第一章 総則
Chapter I General Provisions
(目的)
(Purpose)
第一条この法律は、原子力の研究、開発及び利用を推進することによつて、将来におけるエネルギー資源を確保し、学術の進歩と産業の振興とを図り、もつて人類社会の福祉と国民生活の水準向上とに寄与することを目的とする。
Article 1The purpose of this Act is to secure energy resources in the future, achieve scientific and technological progress, and promote industry by encouraging the research, development and utilization of nuclear energy, thereby contributing to the improvement of the welfare of human society and of the national living standard.
(基本方針)
(Basic Policy)
第二条原子力の研究、開発及び利用は、平和の目的に限り、安全の確保を旨として、民主的な運営の下に、自主的にこれを行うものとし、その成果を公開し、進んで国際協力に資するものとする。
Article 2The research, development and utilization of nuclear energy is limited to peaceful purposes, is to aim at ensuring safety, and is performed independently under democratic administration, and the results obtained is made public so as to actively contribute to international cooperation.
(定義)
(Definitions)
第三条この法律において次に掲げる用語は、次の定義に従うものとする。
Article 3In this Act, the following terms are defined as follows:
「原子力」とは、原子核変換の過程において原子核から放出されるすべての種類のエネルギーをいう。
(i)the term "Nuclear Energy" means all types of energy emitted from the nucleus of an atom in the process of nuclear transmutation;
「核燃料物質」とは、ウラン、トリウム等原子核分裂の過程において高エネルギーを放出する物質であつて、政令で定めるものをいう。
(ii)the term "Nuclear Fuel Materials" means materials that emit high energy in the process of nuclear fission, such as uranium and thorium, which are specified by Cabinet Order;
「核原料物質」とは、ウラン鉱、トリウム鉱その他核燃料物質の原料となる物質であつて、政令で定めるものをいう。
(iii)the term "Nuclear Source Materials" means materials that are used as the raw materials of nuclear fuel materials, such as uranium ore and thorium ore, which are specified by Cabinet Order;
「原子炉」とは、核燃料物質を燃料として使用する装置をいう。ただし、政令で定めるものを除く。
(iv)the term "Reactor" means a device that uses Nuclear Fuel Materials as fuel; provided, however, that those specified by Cabinet Order are excluded; and
「放射線」とは、電磁波又は粒子線のうち、直接又は間接に空気を電離する能力をもつもので、政令で定めるものをいう。
(v)the term "Radiation" means electromagnetic waves or corpuscular beams capable of ionizing air directly or indirectly and specified by Cabinet Order.
第二章 原子力委員会及び原子力安全委員会
Chapter II Atomic Energy Commission and Nuclear Safety Commission
(設置)
(Establishment)
第四条原子力の研究、開発及び利用に関する国の施策を計画的に遂行し、原子力行政の民主的な運営を図るため、内閣府に原子力委員会及び原子力安全委員会を置く。
Article 4The Atomic Energy Commission and the Nuclear Safety Commission are established under the Cabinet Office for the purposes of systematically carrying out the planned national policies on the research, development and utilization of nuclear energy and of implementing the democratic operation of nuclear energy administration.
(任務)
(Duties)
第五条原子力委員会は、原子力の研究、開発及び利用に関する事項(安全の確保のための規制の実施に関する事項を除く。)について企画し、審議し、及び決定する。
Article 5(1)The Atomic Energy Commission plans, deliberates on and determines matters related to the research, development and utilization of nuclear energy (excluding those related to implementing regulations for ensuring safety).
原子力安全委員会は、原子力の研究、開発及び利用に関する事項のうち、安全の確保に関する事項について企画し、審議し、及び決定する。
(2)The Nuclear Safety Commission plans, deliberates on and determines matters related to ensuring safety from among the matters related to the research, development and utilization of nuclear energy.
(組織、運営及び権限)
(Organization, Operation and Authority)
第六条原子力委員会及び原子力安全委員会の組織、運営及び権限については、別に法律で定める。
Article 6The matters concerning the organizations, operations and authorities of the Atomic Energy Commission and the Nuclear Safety Commission are provided separately by law.
