外国人漁業の規制に関する法律施行規則（暫定版）
Enforcement Regulation of the Act on Regulation of Fishing Operation by Foreign Nationals (Tentative translation)
外国人漁業の規制に関する法律（昭和四十二年法律第六十号）第二条第一項及び第四条第一項の規定に基づき、外国人漁業の規制に関する法律施行規則を次のように定める。
Pursuant to the provisions of Article 2, paragraph (1) and Article 4, paragraph (1) of the Act on Regulation of Fishing Operation by Foreign Nationals (Act No. 60 of 1967), Enforcement Regulation of the Act on Regulation of Fishing Operation by Foreign Nationals is established as follows.
（本邦に含まれる附属の島）
(Annexed Islands Included in Japan)
第一条　外国人漁業の規制に関する法律（以下「法」という。）第二条第一項の農林水産省令で定める附属の島は、本州、北海道、四国及び九州に附属する島のうち、当分の間、歯舞群島、色丹島、国後島及び択捉島を除いたものとする。
Article 1  The annexed islands specified by Order of the Ministry of Agriculture, Forestry and Fisheries as referred to in Article 2, paragraph (1) of the Act on Regulation of Fishing Operation by Foreign Nationals (hereinafter referred to as the "Act") are islands that belong to Honshu, Hokkaido, Shikoku and Kyushu, excluding Habomai Islands, Shikotan Island, Kunashiri Island, and Etorofu Island until otherwise provided for by law or regulation
（軽易な水産動植物の採捕）
(Gathering or Catching Aquatic Animals or Plants on a Minor Scale)
第二条　法第三条ただし書の農林水産省令で定める軽易な水産動植物の採捕は、次に掲げる水産動植物の採捕で、第一号、第二号及び第四号に掲げるものにあつては総トン数三トン未満の船舶により若しくは船舶によらないで行うもの又は適法に我が国に在留する外国人が日本の国籍を有する漁業者（人に水産動植物の採捕をさせることを業とする者を含む。）の管理の下に総トン数三トン以上の日本船舶により行うものと、第三号に掲げるものにあつては船舶によらないで行うものとする。ただし、第四号に掲げるものにあつては、農林水産大臣が別に定めて告示する水域及び期間において行うものに限るものとする。
Article 2  The gathering or catching of aquatic animals or plants on a minor scale as specified by Order of the Ministry of Agriculture, Forestry and Fisheries pursuant to the proviso of Article 3 of the Act refers to the following gathering or catching of aquatic animals or plants, which in the case stated in items (i), (ii) and (iv) are carried out by a vessel with gross tonnage of less than 3 tons or without a vessel or which are carried out by a legitimate foreign resident under management of a fishery operator with Japanese nationality (including a person that has others gather or catch aquatic animals or plants as a business) using a Japanese vessel with gross tonnage of 3 tons or more, and which in the case of item (iii) are carried out without a vessel; provided, however, that for those stated in item (iv), it is limited to the gathering or catching carried out in the water area and during the period separately specified and publicly notified by the Minister of Agriculture, Forestry and Fisheries:
一　さおづり又は手づり（まき餌（え）づりを除く。）による水産動植物の採捕
(i) gathering or catching of aquatic animals or plants by rod fishing or handline fishing (excluding chumming);
二　たも網、叉（さ）手網、やす及びは具以外の漁具を使用しないで行う水産動植物の採捕
(ii) gathering or catching of aquatic animals or plants by using no fishing gear other than a landing net, scoop net, fishing spear or stripping-off gear;
三　投網による水産動植物の採捕
(iii) gathering or catching aquatic animals or plants by using a cast net;
四　ひき縄づりによる水産動植物の採捕
(iv) gathering or catching of aquatic animals or plants by using a trolling line.
