Ⅰ 基本的な考え方
I. Basic Concept
1 策定の趣旨
1. Purport of formulation
特定秘密の保護に関する法律(平成25年法律第108号。以下「特定秘密保護法」という。)の統一的な運用を図るため、特定秘密保護法第18条第1項の規定に基づき、「特定秘密の指定及びその解除並びに適性評価の実施に関し統一的な運用を図るための基準」(以下「本運用基準」という。)を定める。
In order to ensure uniform implementation of the Act on the Protection of Specially Designated Secrets (Act No. 108 of 2013; hereinafter referred to as the "Specially Designated Secrets Act"), the Standards to Ensure Uniform Implementation in Connection with the Designation of Specially Designated Secrets and the Termination of the Designation as Well as the Conduct of the Security Clearance Assessment (hereinafter referred to as the "Implementation Standards") are hereby established based on Article 18, paragraph (1) of the Specially Designated Secrets Act.
本運用基準は、行政機関の長をはじめ、特定秘密保護法の運用その他特定秘密に関する業務を行う全ての者が、本運用基準が定める内容に従って特定秘密保護法の運用を統一的に行うことにより、特定秘密の漏えいの防止を図るとともに、その適正を確保するために定めるものである。
The Implementation Standards are established in order to prevent unauthorized disclosure of specially designated secrets and to ensure the proper implementation of the Specially Designated Secrets Act by having all people engaged in the implementation of the Specially Designated Secrets Act and other duties concerning specially designated secrets, including the Heads of Administrative Organs, uniformly implement the Specially Designated Secrets Act in accordance with the contents of the Implementation Standards.
なお、本運用基準における用語の定義は、特定秘密保護法又は特定秘密の保護に関する法律施行令(平成26年政令第336号。以下「施行令」という。)の定めるところによる。
The definitions of terms used in the Implementation Standards are as prescribed in the Specially Designated Secrets Act or the Order for Enforcement of the Act on the Protection of Specially Designated Secrets (Cabinet Order No. 336 of 2014; hereinafter referred to as the "Enforcement Order").
2 特定秘密保護法の運用に当たって留意すべき事項
2. Matters to note when implementing the Specially Designated Secrets Act
(1) 拡張解釈の禁止並びに基本的人権及び報道・取材の自由の尊重
(1) Prohibition of expansive interpretation and respect for the fundamental human rights and the freedom of news reporting or news coverage
特定秘密保護法は、第22条第1項及び第2項において、その適用に当たっては、これを拡張して解釈して、国民の基本的人権を不当に侵害するようなことがあってはならず、国民の知る権利の保障に資する報道又は取材の自由に十分に配慮しなければならないこと、及び出版又は報道の業務に従事する者の取材行為については、専ら公益を図る目的を有し、かつ、法令違反又は著しく不当な方法によるものと認められない限りは、これを正当な業務による行為とするものとすることを定めている。当該規定は、行政機関等における解釈適用の準則、すなわち、特定秘密保護法の運用その他特定秘密に関する業務を行う全ての者が特定秘密保護法を解釈適用するに当たって従わなくてはならない基準である。特定秘密保護法の運用その他特定秘密に関する業務を行う全ての者は、当該規定の内容を十分に理解し、以下の点に留意しなければならない。
The Specially Designated Secrets Act provides the following in Article 22, paragraphs (1) and (2): when applying the Specially Designated Secrets Act, its interpretation must not be expanded to unfairly violate the fundamental human rights of the citizens, and due consideration must be paid to the freedom of news reporting or news coverage, which contributes to guaranteeing the citizens' right to know; and the act of news coverage by persons engaged in publishing or news reporting is to be treated as an act in the pursuit of lawful business as long as it has the sole aim of furthering the public interest and is not found to have been done in violation of laws or regulations or through the use of extremely unjustifiable means. These provisions are rules for interpretation and application by Administrative Organs, etc.; in other words, they are standards which all people engaged in the implementation of the Specially Designated Secrets Act and other duties concerning specially designated secrets must observe when interpreting or applying the Specially Designated Secrets Act. All people engaged in the implementation of the Specially Designated Secrets Act and other duties concerning specially designated secrets must sufficiently understand the contents of these provisions, and note the following points:
ア 特定秘密保護法が定める各規定を拡張して解釈してはならず、厳格にこれを適用すること。
A. The provisions of the Specially Designated Secrets Act must not be expansively interpreted, and they should be rigorously applied.
特に、特定秘密保護法第3条第1項、第4条及び別表各号については、この点により一層留意し、本運用基準Ⅱ1、Ⅱ4(1)、Ⅲ1(1)等の規定に従って、必要最小限の情報を必要最低限の期間に限って特定秘密として指定するものとすること。
In particular, this point should be specially noted with regard to Article 3, paragraph (1), Article 4, and the items of the Appended Table of the Specially Designated Secrets Act, and the minimum information necessary should be designated as a specially designated secret only for the minimum period necessary in accordance with II. 1., II. 4. (1), III. 1. (1), etc. of the Implementation Standards.
イ 憲法に規定する基本的人権を不当に侵害することのないようにすること。特に、適性評価の実施に当たっては、プライバシーの保護に十分に配慮しなければならないこと。
B. The fundamental human rights prescribed in the Constitution may not be unfairly violated. In particular, due consideration must be paid to privacy protection when conducting the Security Clearance Assessment.
ウ いわゆる国民の知る権利は、憲法第21条の保障する表現の自由や、憲法のよって立つ基盤である民主主義社会の在り方と結び付いたものとして、十分尊重されるべきものであること。特に、報道又は取材の自由については、国民の知る権利を保障するものとして十分に配慮することとし、出版又は報道の業務に従事する者と接触する際には、特定秘密保護法第22条第1項及び第2項の規定を遵守すること。
C. What is known as the "citizens' right to know" should be sufficiently respected as the right connected to the freedom of expression guaranteed under Article 21 of the Constitution, and to what a democratic society, which serves as the foundation for the Constitution, should be. In particular, due consideration should be paid to the freedom of news reporting or news coverage, which guarantees the citizens' right to know, and when contacting persons engaged in publishing or news reporting, the provisions of Article 22, paragraphs (1) and (2) of the Specially Designated Secrets Act must be observed.
(2) 公文書管理法及び情報公開法の適正な運用
(2) Proper implementation of the Public Records Management Act and the Act on Access to Information
行政文書(公文書等の管理に関する法律(平成21年法律第66号。以下「公文書管理法」という。)第2条第4項に規定する行政文書をいう。以下同じ。)は、公文書管理法に基づき管理され、また、行政機関の保有する情報の公開に関する法律(平成11年法律第42号。以下「情報公開法」という。)に基づく開示請求がされた場合には、情報公開法第5条各号に掲げる不開示情報を除き、開示されることとなる。
Administrative Documents (meaning the administrative documents prescribed in Article 2, paragraph (4) of the Public Records and Archives Management Act (Act No. 66 of 2009; hereinafter referred to as the "Public Records Management Act"); the same applies hereinafter) are managed under the Public Records Management Act, and when a disclosure request is made under the Act on Access to Information Held by Administrative Organs (Act No. 42 of 1999; hereinafter referred to as the "Act on Access to Information"), they are disclosed unless they are any of the non-disclosure information set forth in the items of Article 5 of the Act on Access to Information.
特定秘密である情報を記録する行政文書も、公文書管理法及び情報公開法が当然適用される。すなわち、特定秘密である情報を記録する行政文書についても、指定が解除され、又は指定の有効期間が満了し、当該行政文書の保存期間が満了した場合に、歴史公文書等(公文書管理法第2条第6項に規定する歴史公文書等をいう。以下同じ。)に該当するものは、国立公文書館等に移管されることとなる。また、何人も、情報公開法に定めるところにより、行政機関の長に対し、特定秘密である情報を記録する行政文書の開示を請求することができ、開示請求を受けた行政機関の長は、情報公開法に基づき、開示・不開示の決定を行うこととなる。特定秘密に係る部分は、特定秘密に指定される情報の性質上、情報公開法第5条に規定する不開示情報の一部に該当するものと解されるが、実際に開示・不開示の決定を行う際には、当該部分が情報公開法上の不開示情報に該当するか否かについて厳格に判断する必要がある。
Administrative Documents which record information that is a specially designated secret are also subject to application of the Public Records Management Act and the Act on Access to Information. In other words, Administrative Documents which record information that is a specially designated secret are also transferred to the National Archives of Japan, etc. if they fall under the category of Historical Public Records and Archives (meaning the historical public records and archives prescribed in Article 2, paragraph (6) of the Public Records Management Act; the same applies hereinafter) when the Designation is terminated or the effective period of the Designation expires, and the retention period of the Administrative Documents expires. Any person may file a request for disclosure of Administrative Documents which record information that is a specially designated secret with the Head of an Administrative Organ pursuant to the provisions of the Act on Access to Information, and the Head of an Administrative Organ who receives a disclosure request decides on disclosure or non-disclosure based on the Act on Access to Information. The part of an Administrative Document that constitutes a specially designated secret is construed to constitute a part of the non-disclosure information prescribed in Article 5 of the Act on Access to Information given the nature of information designated as a specially designated secret, but when actually deciding on disclosure or non-disclosure, it is necessary to rigorously determine whether or not that part falls under the category of non-disclosure information under the Act on Access to Information.
なお、当該特定秘密に係る部分について不開示決定がなされた場合であって、当該不開示決定について不服申立てがなされたときは、行政機関の長の諮問に応じ、情報公開・個人情報保護審査会等(以下単に「審査会等」という。)が当該不開示決定の適否を調査審議することとなる。この場合において、審査会等は、必要があると認めるときは、情報公開・個人情報保護審査会設置法(平成15年法律第60号)第9条第1項(会計検査院法(昭和22年法律第73号)第19条の4において読み替えて準用する場合を含む。)の規定に基づき、当該行政機関の長に対し、当該不開示決定に係る行政文書の提示を求めることができ、提示を求められた当該行政機関の長は、特定秘密保護法第10条第1項第3号又は第4号の規定に基づき、審査会等に特定秘密を提供することとなる。そして、審査会等による調査審議の結果、行政機関の長が当該特定秘密に係る部分を開示する際は、その指定を解除することとなる。
If a decision of non-disclosure is made for the part constituting the specially designated secret and an objection to the decision of non-disclosure is filed, the Information Disclosure and Personal Information Protection Review Board, etc. (hereinafter simply referred to as the "Board, etc.") investigates and deliberates on the appropriateness of the decision of non-disclosure in response to consultation by the Head of an Administrative Organ. In this case, if the Board, etc. finds it to be necessary, it may request the Head of an Administrative Organ to present the Administrative Document subject to the decision on non-disclosure pursuant to Article 9, paragraph (1) of the Act for Establishment of the Information Disclosure and Personal Information Protection Review Board (Act No. 60 of 2003) (including as applied mutatis mutandis pursuant to Article 19-4 of the Board of Audit Act (Act No. 73 of 1947) following the deemed replacement of terms), and the Head of an Administrative Organ who receives the request for presentation provides the specially designated secret to the Board, etc. pursuant to Article 10, paragraph (1), item (iii) or (iv) of the Specially Designated Secrets Act. If, as a result of the investigation and deliberation by the Board, etc., the Head of an Administrative Organ discloses the part constituting the specially designated secret, the Designation of the specially designated secret is terminated.
特定秘密保護法の運用その他特定秘密に関する業務を行う全ての者は、これらの点について十分に理解した上で、特定秘密保護法だけではなく、公文書管理法及び情報公開法についても各規定の内容を正確に理解してその適正な運用を徹底し、国民に対する説明責務を全うしなければならない。
All people engaged in implementation of the Specially Designated Secrets Act and other duties concerning specially designated secrets must achieve their accountability to citizens by correctly understanding the contents of the provisions of not only the Specially Designated Secrets Act but also the Public Records Management Act and the Act on Access to Information after sufficiently understanding these points to complete their proper implementation.
3 特定秘密を取り扱う者等の責務
3. Responsibilities of persons handling specially designated secrets
(1) 特定秘密を取り扱う者は、特定秘密保護法、施行令、本運用基準及び各種関連規程の内容を十分に理解し、これらの適正な運用の確保を図りつつ、特定秘密の保護のための措置を適確に講じなければならない。
(1) A person handling a specially designated secret must appropriately take measures for protecting the specially designated secret, while sufficiently understanding the contents of the Specially Designated Secrets Act, the Enforcement Order, the Implementation Standards, and various related rules and ensuring their proper implementation.
(2) 特定秘密を取り扱う者は、自身が特定秘密の漏えいの働き掛けを受ける対象となり得ることを十分に認識し、施行令第12条第2項に基づき実施される特定秘密の保護に関する教育を受講するなどして規範意識を常に高く保たなければならない。
(2) A person handling a specially designated secret must constantly maintain high respect for social norms by sufficiently recognizing that the person may be approached to make unauthorized disclosure of the specially designated secret and receiving education concerning the protection of specially designated secrets that is implemented pursuant to Article 12, paragraph (2) of the Enforcement Order.
(3) 特定秘密を取り扱う者は、特定秘密の漏えいの働き掛けを受けた場合又はその兆候を認めた場合には、上司その他の適当な者へ報告するなど、適切に対処するものとする。
(3) If a person handling a specially designated secret is approached to make unauthorized disclosure of the specially designated secret or finds signs of such approach, the person is to appropriately deal with it by such means as reporting to the person's supervisor or any other appropriate person.
(4) (1)から(3)までは、特定秘密を取り扱わなくなった者についても、同様とする。
(4) (1) through (3) above also apply to a person who no longer handles a specially designated secret.
Ⅱ 特定秘密の指定等
II. Designation of Specially Designated Secrets
1 指定の要件
1. Requirements for Designation
特定秘密保護法第3条第1項は、行政機関の長が指定する特定秘密について、以下の3つの要件を規定している。
Article 3, paragraph (1) of the Specially Designated Secrets Act prescribes the following three requirements for a specially designated secret to be designated by the Head of an Administrative Organ:
・ 当該行政機関の所掌事務に係る特定秘密保護法別表に掲げる事項に関する情報であること(以下「別表該当性」という。)。
- The information concerns the matters set forth in the Appended Table of the Specially Designated Secrets Act pertaining to the affairs under the jurisdiction of the Administrative Organ (hereinafter referred to as the "Relevance to the Appended Table").
・ 公になっていない情報であること(以下「非公知性」という。)。
- The information is publicly undisclosed (hereinafter referred to as "Non-Public Nature").
・ その漏えいが我が国の安全保障に著しい支障を与えるおそれがあるため、特に秘匿することが必要である情報であること(以下「特段の秘匿の必要性」という。)。
- The information is particularly required to be kept secret due to the risk of causing severe damage to Japan's national security, if disclosed without authorization (hereinafter referred to as the "Particular Need to Be Kept Secret").
行政機関の長が指定しようとする情報が、この3つの要件を満たすか否かを判断するに当たっての基準は以下のとおりとする。
The following standards are used when the Head of an Administrative Organ determines whether or not the information to be designated satisfies these three requirements:
(1) 別表該当性
(1) Relevance to the Appended Table
別表該当性の判断は、以下のとおり特定秘密保護法別表に掲げる事項の範囲内でそれぞれの事項の内容を具体的に示した事項の細目に該当するか否かにより行うものとする。なお、事項の細目に該当する情報の全てを特定秘密として指定するものではなく、当該情報のうち、後述の非公知性及び特段の秘匿の必要性の要件を満たすもののみを特定秘密として指定する。
Determination on Relevance to the Appended Table is to be based on whether or not the information falls under the details of the matters set forth in the Appended Table of the Specially Designated Secrets Act as shown below, which specifically indicate the contents of the respective matters within the scope of the matters. Meanwhile, not all information that falls under the details of the matters is eligible to be designated as a specially designated secret, but only such information that also satisfies the later-mentioned requirements of Non-Public Nature and Particular Need to Be Kept Secret is designated as a specially designated secret.