第三章 原子力の開発機関
Chapter III Organization for Development of Nuclear Energy
(独立行政法人日本原子力研究開発機構)
(Japan Atomic Energy Agency)
第七条原子力に関する基礎的研究及び応用の研究並びに核燃料サイクルを確立するための高速増殖炉及びこれに必要な核燃料物質の開発並びに核燃料物質の再処理等に関する技術の開発並びにこれらの成果の普及等は、第二条に規定する基本方針に基づき、独立行政法人日本原子力研究開発機構において行うものとする。
Article 7Activities such as the basic research and applied research on nuclear energy, the development of fast breeder reactors and necessary nuclear fuel materials for the purpose of establishing a nuclear fuel cycle, the development of technology for reprocessing, etc. of Nuclear Fuel Materials, as well as the dissemination of the results of such research and development, are carried out by the Japan Atomic Energy Agency in accordance with the Basic Policy prescribed in Article 2.
第四章 原子力に関する鉱物の開発取得
Chapter IV Development and Acquisition of Minerals Related to Nuclear Energy
鉱業法の特例)
(Special Provisions on the Mining Act)
第八条核原料物質に関する鉱業権又は租鉱権に関しては、別に法律をもつて、鉱業法(昭和二十五年法律第二百八十九号)の特例を定めるものとする。
Article 8With regard to mining rights or mining lease rights related to Nuclear Source Materials, special provisions on the Mining Act (Act No. 289 of 1950) are established separately by law.
(買取命令及び譲渡命令)
(Purchase Order and Transfer Order)
第九条政府は、別に法律で定めるところにより、その指定する者に対し、核原料物質を買い取るべきことを命じ、又は核原料物質の生産者又は所有者若しくは管理者に対し、政府の指定する者に核原料物質を譲渡すべきことを命ずることができる。
Article 9The Government may, as provided separately by law, order a person designated thereby to purchase Nuclear Source Materials, or order a producer, owner or manager of Nuclear Source Materials to transfer Nuclear Source Materials to a person designated by the Government.

(Control over Nuclear Source Materials)
第十条核原料物質の輸入、輸出、譲渡、譲受及び精錬は、別に法律で定めるところにより、政府の指定する者に限つてこれを行わしめるものとする。
Article 10The import, export, transfer, receipt and purification of Nuclear Source Materials are entrusted only to persons designated by the Government, as provided separately by law.
(奨励金等)
(Financial Incentives)
第十一条政府は、核原料物質の開発に寄与する者に対し、予算の範囲内において奨励金又は賞金を交付することができる。
Article 11The Government may, within its budgetary limits, grant financial incentives or prize money to persons who contribute to the development of Nuclear Source Materials.
第五章 核燃料物質の管理
Chapter V Control over Nuclear Fuel Materials
(核燃料物質に関する規制)
(Regulations Concerning Nuclear Fuel Materials)
第十二条核燃料物質を生産し、輸入し、輸出し、所有し、所持し、譲渡し、譲り受け、使用し、又は輸送しようとする者は、別に法律で定めるところにより政府の行う規制に従わなければならない。
Article 12Persons who intend to produce, import, export, own, possess, transfer, receive, use or transport Nuclear Fuel Materials must be subject to the regulations to be enforced by the Government as provided separately by law.
(核燃料物質の譲渡命令)
(Order of Transfer of Nuclear Fuel Materials)
第十三条政府は、前条に規定する規制を行う場合において、別に法律で定めるところにより、核燃料物質を所有し、又は所持する者に対し、譲渡先及び価格を指示してこれを譲渡すべきことを命ずることができる。
Article 13When enforcing the regulations prescribed in the preceding Article, the Government may, as provided separately by law, order a person who owns or possesses Nuclear Fuel Materials to transfer the same to the party and at the price designated by the Government.
第六章 原子炉の管理
Chapter VI Control of Reactors
(原子炉の建設等の規制)
(Regulations over Construction of Reactors)
第十四条原子炉を建設しようとする者は、別に法律で定めるところにより政府の行う規制に従わなければならない。これを改造し、又は移動しようとする者も、同様とする。
Article 14A persons who intends to construct reactor(s) must be subject to the regulations of the Government as provided separately by law. The same also applies to a person who intends to reconstruct or relocate them.
