借地借家法施行規則 Regulations for Enforcement of the Act on Land and Building Leases 令和四年法務省令第二十九号 Ministry of Justice Order No. 29 of 2022 借地借家法施行規則（令和四年五月十八日法務省令第二十九号） Regulations for Enforcement of the Act on Land and Building Leases (Ministry of Justice Order No. 29 of May 18, 2022) デジタル社会の形成を図るための関係法律の整備に関する法律（令和三年法律第三十七号）の施行に伴い、並びに借地借家法（平成三年法律第九十号）第三十八条第四項及び借地借家法施行令（令和四年政令第百八十七号）第一項の規定に基づき、借地借家法施行規則を次のように定める。 In conjunction with the enforcement of the Act on the Arrangement of Related Laws for the Formation of a Digital Society (Act No. 37 of 2021), and pursuant to the provisions of Article 38, paragraph (4) of the Act on Land and Building Leases (Act No. 90 of 1991) and paragraph (1) of the Order for Enforcement of the Act on Land and Building Leases (Cabinet Order No. 187 of 2022), the Regulations for Enforcement of the Act on Land and Building Leases are established as follows. （電磁的方法） (Electronic or Magnetic Means) 第一条　借地借家法第三十八条第四項に規定する電子情報処理組織を使用する方法その他の情報通信の技術を利用する方法であって法務省令で定めるものは、次に掲げる方法とする。 Article 1 (1) The means of using an electronic data processing system provided for in Article 38, paragraph (4) of the Act on Land and Building Leases or any other means of using information and communications technology which are specified by Ministry of Justice Order are any of the following means: 一　電子情報処理組織を使用する方法のうちイ又はロに掲げるもの (i) the means of using an electronic data processing system, which are set forth in sub-item (a) or (b): イ　送信者の使用に係る電子計算機と受信者の使用に係る電子計算機とを接続する電気通信回線を通じて送信し、受信者の使用に係る電子計算機に備えられたファイルに記録する方法 (a) the means of transmitting information via a telecommunications line that connects a computer used by the sender^ and a computer used by the recipient and recording the information in a file stored in the computer used by the recipient; ロ　送信者の使用に係る電子計算機に備えられたファイルに記録された情報の内容を電気通信回線を通じて情報の提供を受ける者の閲覧に供し、当該情報の提供を受ける者の使用に係る電子計算機に備えられたファイルに当該情報を記録する方法 (b) the means of making the content of the information recorded in a file stored in a computer used by the sender available for inspection by the person who receives the information via a telecommunications line, and recording the information in a file stored in a computer used by the person who receives the information; 二　磁気ディスクその他これに準ずる方法により一定の情報を確実に記録しておくことができる物をもって調製するファイルに情報を記録したものを交付する方法 (ii) the means of delivering an object onto which information has been recorded in a file prepared using media that can securely record certain information using a magnetic disk or any other equivalent means; ２　前項各号に掲げる方法は、受信者がファイルへの記録を出力することにより書面を作成することができるものでなければならない。 (2) The means set forth in the items of the preceding paragraph must be those that enable the recipient to create a document by outputting the information recorded in a file. （借地借家法施行令に係る電磁的方法） (Electronic or Magnetic Means Related to the Order for Enforcement of the Act on Land and Building Leases) 第二条　借地借家法施行令第一項の規定により示すべき電磁的方法の種類及び内容は、次に掲げるものとする。 Article 2 (1) The type and content of the electronic or magnetic means required to be indicated pursuant to the provisions of paragraph (1) of the Order for Enforcement of the Act on Land and Building Leases are as follows: 一　次に掲げる方法のうち、送信者が使用するもの (i) among the following means, those used by the sender: イ　電子情報処理組織を使用する方法のうち次に掲げるもの (a) the means using an electronic data processing system, which are set forth in the following: （１）　送信者の使用に係る電子計算機と受信者の使用に係る電子計算機とを接続する電気通信回線を通じて送信し、受信者の使用に係る電子計算機に備えられたファイルに記録する方法 1. the means of transmitting information via a telecommunications line that connects a computer used by the sender and a computer used by the recipient, and recording the information in a file stored in a computer used by the recipient; （２）　送信者の使用に係る電子計算機に備えられたファイルに記録された情報の内容を電気通信回線を通じて情報の提供を受ける者の閲覧に供し、当該情報の提供を受ける者の使用に係る電子計算機に備えられたファイルに当該情報を記録する方法 2. the means of making the content of the information recorded in a file stored in a computer used by the sender available for inspection by the person who receives the information via a telecommunications line, and recording the information in a file stored in a computer used by the person who receives the information; ロ　磁気ディスクその他これに準ずる方法により一定の情報を確実に記録しておくことができる物をもって調製するファイルに情報を記録したものを交付する方法 (b) the means of delivering an object onto which information has been recorded in a file prepared using media that can securely record certain information using a magnetic disk or any other equivalent means; 二　ファイルへの記録の方式 (ii) the means of recording information in a file. （情報通信の技術を利用する方法） (Means of Using Information and Communications Technology) 第三条　借地借家法施行令第一項に規定する電子情報処理組織を使用する方法その他の情報通信の技術を利用する方法であって法務省令で定めるものは、次に掲げる方法とする。 Article 3 The means of using an electronic data processing system provided for in paragraph (1) of the Order for Enforcement of the Act on Land and Building Leases or any other means using information and communications technology, which are specified by Ministry of Justice Order are any of the following: 一　電子情報処理組織を使用する方法のうちイ又はロに掲げるもの (i) the means of using an electronic data processing system, which are set forth in sub-item (a) or (b): イ　送信者の使用に係る電子計算機と受信者の使用に係る電子計算機とを接続する電気通信回線を通じて送信し、受信者の使用に係る電子計算機に備えられたファイルに記録する方法 (a) the means of transmitting information via a telecommunications line that connects a computer used by the sender and a computer used by the recipient, and recording the information in a file stored in a computer used by the recipient; ロ　送信者の使用に係る電子計算機に備えられたファイルに記録された情報の内容を電気通信回線を通じて情報の提供を受ける者の閲覧に供し、当該情報の提供を受ける者の使用に係る電子計算機に備えられたファイルに当該情報を記録する方法 (b) the means of making the content of the information recorded in a file stored in a computer used by the sender available for inspection by the person who receives the information via a telecommunications line, and recording the information in a file stored in a computer used by the person who receives the information; 二　磁気ディスクその他これに準ずる方法により一定の情報を確実に記録しておくことができる物をもって調製するファイルに情報を記録したものを交付する方法 (ii) the means of delivering an object onto which information has been recorded in a file prepared using media that can securely record certain information using a magnetic disk or any other equivalent means. ２　前項各号に掲げる方法は、受信者がファイルへの記録を出力することにより書面を作成することができるものでなければならない。 (2) The means set forth in the items of the preceding paragraph must be those that enable the recipient to create a document by outputting the information recorded in a file. 附　則 Supplementary Provisions この省令は、デジタル社会の形成を図るための関係法律の整備に関する法律第三十五条の規定の施行の日（令和四年五月十八日）から施行する。 This Ministerial Order comes into effect as of the date on which the provisions of Article 35 of the Act on the Arrangement of Related Acts for the Formation of a Digital Society comes into effect (May 18, 2022).