イ 自衛隊の運用又はこれに関する見積り若しくは計画若しくは研究

非公知性の判断は、現に不特定多数の人に知られていないか否かにより行うものとする。当該情報と同一性を有する情報が報道機関、外国の政府その他の者により公表されていると認定する場合には、たとえ我が国の政府により公表されていなくても、本要件を満たさない。なお、実際の判断に当たっては、当該情報の内容に応じ、これを知る必要がある者、実際にこれを知っている者、当該時点までの当該情報の管理の状態等の要素を勘案して個別具体的に行うものとする。
Determination on Non-Public Nature is to be based on whether or not the information is actually known to many and unspecified persons. If information identical to the information is recognized to have been published by a news organization, a government of a foreign country, or any other person, this requirement is not satisfied even if it is has not been published by the Japanese government. The actual determination is to be made on a case-by-case basis according to the contents of the information by taking into account factors including the persons who need to know the information, persons who actually know the information, and the conditions of management of the information up to the time of the determination.
(3) 特段の秘匿の必要性

特段の秘匿の必要性の判断は、当該情報の漏えいにより、
・ 安全保障のために我が国が実施する施策、取組等に関し、これらの計画、方針、措置その他の手の内やこれらのための我が国の能力が露見し、対抗措置が講じられ、我が国に対する攻撃が容易となったり、外国の政府等との交渉が困難となったりすることとなる
・ 外国の政府その他の者との信頼関係や我が国の秘密保護に関する信用が著しく損なわれ、今後の情報収集活動、当該外国の政府等との安全保障協力等が滞る
など我が国の安全保障に著しい支障を与える事態が生じるおそれがあるか否かにより行うものとする。
Determination on Particular Need to Be Kept Secret is to be based on whether or not unauthorized disclosure of the information poses the risk of causing severe damage to Japan's national security, such as the following:
- plans, policies, measures or any other intentions concerning measures or initiatives that Japan implements for national security or Japan's capacity for implementing such measures or initiatives come to light, and as a result, countermeasures are taken and an attack on Japan becomes easy, or it becomes difficult for Japan to negotiate with a Foreign Government, etc.; or
- the relationship of mutual trust with a Foreign Government or any other person or the trust of a Foreign Government, etc. with Japan's protection of secrets becomes substantially damaged, and as a result, Japan's future information collecting activities or security cooperation with the Foreign Government, etc. becomes stagnant.
(4) 特に遵守すべき事項

特定秘密を指定するに当たって、行政機関の長は、以下の点を遵守しなければならない。
When making Designation of a specially designated secret, the Head of an Administrative Organ must observe the following points:
ア 3つの要件の該当性の判断は、厳格に行い、特定秘密として保護すべき情報を漏れなく指定するとともに、当該情報以外の情報を指定する情報に含めないようにすること。
A. the Head of an Administrative Organ should rigorously determine whether information satisfies the three requirements, and designate the information to be protected as a specially designated secret without omission, as well as ensuring that other information is not included in the designated information;
イ 公益通報の通報対象事実その他の行政機関による法令違反の事実を指定し、又はその隠蔽を目的として、指定してはならないこと。
B. the Head of an Administrative Organ must not designate facts reportable in whistleblowing or any other facts of violation of laws and regulations by an Administrative Organ, or make a Designation for the purpose of concealing such facts; and
ウ 国民に対する説明責任を怠ることのないよう、指定する情報の範囲が明確になるよう努めること。
C. the Head of an Administrative Organ should endeavor to clarify the scope of information designated, so as not to neglect accountability to citizens.
2 実施体制
2. Implementation framework
行政機関の長は、施行令第12条第1項第1号の特定秘密の保護に関する業務を管理する者として、行政機関の長以外の当該行政機関の職員のうちから、我が国の安全保障に関する事務のうち特定秘密保護法別表に掲げる事項に係るものを所掌する国家行政組織法(昭和23年法律第120号)第7条の官房、局、部若しくは委員会の事務局若しくは事務総局の長、同法第8条の2の施設等機関の長、同法第8条の3の特別の機関の長、同法第9条の地方支分部局の長又はこれらに準ずる者を特定秘密管理者に指名し、特定秘密の保護に関する業務を管理するために必要な以下に掲げる措置を講じさせるものとする。
As a person who manages the duties concerning the protection of specially designated secrets as referred to in Article 12, paragraph (1), item (i) of the Enforcement Order, the Head of an Administrative Organ is to nominate the head of a secretariat, a bureau, a department, or an executive office or general executive office of a commission as referred to in Article 7 of the National Government Organization Act (Act No. 120 of 1948), the head of an organ such as a facility as referred to in Article 8-2 of the same Act, the head of an extraordinary organ as referred to in Article 8-3 of the same Act, the head of a local branch bureau as referred to in Article 9 of the same Act, or a person equivalent thereto that has jurisdiction over the affairs concerning Japan's national security pertaining to the matters set forth in the Appended Table of the Specially Designated Secrets Act as a specially designated secret manager, from among the officials of the relevant Administrative Organ other than the Head of an Administrative Organ, and has the specially designated secret manager take the following measures that are necessary for managing the duties concerning the protection of specially designated secrets:
(1) 施行令第4条、第7条、第8条第1項第3号、第9条第2号及び第11条第1項第3号並びに3(5)の規定による特定秘密指定管理簿への記載又は記録
(1) the entering or recording in a Book for Managing Designation of Specially Designated Secrets under Article 4, Article 7, Article 8, paragraph (1), item (iii), Article 9, item (ii), or Article 11, paragraph (1), item (iii) of the Enforcement Order or 3 (5) of the Implementation Standards;
(2) 特定秘密保護法第3条第2項第1号の規定による特定秘密の表示
(2) the marking as a specially designated secret under Article 3, paragraph (2), item (i) of the Specially Designated Secrets Act;
(3) 特定秘密保護法第3条第2項第2号の規定による通知
(3) the notice under Article 3, paragraph (2), item (ii) of the Specially Designated Secrets Act;
(4) 3(6)の規定による周知
(4) the informing under 3 (6) of the Implementation Standards;
(5) 特定秘密保護法第3条第3項の規定による同条第2項第1号に掲げる措置
(5) the measure set forth in Article 3, paragraph (2), item (i) of the Specially Designated Secrets Act implemented pursuant to paragraph (3) of the same Article;
(6) 施行令第8条第1項第1号及び第2号の規定による措置並びにⅢ1(2)アの規定による周知等
(6) the measures under Article 8, paragraph (1), items (i) and (ii) of the Enforcement Order and the informing, etc. under III, 1, (2), A of the Implementation Standards;

(12) (1)から(11)までに掲げるもののほか、特定秘密の保護に関する業務を管理するために必要な措置

3 指定手続
3. Designation procedure
(1) 行政機関又は都道府県警察の職員は、特定秘密に指定すべきと考えられる情報を知ったときには、直ちに当該情報が特定秘密に指定されるよう関係職員に通報するなどの措置を講ずるものとする。
(1) When an official of an Administrative Organ or a Prefectural Police comes to obtain information that is considered desirable to be designated as a specially designated secret, the official is to take a measure such as reporting to a relevant official so that the information will be designated as a specially designated secret immediately.
(2) 行政機関の長は、指定する際には、書面又は電磁的記録により、当該指定に係る情報を他の情報と区別することができるように記述するとともに、当該情報の指定の理由(以下「指定の理由」という。)を記すものとする。この場合において、当該指定に係る情報の記述(以下「対象情報の記述」という。)は、これを特定秘密として取り扱うことを要しないように記さなければならない。また、指定の理由の中には、当該情報が指定の要件を満たしていると判断する理由を明記することとする。
(2) When making a Designation, the Head of an Administrative Organ is to describe the information subject to the Designation in a manner distinguishable from other information as well as the reason for the Designation of the information (hereinafter referred to as the "Reason for Designation") in a document or Electronic or Magnetic Record. In this case, the description of the information subject to the Designation (hereinafter referred to as the "Description of the Target Information") must be made in a manner that does not require it to be treated as a specially designated secret. In addition, the reason for determining that the information satisfies the requirements for Designation is to be clearly indicated in the Reason for Designation.
(3) 対象情報の記述は、必要に応じ、「(○○を含む。)」、「(○○を除く。)」と記すこと等により、当該指定に係る情報の範囲が明確になるようにするものとする。また、毎年度作成する計画や継続的に収集する情報など、行政機関が当該指定に係る情報を異なる時期に複数回保有することが想定される場合には、指定の有効期間を定める趣旨に鑑み、対象情報の記述及び施行令第4条第3号の特定秘密の概要は、例えば「平成○○年度○○計画」、「情報収集衛星により平成○○年中に入手した衛星画像情報」、「平成○○年中の○○国との間の○○に関する交渉の内容」と期間を区切るなどして、適切に管理できるよう記すものとする。
(3) The Description of the Target Information is to be made, if necessary, in a manner that clarifies the scope of the information subject to the Designation, such as stating "(including xxxx)" or "(excluding xxxx)." When an Administrative Organ is assumed to hold the information subject to the Designation multiple times in different periods, in such a case of a plan to be prepared every fiscal year or information to be collected continuously, the Description of the Target Information and the outline of the specially designated secret as referred to in Article 4, item (iii) of the Enforcement Order are to be made in a manner that enables to manage the information appropriately, such as segmenting the period: "xxxx plan for FYxxxx," "satellite image information acquired during Year xxxx through the information collecting satellite," or "the contents of negotiations concerning xxx between Japan and country xxxx during year xxxx," in light of the purport that the effective period of the Designation is specified.
(4) 特定秘密に指定しようとする情報が、災害時の住民の避難等国民の生命及び身体を保護する観点からの公表の必要性、外国の政府等との交渉の終了その他の一定の条件が生じた場合に指定を解除すべき情報である場合には、当該条件を指定の理由の中で明らかにするものとする。
(4) If the information to be designated as a specially designated secret is information of which Designation should be terminated when there is a need for publication from the viewpoint of protecting the lives and bodies of the citizens such as upon evacuation of residents at the time of a disaster, when negotiations with a Foreign Government, etc. terminate, or when any other specific condition occurs, such condition is to be clarified in the Reason for Designation.
(5) 特定秘密指定管理簿には、個々の特定秘密について、施行令第4条第1号から第5号までに掲げる事項、指定の整理番号及び当該指定に係る特定秘密の保護に関する業務を管理する特定秘密管理者の官職を一覧できるように記載し、又は記録するものとする。同条第3号の特定秘密の概要については、特定秘密として取り扱うことを要しないよう要約したものを記述するものとする。なお、記載事項に変更があったときは、遅滞なく必要な変更を加えなければならない。
(5) In a Book for Managing Designation of Specially Designated Secrets, the matters set forth in Article 4, items (i) through (v) of the Enforcement Order, the serial number of the Designation, and the government position of the specially designated secret manager who manages the duties concerning the protection of the specially designated secret subject to the Designation are to be entered or recorded in an at-a-glance format for each specially designated secret. The outline of the specially designated secret as referred to in Article 4, item (iii) is to be described in a summarized form so that it is not required to be treated as a specially designated secret. When there is a change to any of the matters entered, the necessary change must be made in the Book for Managing Designation of Specially Designated Secrets without delay.
(6) 特定秘密管理者は、指定がされたときは、行政機関の長の命を受けて、特定秘密保護法第3条第2項第1号又は第2号に規定する措置を講ずるほか、当該指定に係る施行令第4条第2号及び第3号に掲げる事項(同条第2号に掲げる事項にあっては、指定の有効期間が満了する年月日に限る。)を当該行政機関において当該指定に係る特定秘密の取扱いの業務に従事する職員(当該指定について特定秘密保護法第3条第2項第2号の通知を受けた者を除く。)に周知するものとする。
(6) When a Designation is made, the specially designated secret manager, under the order of the Head of an Administrative Organ, is to take the measure prescribed in Article 3, paragraph (2), item (i) or (ii) of the Specially Designated Secrets Act as well as informing the officials engaged in the duty of handling the specially designated secret subject to the Designation at the Administrative Organ (excluding those who have received a notice as referred to in Article 3, paragraph (2), item (ii) of the Specially Designated Secrets Act with regard to the Designation) of the matters set forth in Article 4, items (ii) and (iii) of the Enforcement Order with regard to the Designation (the matter set forth in item (ii) of the same Article is limited to the date the effective period of the Designation expires).
4 指定の有効期間の設定
4. Establishment of the effective period of Designation
(1) 行政機関の長は、特定秘密保護法第4条第1項に基づく指定の有効期間として、特定秘密に指定しようとする情報に係る諸情勢が変化すると考えられる期間を勘案し、指定の理由を見直すに当たって適切であると考えられる最も短い期間を定めるものとする。例えば、
・ 定期的に策定される計画の策定に必要な資料にあっては、当該計画の次の計画が策定されるまでの間(毎年策定する計画の場合には2年等)
・ 情報通信技術の動向に密接に関係する情報にあっては、一般に当該技術の進展に応じた年数(3年等)
・ 外国の政府等の政策に密接に関係する要人の動向に関する情報にあっては、当該国の指導者の任期(4年等)
と定めることが考えられるが、行政機関の長は、指定の有効期間の基準を定めることが可能な情報についてはこれを定めるなどにより、統一的な運用を図るものとする。
(1) As the effective period of Designation based on Article 4, paragraph (1) of the Specially Designated Secrets Act, the Head of an Administrative Organ is to specify the shortest period that is considered to be appropriate for reviewing the Reason for Designation while taking into account the period over which various situations concerning the information to be designated as a specially designated secret are considered to change. The following periods may be specified:
- in the case of materials necessary for formulating a plan to be formulated periodically, the period until the next plan is to be formulated (e.g., two years in the case of a plan to be formulated every year);
- in the case of information closely related to trends of information and communications technology, the general number of years according to the progress of the technology (e.g., three years); and
- in the case of information concerning trends of important persons closely related to policies of a Foreign Government, etc., the term of office of the leader of that country (e.g., four years).
The Head of an Administrative Organ is to ensure uniform implementation by specifying the standards for the effective period of Designation for information for which such standards can be specified, or in other ways.
(2) 行政機関の長は、現に行われている外国の政府等との交渉の方針など、指定の有効期間を年数により設定することが困難である場合は、当該指定の有効期間を5年とした上で、指定を解除する条件を指定の理由の中で明らかにするよう努めるものとする。
(2) When it is difficult to establish the effective period of Designation, in such a case of a policy of negotiations currently carried out with a Foreign Government, etc., the Head of an Administrative Organ is to endeavor to clarify the condition based on which the Designation is terminated, while specifying the effective period of the Designation to be five years.
5 指定に関する関係行政機関の協力
5. Cooperation of related Administrative Organs concerning Designation
複数の行政機関が保有する文書、図画、電磁的記録又は物件に記録又は化体された情報を、そのうちの一つ又は複数の行政機関の長が特定秘密として指定する場合には、関係行政機関が協議の上、それぞれの行政機関の長が特定秘密に指定するなどにより、当該特定秘密の保護を図るものとする。
When information recorded in or embodied by a document, picture, Electronic or Magnetic Record, or object that is held by multiple Administrative Organs is designated as a specially designated secret by one or multiple Heads of the Administrative Organs, protection of the specially designated secret is to be ensured in such a manner that the related Administrative Organs holding a consultation and the respective Heads of the Administrative Organs designating the information as a specially designated secret.
6 指定した特定秘密を適切に保護するための規程
6. Rules for appropriately protecting designated specially designated secrets
(1) 施行令第12条第1項に規定する規程(以下「規程」という。)には、同条各号に掲げる措置及び特定秘密の保護に関する業務の実施体制の構築その他特定秘密を適切に保護するために必要な事項を定めるものとする。
(1) The rules prescribed in Article 12, paragraph (1) of the Enforcement Order (hereinafter referred to as the "Rules") are to provide construction of the implementation framework for the measures set forth in the items of the same Article and the duties concerning the protection of specially designated secrets as well as other matters necessary for appropriately protecting specially designated secrets.
(2) 規程には、施行令第12条第1項第2号の職員に対する特定秘密の保護に関する教育について、当該規程が定められた行政機関に属する特定秘密保護法第11条各号に規定する者を含めて実施することその他必要な事項を定めるものとする。
(2) The Rules are to provide the fact that education concerning the protection of specially designated secrets for the officials as referred to in Article 12, paragraph (1), item (ii) of the Enforcement Order should be implemented for persons including those prescribed in the items of Article 11 of the Specially Designated Secrets Act who belong to the Administrative Organ for which the Rules are established and other necessary matters with regard to the education.
(3) 規程には、緊急の事態における施行令第12条第1項第10号の廃棄について、危機管理及び公文書の管理に万全を期するため、次に掲げる事項その他必要な事項を定めるものとする。
(3) The Rules are to provide the following matters and other necessary matters in order to take every possible measure to ensure risk management and management of public records with regard to the destruction as referred to in Article 12, paragraph (1), item (x) of the Enforcement Order in an emergency situation:
・ 廃棄をする場合には、あらかじめ行政機関の長の承認を得ること。ただし、その手段がない場合又はそのいとまがない場合には、廃棄後、速やかに行政機関の長に報告すること。
- when destroying a Document Containing a Specially Designated Secret, etc., the approval of the Head of an Administrative Organ should be obtained in advance; provided, however, that when there is no means or time for obtaining the approval, a report should be made to the Head of an Administrative Organ promptly after the destruction;
・ 廃棄をした場合には、廃棄をした特定秘密文書等の概要、同号の要件に該当すると認めた理由及び廃棄に用いた方法を記載した書面を作成し、行政機関の長に報告すること。
- when having destroyed a Document Containing a Specially Designated Secret, etc., a document including the outline of the Document Containing a Specially Designated Secret, etc. that has been destroyed, the reason for finding that the case satisfies the requirement as referred to in the same item, and the method used for the destruction should be prepared, and reported to the Head of an Administrative Organ; and
・ 上記の報告を受けた行政機関の長は、当該廃棄をした旨を内閣保全監視委員会及び内閣府独立公文書管理監に報告すること。
- the Head of an Administrative Organ who receives the abovementioned report should report the fact that the destruction has been carried out to the Cabinet Committee for Protection and Oversight and the Inspector General for Public Records Management of the Cabinet Office.
(4) 行政機関の長は、規程を定めようとするときは、あらかじめ、その案を内閣総理大臣に通知するものとする。

Ⅲ 特定秘密の指定の有効期間の満了、延長、解除等
III. Expiration, Extension, Termination of the Effective Period of Designation of Specially Designated Secrets
1 指定の有効期間の満了及び延長
1. Expiration and extension of the effective period of Designation
(1) 指定時又は延長時に定めた有効期間が満了する場合

行政機関の長は、指定の有効期間を延長するときには、指定の理由を点検する。時の経過に伴い指定の理由に係る特段の秘匿の必要性を巡る状況が変化している中、更に当該指定の有効期間を延長するときは、書面又は電磁的記録により、その判断の理由を明らかにしておくものとする。特に、以下のアからオまでに掲げる事項に関する特定秘密(外国の政府等から提供されたものを除く。)について、当該アからオまでに掲げるときを経過した後、当該指定の有効期間を延長するときには、慎重に判断するものとする。
When extending the effective period of Designation, the Head of an Administrative Organ inspects the Reason for Designation. When further extending the effective period of the Designation while circumstances surrounding the Particular Need to Be Kept Secret pertaining to the Reason for Designation have changed with the passage of time, the reason for such determination is to be clarified by a document or Electronic or Magnetic Record. In particular, careful determination is to be made when extending the effective period of the Designation after the passage of the times set forth in A. through E. below with regard to specially designated secrets concerning the matters respectively set forth therein (excluding those provided by a Foreign Government, etc.):
ア 見積り又は計画のうち、対象期間が定められているもの 当該対象期間が満了したとき
A. assessments or plans for which the target period has been specified: when the target period expires;
イ 情報収集活動の方法又は能力 これらのものを活用しなくなったとき
B. methods or capabilities of information collecting activities: when they are no longer utilized;

エ 防衛の用に供する物、通信網若しくは通信の方法又は施設 これらのものを使用しなくなったとき
D. objects, communications networks or means of communication, or facilities used for defense: when they are no longer used; and
オ 外国の政府等との交渉が困難となるおそれのある情報 当該交渉が終了したとき
E. information that is likely to make negotiations with a Foreign Government, etc. difficult: when the negotiations are terminated.