第十五条原子炉を譲渡し、又は譲り受けようとする者は、別に法律で定めるところにより政府の行う規制に従わなければならない。
Article 15A person who intends to transfer or receive reactor(s) must be subject to the regulations of the Government as provided separately by law.
第十六条前二条に規定する規制に従つて原子炉を建設し、改造し、移動し、又は譲り受けた者は、別に法律で定めるところにより、操作開始前に運転計画を定めて、政府の認可を受けなければならない。
Article 16A person who has constructed, reconstructed, relocated or received reactor(s) in compliance with the regulations prescribed in the preceding two Articles must, as provided separately by law, formulate an operation plan and obtain the approval of the Government prior to the operation.
第七章 特許発明等に対する措置
Chapter VII Measures for Patented Inventions, etc.
特許法による措置)
(Measures under the Patent Act)
第十七条政府は、原子力に関する特許発明につき、公益上必要があると認めるときは、特許法(昭和三十四年法律第百二十一号)第九十三条の規定により措置するものとする。
Article 17When it finds it necessary for the public interest, the Government is to take measures for patented inventions related to nuclear energy pursuant to the provisions of Article 93 of the Patent Act (Act No. 121 of 1959).
(譲渡制限)
(Restriction on Transfer)
第十八条原子力に関する特許発明、技術等の国外流出に係る契約の締結は、別に法律で定めるところにより政府の行う規制に従わなければならない。
Article 18The conclusion of contracts resulting in the outflow of patented inventions, technologies, etc. related to nuclear energy from Japan must be subject to the regulations of the Government as provided separately by law.
(奨励金等)
(Financial Incentives)
第十九条政府は、原子力に関する特許出願に係る発明又は特許発明に関し、予算の範囲内において奨励金又は賞金を交付することができる。
Article 19The Government may, within its budgetary limits, grant financial incentives or prize money with regard to inventions claimed in patent applications or patented inventions, which are related to nuclear energy.
第八章 放射線による障害の防止
Chapter VIII Prevention of Radiation Hazards
(放射線による障害の防止措置)
(Measures for the Prevention of Radiation Hazards)
第二十条放射線による障害を防止し、公共の安全を確保するため、放射性物質及び放射線発生装置に係る製造、販売、使用、測定等に対する規制その他保安及び保健上の措置に関しては、別に法律で定める。
Article 20In order to prevent radiation hazards and ensure public safety, the regulations on the manufacture, sale, use, measurement, etc. and any other safety and health measures relating to radioactive materials and radiation generating devices are provided separately by law.
第九章 補償
Chapter IX Compensation
(補償)
(Compensation)
第二十一条政府又は政府の指定する者は、この法律及びこの法律を施行する法律に基き、核原料物質の開発のためその権限を行う場合において、土地に関する権利、鉱業権又は租鉱権その他の権利に関し、権利者及び関係人に損失を与えた場合においては、それぞれ法律で定めるところにより、正当な補償を行わなければならない。
Article 21Where the Government or a person designated by the Government, when exercising its or the person's authority for the development of Nuclear Source Materials under this Act and the law enacted to enforce this Act, has caused a loss in relation to a right to land, mining right or mining lease right, or any other right to the right holder and the parties concerned, the Government or such person must provide justifiable compensation to them as respectively provided by law.
附 則
Supplementary Provisions
この法律は、昭和三十一年一月一日から施行する。
This Act comes into effect as of January 1, 1956.
附 則〔昭和四十二年七月二十日法律第七十二号〕
Supplementary Provisions[Act No. 72 of July 20, 1967]
この法律は、公布の日から施行する。ただし、第七条の改正規定は、公布の日から起算して六月をこえない範囲内において政令で定める日から施行する。
This Act comes into effect as of the date of its promulgation; provided, however, that the provisions for revisions of Article 7 comes into effect as of the day specified by Cabinet Order within a period not exceeding six months from the date of promulgation.

