裁判官の報酬等に関する法律 Act on the Compensation of Judges 昭和二十三年法律第七十五号 Act No. 75 of 1948 令和六年法律第七十六号 Act No. 76 of 2024 裁判官の報酬等に関する法律（昭和二十三年七月一日法律第七十五号） Act on the Compensation of Judges (Act No. 75 of July 1, 1948) 第一条　裁判官の受ける報酬その他の給与については、この法律の定めるところによる。 Article 1 The compensation and other salaries received by judges are governed by the provisions of this Act. 第二条　裁判官の報酬月額は、別表による。 Article 2 The monthly compensation of a judge is to be in accordance with the attached table. 第三条　各判事、各判事補及び各簡易裁判所判事の受ける別表の報酬の号又は報酬月額は、最高裁判所が、これを定める。 Article 3 The category of compensation or monthly compensation received by each judge, each assistant judge and each summary court judge is specified by the Supreme Court. 第四条　裁判官の報酬は、発令の日から、これを支給する。但し、裁判官としての地位を失つた者が、即日裁判官に任ぜられたときは、発令の日の翌日から報酬を支給する。 Article 4 (1) The compensation of a judge is paid from the day they are appointed; provided, however, that when a person who has lost their position as a judge is appointed as a judge on the same day, their compensation is paid from the following day of their appointment. ２　裁判官の報酬が増額された場合には、増額された日からあらたな額の報酬を支給する。 (2) If the judge's compensation is increased, the new amount of compensation is paid from the date of the increase. 第五条　裁判官がその地位を失つたときは、その日まで、報酬を支給する。 Article 5 (1) If a judge loses their position, they are to receive compensation until that date. ２　裁判官が死亡したときは、その月まで、報酬を支給する。 (2) If a judge dies, their compensation is paid until the month of their death. 第六条　裁判官の報酬は、毎月、最高裁判所の定める時期に、これを支給する。但し、前条の場合においては、その際、これを支給する。 Article 6 The compensation of a judge is paid monthly at a time to be specified by the Supreme Court; provided, however, that in the case of the preceding Article, it is paid at the time when a judge loses their position or dies. 第七条　第四条又は第五条第一項の規定により報酬を支給する場合においては、その報酬の額は、報酬月額の二十五分の一をもつて報酬日額とし、日割りによつてこれを計算する。ただし、その額が報酬月額を超えるときは、これを報酬月額にとどめるものとする。 Article 7 When compensation is paid pursuant to the provisions of Article 4 or Article 5, paragraph (1), the amount of that compensation is calculated on a daily basis, with one twenty-fifth of the monthly compensation amount as the daily compensation amount; provided, however, that if the amount exceeds the monthly amount of compensation, it is to be limited to the monthly compensation. 第八条　削除 Article 8 Deleted 第九条　報酬以外の給与は、最高裁判所長官、最高裁判所判事及び高等裁判所長官には、特別職の職員の給与に関する法律（昭和二十四年法律第二百五十二号）第一条第一号から第四十二号までに掲げる者の例に準じ、判事及び第十五条に定める報酬月額の報酬又は一号から四号までの報酬を受ける簡易裁判所判事には、一般職の職員の給与に関する法律（昭和二十五年法律第九十五号）による指定職俸給表の適用を受ける職員の例に準じ、その他の裁判官には、一般の官吏の例に準じて最高裁判所の定めるところによりこれを支給する。ただし、報酬の特別調整額、超過勤務手当、休日給、夜勤手当及び宿日直手当は、これを支給しない。 Article 9 (1) As specified by the Supreme Court, salary other than compensation is paid to the Chief Justice of the Supreme Court, Supreme Court Justices, and high court presidents in the same manner as that of persons listed in Article 1, items (i) through (xlii) of the Act on Remuneration of Government Officials with Special Capacity (Act No. 252 of 1949); to judges and summary court judges who receive the monthly compensation as specified in Article 15 or the compensation in categories 1 through 4 in the same manner as that of officials to whom the Designated Service Salary Schedule is applied under the Act on Remuneration of Officials in the Regular Service Category (Act No. 95 of 1950); and to other type of judges in the same manner as that of general government officials; provided, however, that a special adjustment of compensation, overtime allowances, holiday pay, night shift allowances, and night and day shift allowances are not paid. ２　高等裁判所長官には、一般の官吏の例に準じて、最高裁判所の定めるところにより、単身赴任手当を支給する。 (2) An unaccompanied transfer allowance is paid to the high court presidents, as specified by the Supreme Court, in the same manner as that of general government officials. ３　寒冷地に在勤する高等裁判所長官には、一般の官吏の例に準じて、最高裁判所の定めるところにより、寒冷地手当を支給する。 (3) A cold area allowance is paid to the high court presidents who serves in cold areas, as specified by the Supreme Court, in the same manner as that of general government officials. 第十条　生計費及び一般賃金事情の著しい変動により、一般の官吏について、政府がその俸給その他の給与の額を増加し、又は特別の給与を支給するときは、最高裁判所は、別に法律の定めるところにより、裁判官について、一般の官吏の例に準じて、報酬その他の給与の額を増加し、又は特別の給与を支給する。 Article 10 When the government increases the amount of salaries and other wages or provides special salaries for general officials due to significant changes in the cost of living and general wage conditions, the Supreme Court, as specified by other Acts, increases the amount of compensation and other salary or provides special salaries for judges in the same manner as those of general government officials. 第十一条　裁判官の報酬その他の給与に関する細則は、最高裁判所が、これを定める。 Article 11 The detailed regulations concerning the compensation and other salaries of judges are established by the Supreme Court. 附　則〔抄〕 Supplementary Provisions [Extract] 第十五条　簡易裁判所判事の報酬月額は、特別のものに限り、当分の間、第二条の規定にかかわらず、九十七万九千円とすることができる。 Article 15 Until otherwise provided, the monthly compensation for summary court judges may be set at 979,000 yen, limited to special cases, notwithstanding the provisions of Article 2. 別表（第二条関係） Appended Table (Re.