特定秘密管理者は、指定の有効期間が満了したときは、行政機関の長の命を受けて、施行令第8条第1項の規定による措置を講ずるほか、当該指定の有効期間が満了した旨を当該行政機関において当該指定に係る情報の取扱いの業務に従事する職員(当該指定の有効期間の満了について施行令第8条第1項第2号の通知を受けた者を除く。)に周知するとともに、当該指定に係る情報の取扱いの業務に従事していた者が、その取り扱っていた特定秘密の指定の有効期間が満了したか否かを確認することができるようにするものとする。

施行令第8条第1項第1号の規定による特定秘密表示の抹消は、特定秘密表示に、赤色の二重線を付すことその他これに準ずる方法によりするものとする。
The deletion of the Marking as a Specially Designated Secret under Article 8, paragraph (1), item (i) of the Enforcement Order is to be made by applying double red lines over the Marking as a Specially Designated Secret or by another method equivalent thereto.
ウ 指定有効期間満了表示

施行令第8条第1項第1号の規定による指定有効期間満了表示は、特定秘密表示の傍らの見やすい箇所にするものとする。

特定秘密管理者は、指定の有効期間が延長されたときは、行政機関の長の命を受けて、施行令第9条の規定による措置を講ずるほか、当該指定の有効期間を延長した旨及び延長後の当該指定の有効期間が満了する年月日を当該行政機関において当該指定に係る特定秘密の取扱いの業務に従事する職員(当該指定の有効期間の延長について施行令第9条第1号の通知を受けた者を除く。)に周知するものとする。
When the effective period of Designation is extended, the specially designated secret manager, under the order of the Head of an Administrative Organ, is to take measures under Article 9 of the Enforcement Order as well as informing the officials engaged in the duty of handling the specially designated secret subject to the Designation at the Administrative Organ (excluding those who have received a notice as referred to in Article 9, item (i) of the Enforcement Order with regard to the extension of the effective period of the Designation) of the fact that the effective period of the Designation has been extended and the date the extended effective period of the Designation expires.
(4) 通じて30年を超えて延長する場合

特定秘密保護法第4条第4項の規定により通じて30年を超えて指定の有効期間を延長することについて、内閣が承認するか否かの判断は、当該特定秘密が同項各号に掲げる事項に関する情報であることを基本とし、特に慎重に行うものとする。
The Cabinet's determination on whether or not to approve extension of the effective period of Designation for more than 30 consecutive years pursuant to Article 4, paragraph (4) of the Specially Designated Secrets Act is to be made particularly carefully on the basis that the specially designated secret is the information concerning any of the matters set forth in the items of the same paragraph.

(1) 指定の理由の点検等
(1) Inspection of the Reason for Designation
行政機関の長は、その指定に係る特定秘密の取扱いの業務に従事する当該行政機関の職員に、当該指定の理由を点検させ、その実施年月日を書面又は電磁的記録に記載又は記録させるとともに、指定の要件を満たしていないと認めたときには、速やかに指定を解除するものとする。
The Head of an Administrative Organ is to have officials engaged in the duty of handling the specially designated secret subject to the Designation at the Administrative Organ inspect the Reason for Designation, enter or record the date of the inspection in a document or Electronic or Magnetic Record, and promptly terminate the Designation on finding that the specially designated secret fails to satisfy the requirements for Designation.
(2) 解除の周知等

特定秘密管理者は、指定が解除されたときには、行政機関の長の命を受けて、施行令第11条第1項の規定による措置を講ずるほか、当該指定を解除した旨及びその年月日を当該行政機関において当該指定に係る情報の取扱いの業務に従事する職員(当該指定の解除について施行令第11条第1項第2号の通知を受けた者を除く。)に周知するとともに、当該指定に係る情報の取扱いの業務に従事していた者が、その取り扱っていた特定秘密の指定が解除されたか否かを確認することができるようにするものとする。
When Designation is terminated, the specially designated secret manager, under the order of the Head of an Administrative Organ, is to take measures under Article 11, paragraph (1) of the Enforcement Order as well as informing the officials engaged in the duty of handling the information subject to the Designation at the Administrative Organ (excluding those who have received a notice as referred to in Article 11, paragraph (1), item (ii) of the Enforcement Order with regard to the expiration of the effective period of the Designation) of the fact that the effective period of the Designation has been terminated, and enable those who were engaged in the duty of handling the information subject to the Designation to check whether or not the effective period of the Designation of the specially designated secret they handled has been terminated.
(3) 特定秘密表示の抹消

施行令第11条第1項第1号の規定による特定秘密表示の抹消は、1(2)イの要領によりするものとする。

(1) 指定の有効期間が通じて30年を超える特定秘密

行政機関の長は、指定の有効期間が通じて30年を超える特定秘密に係る情報であって、その指定を解除し、又は指定の有効期間が満了したものを記録する行政文書のうち、保存期間が満了したものは、公文書管理法第8条第1項の規定にかかわらず、歴史公文書等として国立公文書館等に移管するものとする。
The Head of an Administrative Organ is to transfer an Administrative Document for which the retention period has expired, from among Administrative Documents which record information that is a specially designated secret for which the effective period of Designation exceeds 30 consecutive years and for which the Designation has been terminated or the effective period of the Designation has expired, to the National Archives of Japan, etc. as a document constituting Historical Public Records and Archives, notwithstanding the provisions of Article 8, paragraph (1) of the Public Records Management Act.

ア 行政機関の長は、通じて30年を超えて指定の有効期間を延長することについて内閣の承認が得られなかったときは、特定秘密保護法第4条第6項の規定により、当該指定に係る情報を記録する行政文書の保存期間の満了とともに、これを国立公文書館等に移管する。
A. If the approval of the Cabinet could not be obtained with regard to the extension of the effective period of Designation for more than 30 consecutive years, the Head of an Administrative Organ transfers the Administrative Document which records the information subject to the Designation to the National Archives of Japan, etc. upon expiration of the retention period of the Administrative Document, pursuant to Article 4, paragraph (6) of the Specially Designated Secrets Act.
イ 行政機関の長は、指定の有効期間が通じて30年以下の特定秘密に係る情報であって、その指定を解除し、又は指定の有効期間が満了したものを記録する行政文書のうち、保存期間が満了したものは、公文書管理法第8条に基づき、歴史公文書等については国立公文書館等に移管し、又は、歴史公文書等に該当しないもの(例えば、正本・原本以外の写しの文書、断片情報を記録した文書)については内閣総理大臣の同意を得て廃棄する。
B. The Head of an Administrative Organ transfers an Administrative Document for which the retention period has expired, from among Administrative Documents which record information pertaining to a specially designated secret for which the effective period of Designation is not more than 30 consecutive years and for which the Designation has been terminated or the effective period of the Designation has expired, to the National Archives of Japan, etc. if it constitutes Historical Public Records and Archives, and destroys it with the consent of the Prime Minister if it does not constitute Historical Public Records and Archives (such as a copy which is not the original or an authenticated copy, or a document which records fragmented information), based on Article 8 of the Public Records Management Act.
ウ 行政機関の長は、イの行政文書のうち、指定の有効期間が通じて25年を超える特定秘密を記録するものについては、当該行政文書に長期間にわたり特定秘密に指定された情報が記録されていることを踏まえ、万が一にも歴史公文書等を廃棄することのないよう、当該行政文書が歴史資料として重要なものでないか否か特に慎重に判断するものとする。
C. With regard to an Administrative Document as referred to in B. which records a specially designated secret for which the effective period of Designation exceeds 25 years, the Head of an Administrative Organ is to determine whether or not the Administrative Document is an important historical material particularly carefully, so as not to destroy a document constituting Historical Public Records and Archives by any chance, given that the Administrative Document records information that has been designated as a specially designated secret for a long time.
Ⅳ 適性評価の実施
IV. Conduct of Security Clearance Assessments
1 適性評価の実施に当たっての基本的な考え方
1. Basic concept in conduct of Security Clearance Assessments
(1) プライバシーの保護
(1) Protection of privacy
適性評価は、評価対象者やその家族等のプライバシーに関わるものであることから、そのプライバシーの保護に十分に配慮しなければならない。したがって、評価対象者の選定に当たっては、過不足なく必要な者に範囲を限って行うようにしなければならない。また、適合事業者の従業者は行政機関の職員と異なる立場にあること等を考慮し、適性評価の実施に当たっては、適性評価について分かりやすい説明を行い、その実施についてよく理解を得なければならない。
Since a Security Clearance Assessment concerns the privacy of the Persons subject to Assessment and their family, etc., due consideration must be paid to protection of the privacy. Therefore, when selecting the Persons subject to Assessment, only the necessary people must be selected without excess or deficiency. Also, considering that Workers of an Eligible Contractor are in a different position from officials of an Administrative Organ, when conducting a Security Clearance Assessment, a comprehensive explanation about the Security Clearance Assessment must be given to the Workers to ensure that they understand the conduct of the Security Clearance Assessment well.
(2) 調査事項以外の調査の禁止
(2) Prohibition of examination of matters other than the prescribed matters to be examined
適性評価の調査は、特定秘密保護法第12条第2項各号に掲げる事項以外の事項について行ってはならず、例えば、評価対象者の思想、信条及び信教並びに適法な政治活動、市民活動及び労働組合の活動について調査してはならない。また、仮に調査の過程で調査事項に関係しない情報を取得した場合には、これを記録してはならない。
Examination in a Security Clearance Assessment must not be conducted for matters other than those set forth in the items of Article 12, paragraph (2) of the Specially Designated Secrets Act. For example, examination must not be conducted with regard to the thought, creed, or religion, or lawful political activities, civil activities, or labor union activities of the Person subject to Assessment. In addition, if any information that is unrelated to the prescribed matters to be examined is obtained in the course of examination, such information must not be recorded.
(3) 適性評価の結果の目的外利用の禁止
(3) Prohibition of use of the results of Security Clearance Assessment for any purpose other than the intended purpose
適性評価は、特定秘密の取扱いの業務を行った際に特定秘密を漏らすおそれがないことについての評価であり、人事評価又はその他の能力の実証を行うものではなく、人事評価のために適性評価の結果を利用等してはならない。
A Security Clearance Assessment is an assessment of whether a person is unlikely to disclose a specially designated secret without authorization when performing the duty of handling a specially designated secret, and it is not a personnel evaluation or any other verification of the person's ability. The results of a Security Clearance Assessment must not be used for personnel evaluation or the like.
(4) 基本的人権の尊重等
(4) Respect for fundamental human rights
適性評価に関わる者は、「すべて国民は、法の下に平等であつて、人種、信条、性別、社会的身分又は門地により、政治的、経済的又は社会的関係において、差別されない」と規定する憲法第14条を遵守するとともに、基本的人権を不当に侵害することのないようにしなければならない。
Persons involved in a Security Clearance Assessment must observe Article 14 of the Constitution, which provides that "all of the people are equal under the law and there shall be no discrimination in political, economic or social relations because of race, creed, sex, social status or family origin," and must not unfairly violate fundamental human rights.
2 実施体制
2. Implementation framework
(1) 適性評価実施責任者
(1) Person responsible for conduct of Security Clearance Assessment
行政機関の長は、適性評価を実施するため、官房長、局長又はこれらに準ずる者を適性評価実施責任者に指名し、適性評価の実施に関する事務を総括させる。
In order to conduct a Security Clearance Assessment, the Head of an Administrative Organ nominates a deputy vice minister, bureau chief, or a person equivalent thereto as a person responsible for the conduct of Security Clearance Assessment and has the person supervise affairs concerning the conduct of the Security Clearance Assessment.
(2) 適性評価実施担当者
(2) Person in charge of conduct of Security Clearance Assessment
適性評価実施責任者は、適性評価を実施するに当たって、適性評価実施担当者を指名し、適性評価の実施に必要な事務を行わせる。
When conducting a Security Clearance Assessment, a person responsible for the conduct of Security Clearance Assessment nominates a person in charge of the conduct of Security Clearance Assessment and has the person carry out affairs necessary for the conduct of the Security Clearance Assessment.
(3) 関与の制限
(3) Restriction on involvement
行政機関の長並びに適性評価実施責任者及び適性評価実施担当者以外の者は、適性評価実施責任者の上司その他の当該行政機関の長が指名する者を除き、適性評価に関する事務に関与することができない。ただし、特定秘密保護法第12条第4項の規定による質問に回答し若しくは同項の規定による照会に対し必要な事項を報告する場合、若しくは適性評価の実施に関する事務に必要な連絡を取り次ぐ場合、又は苦情の申出に対応するため必要な場合は、この限りでない。
No person other than the Head of an Administrative Organ, the person responsible for the conduct of Security Clearance Assessment, and the person in charge of the conduct of Security Clearance Assessment may be involved in affairs concerning Security Clearance Assessment, except for the supervisor of the person responsible for the conduct of Security Clearance Assessment or any other person nominated by the Head of an Administrative Organ; provided, however, that this does not apply when answering a question under Article 12, paragraph (4) of the Specially Designated Secrets Act or reporting necessary matters in response to an inquiry under the same paragraph, when forwarding communication necessary for affairs concerning the conduct of a Security Clearance Assessment, or when necessary for dealing with a complaint filed.

適合事業者の従業者の適性評価を実施するに当たり、当該適合事業者に対し、評価対象者との間の書類の受渡しその他の連絡の取次ぎを依頼することは差し支えないが、適合事業者が取次ぎを行う際には、評価対象者が記載した書類の内容等適合事業者に通知することとされていない情報が当該適合事業者の知るところとならないようにしなければならない。
When conducting a Security Clearance Assessment of a Worker of an Eligible Contractor, it is permissible to request the Eligible Contractor to deliver documents to and from the Person subject to Assessment or otherwise intermediate communication with such person, but when the Eligible Contractor intermediates communication, it must be ensured that information which the Eligible Contractor is not to be notified of, such as the contents of a document described by the Person subject to Assessment, will not be known to the Eligible Contractor.
3 評価対象者の選定
3. Selection of Persons subject to Assessment
(1) 名簿の提出
(1) Submission of a name list
ア 特定秘密管理者は、当該行政機関の職員として特定秘密の取扱いの業務を行わせるために適性評価を実施する必要があると認めるときは、その者の氏名、生年月日、所属する部署、役職名、特定秘密保護法第12条第1項各号のうち該当する号、同項第3号に該当する場合には該当すると認める理由その他評価対象者の選定に当たって参考となる事項を記載し、又は記録した名簿を作成し、これを適性評価実施責任者に提出する。
A. If a specially designated secret manager finds it to be necessary to conduct a Security Clearance Assessment to have officials of the relevant Administrative Organ perform the duty of handling a specially designated secret, the specially designated secret manager prepares a name list including or recording the persons' names, dates of birth, divisions to which they belong, job titles, the item applicable from among the items of Article 12, paragraph (1) of the Specially Designated Secrets Act, the reason for finding that item (iii) of the same paragraph is applicable if it applies, and other matters that serve as reference in selecting the Persons subject to Assessment, and submits it to the person responsible for the conduct of Security Clearance Assessment.
イ 特定秘密保護法第5条第4項又は第8条第1項に規定する契約に基づき特定秘密を保有し又は提供される適合事業者は、その従業者として特定秘密の取扱いの業務を行わせるために適性評価を実施する必要があると認めるときは、その者の氏名、生年月日、所属する部署、役職名、派遣労働者であるときはその旨及び予定している業務内容、特定秘密保護法第12条第1項各号のうち該当する号その他評価対象者の選定に当たって参考となる事項を記載し、又は記録した名簿を作成し、これを当該特定秘密に係る特定秘密管理者に提出する。
B. If an Eligible Contractor that holds or is provided with a specially designated secret based on the contract prescribed in Article 5, paragraph (4) or Article 8, paragraph (1) of the Specially Designated Secrets Act finds it to be necessary to conduct a Security Clearance Assessment to have its Workers perform the duty of handling a specially designated secret, the Eligible Contractor prepares a name list including or recording the persons' names, dates of birth, divisions to which they belong, job titles, the fact that they are dispatched workers and the contents of the business they plan to engage in if they are dispatched workers, the item applicable from among the items of Article 12, paragraph (1) of the Specially Designated Secrets Act, and other matters that serve as reference in selecting the Persons subject to Assessment, and submits it to the specially designated secret manager related to the specially designated secret.
なお、派遣労働者を名簿に登載する場合には、適合事業者は、その旨を当該派遣労働者を雇用する事業主に対して通知するものとする。
When listing a dispatched worker on the name list, the Eligible Contractor is to notify the dispatched worker’s employer of such fact.
ウ イにより名簿の提出を受けた特定秘密管理者は、名簿に登載された者のうち特定秘密の取扱いの業務を行わせるために適性評価を実施する必要があると認める者について、その氏名、生年月日、所属する部署、役職名、派遣労働者であるときはその旨及び予定している業務内容、特定秘密保護法第12条第1項各号のうち該当する号、同項第3号に該当する場合には該当すると認める理由その他評価対象者の選定に当たって参考となる事項を記載し、又は記録した名簿を作成し、これを適性評価実施責任者に提出する。この場合において、当該特定秘密管理者は、名簿に登載しない者があるときは、その旨を適合事業者に通知するとともに、当該通知に係る従業者が派遣労働者であるときは、当該通知の内容を当該従業者を雇用する事業主に通知するよう当該適合事業者に求めるものとする。
C. A specially designated secret manager who receives submission of a name list pursuant to B. prepares a name list including or recording, with regard to the persons listed on the received name list for whom the specially designated secret manager finds it to be necessary to conduct a Security Clearance Assessment to have them perform the duty of handling a specially designated secret, their names, dates of birth, divisions to which they belong, job titles, the fact that they are dispatched workers and the contents of the business they plan to engage in if they are dispatched workers, the item applicable from among the items of Article 12, paragraph (1) of the Specially Designated Secrets Act, the reason for finding that item (iii) of the same paragraph is applicable if it applies, and other matters that serve as reference in selecting the Persons subject to Assessment, and submits it to the person responsible for the conduct of Security Clearance Assessment. In this case, if there is a person who is not to be listed on the name list, the specially designated secret manager is to notify the Eligible Contractor of such fact, and if the Worker to whom the notice pertains is a dispatched worker, the specially designated secret manager is to request the Eligible Contractor to notify the Worker’s employer regarding the contents of that notice.
エ ア、イ又はウの名簿に記載し、又は記録した事項に変更があるときは、当該名簿を提出した者は速やかにこれを当該名簿の提出を受けた者に通知する。
D. If there is a change to any of the matters included or recorded in the name list as referred to in A., B., or C., the person who has submitted the name list is to promptly notify the person who has received it of the change.
(2) 行政機関の長の承認
(2) Approval of the Head of an Administrative Organ
ア (1)ア又はウにより名簿の提出を受けた適性評価実施責任者は、名簿に登載された者について、特定秘密保護法第12条第1項各号のいずれかに該当するものとして適性評価を実施する必要があると認めるときは、適性評価を実施することについて行政機関の長の承認を得なければならない。
A. If a person responsible for conduct of Security Clearance Assessment who receives submission of a name list pursuant to (1) A. or C. finds it to be necessary to conduct a Security Clearance Assessment for a person listed on the name list as falling under any of the items of Article 12, paragraph (1) of the Specially Designated Secrets Act, the person responsible for the conduct of Security Clearance Assessment must obtain the approval of the Head of an Administrative Organ about the conduct of the Security Clearance Assessment.
イ 適性評価実施責任者は、アの承認を得たか否かを名簿を提出した特定秘密管理者に通知する。この場合において、特定秘密管理者は、(1)ウの名簿に登載された者に係る通知があるときは、当該通知の内容を適合事業者に通知するとともに、当該通知に係る従業者が派遣労働者であるときは、当該通知の内容を当該従業者を雇用する事業主に通知するよう当該適合事業者に求めるものとする。
B. The person responsible for the conduct of Security Clearance Assessment notifies the specially designated secret manager who has submitted the name list of whether or not the approval as referred to in A. has been obtained. In this case, if the notice concerns any of the persons listed on the name list as referred to in (1) C., the specially designated secret manager is to notify the Eligible Contractor regarding the contents of that notice, and if the Worker to whom the notice pertains is a dispatched worker, the specially designated secret manager is to request the Eligible Contractor to notify the Worker’s employer regarding the contents of that notice.
(3) 留意事項