（寄港の許可の申請）
(Application for Permission for Calling)
第三条　法第四条第一項の規定による許可を受けようとする船長は、次に掲げる事項を記載した申請書を農林水産大臣に提出しなければならない。
Article 3  (1) A captain seeking to obtain the authorization under the provisions of Article 4, paragraph (1) of the Act must submit a written application containing the following information to the Minister of Agriculture, Forestry and Fisheries:
一　船長の氏名及び国籍
(i) the name and nationality of the captain;
二　当該外国漁船の名称、種類、旗国（海洋法に関する国際連合条約第九十一条２に規定するその旗を掲げる権利を有する国をいう。以下同じ。）、総トン数、長さ、幅及び喫水、旗国における船舶の登録に係る番号、国際海事機関船舶識別番号、呼出符号並びに船舶の外部から当該船舶を識別できる番号、当該外国漁船との連絡手段並びに当該外国漁船が水産資源の持続的な利用に関する国際機関その他の国際的な枠組み（以下「国際的な枠組み」という。）に登録されている場合にあつては当該登録に係る番号（以下「名称等」という。）
(ii) the name of the foreign fishing vessel, type, flag state (meaning the State having the right to fly its flag as prescribed in Article 91, paragraph (2) of the United Nations Convention on the Law of the Sea. The same applies hereinafter.), gross tonnage, length, width and draft, number pertaining to register of vessels in flag state, identification number of vessels in the International Maritime Organization, a calling code and a number by which the vessel can be identified from its outside, lines of communication with the foreign fishing vessel, and, if the foreign fishing vessel is registered with an international organization relating to the sustainable use of fishery resources or other international frameworks (hereinafter referred to as "international framework"), the number of that register (hereinafter referred to as the "name, etc,");
三　当該外国漁船の有する漁ろう設備の種類並びに衛星船位測定送信機（人工衛星を利用して船舶の位置の測定及び送信を行う機器であつて、次に掲げる基準に適合するものをいう。以下同じ。）の有無、種類、情報の送信先及び当該外国漁船内に備え付けることを要求している国又は国際的な枠組み
(iii) type of fishing gear the foreign fishing vessel is equipped with and existence or nonexistence, type, and destination of the information sent by the satellite vessel positioning system transmitter (a device which measures the location of a vessel and transmits the location information using satellite, and that complies with the following standards. The same applies hereinafter.) and national or international framework requiring the vessel to be equipped with the system;
イ　当該船舶の位置を自動的に測定及び記録できるものであること。
(a) the device can measure and record the location of the vessel automatically;
ロ　次に掲げる情報を自動的に送信できるものであること。
(b) the device can automatically send the following information
（１）　当該船舶を特定することができる情報
1. Information which can identify the vessel
（２）　当該船舶の位置を示す情報並びに当該位置における日付及び時刻
2. Information identifying the positions of the vessel and dates and times for each position
ハ　ロに掲げる情報の改変を防止するための措置が講じられているものであること。
(c) measures are taken to prevent the information listed (b) from being altered
四　当該外国漁船に積載されている漁獲物等の品名、魚種、形態、数量及び積込地（採捕した場所を含む。）（以下「品名等」という。）、当該漁獲物等の全部又は一部の本邦への陸揚げ又は他の船舶への転載を行う場合においてはその漁獲物等の品名等並びに当該外国漁船の漁業に係る許可の権限を有する者、有効期間及び許可番号並びに当該許可に係る操業の場所、魚種及び漁具（以下「漁業の内容等」という。）
(iv) the item name, species, conformation, quantity and loading area (including the place where the fish were gathered or caught) of catches, etc. with which the foreign fishing vessel was loaded (hereinafter referred to as "item name, etc."), and in the case of landing to Japanese ports or transshipment to other vessel of all or part of the catches, etc., item name, etc. of the catches, person that has authority to give permission to the foreign fishing vessel to conduct fishing operations, effective period, permission number, and operation area, species and fishing gears pertaining to the permission (hereinafter referred to as "contents of fishing operations, etc.".);
五　漁獲物等を当該外国漁船から他の船舶に転載し、又は他の船舶から当該外国漁船に積み込んだ場合にあつては、その場所及び年月日、当該他の船舶の名称、旗国及び国際海事機関船舶識別番号その他の当該他の船舶を特定することができる番号並びに当該漁獲物等の品名等
