消費生活用製品安全法(昭和四十八年法律第三十一号)及び消費生活用製品安全法施行令(昭和四十九年政令第四十八号)に基づき、並びに同法を実施するため、通商産業省関係特定製品の安全基準等に関する省令を次のように制定する。
Based on the Consumer Product Safety Act (Act No. 31 of 1973) and the Order for Enforcement of the Consumer Product Safety Act (Cabinet Order No. 48 of 1974) and in order to implement the Act, the Ministerial Order on Technical Requirements for Specified Products Related to the Ministry of International Trade and Industry is established as follows.

第一章 総則
Chapter I General Provisions
(定義)
(Definitions)
第一条この省令において使用する用語は、消費生活用製品安全法(昭和四十八年法律第三十一号。以下「法」という。)及び消費生活用製品安全法施行令(昭和四十九年政令第四十八号。以下「令」という。)において使用する用語の例による。
Article 1The terms used in this Ministerial Order follow the definitions in the Consumer Product Safety Act (Act No. 31 of 1973; hereinafter referred to as the "Act") and the Order for Enforcement of the Consumer Product Safety Act (Cabinet Order No. 48 of 1974; hereinafter referred to as the "Order").

(Application)
第二条この省令は、特定製品のうち令別表第一に掲げるもの及び令別表第二に掲げるものについて適用する。
Article 2This Ministerial Order applies to Specified Products which are listed in Appended Table 1 of the Order and those listed in Appended Table 2 of the Order.
第二章 基準及び販売の制限
Chapter II Requirements and Restrictions on Sales
(技術上の基準)
(Technical Requirements)
第三条法第三条の主務省令で定める技術上の基準は、別表第一の特定製品の区分の欄に掲げる区分ごとにそれぞれ同表の技術上の基準の欄に掲げるとおりとする。
Article 3The technical requirements established in the order of the competent ministry as set forth in Article 3 of the Act are those listed in the "Technical Requirements" column of Appended Table 1 for the respective classes listed in the "Classification of Specified Products" column of the same table.
(販売等に係る例外の届出等)
(Notification of Exception Pertaining to Sales)
第四条法第四条第二項第一号の届出をしようとする者は、様式第一による届出書に当該特定製品が輸出用のものであることを証する書面を添えて経済産業大臣(令第十七条第一項に規定する者にあつてはその者の当該工場又は事業場の所在地を管轄する経済産業局長、同条第二項に規定する者にあつてはその者の当該事務所、事業場、店舗又は倉庫の所在地を管轄する経済産業局長)に提出しなければならない。
Article 4(1)A person who intends to make a notification as set forth in Article 4, paragraph (2), item (i) of the Act must submit to the Minister of Economy, Trade and Industry (in the case of a person as prescribed in Article 17, paragraph (1) of the Order, the Director-General of the Regional Bureau of Economy, Trade and Industry having jurisdiction over the location of the relevant factory or workplace of the person, and in the case of a person as prescribed in paragraph (2) of the same Article, the Director-General of the Regional Bureau of Economy, Trade and Industry having jurisdiction over the location of the relevant office, workplace, store, or warehouse of the person) a written notification that has been prepared according to Form No. 1 together with a document proving that the Specified Products are for export.
2法第四条第二項第二号の承認を受けようとする者は、様式第二による申請書を経済産業大臣に提出しなければならない。
(2)A person who intends to obtain an approval as set forth in Article 4, paragraph (2), item (ii) of the Act must submit to the Minister of Economy, Trade and Industry a written application that has been prepared according to Form No. 2.
3経済産業大臣は、前項の承認の申請があつた場合において必要があると認めるときは、申請者に対し、当該申請に係る特定製品の見本品又は検査記録の提出を求めることができる。
(3)Where an application for an approval as set forth in the preceding paragraph has been filed, if the Minister of Economy, Trade and Industry finds it necessary, the Minister may request the applicant to submit a sample or an inspection record of the Specified Products pertaining to the application.
第三章 事業の届出等
Chapter III Notification of Business
(特定製品の区分)
(Classification of Specified Products)
第五条法第六条の主務省令で定める特定製品の区分は、別表第一の特定製品の区分の欄に掲げるとおりとする。
Article 5The Classification of Specified Products provided for by the order of the competent ministry as set forth in Article 6 of the Act is that listed in the "Classification of Specified Products" column of Appended Table 1.