ア 適合事業者の従業者についての適性評価は、当該適合事業者と行政機関との契約後など当該従業者が特定秘密の取扱いの業務を行うことが見込まれることとなった後に実施するものとする。
A. A Security Clearance Assessment of a Worker of an Eligible Contractor is to be conducted after the Worker comes to be expected to be newly assigned to perform the duty of handling a specially designated secret, such as after the Eligible Contractor and an Administrative Organ concludes a contract.
イ 特定秘密保護法第12条第1項第1号に規定する「当該行政機関の長がその者について直近に実施して次条第1項の規定による通知をした日から5年を経過していない適性評価において、特定秘密の取扱いの業務を行った場合にこれを漏らすおそれがないと認められた者であって、引き続き当該おそれがないと認められるもの」として適性評価を実施する必要がない者は、以下に掲げる者であって、当該行政機関の長が直近に実施した適性評価に係る結果の通知から5年を経過していないものとする。ただし、特定秘密保護法第12条第1項第3号に掲げる者を除く。
B. A person for whom a Security Clearance Assessment need not be conducted as "a person who has been found to have no risk of unauthorized disclosure of any specially designated secret if the person performs the duty of handling a specially designated secret in the Security Clearance Assessment which the Head of the Administrative Organ conducted most recently for the person and for whom five years have not yet elapsed since the day on which the Head of the Administrative Organ gave the notice under paragraph (1) of the following Article to the person, and is found to continue to be free from the risk of unauthorized disclosure" as prescribed in Article 12, paragraph (1), item (i) of the Specially Designated Secrets Act is to be any of the following persons for whom five years have not yet elapsed since the day of the notice of results of the Security Clearance Assessment most recently conducted by the Head of the Administrative Organ; provided, however, that the person set forth in Article 12, paragraph (1), item (iii) of the Specially Designated Secrets Act is excluded:
(ア) 当該行政機関において当該通知の日から勤務し続けている者(当該行政機関における勤務には、併任による当該行政機関以外における勤務及び当該行政機関が警察庁である場合の都道府県警察における警察本部長としての勤務を含む。)であって、特定秘密の取扱いの業務を行わないこととなった後に再び特定秘密の取扱いの業務を行うことが見込まれることとなった者など、当該行政機関の長が適性評価を要しないと認めるもの
(a) a person who has worked for the Administrative Organ since the day of the notice (the work for the Administrative Organ includes work for a party other than the Administrative Organ due to holding an additional post and, if the Administrative Organ is the National Police Agency, work for a Prefectural Police as the Chief of Police) and for whom the Head of an Administrative Organ finds the Security Clearance Assessment to be unnecessary, such as a person who comes to be expected to be assigned to perform the duty of handling a specially designated secret again after ceasing to perform such duty; or
(イ) 当該行政機関との契約に基づき保有し又は提供された特定秘密の取扱いの業務を行う適合事業者において当該通知の日から勤務し続けている者(当該適合事業者における勤務には、併任による当該適合事業者以外における勤務を含む。)であって、特定秘密の取扱いの業務を行わないこととなった後に再び特定秘密の取扱いの業務を行うことが見込まれることとなった者など、当該行政機関の長が適性評価を要しないと認めるもの
(b) a person who has continued to work for an Eligible Contractor performing the duty of handling a specially designated secret that is held or was provided based on a contract with the Administrative Organ since the day of the notice (the work for the Eligible Contractor includes work for a party other than the Eligible Contractor due to holding an additional post) and for whom the Head of the Administrative Organ finds the Security Clearance Assessment to be unnecessary, such as a person who comes to be expected to be assigned to perform the duty of handling a specially designated secret again after ceasing to perform such duty.
4 適性評価の実施についての告知と同意
4. Notification of and consent for the conduct of a Security Clearance Assessment
(1) 評価対象者に対する告知
(1) Notification to a Person Subject to Assessment
特定秘密保護法第12条第3項の告知は、評価対象者に別添1の「適性評価の実施に当たってのお知らせ(告知書)」を交付することにより行うものとする。
The notification as referred to in Article 12, paragraph (3) of the Specially Designated Secrets Act is to be made by delivering "Notification upon Conducting Security Clearance Assessment (Written Notification)" in Appendix 1 to the Person subject to Assessment.
(2) 同意の手続
(2) Consent procedure
ア 特定秘密保護法第12条第3項の同意は、評価対象者が必要事項を記載した別添2-1の「適性評価の実施についての同意書」及び別添2-2の「公務所又は公私の団体への照会等についての同意書」(以下これらを「同意書」という。)の提出を受けることにより得るものとする。
A. The consent as referred to in Article 12, paragraph (3) of the Specially Designated Secrets Act is to be obtained by receiving submission of "Written Consent to Conducting Security Clearance Assessment" in Appendix 2-1 and "Written Consent to Making Inquiries with Public Offices or Public or Private Organizations" in Appendix 2-2 (hereinafter collectively referred to as the "Written Consent") in which the Person subject to Assessment has entered necessary matters.
イ 適性評価実施担当者は、同意書の提出の後に適性評価のための調査を開始するものとする。ただし、評価対象者の便宜も考慮して、5(1)アの「質問票(適性評価)」及びイの資料については、同意書と同時に提出を受けて差し支えない。
B. A person in charge of the conduct of Security Clearance Assessment is to start the examination for Security Clearance Assessment after the submission of the Written Consent; provided, however, that considering the convenience of the Person subject to Assessment, it is permissible to receive submission of the "Questionnaire (Security Clearance Assessment)" in 5, (1), A. and the materials as referred to in 5, (1), B. at the same time as the Written Consent.
ウ 特定秘密保護法第13条第4項の理由の通知を希望しない旨の申出は、評価対象者が別添2-1の「適性評価の実施についての同意書」に必要事項を記載することにより行うものとする。なお、理由の通知についての希望は、適性評価の結果の通知が行われるまでの間、氏名、生年月日、所属する部署、役職名及び連絡先並びに変更を希望する旨を記載し、自署又は記名押印した書面を適性評価実施担当者に提出することにより変更することができるものとする。
C. When making a notification that the person does not wish to receive notice of reasons as referred to in Article 13, paragraph (4) of the Specially Designated Secrets Act, the Person subject to Assessment is to enter necessary matters in "Written Consent to Conducting Security Clearance Assessment" in Appendix 2-1. The wish for receiving notice of reasons may be changed by the time the notice of the results of the Security Clearance Assessment is given, by submitting a document which contains the person's name, date of birth, division to which the person belongs, job title, and contact information, and the fact that the change is desired, and which is signed by the person or has the person's name and seal affixed thereto to the person in charge of the conduct of Security Clearance Assessment.
(3) 不同意の場合の措置
(3) Measure in the case of dissent
ア 適性評価実施担当者は、評価対象者が別添3の「適性評価の実施についての不同意書」を提出するなど、同意をしなかったときは、その旨を適性評価実施責任者を経て行政機関の長に報告する。
A. If a Person subject to Assessment does not give consent, such as by submitting "Written Dissent from Conducting Security Clearance Assessment" in Appendix 3, the person in charge of the conduct of Security Clearance Assessment reports such fact to the Head of an Administrative Organ via the person responsible for the conduct of Security Clearance Assessment.
イ 適性評価実施責任者は、アの報告を受けたときは、当該評価対象者が登載された名簿を提出した特定秘密管理者に対し、当該評価対象者の同意を得られなかったことにより適性評価を実施しなかった旨を通知する。
B. When receiving the report as referred to in A., the person responsible for the conduct of Security Clearance Assessment notifies the specially designated secret manager who has submitted the name list on which the Person subject to Assessment is listed of the fact that a Security Clearance Assessment has not been conducted because the consent of the Person subject to Assessment could not be obtained.
ウ 特定秘密管理者は、適合事業者の従業者についてイの通知を受けたときは、当該適合事業者に対し、当該従業者の同意を得られなかったことにより適性評価を実施しなかった旨を別添9-2の「適性評価結果等通知書(適合事業者用)」により通知する。
C. When receiving the notice as referred to in B. with regard to a Worker of an Eligible Contractor, the specially designated secret manager notifies the Eligible Contractor of the fact that a Security Clearance Assessment has not been conducted because the consent of the Worker could not be obtained by sending "Written Notice of the Results of Security Clearance Assessment (for Eligible Contractors)" in Appendix 9-2.
エ ウの通知を受けた適合事業者は、当該従業者が派遣労働者であるときは、当該通知の内容を当該従業者を雇用する事業主に通知する。
D. If the Worker is a dispatched worker, the Eligible Contractor that receives the notice as referred to in C. notifies the Worker’s employer regarding the contents of that notice.
(4) 同意の取下げ
(4) Withdrawal of consent
ア 特定秘密保護法第12条第3項の同意は、同意書を提出した後から適性評価の結果が通知されるまでの間、別添4の「適性評価の実施についての同意の取下書」(以下「同意の取下書」という。)の提出により取り下げることができるものとする。
A. Consent as referred to in Article 12, paragraph (3) of the Specially Designated Secrets Act may be withdrawn after submitting the Written Consent by the time the notice of the results of the Security Clearance Assessment is given, by submitting "Written Withdrawal of Consent to Conducting Security Clearance Assessment" in Appendix 4 (hereinafter referred to as the "Written Withdrawal of Consent").
イ アにより同意の取下書の提出があったときは、適性評価実施担当者は、その旨を適性評価実施責任者を経て行政機関の長に報告する。
B. If a Written Withdrawal of Consent is submitted pursuant to A., the person in charge of the conduct of Security Clearance Assessment reports such fact to the Head of an Administrative Organ via the person responsible for the conduct of Security Clearance Assessment.
ウ 適性評価実施責任者は、イの報告を受けたときは、当該評価対象者が登載された名簿を提出した特定秘密管理者に対し、当該評価対象者の同意が取り下げられたことにより適性評価の手続を中止した旨を通知する。
C. When receiving the report as referred to in B., the person responsible for the conduct of Security Clearance Assessment notifies the specially designated secret manager who has submitted the name list on which the Person subject to Assessment is listed of the fact that the procedure of Security Clearance Assessment has been terminated because the consent of the Person subject to Assessment has been withdrawn.
エ 特定秘密管理者は、適合事業者の従業者についてウの通知を受けたときは、当該適合事業者に対し、当該従業者の同意が取り下げられたことにより適性評価の手続を中止した旨を別添9-2の「適性評価結果等通知書(適合事業者用)」により通知するとともに、当該通知に係る従業者が派遣労働者であるときは、当該通知の内容を当該従業者を雇用する事業主に通知するよう当該適合事業者に求めるものとする。
D. When receiving the notice as referred to in C. with regard to a Worker of an Eligible Contractor, the specially designated secret manager is to notify the Eligible Contractor of the fact that the procedure of Security Clearance Assessment has been terminated because the consent of the Worker has been withdrawn by sending "Written Notice of the Results of Security Clearance Assessment (for Eligible Contractors)" in Appendix 9-2, and if the Worker subject to the notice is a dispatched worker, the specially designated secret manager is to request the Eligible Contractor to notify the Worker’s employer regarding the contents of that notice.
5 調査の実施
5. Conduct of examination
(1) 評価対象者による質問票の記載と提出
(1) Filling out and submission of a questionnaire by a Person subject to Assessment
ア 適性評価実施担当者は、適性評価の実施に同意した評価対象者に対し、必要事項を記載した別添5の「質問票(適性評価)」(以下「質問票」という。)の提出を求めるものとする。
A. The person in charge of the conduct of Security Clearance Assessment is to request a Person subject to Assessment who has given consent for the conduct of Security Clearance Assessment to submit the "Questionnaire (Security Clearance Assessment)" in Appendix 5 (hereinafter referred to as the "Questionnaire") in which necessary matters are entered.
イ 適性評価実施担当者は、評価対象者に質問票の提出を求める際に、調査のため必要な範囲内において、旅券の写し等資料の提出を求めることができる。
B. When requesting the Person subject to Assessment to submit the Questionnaire, the person in charge of the conduct of Security Clearance Assessment may request the Person subject to Assessment to submit materials such as a copy of the person's passport within the extent necessary for the examination.
ウ 適性評価実施担当者は、質問票が具体的に、漏れなくかつ正確に記載されるよう、また、適性評価の結果が通知されるまでの間に質問票に記載した事項に変更が生じたときには速やかに申し出るよう、評価対象者に求めるものとする。
C. The person in charge of the conduct of Security Clearance Assessment is to request the Person subject to Assessment to enter matters in the Questionnaire specifically, without omission, and accurately and to promptly give notice by the time the notice of the results of the Security Clearance Assessment is given if a change occurs to the matters entered in the Questionnaire.
(2) 上司等に対する質問等
(2) Questions to supervisors
ア 適性評価実施担当者は、評価対象者の上司、人事担当課の職員等の中から評価対象者の職務の遂行状況等についてよく知ると認める者を選定し、この者に対し、別添6の「調査票(適性評価)」(以下「調査票」という。)の提出を求めるものとする。この場合において、当該上司等は、評価対象者への質問とは別に当該調査が行われる趣旨を踏まえ、調査票に記載すべき内容について評価対象者に確認してはならない。
A. The person in charge of the conduct of Security Clearance Assessment is to select a person who is found to know well the status of execution of duties by the Person subject to Assessment from among the supervisors of the Person subject to Assessment, officials of the personnel division, etc., and request that person to submit the "Examination Form (Security Clearance Assessment)" in Appendix 6 (hereinafter referred to as the "Examination Form"). In this case, the supervisor, etc. must not check the contents to be entered in the Examination Form with the Person subject to Assessment, considering that the examination is conducted separately from the questioning of the Person subject to Assessment.
イ アのほか、適性評価実施担当者は、質問票や調査票に記載された事項について疑問点が生じ、これを確認するなどの必要があるときは、評価対象者の上司、同僚その他の知人(以下「関係者」という。)に対し、評価対象者に関する質問を行うことができる。
B. Beyond what is provided in A., if a question arises with regard to matters entered in the Questionnaire or the Examination Form and this needs to be checked, the person in charge of the conduct of Security Clearance Assessment may ask supervisors, colleagues, or any other acquaintances of the Person subject to Assessment (hereinafter referred to as a "Person Concerned") questions concerning the Person subject to Assessment.
ウ 関係者に質問を行うに当たっては、適性評価の趣旨及び当該関係者への質問が評価対象者の適性評価のために行われるものである旨を説明し、当該関係者への質問が、当該関係者についての調査であるとの誤解を与えることのないようにしなければならない。
C. When asking a Person Concerned questions, the person in charge of the conduct of Security Clearance Assessment must explain the purport of the Security Clearance Assessment and the fact that asking the questions to the Person Concerned is intended for Security Clearance Assessment of the Person subject to Assessment, and ensure that asking the questions to the Person Concerned is not misunderstood to be intended for examination of the Person Concerned.
エ 適性評価実施担当者は、関係者から聴取したことにより得られた情報が評価対象者に示される可能性がある旨を当該関係者に説明する。
D. The person in charge of the conduct of Security Clearance Assessment explains to the Person Concerned that the information obtained through the process of interviewing the Person Concerned may be shown to the Person subject to Assessment.
(3) 人事管理情報等による確認
(3) Confirmation based on Personnel Management Information
適性評価実施担当者は、質問票に記載された事項等について疑問点が生じ、これを確認するなどの必要があるときは、当該行政機関内の部署、適合事業者、過去に評価対象者を雇用していた事業者等に対し、評価対象者に関する情報(以下「人事管理情報等」という。)の報告を求めることができる。
If a question arises with regard to matters entered in the Questionnaire, etc. and this needs to be checked, the person in charge of the conduct of Security Clearance Assessment may request a division of the relevant Administrative Organ, the Eligible Contractor, or an employer that employed the Person subject to Assessment in the past to report information concerning the Person subject to Assessment (hereinafter referred to as "Personnel Management Information, etc.").
(4) 評価対象者に対する面接等
(4) Interview with a Person subject to Assessment
適性評価実施担当者は、質問票に記載された事項等について疑問点が生じ、これを確認するなどの必要があるときは、評価対象者本人に対する面接を実施する。この場合において、評価対象者本人であることを確認するため必要があるときは、身分証明書の提示を求めることができる。
If a question arises with regard to matters entered in the Questionnaire, etc. and this needs to be checked, the person in charge of the conduct of Security Clearance Assessment conducts an interview with the Person subject to Assessment directly. In this case, if there is a need to check the identity of the Person subject to Assessment, the person in charge of the conduct of Security Clearance Assessment may request the Person subject to Assessment to present an identification card.
また、評価対象者に質問した事項を確認するなどの必要があるときは、評価対象者に資料の提出を求めることができる。
If there is a need to check the matters questioned to the Person subject to Assessment, the person in charge of the conduct of Security Clearance Assessment may request the Person subject to Assessment to submit materials.
(5) 公務所又は公私の団体に対する照会
(5) Inquiries with public offices or public or private organizations
ア 適性評価実施担当者は、評価対象者について保有し、又は調査により収集した情報のみによっては質問票に記載された事項等について疑問点が解消されず、これを確認するなどの必要があるときは、公務所又は公私の団体に照会して必要な報告を求めるものとする。特に、行政機関以外への照会については、調査のための補完的な措置として、必要最小限となるようにしなければならない。
A. If a question that has arisen with regard to matters entered in the Questionnaire, etc. cannot be resolved merely by the information on the Person subject to Assessment which the person in charge of conduct of Security Clearance Assessment holds or has collected by examination and there is a need to check it, the person in charge of the conduct of Security Clearance Assessment is to make inquiries with public offices or public or private organizations and request reports on the necessary matters from them. In particular, inquiries with organizations other than Administrative Organs must be kept to the minimum extent necessary as a supplementary measure for the examination.
イ 照会に当たっては、別添7の「適性評価のための照会書」(以下「照会書」という。)に公印を押印し、これを照会先に交付することにより行うものとする。ただし、照会先において照会書の交付を要しないとした場合は、この限りでない。
B. When making an inquiry, an official seal is to be affixed to the "Written Inquiry for Security Clearance Assessment" in Appendix 7 (hereinafter referred to as the "Written Inquiry") and the Written Inquiry is to be delivered to the organization subject to the inquiry; provided, however, that this does not apply if the organization subject to the inquiry decides not to require delivery of a Written Inquiry.
ウ 照会先の求めがあったときは、評価対象者が提出した別添2-2の「公務所又は公私の団体への照会等についての同意書」の写しを提示し、又は交付するものとする。
C. If the organization subject to the inquiry requests it, the person in charge of the conduct of Security Clearance Assessment is to present or deliver a copy of the "Written Consent to Making Inquiries with Public Offices or Public or Private Organizations" in Appendix 2-2 which the Person subject to Assessment has submitted.
(6) 留意事項
(6) Matters to note
ア 調査は、質問票及び調査票に記載された事項について、必要に応じ、人事管理情報等と照合するとともに、評価対象者に面接を実施するなどして、疑問点、矛盾点その他の事実を明らかにすべき事項がないかどうか確認することを基本とし、これにより疑問点が解消されない場合等に、公務所等への照会を行うものとする。ただし、調査を適切に実施するため必要があるときは、これらの手続の順序を入れ替えて実施することを妨げない。
A. An examination is, in principle, conducted to check whether there are any questions, contradictions, or any other facts to be clarified with regard to the matters entered in the Questionnaire and the Examination Form by collating the matters with the Personnel Management Information, etc. and conducting an interview with the Person subject to Assessment if necessary, and inquiries with public offices, etc. are to be made if the questions are not resolved through these procedures; provided, however, that this does not preclude conducting an examination by changing the order of these procedures if it is necessary for appropriately conducting the examination.
イ 適性評価実施担当者は、適性評価のための調査に従事する者であることを明らかにするため、別添8の「適性評価実施担当者証」を携帯し、評価対象者、評価対象者の関係者、照会先の担当者等に対し、これを提示するものとする。
B. The person in charge of the conduct of Security Clearance Assessment is to carry the "Certificate of Person in Charge of Conducting Security Clearance Assessment" in Appendix 8 and present it to the Person subject to Assessment, Persons Concerned with the Person subject to Assessment, and the person in charge in the organization subject to inquiry, in order to clarify the status of a person engaged in an examination for Security Clearance Assessment.
ウ 行政機関の長は、以下に掲げるときは、直ちに適性評価の手続を中止する。この場合において、適性評価実施担当者は、評価対象者に対し、適性評価の手続を中止した旨を別添9-1の「適性評価結果等通知書(本人用)」により通知するものとする。
C. In the following cases, the Head of an Administrative Organ immediately terminates the procedure of Security Clearance Assessment; in this case, the person in charge of the conduct of Security Clearance Assessment is to notify the Person subject to Assessment of the fact that the procedure has been terminated by sending the "Written Notice of the Results of Security Clearance Assessment (for Persons subject to Assessment)" in Appendix 9-1:
(ア) 評価対象者から4(4)アにより適性評価の実施についての同意の取下げがあったとき
(a) if the Person subject to Assessment withdraws the consent to conducting Security Clearance Assessment pursuant to 4, (4), A.; or
(イ) 評価対象者が特定秘密の取扱いの業務を行うことが見込まれなくなったとき
(b) if the Person subject to Assessment is no longer expected to perform the duty of handling the specially designated secret subject.
6 評価
6. Assessment
(1) 評価の基本的な考え方
(1) Basic concept of assessment
行政機関の長は、5の調査の結果を基に、評価対象者が特定秘密の取扱いの業務を行った場合にこれを漏らすおそれがないかどうか、以下の視点から、評価対象者の個別具体的な事情を十分に考慮して、総合的に判断するものとする。この場合において、調査を尽くしてもなお、評価対象者が特定秘密を漏らすおそれがないと認めることについて疑念が残る場合には、特定秘密の漏えいを防止し、もって我が国及び国民の安全を確保する特定秘密保護法の目的に鑑み、特定秘密を漏らすおそれがないと認められないと判断するものとする。
Based on the results of the examination as referred to in 5., the Head of an Administrative Organ is to comprehensively determine whether the Person subject to Assessment is unlikely to disclose a specially designated secret without authorization when performing the duty of handling a specially designated secret by sufficiently considering the case-specific circumstances of the Person subject to Assessment from the following viewpoints; in this case, if doubt remains about finding the Person subject to Assessment to have no risk of disclosing a specially designated secret without authorization, even after conducting a thorough examination, the Head of an Administrative Organ is to determine that the Person subject to Assessment is not found to have no risk of disclosing the specially designated secret without authorization, in light of the purpose of the Specially Designated Secrets Act to prevent unauthorized disclosure of specially designated secrets and thereby contribute to securing the safety of Japan and its citizens:
ア 情報を自ら漏らすような活動に関わることがないか
A. whether the Person subject to Assessment becomes involved in an activity to voluntarily disclose information without authorization;
イ 情報を漏らすよう働き掛けを受けた場合に、これに応じるおそれが高い状態にないか
B. whether the Person subject to Assessment is in a state with a high risk of yielding to persuasion to make unauthorized disclosure of information;
ウ 情報を適正に管理することができるか
C. whether the Person subject to Assessment can properly manage information;
エ 規範を遵守して行動することができるか
D. whether the Person subject to Assessment can act by observing the norms;
オ 自己を律して行動することができるか
E. whether the Person subject to Assessment can act by disciplining oneself;
カ 職務の遂行に必要な注意力を有しているか
F. whether the Person subject to Assessment has the attentional capacity required for executing duties; and
キ 職務に対し、誠実に取り組むことができるか
G. whether the Person subject to Assessment can sincerely engage in duties.
(2) 評価の際に考慮する要素
(2) Factors to consider upon assessment
行政機関の長は、評価を実施するに当たり、調査により判明した事実について、以下の要素を考慮するものとする。
When conducting assessment, the Head of an Administrative Organ is to consider the following factors with regard to facts found in the examination:
ア 特定秘密保護法第12条第2項各号に掲げる事項についての評価対象者の行動又は状態(以下「対象行動等」という。)の性質、程度及び重大性
A. the nature, level, and seriousness of the action or state of the Person subject to Assessment with regard to the matters set forth in the items of Article 12, paragraph (2) of the Specially Designated Secrets Act (hereinafter referred to as the "action or state with regard to the relevant matters");
イ 対象行動等の背景及び理由
B. the background of and reasons for the action or state with regard to the relevant matters;
ウ 対象行動等の頻度及び時期
C. the frequency and period of the action or state with regard to the relevant matters;
エ 対象行動等があったときの評価対象者の年齢
D. the age of the Person subject to Assessment at which the action or state with regard to the relevant matters was observed;
オ 対象行動等に対する自発的な関与の程度
E. the level of voluntary involvement of the Person subject to Assessment in the action or state with regard to the relevant matters; and
カ 対象行動等がなくなり、又は再び生ずる可能性
F. the possibility that the action or state with regard to the relevant matters will cease or will occur again.
7 結果等の通知
7. Notice of the results
(1) 評価対象者への結果及び理由の通知
(1) Notice of the results and reasons to the Person subject to Assessment
ア 行政機関の長が評価対象者について特定秘密を漏らすおそれがないと評価したときは、適性評価実施担当者は、当該評価対象者に対し、別添9-1の「適性評価結果等通知書(本人用)」により、その結果を通知する。
A. When the Head of an Administrative Organ assesses that the Person subject to Assessment has no risk of disclosing a specially designated secret without authorization, the person in charge of the conduct of Security Clearance Assessment notifies the Person subject to Assessment of such results by sending the "Written Notice of the Results of Security Clearance Assessment (for Persons subject to Assessment)" in Appendix 9-1.
イ 行政機関の長が評価対象者について特定秘密を漏らすおそれがないと認められないと評価したときは、適性評価実施担当者は、当該評価対象者に対し、別添9-1の「適性評価結果等通知書(本人用)」により、その結果及び当該おそれがないと認められなかった理由を通知するものとする。ただし、当該評価対象者が理由の通知を希望していないときは、理由を通知しないものとする。
B. When the Head of an Administrative Organ assesses that the Person subject to Assessment is not found to have no risk of disclosing a specially designated secret without authorization, the person in charge of the conduct of Security Clearance Assessment is to notify the Person subject to Assessment of such results and the reasons for not finding that such risk does not exist by sending the "Written Notice of the Results of Security Clearance Assessment (for Persons subject to Assessment)" in Appendix 9-1; provided, however, that the notice of the reasons is not to be given if the Person subject to Assessment does not wish to receive notice of the reasons.
ウ 理由を通知する際は、その理由が本人の申告に基づく事実によるものであるときには当該事実を示すなど、具体的に説明するものとする。ただし、評価対象者以外の者の個人情報の保護を図るとともに、理由の通知によって、調査の着眼点、情報源、手法等が明らかとなり、適性評価の円滑な実施の確保を妨げることとならないようにしなければならない。
C. When giving notice of reasons, specific explanation is to be given by indicating the facts if the reasons are based on the facts reported by the Person subject to Assessment, or in other ways; provided, however, that care must be taken so as to protect the personal information of persons other than the Person subject to Assessment, and to ensure that the notice of reasons will not reveal the viewpoints, information sources, and techniques of examination and obstruct the smooth conduct of Security Clearance Assessment.
エ 適性評価実施担当者は、アにより結果を通知する際に、評価対象者が特定秘密の取扱いの業務を行うに当たり、特定秘密の保護のための法令及び関係規程を遵守し、特定秘密の保護に努め、これを漏らさないことを誓約することを明らかにするとともに、9(1)アに掲げる事情が生じた場合に速やかに特定秘密管理者に申し出ること、評価対象者が適合事業者の従業者である場合に適合事業者が当該評価対象者について9(1)アに掲げる事情があると認めるときにこれを特定秘密管理者に報告すること等について確認することを明らかにするため、評価対象者から別添10の「特定秘密の保護に関する誓約書」(以下「誓約書」という。)を徴するものとする。
D. When giving notice of the results pursuant to A., the person in charge of the conduct of Security Clearance Assessment is to collect the "Written Pledge on Protection of Specially Designated Secret" in Appendix 10 (hereinafter referred to as the "Written Pledge") from the Person subject to Assessment, in order to clarify that the Person subject to Assessment will observe laws, regulations, and relevant rules for protection of specially designated secrets, endeavor to protect the specially designated secret, and refrain from disclosing it without authorization when performing the duty of handling the specially designated secret, and that the Person subject to Assessment will promptly notify the specially designated secret manager if the circumstance set forth in 9, (1), A. occurs and, if the Person subject to Assessment is a Worker of an Eligible Contractor and the Eligible Contractor finds that the circumstance set forth in 9, (1), A. exists with regard to the Person subject to Assessment, the Eligible Contractor will report this to the specially designated secret manager.