(v) in the case of transshipping catches, etc. from the foreign fishing vessel to other vessel or loading the foreign fishing vessel with the catches, etc. from other vessel, the area and date, name of the other vessel, flag state and identification number of vessels in the International Maritime Organization or other number which can identify the other vessel and item name, etc. of the catches, etc.;
六　当該外国漁船の所有者その他当該外国漁船を使用する権利を有する者の氏名、国籍及び住所（法人その他の団体にあつては、名称、本店又は主たる事務所の所在地及び代表者の氏名。以下「氏名等」という。）
(vi) name, nationality and domicile of the owner of the foreign fishing vessel and the person that has the right to use the foreign fishing vessel ( if the person is a corporation or other entity, the name, location of the head office or principal office and name of its representative. Hereinafter referred to as "name, etc.");
七　当該外国漁船を寄港させようとする本邦の港の名称及び所在地
(vii) the name of Japanese ports and a location which the foreign fishing vessel seeks to call at;
八　当該外国漁船を寄港させようとする年月日時及び期間並びに当該寄港の目的
(viii) date and time and period when the foreign fishing vessel seeks to call at the Japanese port and the purpose of the call; and
九　当該寄港の前最後に当該外国漁船を寄港させた港の名称及び所在地並びに入出港の年月日並びに次に当該外国漁船を寄港させようとする港の名称及び所在地並びに当該港までの航海の目的
(ix) name and location of the last port which the foreign fishing vessel called at before this call, and date of entry and departure and name and location of the next port which the foreign fishing vessel seeks to call at, and the purpose of the visit to the port.
２　前項の申請書には、次に掲げる事項を記載した書面を添付しなければならない。
(2) A document containing the following information must be attached to the written application set forth in the preceding paragraph.
一　当該外国漁船が漁業の用に供され、又は漁場から漁獲物等を運搬する際に必要とされる当該外国漁船の旗国の効力を有する漁業に係る許可を有している旨
(i) information indicating that the foreign fishing vessel has an effective permission to conduct fishing operations issued by the flag state of the foreign fishing vessel, which is required when it is used for fishing operations or transporting catches, etc. from fishing grounds;
二　当該外国漁船が沿岸国（旗国を除く。以下この号において同じ。）の主権又は管轄権の下にある水域において漁業の用に供され、又は漁獲物等を運搬する場合にあつては、当該外国漁船が、その際に必要とされる当該沿岸国の効力を有する漁業に係る許可を有している旨
(ii) if the foreign fishing vessel is used for fishing operations or transporting catches, etc. within water area under the sovereign power or jurisdiction of a coastal state (excluding the flag state. The same applies hereinafter in this item.), information indicating that the foreign fishing vessel has an effective permission required to conduct fishing operations for such cases issued by the coastal state;
三　当該外国漁船に積載されている漁獲物等が沿岸国の主権又は管轄権の下にある水域で採捕されたものである場合にあつては、当該漁獲物等が当該沿岸国の決定した水産資源の適切な保存及び管理のための措置に違反して採捕されたものではない旨
(iii) if catches, etc. with which the foreign fishing vessel is loaded are gathered or caught within water area under the sovereign power or jurisdiction of the coastal state, information indicating that the catches, etc. have not been gathered or caught in violation of measures taken by the coastal state for appropriate preservation and management of fishery resources;
四　当該外国漁船に積載されている漁獲物等が国際的な枠組みにより当該国際的な枠組みが決定した水産資源の適切な保存及び管理のための措置を適用することとされているものである場合にあつては、当該漁獲物等が当該措置に違反して採捕されたものではない旨
(iv) if the catches, etc. with which the foreign fishing vessel is loaded are deemed by an international framework to be subject to the application of measures for appropriate preservation and management of fishery resources taken by that international framework, information indicating that the catches, etc. have not been gathered or caught in violation of the measures; and
五　前各号に掲げるもののほか、当該外国漁船が国際的な枠組みにより我が国が本邦の港への寄港の禁止その他の必要な措置を講ずることが必要である旨が決定される原因となる行為をしていない旨
(v) beyond the information set forth in the preceding items, information indicating that the foreign fishing vessel is not engaged in conduct which is the reason why, based on an international framework, Japan has decided to prohibit calls at Japanese ports or to take other necessary measures.