Supplementary Provisions[Act No. 86 of July 5, 1978][Extract]

第一条この法律は、次の各号に掲げる区分に応じ、それぞれ当該各号に掲げる日から施行する。
Article 1This Act comes into effect as of the date set forth in each of the following items for the provisions listed in the respective items:
第二条中原子力委員会設置法第十五条を第十二条とし同条の次に二章及び章名を加える改正規定のうち第二十二条(同条において準用する第五条第一項の規定中委員の任命について両議院の同意を得ることに係る部分に限る。)の規定並びに次条第一項及び第三項の規定公布の日
(i)the provisions of Article 22 (limited to the part of the provisions of Article 5, paragraph (1) as applied mutatis mutandis pursuant to Article 22, which pertains to obtaining approval of both Houses of the Diet for appointment of commission members), in the provisions in Article 2 for revision of the Act for Establishment of the Atomic Energy Commission by changing Article 15 into Article 12 and adding two Chapters and Chapter titles following Article 12, as well as the provisions of paragraph (1) and paragraph (3) of the following Article:the date of promulgation;
第一条の規定、第二条の規定(前号に掲げる同条中の規定を除く。)、第三条中核原料物質、核燃料物質及び原子炉の規制に関する法律第四条第二項の改正規定、同法第十四条第二項の改正規定、同法第二十三条に一項を加える改正規定及び同法第二十四条第二項の改正規定(「内閣総理大臣」を「主務大臣」に改める部分を除く。)並びに次条第二項、附則第五条から附則第七条まで及び附則第九条の規定公布の日から起算して三月を超えない範囲内において政令で定める日
(ii)the provisions of Article 1, the provisions of Article 2 (excluding the provisions in Article 2 as set forth in the preceding item), the provisions in Article 3 for revision of Article 4, paragraph (2) of the Act on the Regulation of Nuclear Source Material, Nuclear Fuel Material and Reactors, for revision by adding one paragraph to Article 23 of said Act, and for revision of Article 24, paragraph (2) of said Act (excluding the part for revising "Prime Minister" to "Competent Minister"), as well as the provisions of paragraph (2) of the following Article, Articles 5 through 7 of the Supplementary Provisions, and Article 9 of the Supplementary Provisions:the day specified by Cabinet Order within a period not exceeding three months from the date of promulgation; and
前二号に掲げる規定以外の規定公布の日から起算して六月を超えない範囲内において政令で定める日
(iii)the provisions other than those listed in the preceding two items:the day specified by Cabinet Order within a period not exceeding six months from the date of promulgation.

Supplementary Provisions[Act No. 62 of May 20, 1998][Extract]
(施行期日)
(Effective Date)
第一条この法律は、公布の日から起算して六月を超えない範囲内において政令で定める日から施行する。ただし、第二条中動力炉・核燃料開発事業団法第三十一条及び第三十二条第三項を削る改正規定並びに附則第五条及び第六条の規定については、公布の日から施行する。
Article 1This Act comes into effect as of the day specified by Cabinet Order within a period not exceeding six months from the date of its promulgation; provided, however, that the provisions in Article 2 for revision of the Power Reactor and Nuclear Fuel Development Corporation Act by deleting Article 31 and Article 32, paragraph (3), as well as the provisions of Article 5 and Article 6 of the Supplementary Provisions, come into effect as of the date of this Act's promulgation.
(核燃料サイクル開発機構への移行)
(Change to Japan Nuclear Cycle Development Institute)
第二条動力炉・核燃料開発事業団(以下「事業団」という。)は、この法律の施行の時において、核燃料サイクル開発機構(以下「機構」という。)となるものとする。
Article 2The Power Reactor and Nuclear Fuel Development Corporation (hereinafter referred to as the "PNC") is to become the Japan Nuclear Cycle Development Institute (hereinafter referred to as the "JNC") at the time of the enforcement of this Act.
(持分の払戻し)
(Refund of Equity Interest)
第三条政府以外の出資者は、機構に対し、この法律の施行の日から起算して一月を経過した日までの間に限り、その持分の払戻しを請求することができる。
Article 3(1)Any equity investor other than the Government may request a refund of their equity interest from the JNC up to the day on which one month has elapsed from the date of the enforcement of this Act.