ア 適性評価実施責任者は、適性評価の結果を評価対象者が登載された名簿を提出した特定秘密管理者に対し、通知する。

イ 特定秘密管理者は、適合事業者の従業者についてアの通知を受けたときは、当該適合事業者に対し、別添9-2の「適性評価結果等通知書(適合事業者用)」により、その結果を通知する。
B. When receiving the notice as referred to in A. with regard to a Worker of an Eligible Contractor, the specially designated secret manager notifies the Eligible Contractor of the results by sending "Written Notice of the Results of Security Clearance Assessment (for Eligible Contractors)" in Appendix 9-2.
ウ イの通知を受けた適合事業者は、当該通知に係る従業者が派遣労働者であるときは、当該通知の内容を当該従業者を雇用する事業主に通知する。
C. If the Worker subject to the notice is a dispatched worker, the Eligible Contractor that receives the notice as referred to in B. notifies the Worker’s employer regarding the contents of that notice.
8 苦情の申出とその処理
8. Filing and processing complaints
(1) 苦情の処理のための体制
(1) Framework for processing complaints
ア 行政機関の長は、適性評価についての苦情の申出を受け、これを誠実に処理するため、苦情受理窓口を設けるとともに、官房長、局長又はこれらに準ずる者を苦情処理責任者に指名する。
A. In order to receive the filing of complaints with regard to Security Clearance Assessment and to sincerely process the complaints, the Head of an Administrative Organ establishes a complaint acceptance center and nominates a deputy vice minister, bureau chief, or a person equivalent thereto as a person responsible for processing complaints.
イ 苦情の申出があったときは、苦情処理責任者は速やかに当該苦情の概要を行政機関の長に報告するとともに、苦情処理担当者を指名する。この場合において、苦情処理責任者は、苦情を申し出た者(以下「苦情申出者」という。)に係る適性評価のための調査に直接従事した職員を苦情処理担当者に指名してはならない。
B. When a complaint is filed, the person responsible for processing complaints promptly reports the outline of the complaint to the Head of the Administrative Organ, and nominates a person in charge of processing the complaint. In this case, the person responsible for processing complaints must not nominate the official who was directly engaged in the examination for the Security Clearance Assessment of the person who has filed the complaint (hereinafter referred to as the "Complainant") as the person in charge of processing complaint.

苦情の申出は、適性評価の結果の通知を受けた評価対象者が、その氏名、生年月日、所属する部署、役職名及び連絡先並びに具体的な苦情の内容を記載し、自署又は記名押印した書面を苦情受理窓口に提出することにより行うものとする。
When filing a complaint, the Person subject to Assessment who received the notice of the results of Security Clearance Assessment is to submit to the complaint acceptance center a document which contains the person's name, date of birth, division to which the person belongs, job title, and contact information, as well as the specific contents of the complaint, and which is signed by the person or has the person's name and seal affixed thereto.