（漁獲物等の転載等の許可の申請）
(Application for Permission for Transshipping Catches)
第四条　外国人漁業の規制に関する法律施行令（以下「令」という。）第四条第二号の規定による許可で法第六条第一項の規定の適用の除外に係るものを受けようとする外国漁船の船長は、次に掲げる事項を記載した申請書を農林水産大臣に提出しなければならない。
Article 4  (1) The captain of a foreign fishing vessel seeking to be excluded from the application of the provisions of Article 6, paragraph (1) of the Act by obtaining the permission under the provisions of Article 4, item (ii) of the Order for Enforcement of the Act on Regulation of Fishing Operation by Foreign Nationals (hereinafter referred to as the "Order") must submit a written application containing the following information to the Minister of Agriculture, Forestry and Fisheries:
一　当該外国漁船及び当該他の船舶又は当該他の外国漁船の船長の氏名及び国籍
(i) the names and nationalities of the captains of the foreign vessel and the other vessel or other foreign fishing vessel;
二　当該外国漁船及び当該他の船舶又は当該他の外国漁船の名称等
(ii) the names, etc. of the foreign fishing vessel and the other vessel or other foreign fishing vessel;
三　当該外国漁船及び当該他の船舶（外国漁船に限る。以下この号及び次号において同じ。）又は当該他の外国漁船の有する漁ろう設備の種類並びに衛星船位測定送信機の有無、種類、情報の送信先並びに当該外国漁船及び当該他の船舶又は当該他の外国漁船内に備え付けることを要求している国又は国際的な枠組み
(iii) the type of fishing gear that the foreign fishing vessel and the other vessel (limited to foreign fishing vessel. The same applies hereinafter in this item and next item.) or other foreign fishing vessel is equipped with, the existence or nonexistence, type, destination of the information that is sent by the vessel positioning system transmitter and Nation or International Framework requiring the foreign fishing vessel and the other vessel or other foreign fishing vessel to be equipped with them;
四　当該外国漁船及び当該他の船舶又は当該他の外国漁船に積載されている漁獲物等の品名等並びに当該外国漁船及び当該他の船舶又は当該他の外国漁船の漁業の内容等
(iv) the item name, etc. of the catches, etc with which the foreign fishing vessel and the other vessel or other foreign fishing vessel were loaded with, and contents, etc. of fishing operations of the foreign fishing vessel and the other vessel or other foreign vessel;
五　当該外国漁船及び当該他の船舶又は当該他の外国漁船の所有者その他当該外国漁船及び当該他の船舶又は当該他の外国漁船を使用する権利を有する者の氏名等
(v) the name of the owner of the foreign fishing vessel and the other vessel or other foreign fishing vessel, and the person that has the right to use the foreign fishing vessel and the other vessel or other foreign fishing vessel;
六　当該漁獲物等の品名等、仕向地及び所有者の氏名等
(vi) the Item Name, etc., the place of destination, and the Name, etc. of the owner of the relevant catches;
七　漁獲物等を当該外国漁船から他の船舶に転載し、又は他の船舶から当該外国漁船に積み込んだ場合にあつては、その場所及び年月日、当該他の船舶の名称、旗国及び国際海事機関船舶識別番号その他の当該他の船舶を特定することができる情報並びに当該漁獲物等の品名等
(vii) if catches, etc. are transshipped from the foreign fishing vessel to other vessel or the foreign fishing vessel is loaded with catches, etc. from other vessel, the area and date, the name, flag state and identification number of the other vessel in the International Maritime Organization and other information which can identify the other vessel, and item name, etc. of the catches, etc.; and
八　当該漁獲物等の転載又は積込みの前最後に当該外国漁船及び当該他の船舶又は当該他の外国漁船を寄港させた港の名称及び所在地並びに入出港の年月日並びに次に当該外国漁船及び当該他の船舶又は当該他の外国漁船を寄港させようとする港の名称及び所在地並びに当該港までの航海の目的
(viii) the name and the location of the last port which the foreign fishing vessel and the other vessel or other foreign fishing vessel called at before transshipping or being loaded with the catches, etc., and the date of entry and departure and the name and location of the next port which the foreign fishing vessel and the other vessel or other foreign fishing vessel seek to call at, and the purpose of the visit to the port.