機構は、前項の規定による請求があったときは、この法律による改正後の核燃料サイクル開発機構法(以下「新法」という。)第七条第一項の規定にかかわらず、当該持分に係る出資額に相当する金額により払戻しをしなければならない。この場合において、機構は、その払戻しをした金額により資本金を減少するものとする。
(2)When a request is made under the provisions of the preceding paragraph, the JNC must refund the amount equivalent to the contribution amount pertaining to the equity interest concerned, notwithstanding the provisions of Article 7, paragraph (1) of the Japan Nuclear Cycle Development Institute Act as amended by this Act (hereinafter referred to as the "New Act").In this case, the JNC is to have its stated capital reduced by the amount thus refunded.
(名称の使用制限に関する経過措置)
(Transitional Measures Concerning Restrictions on Use of Name)
第四条この法律の施行の際現に核燃料サイクル開発機構という名称を使用している者については、新法第九条の規定は、この法律の施行後六月間は、適用しない。
Article 4With regard to any person who actually uses the name "Japan Nuclear Cycle Development Institute" at the time of the enforcement of this Act, the provisions of Article 9 of the New Act do not apply for six months after the enforcement of this Act.
(事業団の役員に関する経過措置)
(Transitional Measures Concerning Officers of PNC)
第五条この法律の施行の日の前日において事業団の役員である者の任期は、この法律による改正前の動力炉・核燃料開発事業団法第十四条第一項の規定にかかわらず、その日に満了する。
Article 5The term of office of persons who are officers of the PNC on the day preceding the date of the enforcement of this Act expires as of said day, notwithstanding the provisions of Article 14, paragraph (1) of the Power Reactor and Nuclear Fuel Development Corporation Act prior to the amendment by this Act.
(基本方針に関する経過措置)
(Transitional Measures Concerning Basic Policy)
第六条内閣総理大臣は、この法律の施行の日前において、原子力委員会の議決を経て新法第二十七条第一項の規定による基本方針を定めなければならない。
Article 6(1)The Prime Minister must, prior to the date of the enforcement of this Act, formulate a basic policy under the provisions of Article 27, paragraph (1) of the New Act, after obtaining resolution of the Atomic Energy Commission.
内閣総理大臣は、前項の規定により基本方針を定めようとするときは、あらかじめ、大蔵大臣及び通商産業大臣に協議しなければならない。ただし、通商産業大臣との協議は、新法第二十四条第一項第一号イ、ロ及びニに掲げる業務に係る事項に限られるものとする。
(2)The Prime Minister must, when the Prime Minister intends to formulate a basic policy pursuant to the provisions of the preceding paragraph, consult with the Minister of Finance and the Minister of International Trade and Industry in advance; provided, however, that the consultation with the Minister of International Trade and Industry is limited to the matters relating to the businesses listed in Article 24, paragraph (1), item (i),(a), (b), and (d) of the New Act.
(罰則に関する経過措置)
(Transitional Measures Concerning Penal Provisions)
第七条この法律の施行前にした行為に対する罰則の適用については、なお従前の例による。
Article 7With regard to the application of penal provisions to acts committed prior to the enforcement of this Act, the provisions then in force remain applicable.
附 則〔平成十一年七月十六日法律第百二号〕〔抄〕
Supplementary Provisions[Act No. 102 of July 16, 1999][Extract]
(施行期日)
(Effective Date)
第一条この法律は、内閣法の一部を改正する法律(平成十一年法律第八十八号)の施行の日から施行する。ただし、次の各号に掲げる規定は、当該各号に定める日から施行する。
Article 1This Act comes into effect as of the date of the enforcement of the Act for Partial Revision of the Cabinet Act (Act No. 88 of 1999); provided, however, that the provisions listed in the following items come into effect as of the day specified in the respective items:
第一条から第三条までの規定並びに次条及び附則第三十一条から第三十八条までの規定内閣法の一部を改正する法律の施行前の日で別に法律で定める日
(i)the provisions of Articles 1 through 3, the provisions of the following Article, and the provisions of Articles 31 through 38 of the Supplementary Provisions:the date prior to the enforcement of the Act for Partial Revision of the Cabinet Act, as specified separately by another Act; and
附則第十条第一項及び第五項、第十四条第三項、第二十三条、第二十八条並びに第三十条の規定公布の日
(ii)the provisions of Article 10, paragraph (1) and paragraph (5), Article 14, paragraph (3), Article 23, Article 28, and Article 30 of the Supplementary Provisions:the date of promulgation.