ア 苦情処理担当者は、苦情について調査を行い、その結果及び処理の方針を苦情処理責任者に報告する。
A. A person in charge of processing a complaint conducts examination on the complaint and reports the results and the processing policy to the person responsible for processing complaints.
イ 苦情処理担当者は、必要に応じ、苦情申出者、適性評価実施担当者その他の必要と認める者に質問し、又は苦情申出者若しくは適性評価実施担当者に資料の提出を求めることができる。
B. A person in charge of processing a complaint may ask questions to the Complainant, the person in charge of the conduct of Security Clearance Assessment, or any other person found to be necessary, or request the Complainant or the person in charge of the conduct of Security Clearance Assessment to submit materials if necessary.
ウ 苦情申出者が(2)により申し出た苦情について意見を述べ、又は資料を提出することを希望したときは、苦情処理担当者は、その機会を与えなければならない。
C. If a Complainant wishes to state opinions or submit materials with regard to the complaint which the Complainant has filed pursuant to (2), the person in charge of processing the complaint must give the Complaint such an opportunity.
エ 苦情処理責任者は、調査の結果及び処理の方針を行政機関の長に報告し、その承認を得なければならない。
D. The person responsible for processing complaints must report the results of examination and the processing policy to and obtain the approval of the Head of an Administrative Organ.
(4) 苦情処理結果の通知
(4) Notice of the results of processing a complaint
ア 苦情処理担当者は、(3)エに掲げる行政機関の長の承認を得た後、苦情申出者に対し、別添11の「苦情処理結果通知書」により、苦情についての処理の結果を通知する。
A. After obtaining the approval of the Head of an Administrative Organ as set forth in (3), D., the person in charge of processing the complaint notifies the Complainant of the results of processing the complaint by sending the "Written Notice of the Results of Complaint Processing" in Appendix 11.
イ 苦情の処理の結果を通知する際は、単に結論を示すだけでなく、判断の根拠等を具体的に説明するものとする。ただし、苦情申出者以外の者の個人情報の保護を図るとともに、結果の通知によって、適性評価の調査の着眼点、情報源、手法等が明らかとなり、適性評価の円滑な実施の確保を妨げることとならないようにしなければならない。
B. When giving notice of the results of processing a complaint, not only the results, but also a specific explanation of the grounds for determination, etc. is to be given; provided, however, that care must be taken so as to protect the personal information of persons other than the Complainant, and to ensure that the notice of the results will not reveal the viewpoints, information sources, and techniques of examination of Security Clearance Assessment and obstruct the smooth conduct of Security Clearance Assessment.
ウ 苦情処理の結果、適性評価の手続等が法令若しくは本運用基準の規定に違反し、又は適正を欠いていると認めるときは、苦情処理責任者は適性評価実施責任者にその改善を求めるものとする。
C. If, as a result of processing a complaint, the procedure of Security Clearance Assessment is found to be in violation of laws and regulations or the Implementation Standards, or found to be improper, the person responsible for processing complaints is to request the person responsible for the conduct of Security Clearance Assessment to remedy it.
エ 苦情の処理の結果、改めて適性評価を行う必要があると認める場合には、苦情処理責任者はその旨を適性評価実施責任者に通知する。
D. If, as a result of processing a complaint, it is found to be necessary to conduct Security Clearance Assessment again, the person responsible for processing complaints notifies the person responsible for the conduct of Security Clearance Assessment of such fact.
オ 適性評価実施責任者は、エの通知を受けたときは、当該通知の内容を苦情申出者が登載された名簿を提出した特定秘密管理者に通知する。この場合において、苦情申出者が適合事業者の従業者であるときは、特定秘密管理者は、当該適合事業者に対し、当該通知の内容を通知するとともに、苦情申出者が派遣労働者であるときは、当該通知の内容を当該派遣労働者を雇用する事業主に通知するよう当該適合事業者に求めるものとする。
E. When receiving a notice as referred to in D., the person responsible for the conduct of Security Clearance Assessment notifies the specially designated secret manager who has submitted the name list on which the Complainant is listed regarding the contents of that notice. In this case, if the Complainant is a Worker of an Eligible Contractor, the specially designated secret manager is to notify the Eligible Contractor regarding the contents of the notice above, and if the Complainant is a dispatched worker, the specially designated secret manager is to request the Eligible Contractor to notify the dispatched worker's employer regarding the contents of the notice above.
カ エの場合、適性評価実施責任者は、改めて適性評価を実施する。この場合においては、5(1)ア及び(2)アの規定にかかわらず、質問票及び調査票の提出を求めないことができる。
F. In the case as referred to in D., the person responsible for the conduct of Security Clearance Assessment conducts Security Clearance Assessment again. In this case, it is possible for the person responsible for the conduct of Security Clearance Assessment not to request submission of a Questionnaire and Examination Form, notwithstanding the provisions of 5, (1), A. and 5, (2), A.

ア 行政機関の長、適合事業者及び派遣労働者を雇用する事業主は、苦情申出者について、苦情の申出をしたことを理由として、解雇、減給、降格、懲戒処分、自宅待機命令、不利益な配置の変更、労働契約内容の変更の強要、昇進又は昇格の人事考課において不利益な評価を行うこと、専ら雑務に従事させるなど就業環境を害することなどの不利益な取扱いをしてはならない。
A. The Head of an Administrative Organ, an Eligible Contractor, and an employer of dispatched workers must not adversely treat a Complainant on the grounds of having filed a complaint, such as subjecting the Complainant to dismissal, pay reduction, demotion, disciplinary action, furlough, disadvantageous change of position, coercion to change the contents of labor contract, disadvantageous assessment in personnel evaluation for promotion in position or rank, or damage to the working environment including having the person solely engaged in miscellaneous tasks.
イ 特定秘密保護法第14条第1項に規定する苦情の申出は、適性評価の結果、調査方法など、評価対象者について実施された適性評価について、当該評価対象者が行うことができる。適性評価に関し質問又は照会を受けた者など評価対象者以外の者からの適性評価に関する苦情については、特定秘密保護法第14条に規定する苦情には当たらないが、苦情受理窓口においてこれを受理し、苦情処理手続に準じて、これを誠実に処理するものとする。
B. The complaint prescribed in Article 14, paragraph (1) of the Specially Designated Secrets Act may be filed by a Person subject to Assessment with regard to the Security Clearance Assessment conducted for the Person subject to Assessment, such as the results or the examination method of the Security Clearance Assessment. A complaint concerning Security Clearance Assessment made by a person other than the Person subject to Assessment, such as a person who has received questions or inquiries concerning the Security Clearance Assessment, does not fall under the category of the complaint prescribed in Article 14 of the Specially Designated Secrets Act, but the complaint acceptance center is to accept such complaint and sincerely process it in the same manner as the procedures for processing complaints.
9 適性評価実施後の措置
9. Measures after conduct of a Security Clearance Assessment
(1) 行政機関の職員が特定秘密保護法第12条第1項第3号に該当する可能性がある場合の措置
(1) Measures to be taken if an official of an Administrative Organ may fall under Article 12, paragraph (1), item (iii) of the Specially Designated Secrets Act
ア 特定秘密の取扱いの業務を行う行政機関の職員の上司等は、当該職員について以下の事情があると認めた場合には、速やかにこれを当該職員が取扱いの業務を行う特定秘密に係る特定秘密管理者に報告するものとする。
A. If a supervisor, etc. of an official of an Administrative Organ who performs the duty of handling a specially designated secret finds any of the following circumstances with regard to the official, the supervisor, etc. is to promptly report it to the specially designated secret manager pertaining to the specially designated secret which the official handles:
(ア) 外国籍の者と結婚した場合その他外国との関係に大きな変化があったこと。
(a) when the official marries a person of foreign nationality or there is any other substantial change in the official's relationship with a foreign country;
(イ) 罪を犯して検挙されたこと。
(b) when the official is arrested for committing an offense;
(ウ) 懲戒処分の対象となる行為をしたこと。
(c) when the official commits an act subject to disciplinary action;
(エ) 情報の取扱いに関する規則に違反したこと。
(d) when the official violates rules concerning handling of information;
(オ) 違法な薬物の所持、使用など薬物の違法又は不適切な取扱いを行ったこと。
(e) when the official handles a drug in an illegal or inappropriate manner, such as possessing or using an illegal drug;
(カ) 自己の行為の是非を判別し、若しくはその判別に従って行動する能力を失わせ、又は著しく低下させる症状を呈していると疑われる状況に陥ったこと。
(f) when the official falls into a situation where the official is suspected of presenting a symptom that deprives the official of or notably reduces the official's ability to judge whether the official's own act is right or wrong, or to take an action in accordance with such judgment;
(キ) 飲酒により、けんかなどの対人トラブルを引き起こしたり、業務上の支障を生じさせたりしたこと。
(g) when the official causes an interpersonal problem such as a fight or causes interference with the duty due to drinking alcohol;
(ク) 裁判所から給与の差押命令が送達されるなど経済的な問題を抱えていると疑われる状況に陥ったこと。
(h) when the official falls into a situation where the official is suspected of having an economic problem, such as a wage attachment order having been served by the court; or
(ケ) 特定秘密を漏らすおそれがないと認めることについて疑義が生じたこと。
(i) when doubt arises with regard to finding the official to have no risk of disclosing a specially designated secret without authorization.
イ アの報告又は誓約書に基づき職員からアに掲げる事情がある旨の申出を受けた特定秘密管理者は、当該報告又は申出に係る事情が、特定秘密保護法第12条第1項第3号に規定する「引き続き当該おそれがないと認めることについて疑いを生じさせる事情」に該当すると認めるときは、当該職員が特定秘密の取扱いの業務を行うことのないよう必要な措置を講じなければならない。この場合において、当該職員に特定秘密の取扱いの業務を行わせる必要があるときは、改めて当該職員についての適性評価を実施しなければならない。
B. If a specially designated secret manager who receives a report as referred to in A. or receives a notification from an official of the fact that a circumstance as set forth in A. exists based on a Written Pledge finds that the circumstance subject to the report or notification falls under the category of "circumstances [that] raise doubts as to whether it would be found that the person will continue to be free from the risk of unauthorized disclosure" prescribed in Article 12, paragraph (1), item (iii) of the Specially Designated Secrets Act, the specially designated secret manager must take necessary measures to ensure that the official does not perform the duty of handling the specially designated secret. In this case, if there is a need to have the official perform the duty of handling the specially designated secret, Security Clearance Assessment of the official must be conducted again.
ウ アの報告又は誓約書に基づき職員からアに掲げる事情がある旨の申出を受けた特定秘密管理者は、当該報告又は申出に係る事情が、特定秘密保護法第12条第1項第3号に規定する事情に該当しないと認めるときは、その旨を当該報告又は申出をした者に通知する。
C. If a specially designated secret manager who receives a report as referred to in A. or receives a notification from an official of the fact that a circumstance as set forth in A. exists based on a Written Pledge finds that the circumstance subject to the report or notification does not fall under the category of the circumstances prescribed in Article 12, paragraph (1), item (iii) of the Specially Designated Secrets Act, the specially designated secret manager notifies the person who has made the report or notification of such fact.
(2) 適合事業者の従業者が特定秘密保護法第12条第1項第3号に該当する可能性がある場合の措置
(2) Measures to be taken if a Worker of an Eligible Contractor may fall under Article 12, paragraph (1), item (iii) of the Specially Designated Secrets Act
ア 行政機関の長は、以下に掲げる事項について、契約で定めるものとする。
A. The Head of an Administrative Organ is to provide the following matters by contract:
(ア) 特定秘密保護法第5条第4項又は第8条第1項に規定する契約に基づき特定秘密を保有し又は提供される適合事業者は、当該契約により特定秘密の取扱いの業務を行う従業者について(1)アの事情があると認めた場合には、速やかにこれを契約先の行政機関における当該特定秘密に係る特定秘密管理者に報告すること。
(a) if an Eligible Contractor that holds or is provided with a specially designated secret based on the contract prescribed in Article 5, paragraph (4) or Article 8, paragraph (1) of the Specially Designated Secrets Act finds that a circumstance as referred to in (1), A. exists with regard to a Worker who performs the duty of handling the specially designated secret pursuant to the contract, the Eligible Contractor should promptly report it to the specially designated secret manager pertaining to the specially designated secret at the Administrative Organ which is the contract partner;
(イ) 従業者が派遣労働者である場合、適合事業者は、当該従業者について(1)アの事情があると認められたときに当該従業者を雇用する事業主から当該適合事業者に報告が行われるよう必要な措置を講ずること。
(b) if the Worker is a dispatched worker, the Eligible Contractor should take necessary measures to ensure that the Worker's employer will report to the Eligible Contractor on finding that a circumstance as referred to in (1), A. exists with regard to the Worker;
(ウ) イの通知を受けた場合に、適合事業者は、当該通知に係る従業者が特定秘密の取扱いの業務を行うことのないよう必要な措置を講ずること。
(c) if the Eligible Contractor receives a notice as referred to in B., the Eligible Contractor should take necessary measures to ensure that the Worker to whom the notice pertains does not perform the duty of handling the specially designated secret; and
(エ) イの通知を受けた場合であって、当該通知に係る従業者が派遣労働者であるときは、当該通知の内容を当該派遣労働者を雇用する事業主に通知すること。
(d) if the Eligible Contractor receives a notice as referred to in B. and the Worker to whom the notice pertains is a dispatched worker, the Eligible Contractor should notify the dispatched worker's employer regarding the contents of that notice.
イ ア(ア)の報告又は誓約書に基づき適合事業者の従業者から(1)アに掲げる事情がある旨の申出を受けた特定秘密管理者は、当該報告又は申出に係る事情が、特定秘密保護法第12条第1項第3号に規定する事情に該当すると認めるときは、その旨を適合事業者に通知する。
B. If a specially designated secret manager who receives a report as referred to in A., (a) or receives a notification from a Worker of an Eligible Contractor of the fact that a circumstance as set forth in (1), A. exists based on a Written Pledge finds that the circumstance subject to the report or notification falls under the category of the circumstances prescribed in Article 12, paragraph (1), item (iii) of the Specially Designated Secrets Act, the specially designated secret manager notifies the Eligible Contractor of such fact.
ウ ア(ア)の報告又は誓約書に基づき適合事業者の従業者から(1)アに掲げる事情がある旨の申出を受けた特定秘密管理者は、当該報告又は申出に係る事情が、特定秘密保護法第12条第1項第3号に規定する事情に該当しないと認めるときは、その旨を当該報告又は申出をした者に通知する。
C. If a specially designated secret manager who receives a report as referred to in A., (a) or receives a notification from a Worker of an Eligible Contractor of the fact that a circumstance as set forth in (1), A. exists based on a Written Pledge finds that the circumstance subject to the report or notification does not fall under the category of the circumstances prescribed in Article 12, paragraph (1), item (iii) of the Specially Designated Secrets Act, the specially designated secret manager notifies the person who made the report or notification of such fact.
10 適性評価に関する個人情報等の管理

(1) 適性評価に関する文書等の管理

ア 適性評価実施責任者は、評価対象者ごとに、その適性評価の実施に当たって作成又は取得した文書等を整理して、これを管理する。
A. A person responsible for the conduct of Security Clearance Assessment organizes and manages the documents, etc., which have been prepared or obtained in the course of the conduct of Security Clearance Assessment, for each Person subject to Assessment.
イ 特定秘密管理者は、適性評価実施責任者から通知された不同意、同意の取下げ及び適性評価の結果に係る文書等を整理して、これを管理する。
B. A specially designated secret manager organizes and manages the documents, etc. pertaining to dissent, withdrawal of consent, and the results of Security Clearance Assessment for which notice has been given by the person responsible for the conduct of Security Clearance Assessment.
ウ 苦情処理責任者は、苦情申出者ごとに、その苦情の処理に当たって作成又は取得した文書等を整理して、これを管理する。
C. A person responsible for processing complaints organizes and manages the documents, etc., which have been prepared or obtained in the course of processing the complaint, for each Complainant.
エ アからウの文書等は、人事評価に関する文書等とは別に管理する。
D. Documents, etc. as referred to in A. through C. are managed separately from those concerning personnel evaluation.
(2) 行政機関における個人情報等の管理
(2) Management of personal information at Administrative Organs
ア 適性評価に関する文書等の管理は、公文書管理法など文書管理に関する法令及び規程に基づき、適切に行う。
A. Documents, etc. concerning Security Clearance Assessment are managed appropriately based on laws, regulations, and rules concerning document management, such as the Public Records Management Act.
イ 適性評価に関する文書等に含まれる個人情報の管理については、行政機関の保有する個人情報の保護に関する法律(平成15年法律第58号)及び同法第6条の規定に基づき各行政機関が定める個人情報の適切な管理のための規程による。
B. Personal information included in documents, etc. concerning Security Clearance Assessment is managed pursuant to the Act on the Protection of Personal Information Held by Administrative Organs (Act No. 58 of 2003) and rules for appropriate management of personal information provided by each Administrative Organ based on Article 6 of the same Act.
ウ 適性評価実施責任者は、評価対象者に対し、特定秘密保護法第13条第1項の規定による適性評価の結果を通知した日又は評価対象者に対し、適性評価の手続を中止する旨通知した日のいずれかに属する年度の翌年度の4月1日から起算して10年が経過するまでの期間、適性評価の実施に当たって作成又は取得した文書等を保存するものとする。ただし、評価対象者から適性評価の実施についての不同意書又は同意の取下書が提出された場合の適性評価の実施に当たって作成又は取得した文書等の保存期間については、当該書面が提出された日の属する年度の翌年度の4月1日から起算して3年間とする。
C. A person responsible for the conduct of Security Clearance Assessment is to retain the documents, etc., which have been prepared or obtained in the course of the conduct of Security Clearance Assessment, until 10 years have elapsed from April 1 of the fiscal year following the fiscal year containing either the day on which the Person subject to Assessment is notified of the results of Security Clearance Assessment prescribed in Article 13, paragraph (1) of the Specially Designated Secrets Act or the day on which the Person subject to Assessment is notified of the fact that the procedure of Security Clearance Assessment is terminated; provided, however, that the retention period for the documents, etc., which have been prepared or obtained in the course of the conduct of Security Clearance Assessment if a Written Dissent from Conducting Security Clearance Assessment or a Written Withdrawal of Consent has been submitted by the Person subject to Assessment should be three years from April 1 of the fiscal year following the fiscal year containing the day of submission of the document.
エ 特定秘密管理者が取得した適性評価の結果等に係る文書等の保存期間は、当該文書等を取得した日から1年未満とする。ただし、特定秘密の取扱いの業務を行った場合にこれを漏らすおそれがないと認められた旨の通知に係る文書等の保存期間については、当該文書等を取得した日の属する年度の翌年度の4月1日から起算して5年間とする。
D. The retention period for the documents pertaining to the results of Security Clearance Assessment which the specially designated secret manager obtained should be less than one year from the day of obtainment of the documents, etc.; provided, however, that the retention period for the documents, etc. pertaining to notice of the fact that the person has no risk of unauthorized disclosure of any specially designated secret if the person performs the duty of handling a specially designated secret should be five years from April 1 of the fiscal year following the fiscal year containing the day of submission of the documents, etc.
オ 苦情処理責任者は、苦情申出者に苦情についての処理の結果を通知した日の属する年度の翌年度の4月1日から起算して3年が経過するまでの期間、苦情の処理に当たって作成又は取得した文書等を保存するものとする。
E. A person responsible for processing complaints is to retain the documents, etc., which have been prepared or obtained in the course of processing a complaint, until three years have elapsed from April 1 of the fiscal year following the fiscal year containing the day on which the Complainant is notified of the results of processing the complaint.
カ 保存期間を経過した適性評価に関する文書等は、関係法令及び規程に従い、廃棄等するものとする。
F. Documents, etc. concerning Security Clearance Assessment for which the retention period has passed are to be destroyed, etc. in accordance with the relevant laws, regulations, and rules.
(3) 適合事業者等における個人情報等の管理
(3) Management of personal information at an Eligible Contractor
行政機関の長は、適合事業者及び適合事業者の指揮命令の下に労働する派遣労働者を雇用する事業主が、行政機関の長又は適合事業者から通知された、評価対象者が適性評価の実施に同意をしなかった事実、同意を取り下げた事実及び評価対象者についての適性評価の結果に係る文書等について、これが適切に管理されるよう、(2)イ、エ及びカに準じて必要な措置を講ずることについて、契約で定めるものとする。
The Head of an Administrative Organ is to provide by contract that an Eligible Contractor and the employers of dispatched workers who work under the instructions of the Eligible Contractor should take necessary measures in the same manner as (2), B., D., and F. so as to ensure appropriate management of the documents, etc. pertaining to the fact that the Person subject to Assessment has not given consent to the conduct of Security Clearance Assessment, the fact that the Person subject to Assessment has withdrawn the consent, and the results of Security Clearance Assessment of the Person subject to Assessment, for which notice has been given by the Head of an Administrative Organ or the Eligible Contractor.
(4) 適性評価に関する個人情報の利用及び提供の制限

行政機関の長、適合事業者及び適合事業者の指揮命令の下に労働する派遣労働者を雇用する事業主は、次に掲げる場合を除き、評価対象者が適性評価の実施に同意をしなかった事実、適性評価の結果その他適性評価の実施に当たって取得する個人情報を特定秘密の保護以外の目的のために利用し、又は提供してはならない。

ア 国家公務員法(昭和22年法律第120号)第100条第4項、刑事訴訟法(昭和23年法律第131号)第197条第2項などの法令に基づく場合
A. a case based on a law or regulation such as Article 100, paragraph (4) of the National Public Service Act (Act No. 120 of 1947) and Article 197, paragraph (2) of the Code of Criminal Procedure (Act No. 131 of 1948); and
イ 特定秘密保護法第16条第1項ただし書又は施行令第22条に規定する事由等のいずれかに該当する疑いが生じた場合
B. a case where a doubt arises that any of the grounds prescribed in the proviso to Article 16, paragraph (1) of the Specially Designated Secrets Act or Article 22 of the Enforcement Order apply.