２　前項の申請書には、前条第二項各号に掲げる事項を記載した書面を添付しなければならない。
(2) A document containing the information set forth the items of the paragraph (2) of the preceding Article must be attached to the written application under the preceding paragraph.
３　令第四条第二号の規定による許可で法第六条第二項の規定の適用の除外に係るものを受けようとする外国漁船以外の船舶の船長は、次に掲げる事項を記載した申請書を農林水産大臣に提出しなければならない。
(3) The captain of a vessel other than a foreign fishing vessel seeking to be excluded from the application of the provisions of Article 6, paragraph (2) of the Act by obtaining the permission under the provisions of Article 4, item (ii) of the Order must submit a written application containing the following information to the Minister of Agriculture, Forestry and Fisheries:
一　当該船舶及び当該外国漁船の船長の氏名及び国籍
(i) the names and nationalities of the captains of the vessel and the foreign fishing vessel;
二　当該船舶及び当該外国漁船の名称等
(ii) the names, etc. of the vessel and the foreign fishing vessel;
三　当該外国漁船の有する漁ろう設備の種類並びに衛星船位測定送信機の有無、種類、情報の送信先及び当該外国漁船内に備え付けることを要求している国又は国際的な枠組み
(iii) type of fishing gear the foreign fishing vessel is equipped with, and existence or nonexistence, type, destination of information that is sent by the vessel positioning system transmitter and Nation or International Framework requiring the fishing vessel to be equipped with those;
四　当該外国漁船に積載されている漁獲物等の品名等及び当該外国漁船の漁業の内容等
(iv) item name, etc. of the catches, etc. with which the foreign fishing vessel was loaded and contents of fishing operations of the foreign fishing vessel;
五　当該船舶及び当該外国漁船の所有者その他当該船舶及び当該外国漁船を使用する権利を有する者の氏名等
(v) the name, etc. of the owner of the vessel and foreign fishing vessel and of the person that has the right to use of the vessel and foreign fishing vessel;
六　当該漁獲物等の品名等、仕向地及び所有者の氏名等
(vi) the Item Name, etc., the place of destination, and the Name, etc. of the owner of the relevant catches;
七　当該漁獲物等の積込みの前最後に当該船舶及び当該外国漁船を寄港させた港の名称及び所在地並びに入出港の年月日並びに次に当該船舶及び当該外国漁船を寄港させようとする港の名称及び所在地並びに当該港までの航海の目的
(vii) the name and the location of the last port which the vessel and foreign fishing vessel called before being loaded with the catches, etc., and the date of entry and departure and the name and location of the next port which the vessel and foreign fishing vessel seek to call at, and the purpose of the visit to the port.
４　令第四条第二号の規定による許可で法第六条第三項の規定の適用の除外に係るものを受けようとする外国漁船以外の船舶の船長は、次に掲げる事項を記載した申請書を農林水産大臣に提出しなければならない。
(4) The captain of a vessel other than a foreign fishing vessel seeking to be excluded from the application of the provisions of Article 6, paragraph (3) of the Act by obtaining the permission under the provisions of Article 4, item (ii) of the Order must submit a written application containing the following information to the Minister of Agriculture, Forestry and Fisheries:
一　前項第一号から第六号までに掲げる事項
(i) the information set forth in items (i) through (vi) of the preceding paragraph;
二　当該漁獲物等の陸揚げ又は転載の前最後に当該船舶を寄港させた港（当該本邦の港を除く。）の名称及び所在地並びに入出港の年月日並びに次に当該船舶を寄港させようとする港の名称及び所在地並びに当該港までの航海の目的
(ii) the name and location of the last port which the vessel called at (excluding Japanese ports) before landing or transshipping the catches, etc., and the date of entry and departure and the name and location of the next port which the vessel seeks to call at, and the purpose of the visit to the port; and
三　当該漁獲物等の積込みの前最後に当該外国漁船を寄港させた港の名称及び所在地並びに入出港の年月日並びに次に当該外国漁船を寄港させようとする港の名称及び所在地並びに当該港までの航海の目的
(iii) the name and the location of the last port which the foreign fishing vessel called at before loading the catches, etc., and the date of entry and departure and the name and location of the next port which the foreign fishing vessel seeks to call at, and the purpose of the visit to the port.
