Article 2 The provisions of the National Government Bond Ordinance (Ordinance of the Ministry of Finance No. 31 of 1922) shall not apply to the National Government Bond. 第三条　国債に関する事務の取扱店は、日本銀行本店とする。 Article 3 The head office of the Bank of Japan is to handle affairs relating to the National Government Bond. 第四条国債証券の額面金額及びその合計額は、十三兆円以下の金額とする。 Article 4 The face value of the National Government Bond certificate and the total amount thereof shall be an amount of no more than thirteen trillion yen. （分割及び併合） (Split and Consolidation) 第五条　政府は、預金保険機構（以下「機構」という。）から請求があったときは、当該請求に従い国債証券の額面金額の分割又は併合を行うものとする。 Article 5 (1) If requested by the Deposit Insurance Corporation (hereinafter referred to as the "Corporation"), the government must split or consolidate the face value of the National Government Bond certificate in accordance with such request. ２　前項の規定により国債証券の分割又は併合を行う場合は、当該分割又は併合に係る金額をもってその額面金額とする。 (2) If the National Government Bond certificate is split or consolidated under the preceding paragraph, the face value thereof shall be the amount resulting from such split or consolidation. （登録の請求） (Request for Registration) 第六条　機構は、国債の登録を請求しようとするときは、次に掲げる事項を記載した書面に国債証券を添付して取扱店に提出するものとする。 Article 6 (1) If the Corporation intends to request registration of the National Government Bond, the Corporation must submit a document stating the following matters to the handling office, attaching the National Government Bond certificate: 一　国債の名称 (i) Name of National Government Bond; 二　国債証券の額面金額、記号及び番号 (ii) Face value, mark, and number of the National Government Bond certificate; 三　登録金額 (iii) Registered amount; 四　登録すべき記名 (iv) Holder to be registered; and 五　請求の年月日 (v) Date of request. （登録国債の質権設定の登録） (Registration of Creation of Pledge for Registered National Government Bond) 第七条　機構は、登録国債について日本銀行に対し質権設定の登録を請求しようとするときは、次に掲げる事項を記載した書面を取扱店に提出するものとする。 Article 7 If the Corporation intends to request the Bank of Japan to register the creation of pledge with regard to a registered National Government Bond, the Corporation must submit a document stating the following matters to the handling office: 一　国債の名称及び質権の目的とした登録金額 (i) Name of the National Government Bond and the registered amount that is the subject matter of a pledge; 二　登録国債の記号及び番号 (ii) Mark and number of the registered National Government Bond; 三　登録の記名 (iii) Registered holder; 四　債権の金額及び弁済期の定めがあるときはその期日 (iv) The amount of claims and due date of payment, if any; and 五　請求の年月日 (v) The date of request. （質権の登録の変更等） (Change, etc., of Registration of Pledge) 第八条　前条の規定は、登録国債について質権の登録の変更又は抹消の請求を行う場合について準用する。 Article 8 The provisions of the preceding Article shall apply mutatis mutandis to cases where a request is made for change or cancellation of registration of pledge with regard to a registered National Government Bond. （償還の手続） (Procedures for Redemption) 第九条　政府は、機構から国債の償還の請求を受けた場合において、当該請求に係る金額の償還を行うときは、その償還を行う金額を日本銀行における機構の勘定に払い込むものとする。 Article 9 If the government is to redeem the National Government Bond in the amount requested by the Corporation, the government must credit such amount to an account held by the Corporation at the Bank of Japan. （一部の償還の請求を受けた場合の措置） (Measures in Case of Request for Partial Redemption) 第十条政府は、機構から国債について、その額面金額又は登録金額の一部につき償還の請求を受け、当該請求に係る金額の償還を行った場合には、国債証券にあっては、当該国債証券と引換えに、当該額面金額から当該償還金額を控除した金額を額面金額とする国債証券を機構に交付するものとし、登録国債にあっては、当該登録金額から当該償還金額を減額するものとする。 Article 10 If the government has redeemed the requested amount upon the Corporation's request of a partial redemption of the face value or registered amount of the National Government Bond, the government must, in the case of a National Government Bond certificate, deliver to the Corporation, in exchange of said National Government Bond certificate, a new National Government Bond certificate with a face value in an amount obtained by deducting said redeemed amount from said face value of the National Government Bond, and in the case of a registered National Government Bond, reduce the registered amount by said redeemed amount.