11. Training
適性評価実施責任者は、適性評価実施担当者に対し、適性評価の適正な実施を確保するために必要な知識及び技能を習得させ、並びにこれを向上させるために必要な研修を定期的に行うものとする。
なお、必要な場合に、当該研修を随時に実施することを妨げるものではない。
A person responsible for the conduct of Security Clearance Assessment is to periodically provide training necessary for the person in charge of the conduct of Security Clearance Assessment to acquire and enhance necessary knowledge and skills for ensuring proper conduct of Security Clearance Assessment; provided, however, that this does not preclude the person responsible for the conduct of Security Clearance Assessment from providing such training when necessary.
12 適性評価の実施に関する関係行政機関の協力
12. Cooperation of related Administrative Organs concerning the conduct of Security Clearance Assessments
関係行政機関の長は、評価対象者についての照会があった場合に必要な事項の報告を行い、また、出向又は併任により他の行政機関において勤務することとなった職員の適性評価の実施に当たって必要な情報提供を行うなど、適性評価の実施のために相互に協力するものとする。
The Heads of related Administrative Organs are to cooperate with one another for the conduct of Security Clearance Assessments: such as reporting necessary matters when receiving an inquiry about a Person subject to Assessment or providing necessary information when conducting a Security Clearance Assessment of an official who will work at another Administrative Organ due to being on secondment or holding an additional post.
なお、行政機関の長は、他の行政機関の職員及び他の行政機関が契約する適合事業者の従業者についての適性評価の調査を代行してはならない。
The Head of an Administrative Organ must not conduct, on behalf of another Administrative Organ, examination of Security Clearance Assessment with regard to an official of another Administrative Organ or a Worker of an Eligible Contractor which is under a contract with another Administrative Organ.
13 警察本部長による適性評価
13. Security Clearance Assessment by the Chief of Police
警察本部長による適性評価については、本運用基準に準じて実施するものとする。
Security Clearance Assessment by the Chief of Police is to be conducted in the same manner as the Implementation Standards.
14 特定秘密保護法の公布の日から2年を超えない範囲内において政令で定める日の前日までの特定秘密の取扱いに関する経過措置
14. Transitional measure concerning handling of a specially designated secret until the day preceding the day specified by Cabinet Order within a period not exceeding two years from the date of promulgation of the Specially Designated Secrets Act
行政機関の長は、特定秘密保護法の公布の日から2年を超えない範囲内において政令で定める日の前日までの間において特定秘密の取扱いの業務を行う者について、特定秘密に指定された情報の取扱いの業務を特定秘密保護法の施行前に行っていた者又は適性評価により特定秘密の取扱いの業務を行った場合にこれを漏らすおそれがないと認められた者のいずれかに限るよう努めるものとする。
The Head of an Administrative Organ is to endeavor to limit the persons who perform the duty of handling specially designated secrets until the day preceding the day specified by Cabinet Order within a period not exceeding two years from the date of promulgation of the Specially Designated Secrets Act to either the persons who had been performing the duty of handling information that was designated as specially designated secrets before the Specially Designated Secrets Act came into effect or persons who have been found to have no risk of unauthorized disclosure of any specially designated secret if the persons perform the duty of handling a specially designated secret in the Security Clearance Assessment.
Ⅴ 特定秘密の指定及びその解除並びに適性評価の実施の適正を確保するための措置等
V. Measures for Ensuring Proper Implementation of Designation of Specially Designated Secrets and Termination of the Designation as Well as Conduct of the Security Clearance Assessment
1 内閣官房及び内閣府の任務並びにその他の行政機関の協力
1. Duties of the Cabinet Secretariat and the Cabinet Office and cooperation of any other Administrative Organs
(1) 内閣官房は、特定秘密保護法の適正な運用の確保についての自らの責任を十分に認識し、特定秘密の指定、その有効期間の設定及び延長並びに指定の解除(以下単に「特定秘密の指定及びその解除」という。)並びに適性評価の実施の適正を確保するための事務を行う。
(1) The Cabinet Secretariat should sufficiently recognize its responsibilities for ensuring the proper implementation of the Specially Designated Secrets Act, and carry out affairs for ensuring proper implementation of the Designation of specially designated secrets, the establishment and extension of their effective periods, and the termination of Designation (hereinafter simply referred to as the "Designation of specially designated secrets and the termination of the Designation") as well as the conduct of the Security Clearance Assessment.
(2) 特定秘密の指定及びその解除並びに適性評価の実施の適正を確保するための事務の公正かつ能率的な遂行を図るため、内閣に内閣保全監視委員会を設置する。内閣保全監視委員会の庶務は、内閣官房内閣情報調査室において処理し、内閣保全監視委員会の構成その他必要な事項は、別に内閣官房長官が定めるものとする。
(2) In order to achieve fair and efficient execution of the affairs for ensuring proper implementation of the Designation of specially designated secrets and the termination of the Designation as well as the conduct of the Security Clearance Assessment, the Cabinet Committee for Protection and Oversight is established in the Cabinet. General affairs of the Cabinet Committee for Protection and Oversight are to be processed by the Cabinet Intelligence and Research Office of the Cabinet Secretariat, and the structure of and other necessary matters regarding the Cabinet Committee for Protection and Oversight are to be separately specified by the Chief Cabinet Secretary.
(3) 内閣府は、内閣官房とは別の立場から、いずれの行政機関にも偏ることなく判断することの重要性を十分に認識し、特定秘密の指定及びその解除並びに行政文書ファイル管理簿(公文書管理法第7条第1項に規定する行政文書ファイル管理簿をいう。)に記載された行政文書ファイル等(公文書管理法第5条第5項に規定する行政文書ファイル等をいう。5(1)ア(エ)及び(オ)において同じ。)のうち特定秘密である情報を記録するもの(以下「特定行政文書ファイル等」という。)の管理の適正の確保に関する事務を行う。
(3) The Cabinet Office should sufficiently recognize the importance of making determinations without partiality to any Administrative Organs, from a different standpoint from the Cabinet Secretariat, and carry out affairs for ensuring proper implementation of the Designation of specially designated secrets and the termination of the Designation as well as the management of administrative document files, etc. (meaning the administrative document files, etc. prescribed in Article 5, paragraph (5) of the Public Records Management Act; the same applies in 5, (1), A., (d) and (e)) which record information that is a specially designated secret out of those listed in an administrative document file management register (meaning the administrative document file management register prescribed in Article 7, paragraph (1) of the Public Records Management Act) (such administrative document files, etc. are hereinafter referred to as "Specified Administrative Document Files, etc.").
(4) 行政機関は、(1)及び(3)に定める事務に関し、内閣官房及び内閣府にそれぞれ協力するものとする。
(4) Administrative Organs are to cooperate with the Cabinet Secretariat and the Cabinet Office with regard to the affairs provided in (1) and (3).
2 内閣総理大臣による指揮監督

内閣保全監視委員会は、内閣総理大臣が特定秘密保護法第18条第4項に基づき、特定秘密の指定及びその解除並びに適性評価の実施の状況に関し、その適正を確保するため、行政各部を指揮監督するに当たり、行政機関の長に対し、特定秘密である情報を含む資料の提出及び説明を求めることができ、必要があると認めるときは是正を求めるものとする。
When the Prime Minister exercises control and supervision over the administrative branches concerning the state of the Designation of specially designated secrets and the termination of the Designation as well as the conduct of the Security Clearance Assessment, in order to ensure that these affairs are implemented properly, based on Article 18, paragraph (4) of the Specially Designated Secrets Act, the Cabinet Committee for Protection and Oversight may request the Head of an Administrative Organ to submit and explain materials that contain the information that is a specially designated secret, and is to request rectification if it is found to be necessary.
3 特定秘密の指定及びその解除並びに特定行政文書ファイル等の管理の検証・監察・是正
3. Verification, oversight, and request for rectification of the Designation of specially designated secrets and the termination of the Designation as well as the management of Specified Administrative Document Files
(1) 内閣府独立公文書管理監による検証・監察・是正
(1) Verification, oversight, and request for rectification by the Inspector General for Public Records Management of the Cabinet Office
ア 内閣府独立公文書管理監(内閣府独立公文書管理監が指名する内閣府の職員を含む。以下同じ。)は、特定秘密の指定及びその解除並びに特定行政文書ファイル等の管理が特定秘密保護法及び施行令の規定並びに本運用基準ⅠからⅢまで(以下「特定秘密保護法等」という。)に従って行われているかどうか検証し、監察するものとする。
A. The Inspector General for Public Records Management of the Cabinet Office (including an official of the Cabinet Office nominated by the Inspector General for Public Records Management of the Cabinet Office; the same applies hereinafter) is to verify and oversee whether the Designation of specially designated secrets and the termination of the Designation as well as the management of Specified Administrative Document Files, etc. are implemented in accordance with the provisions of the Specially Designated Secrets Act and the Enforcement Order and I through III of the Implementation Standards (hereinafter referred to as the "Specially Designated Secrets Act, etc.").
イ 内閣府独立公文書管理監は、必要があると認めるときは、行政機関の長に対し、特定秘密である情報を含む資料の提出若しくは説明を求め、又は実地調査をすることができる。
B. If it is found to be necessary, the Inspector General for Public Records Management of the Cabinet Office may request the Head of an Administrative Organ to submit or explain materials that contain the information that is a specially designated secret or may conduct field examination.
ウ 内閣府独立公文書管理監は、検証又は監察の結果、行政機関の長による特定秘密の指定及びその解除又は特定行政文書ファイル等の管理が特定秘密保護法等に従って行われていないと認めるときは、当該特定秘密の指定及びその解除をし、又は当該特定行政文書ファイル等を保有する行政機関の長に対し、当該指定の解除、当該特定行政文書ファイル等の適正な管理その他の是正を求めるものとする。内閣府独立公文書管理監は、是正を求めたときは、その内容を内閣保全監視委員会へ通知するものとする。
C. ア 行政機関の長は、(1)アに定める検証及び監察の実施に資するため、次に掲げる事務を行うものとする。
A. The Head of an Administrative Organ is to carry out the following affairs in order to contribute to implementation of the verification and oversight provided in (1), A.:
(ア) 特定秘密を指定し、施行令第4条に基づき特定秘密指定管理簿に必要な事項を記載し若しくは記録したとき、又は、指定の有効期間を延長し、若しくは指定を解除し、施行令第9条第2号若しくは第11条第1項第3号に基づき、それぞれ特定秘密指定管理簿に必要な事項を記載し若しくは記録したときは、速やかに、内閣府独立公文書管理監に、当該指定に関する特定秘密指定管理簿の写しを提出すること。
(a) when entering or recording necessary matters in a Book for Managing Designation of Specially Designated Secrets based on Article 4 of the Enforcement Order after making Designation of a specially designated secret, or when entering or recording necessary matters in the Book for Managing Designation of Specially Designated Secrets based on Article 9, item (ii) or Article 11, paragraph (1), item (iii) of the Enforcement Order after extending the effective period of Designation or terminating the Designation, the Head of an Administrative Organ should promptly submit a copy of the Book for Managing Designation of Specially Designated Secrets concerning the Designation to the Inspector General for Public Records Management of the Cabinet Office;
(イ) 特定行政文書ファイル等の管理について、毎年1回、次に掲げる事項その他の特定行政文書ファイル等の管理に資する事項を、内閣府独立公文書管理監に報告すること。
(b) the Head of an Administrative Organ should annually report the following matters with regard to the management of Specified Administrative Document Files, etc. and any other matters that contribute to the management of Specified Administrative Document Files, etc. to the Inspector General for Public Records Management of the Cabinet Office:
a 特定行政文書ファイル等の名称

c. the retention periods of the Specified Administrative Document Files, etc.; and
d 特定行政文書ファイル等の保存期間が満了したときの措置

(ウ) 特定秘密の指定及びその解除又は特定行政文書ファイル等の管理が特定秘密保護法等に従って行われていないと行政機関の長が認めた場合には、速やかに内閣府独立公文書管理監に報告すること。
(c) if the Head of an Administrative Organ finds that the Designation of a specially designated secret and the termination of the Designation or the management of a Specified Administrative Document File, etc. has not been implemented in accordance with the Specially Designated Secrets Act, etc., the Head of an Administrative Organ should promptly report it to the Inspector General for Public Records Management of the Cabinet Office.
イ 行政機関の長は、(1)イによる求めがあったときは、特定秘密保護法第10条第1項の規定により、内閣府独立公文書管理監に特定秘密を提供するものとする。
B. If a request under (1), B. is made, the Head of an Administrative Organ is to provide the specially designated secret to the Inspector General for Public Records Management of the Cabinet Office pursuant to Article 10, paragraph (1) of the Specially Designated Secrets Act.
ウ 行政機関の長は、当該特定秘密の提供が我が国の安全保障に著しい支障を及ぼすおそれがないと認められないとして(1)イによる求めに応じないときは、その理由を内閣府独立公文書管理監に疎明しなければならない。
C. If the Head of an Administrative Organ does not respond to a request under (1), B. on the basis that it cannot be found that the provision of the specially designated secret has no risk of causing severe damage to Japan's national security, the Head of an Administrative Organ must make a prima facie showing of the reasons to the Inspector General for Public Records Management of the Cabinet Office.
エ 行政機関の長は、(1)ウの求めがあったときは、適切な措置を講じた上で、当該措置について内閣府独立公文書管理監に報告するものとする。
D. If a request under (1), C. is made, the Head of an Administrative Organ is to take appropriate measures, and then report those measures to the Inspector General for Public Records Management of the Cabinet Office.
4 特定秘密の指定及びその解除並びに特定行政文書ファイル等の管理の適正に関する通報

(1) 通報の処理の枠組み

内閣府独立公文書管理監及び行政機関の長は、特定秘密の取扱いの業務を行う者若しくは行っていた者又は特定秘密保護法第4条第5項、第9条、第10条若しくは第18条第4項後段の規定により提供された特定秘密について、当該提供の目的である業務により当該特定秘密を知得した者(以下「取扱業務者等」という。)が、特定秘密の指定及びその解除又は特定行政文書ファイル等の管理が特定秘密保護法等に従って行われていないと思料する場合に行う通報を受け付け、処理するため、窓口(以下「通報窓口」という。)を設置し、公表するものとする。
The Inspector General for Public Records Management of the Cabinet Office and the Head of an Administrative Organ are to establish a center for receiving and processing notification which a person who performs or had performed the duty of handling a specially designated secret or a person who has come to know a specially designated secret provided pursuant to Article 4, paragraph (5), Article 9, Article 10, or the second sentence of Article 18, paragraph (4) of the Specially Designated Secrets Act in the course of the duty for which the secret was provided (hereinafter referred to as a "Person Handling a Specially Designated Secret, etc.") makes when the person considers that the Designation of a specially designated secret and the termination of the Designation or the management of a Specified Administrative Document File, etc. has not been implemented in accordance with the Specially Designated Secrets Act, etc. (hereinafter such center is referred to as the "Notification Center"), and publicly announce it.