（停船命令）
(Order to Halt)
第五条　漁業監督官は、法第六条の二第一項の規定による検査又は質問をするため必要があるときは、漁業、水産動植物の採捕、採捕準備行為又は探査に係る船舶の船長、船長の職務を行う者又は操業を指揮する者に対し、停船を命ずることができる。
Article 5  (1) If it is necessary to carry out the inspection or interview under the provisions of paragraph (1), Article 6-2 of the Act, an authorized fisheries supervisor may order the captain or the person who performs the duties of the captain or commands the operation of a vessel that conducts fishing operations, gathers or catches aquatic animals and plants, conducts preparatory actions for gathering or catching or conducts exploration, to halt.
２　前項の停船命令は、同項の検査又は質問をする旨を告げ、又は表示し、かつ、国際海事機関が採択した国際信号書に規定する次に掲げる信号その他の適切な手段により行うものとする。
(2) The order to halt under the preceding paragraph must be issued by announcing or indicating that inspection or interview under the preceding paragraph will be conducted and by using the following signals provided for the International Code of Signals adopted by the International Maritime Organization or other appropriate means:
一　信号旗Ｌを掲げること。
(i) to hoist the signal flag L;
二　サイレン、汽笛その他の音響信号によりＬの信号（短音一回、長音一回、短音二回）を約七秒の間隔を置いて連続して行うこと。
(ii) to continuously give L signals (one short sound, one prolonged sound and two short sounds) by siren, steam whistle or other acoustic signals at intervals of about seven seconds;
三　投光器によりＬの信号（短光一回、長光一回、短光二回）を約七秒の間隔を置いて連続して行うこと。
(iii) to continuously give L signals (one short light, one prolonged light, and two short lights) with a floodlight at intervals of about 7 seconds.
３　前項において、「長音」又は「長光」とは、約三秒間継続する吹鳴又は投光をいい、「短音」又は「短光」とは、約一秒間継続する吹鳴又は投光をいう。
(3) In the preceding paragraph, "prolonged sound" or "prolonged light" refers to the action of continuously making a sound or throwing light for about 3 seconds, "short sound" or "short light" refers to the action of continuously making a sound or throwing light for about 1 second.
附　則
Supplementary Provisions
この省令は、法の施行の日（昭和四十二年十月十二日）から施行する。
This Ministerial Order comes into effect as of the date (October 12, 1967) on which the Act comes into effect.

This Ministerial Order comes into effect as of the date (May 15, 1972) on which the Act on the Amendment and Repeal of the Relevant Laws and Regulations in Connection with the Reversion of Okinawa comes into effect.

この省令は、外国人漁業の規制に関する法律施行令の一部を改正する政令の施行の日（平成二十八年八月二十日）から施行する。
This Ministerial Order comes into effect as of the date (August 20, 2016) on which the Cabinet Order Partially Amending the Order for Enforcement of the Act on Regulation of Fishing Operation by Foreign Nationals comes into effect.

(Effective Date)
１　この省令は、漁業法等の一部を改正する等の法律（以下「改正法」という。）の施行の日（令和二年十二月一日）から施行する。
(1) This Ministerial Order comes into effect as of the date on which the Act for Partial Revision, etc. of the Fishery Act, etc. (hereinafter referred to as the "Revised Act") comes into effect (December 1, 2020).

５　この省令の施行前にした行為及び前項の規定によりなおその効力を有することとされる場合におけるこの省令の施行後にした行為に対する罰則の適用については、なお従前の例による。
(5) With regard to the application of penal provisions to acts committed prior to the enforcement of this Ministerial Order and acts committed after the enforcement of this Ministerial Order in the case where the provisions then in force remain in force pursuant to the provisions of the preceding paragraph, the provisions then in force remain applicable.