(職員の身分引継ぎ)
(Succession of Status of Officials)
第三条この法律の施行の際現に従前の総理府、法務省、外務省、大蔵省、文部省、厚生省、農林水産省、通商産業省、運輸省、郵政省、労働省、建設省又は自治省(以下この条において「従前の府省」という。)の職員(国家行政組織法(昭和二十三年法律第百二十号)第八条の審議会等の会長又は委員長及び委員、中央防災会議の委員、日本工業標準調査会の会長及び委員並びにこれらに類する者として政令で定めるものを除く。)である者は、別に辞令を発せられない限り、同一の勤務条件をもって、この法律の施行後の内閣府、総務省、法務省、外務省、財務省、文部科学省、厚生労働省、農林水産省、経済産業省、国土交通省若しくは環境省(以下この条において「新府省」という。)又はこれに置かれる部局若しくは機関のうち、この法律の施行の際現に当該職員が属する従前の府省又はこれに置かれる部局若しくは機関の相当の新府省又はこれに置かれる部局若しくは機関として政令で定めるものの相当の職員となるものとする。
Article 3Unless an appointment is announced separately, persons who are officials (excluding the chairperson and members of the Council, etc. under Article 8 of the National Government Organization Act (Act No. 120 of 1948)), the members of the Central Disaster Prevention Council, the chairperson and members of the Japanese Industrial Standards Committee, and those specified by Cabinet Order as similar persons) of the former Prime Minister's Office, Ministry of Justice, Ministry of Foreign Affairs, Ministry of Finance, Ministry of Education, Ministry of Health and Welfare, Ministry of Agriculture, Forestry and Fisheries, Ministry of International Trade and Industry, Ministry of Transport, Ministry of Posts and Telecommunications, Ministry of Labor, Ministry of Construction or Ministry of Home Affairs (hereinafter referred to as the "Former Offices or Ministries" in this Article), at the time of the enforcement of this Act, are to become corresponding officials of the Cabinet Office, Ministry of Internal Affairs and Communications, Ministry of Justice, Ministry of Foreign Affairs, Ministry of Finance, Ministry of Education, Culture, Sports, Science and Technology, Ministry of Health, Labour and Welfare, Ministry of Agriculture, Forestry and Fisheries, Ministry of Economy, Trade and Industry, Ministry of Land, Infrastructure, Transport and Tourism, or Ministry of the Environment after the enforcement of this Act (hereinafter referred to as the "New Offices or Ministries" in this Article) or of a department or organization established thereunder specified by Cabinet Order as the New Offices or Ministries, or of the department or organization established thereunder that corresponds to the Former Offices or Ministries, or of the department or organization established thereunder to which the relevant officials belong at the time of enforcement of this Act, with the same working conditions.

第三十条第二条から前条までに規定するもののほか、この法律の施行に伴い必要となる経過措置は、別に法律で定める。
Article 30In addition to what is provided for from Article 2 to the preceding Article, transitional measures necessary upon the enforcement of this Act are provided separately in another Act.

(Effective Date)
第一条この法律は、公布の日から施行する。ただし、附則第十条から第十二条まで、第十四条から第十七条まで、第十八条第一項及び第三項並びに第十九条から第三十二条までの規定は、平成十七年十月一日から施行する。
Article 1This Act comes into effect as of the date of its promulgation; provided, however, that the provisions of Articles 10 through 12, Articles 14 through 17, Article 18, paragraph (1) and paragraph (3), and Articles 19 through 32 of the Supplementary Provisions come into effect as of October 1, 2005.