ア 行政機関に対する通報
A. Notification to an Administrative Organ
(ア) 取扱業務者等は、特定秘密の指定及びその解除又は特定行政文書ファイル等の管理が特定秘密保護法等に従って行われていないと思料するときは、当該特定秘密の指定及びその解除又は当該特定行政文書ファイル等の管理に係る行政機関の通報窓口に対し、その旨の通報をすることができる。この場合において、取扱業務者等は、特定秘密指定管理簿に記述された特定秘密の概要や特定秘密が記録された文書の番号を用いるなどし、特定秘密を漏らしてはならない。
(a) If a Person Handling a Specially Designated Secret, etc. considers that the Designation of a specially designated secret and the termination of the Designation or the management of a Specified Administrative Document File, etc. has not been implemented in accordance with the Specially Designated Secrets Act, etc., the person may make notification of such fact to the Notification Center of the Administrative Organ relating to the Designation of the specially designated secret and the termination of the Designation or the management of the Specified Administrative Document File, etc. In this case, the Person Handling a Specially Designated Secret, etc. must prevent the disclosure of the specially designated secret by taking a measure such as using the outline of the specially designated secret described in the Book for Managing Designation of Specially Designated Secrets or using the number of the document which records the specially designated secret.
(イ) 行政機関の長は、通報を受理した場合、調査の必要性を十分に検討し、調査を行う場合はその旨及び着手の時期を、調査を行わない場合はその旨及び理由を、当該通報を行った者(以下「通報者」という。)に対し、遅滞なく通知するものとする。ただし、適正な調査の遂行に支障がある場合はこの限りではない。

(エ) 行政機関の長は、調査の結果、特定秘密の指定及びその解除又は特定行政文書ファイル等の管理が特定秘密保護法等に従って行われていないことが明らかになったときは、速やかに当該指定の解除、当該特定行政文書ファイル等の適正な管理その他の適切な措置を講ずるものとする。
(d) If, as a result of examination, it becomes clear that the Notification Center of the Administrative Organ relating to the Designation of the specially designated secret and the termination of the Designation or the management of the Specified Administrative Document File, etc. has not been implemented in accordance with the Specially Designated Secrets Act, etc., the Head of an Administrative Organ is to promptly terminate the Designation, properly manage the Specified Administrative Document Files, etc., or take any other appropriate measures.
(オ) 行政機関の長は、調査の結果を遅滞なく通報者に対し通知するものとする。
(e) The Head of an Administrative Organ is to notify the Notifier of the results of examination without delay.
(カ) 行政機関の長は、通報を処理したときは、その内容を内閣府独立公文書管理監に報告するものとする。
(f) When having processed notification, the Head of an Administrative Organ is to report the contents thereof to the Inspector General for Public Records Management of the Cabinet Office.
イ 内閣府独立公文書管理監に対する通報
B. Notification to the Inspector General for Public Records Management of the Cabinet Office
(ア) 取扱業務者等は、特定秘密の指定及びその解除又は特定行政文書ファイル等の管理が特定秘密保護法等に従って行われていないと思料するときは、内閣府独立公文書管理監の通報窓口に対し、その旨の通報をすることができる。この場合において、取扱業務者等は、特定秘密指定管理簿に記述された特定秘密の概要や特定秘密が記録された文書の番号を用いるなどし、特定秘密を漏らしてはならない。
(a) If a Person Handling a Specially Designated Secret, etc. considers that the Designation of a specially designated secret and the termination of the Designation or the management of a Specified Administrative Document File, etc. has not been implemented in accordance with the Specially Designated Secrets Act, etc., the person may make notification of such fact to the Notification Center of the Inspector General for Public Records Management of the Cabinet Office. (イ) (ア)に定める通報は、ア(イ)において調査を行わない旨の通知又は同(オ)の通知を受けた後でなければ、行うことができない。ただし、次に掲げる場合は、この限りではない。
(b) The notification provided in (a) may only be made after receiving notice of the fact that examination is not to be conducted in A, (b) or notice as referred to in A, (e); provided, however, that this does not apply in the following cases:
a ア(ア)に定める通報をすれば不利益な取扱いを受けると信ずるに足りる相当の理由がある場合
a. when there are adequate grounds that are sufficient to believe that the person will be subjected to adverse treatment if the person makes the notification provided in A, (a);
b ア(ア)に定める通報をすれば当該通報に係る証拠が隠滅され、偽造され、又は変造されるおそれがあると信ずるに足りる相当の理由がある場合
b. when there are adequate grounds that are sufficient to believe that the evidence pertaining to the notification is likely to be destroyed, counterfeited, or altered if the person makes the notification provided in A, (a); and
c 個人の生命又は身体に危害が発生し、又は発生する急迫した危険があると信ずるに足りる相当の理由がある場合
c. when there are adequate grounds that are sufficient to believe that there is imminent danger that has caused or will cause harm to the life or body of an individual.
(ウ) 内閣府独立公文書管理監は、通報を受理した場合、遅滞なく必要な調査を行うものとする。
(c) When having accepted notification, the Inspector General for Public Records Management of the Cabinet Office is to conduct the necessary examination without delay.
(エ) 通報を受理した内閣府独立公文書管理監は、必要があると認めるときは、(イ)の通知に係る行政機関の長に対し、特定秘密である情報を含む資料の提出若しくは説明を求め、又は実地調査をすることができる。

(e) If a request under (d) is made, the Head of an Administrative Organ is to provide the specially designated secret to the Inspector General for Public Records Management of the Cabinet Office pursuant to Article 10, paragraph (1) of the Specially Designated Secrets Act.
(カ) 行政機関の長は、当該特定秘密の提供が我が国の安全保障に著しい支障を及ぼすおそれがないと認められないとして(エ)による求めに応じないときは、その理由を内閣府独立公文書管理監に疎明しなければならない。
(f) If the Head of an Administrative Organ does not respond to a request under (d) on the basis that it cannot be found that the provision of the specially designated secret has no risk of causing severe damage to Japan's national security, the Head of an Administrative Organ must make a prima facie showing of the reasons to the Inspector General for Public Records Management of the Cabinet Office.
(キ) 内閣府独立公文書管理監は、特定秘密の指定及びその解除又は特定行政文書ファイル等の管理が特定秘密保護法等に従って行われていないと認めるときは、当該特定秘密の指定及びその解除をし、又は特定行政文書ファイル等を保有する行政機関の長に対し、当該指定の解除、当該特定行政文書ファイル等の適正な管理その他の是正を求めるものとする。
(g) If it is found that the Designation of a specially designated secret and the termination of the Designation or the management of Specified Administrative Document File, etc. has not been implemented in accordance with the Specially Designated Secrets Act, etc., the Inspector General for Public Records Management of the Cabinet Office is to request the Head of an Administrative Organ that has implemented the Designation of the specially designated secret and the termination of the Designation or that retains the Specified Administrative Document File, etc. to terminate the Designation, to properly manage the Specified Administrative Document File, etc., or conduct any other rectification.
(ク) 行政機関の長は、(キ)の求めがあったときは、適切な措置を講じた上で、当該措置について内閣府独立公文書管理監に報告するものとする。
(h) If a request under (g) is made, the Head of an Administrative Organ is to take appropriate measures, and then report those measures to the Inspector General for Public Records Management of the Cabinet Office.
(ケ) 内閣府独立公文書管理監は、調査の結果を遅滞なく通報者に対し通知するものとする。
(i) The Inspector General for Public Records Management of the Cabinet Office is to notify the Notifier of the results of examination without delay.
(3) 通報者の保護等
(3) Protection of the Notifier
ア 通報の処理に関与した職員は、通報者を特定させることとなる情報その他の通報に関する秘密を漏らしてはならず、又は知り得た個人情報の内容をみだりに他人に知らせ、若しくは不当な目的に利用してはならない。
A. An official involved in processing notification must not disclose information that would identify the Notifier or any other secret concerning the notification without authorization, and must not let other persons know the contents of personal information which the official came to know, without due cause, or use the contents of such personal information for an unjust purpose.
イ 行政機関の長は、当該行政機関の職員が、通報者(通報者が適合事業者の従業者である場合にあっては、当該適合事業者を含む。ウ前段において同じ。)に対し、通報をしたことを理由として不利益な取扱いをすることのないよう適切な措置を講じなければならない。
B. The Head of an Administrative Organ must take appropriate measures to ensure that officials of the Administrative Organ do not adversely treat the Notifier (if the Notifier is a Worker of an Eligible Contractor, including the Eligible Contractor; the same applies in the first sentence of C.) on the grounds of having made notification.
ウ 行政機関の長は、通報者に対し、通報をしたことを理由として懲戒処分その他不利益な取扱いを行った職員があるときは、当該不利益な取扱いを取り消し、又は是正するとともに、当該職員に対し、懲戒処分その他適切な措置を講ずるものとする。正当な理由なく、通報に関する秘密を漏らした職員及び知り得た個人情報の内容をみだりに他人に知らせ、又は不当な目的に利用した職員についても同様とする。
C. If any official subjects the Notifier to a disciplinary action or other adverse treatment on the grounds of having made notification, the Head of an Administrative Organ is to cancel or rectify the adverse treatment and take a disciplinary action or other appropriate measure against the official. The same applies to an official who, without reasonable grounds, discloses a secret concerning the notification without authorization or who, without due cause, lets other persons know or uses for an unjust purpose the contents of personal information which the official has come to know.
エ 行政機関の長及び内閣府独立公文書管理監は、通報の処理に係る記録を作成し、適切な保存期間を定めた上で、当該記録を関係資料とともに適切な方法で管理しなければならない。
D. The Head of an Administrative Organ and the Inspector General for Public Records Management of the Cabinet Office must prepare records pertaining to the processing of notification and manage the records together with the related materials by an appropriate method after specifying an appropriate retention period.
5 特定秘密保護法第18条第2項に規定する者及び国会への報告
5. Report to the persons prescribed in Article 18, paragraph (2) of the Specially Designated Secrets Act and the Diet
(1) 内閣総理大臣への報告等
(1) Report to the Prime Minister
ア 行政機関の長は、毎年1回、(ア)から(シ)までに掲げる事項を内閣保全監視委員会に、(ア)から(キ)まで及び(シ)に掲げる事項を内閣府独立公文書管理監に報告するものとする。
A. The Head of an Administrative Organ is to annually report the matters set forth in (a) through (l) below to the Cabinet Committee for Protection and Oversight and the matters set forth in (a) through (g) and (l) below to the Inspector General for Public Records Management of the Cabinet Office:
(ア) 当該行政機関の長が指定をした特定秘密の件数及び過去1年に新たに指定をした特定秘密の件数(Ⅱ1(1)に規定する事項の細目ごと。(イ)及び(ウ)において同じ。)
(a) the number of specially designated secrets which the Head of an Administrative Organ has designated and the number of specially designated secrets which were newly designated over the past year (for each category of the details of the matters prescribed in II, 1, (1); the same applies in (b) and (c));
(イ) 過去1年に指定の有効期間の延長をした件数
(b) the number of specially designated secrets for which the effective period of the Designation was extended over the past year;
(ウ) 過去1年に指定を解除した件数
(c) the number of specially designated secrets for which the Designation was terminated over the past year;
(エ) 特定秘密であった情報を記録する行政文書ファイル等を過去1年に国立公文書館等に移管した件数
(d) the number of administrative document files, etc. which record information that had been a specially designated secret and which were transferred to the National Archives of Japan, etc. over the past year;
(オ) 特定秘密であった情報を記録する行政文書ファイル等を過去1年に廃棄した件数
(e) the number of administrative document files, etc. which record information that had been a specially designated secret and which were destroyed over the past year;
(カ) 過去1年に廃棄した特定行政文書ファイル等の件数
(f) the number of Specified Administrative Document Files, etc. which were destroyed over the past year;
(キ) 過去1年に処理した4(2)ア(ア)の通報の件数
(g) the number of the cases of notification as referred to in 4, (2), A, (a) which were processed over the past year;
(ク) 過去1年に適性評価を実施した件数(警察庁長官にあっては、警察本部長が実施した適性評価の件数を含む。(ケ)及び(コ)において同じ。)
(h) the number of the cases in which Security Clearance Assessments conducted over the past year (in the case of the Commissioner General of the National Police Agency, including the number of the cases in which Security Clearance Assessments were conducted by the Chief of Police; the same applies in (i) and (j));
(ケ) 過去1年に適性評価の評価対象者が特定秘密保護法第12条第3項の同意をしなかった件数
(i) the number of the cases in which the Person subject to Assessment with regard to a Security Clearance Assessment did not give the consent as referred to in Article 12, paragraph (3) of the Specially Designated Secrets Act over the past year;
(コ) 過去1年に申出のあった特定秘密保護法第14条の苦情の件数
(j) the number of complaints as referred to in Article 14 of the Specially Designated Secrets Act filed over the past year;
(サ) 過去1年に行った適性評価に関する改善事例
(k) case examples of improvements made concerning Security Clearance Assessments conducted over the past year; and
(シ) その他参考となる事項
(l) other matters that serve as reference.
イ 内閣保全監視委員会は、アの報告に加え、必要があると認めるときは、行政機関の長に対し、特定秘密である情報を含む資料の提出又は説明を求めることができる。
B. If it is found to be necessary in addition to the report as referred to in A., the Cabinet Committee for Protection and Oversight may request the Head of an Administrative Organ to submit or explain materials that contain the information that is a specially designated secret.
ウ 内閣府独立公文書管理監は、内閣保全監視委員会に対し、ア(ア)から(キ)まで及び(シ)に掲げる事項に関し、行政機関の長による特定秘密の指定及びその解除並びに特定行政文書ファイル等の管理についての意見を述べることができる。
C. The Inspector General for Public Records Management of the Cabinet Office may state opinions to the Cabinet Committee for Protection and Oversight with regard to the Designation of specially designated secrets and the termination of the Designation and the management of Specified Administrative Document Files, etc. by the Head of an Administrative Organ concerning the matters set forth in A, (a) through (g) and (l).
エ 内閣保全監視委員会は、アからウまでに定める報告、説明及び意見を取りまとめ、国民に分かりやすい形で取りまとめた概要を付して、特定秘密の指定及びその解除並びに適性評価の実施の状況を内閣総理大臣に報告するものとする。
D. The Cabinet Committee for Protection and Oversight is to organize the reports, explanations, and opinions provided in A. through C. and report the state of the Designation of specially designated secrets and the termination of the Designation as well as the conduct of Security Clearance Assessment to the Prime Minister by attaching an outline that has been compiled in a form that is easy to understand for the citizens.
オ 内閣府独立公文書管理監は、毎年1回、特定秘密の指定及びその解除並びに特定行政文書ファイル等の管理の適正を確保するため内閣府独立公文書管理監及び行政機関の長がとった措置の概要を内閣総理大臣に報告するとともに、公表するものとする。
E. The Inspector General for Public Records Management of the Cabinet Office is to annually report to the Prime Minister and publish the outline of the measures taken by the Inspector General for Public Records Management of the Cabinet Office and the Heads of Administrative Organs for ensuring proper implementation of the Designation of specially designated secrets and the termination of the Designation and the management of Specified Administrative Document Files, etc.
(2) 特定秘密保護法第18条第2項に規定する者への報告
(2) Report to the persons prescribed in Article 18, paragraph (2) of the Specially Designated Secrets Act
内閣総理大臣は、毎年1回、(1)エの状況を特定秘密保護法第18条第2項に規定する者に報告し、その意見を聴かなければならない。
The Prime Minister must annually report the state as referred to in (1), D. to the persons prescribed in Article 18, paragraph (2) of the Specially Designated Secrets Act, and hear their opinions.

ア 内閣総理大臣は、毎年1回、(2)の意見を付して、特定秘密の指定及びその解除並びに適性評価の実施の状況を国会に報告するとともに、公表するものとする。
A. The Prime Minister is to annually report to the Diet and publish the state of the Designation of specially designated secrets and the termination of the Designation as well as the conduct of Security Clearance Assessment by attaching the opinions as referred to in (2).
イ なお、両院に設置される情報監視審査会に報告する際には、行政機関の長が保存する特定秘密指定管理簿を取りまとめたものをアに添付するものとする。
B. When reporting to the Board of Oversight and Review of Specially Designated Secrets established in both the House of Representatives and the House of Councillors, the Prime Minister is to attach to A a material that brings together the contents of the Book for Managing Designation of Specially Designated Secrets retained by the Head of an Administrative Organ.
6 その他の遵守すべき事項
6. Other matters to be observed
(1) 2、3(1)イ、4(2)イ(エ)又は5(1)イに基づき特定秘密の提供を受けた内閣保全監視委員会又は内閣府独立公文書管理監は、当該特定秘密を提供した行政機関の長とあらかじめ協議して定めるところに従い、当該特定秘密を利用する職員の範囲を制限することその他の当該特定秘密の保護のために必要な措置を講じなければならない。
(1) The Cabinet Committee for Protection and Oversight or the Inspector General for Public Records Management of the Cabinet Office which has received provision of a specially designated secret based on 2, 3, (1), B, 4, (2), B, (d), or 5, (1), B. must limit the scope of officials who use the specially designated secret and take any other necessary measures for protecting the specially designated secret in accordance with what has been decided through consultation, in advance, with the Head of an Administrative Organ that provided the specially designated secret.
(2) 内閣保全監視委員会は、特定秘密の指定及びその解除並びに適性評価の実施の適正を確保するために必要な専門的技術的知識及び能力の維持向上に努めなければならない。
(2) The Cabinet Committee for Protection and Oversight must endeavor to maintain and enhance the professional and technical knowledge and ability necessary for ensuring proper implementation of the Designation of specially designated secrets and the termination of the Designation as well as the conduct of Security Clearance Assessment.
(3) 内閣府独立公文書管理監は、特定秘密の指定及びその解除並びに特定行政文書ファイル等の管理の適正を確保するために必要な専門的技術的知識及び能力の維持向上に努めなければならない。
(3) The Inspector General for Public Records Management of the Cabinet Office must endeavor to maintain and enhance the professional and technical knowledge and ability necessary for ensuring proper implementation of the Designation of specially designated secrets and the termination of the Designation as well as the management of Specified Administrative Document Files, etc.
Ⅵ 本運用基準の見直し
VI. Review of the Implementation Standards
政府は、特定秘密の指定及びその解除並びに適性評価の実施に関し、常にその運用の改善に努めつつ、定期的に、又は必要に応じて本運用基準について見直しを行うものとする。なお、特定秘密保護法の施行後5年を経過した場合においては、その運用状況について検討を加え、必要があると認めるときは、その結果に応じて所要の見直しを行うものとする。また、見直しの結果については、これを公表するものとする。
The government is to review the Implementation Standards periodically or if necessary while constantly endeavoring to improve the implementation of the Designation of specially designated secrets and the termination of the Designation as well as the conduct of Security Clearance Assessment. When five years have elapsed since the Specially Designated Secrets Act comes into effect, the state of the implementation is to be examined, and required review is to be made according to the results if it is found to be necessary. The results of the review are to be published.

VII. Effective Date of the Implementation Standards
本運用基準は、特定秘密保護法の施行の日(平成26年12月10日)から施行する。
The Implementation Standards come into effect as of the date on which the Specially Designated Secrets Act comes into effect (December 10, 2014).