(事業の届出)
(Notification of Business)
第六条法第六条の規定により事業の届出をしようとする者は、様式第三による届出書を経済産業大臣(令第十七条第三項に規定する者にあつてはその者の当該工場又は事業場の所在地を管轄する経済産業局長、同条第四項に規定する者にあつてはその者の当該事務所、事業場、店舗又は倉庫の所在地を管轄する経済産業局長。第八条第一項、第九条、第十一条及び第十二条において同じ。)に提出しなければならない。
Article 6A person who intends to make a notification of business pursuant to the provisions of Article 6 of the Act must submit to the Minister of Economy, Trade and Industry (in the case of a person as prescribed in Article 17, paragraph (3) of the Order, the Director-General of the Regional Bureau of Economy, Trade and Industry having jurisdiction over the location of the relevant factory or workplace of the person, and in the case of a person as prescribed in paragraph (4) of the same Article, the Director-General of the Regional Bureau of Economy, Trade and Industry having jurisdiction over the location of the relevant office, workplace, store, or warehouse of the person; the same applies in Article 8, paragraph (1) and Articles 9, 11, and 12) a written notification that has been prepared according to Form No. 3.
(型式の区分)
(Classification of the Type of Specified Products)
第七条法第六条第二号の主務省令で定める型式の区分は、別表第二の特定製品の区分の欄に掲げるものについて、それぞれ同表の型式の区分の欄において材質等の区分として掲げるとおりとする。この場合において、要素が二以上ある特定製品については、それぞれの材質等の区分として掲げる区分の一をすべての要素について組み合わせたものごとに一の型式の区分とする。
Article 7The classification of the type of Specified Products prescribed by the order of the competent ministry as set forth in Article 6, item (ii) of the Act is that listed as the classification of the material, etc. in the "Classification of the Type" column of Appended Table 2 for the respective products listed in the "Classification of Specified Products" column of the same table.In this case, if Specified Products comprise two or more elements, one of the classes listed as the classification of the material, etc. for each element that has been combined for all of the elements is deemed to constitute a single class of the type of Specified Products.
(承継の届出)
(Notification of Succession)
第八条法第七条第二項の規定により届出事業者の地位の承継の届出をしようとする者は、様式第四による届出書を経済産業大臣に提出しなければならない。
Article 8(1)A person who intends to make a notification of succession of the status of a Notifying Enterprise pursuant to the provisions of Article 8, paragraph (2) of the Act must submit to the Minister of Economy, Trade and Industry a written notification that has been prepared according to Form No. 4.
2前項の届出書には、次の書面を添付しなければならない。
(2)A written notification as set forth in the preceding paragraph must have attached thereto the following documents:
一法第七条第一項の規定により届出に係る事業の全部を譲り受けて、届出事業者の地位を承継した者にあつては、様式第五による書面
(i)in the case of a person who has succeeded to the status of a Notifying Enterprise by receiving a transfer of the whole of the business subject to the notification pursuant to the provisions of Article 7, paragraph (1) of the Act, a document that has been prepared according to Form No. 5;
二法第七条第一項の規定により届出事業者の地位を承継した相続人であつて、二以上の相続人の全員の同意により選定されたものにあつては、様式第六による書面及び戸籍謄本
(ii)in the case of an heir who has succeeded to the status of a Notifying Enterprise pursuant to the provisions of Article 7, paragraph (1) of the Act and who has been selected by the unanimous agreement of two or more heirs, a document that has been prepared according to Form No. 6 and a transcript of the family register;
三法第七条第一項の規定により届出事業者の地位を承継した相続人であつて、前号の相続人以外のものにあつては、様式第七による書面及び戸籍謄本
(iii)in the case of an heir who has succeeded to the status of a Notifying Enterprise pursuant to the provisions of Article 7, paragraph (1) of the Act but who is not an heir as set forth in the preceding item, a document that has been prepared according to Form No. 7 and a transcript of the family register;
四法第七条第一項の規定により合併によつて届出事業者の地位を承継した法人にあつては、その法人の登記事項証明書
(iv)in the case of a corporation which has succeeded to the status of a Notifying Enterprise through a merger pursuant to the provisions of Article 7, paragraph (1) of the Act, a certificate of registered information of the corporation; and
五法第七条第一項の規定により分割によつて届出事業者の地位を承継した法人にあつては、様式第七の二による書面及びその法人の登記事項証明書
(v)in the case of a corporation which has succeeded to the status of a Notifying Enterprise through a split pursuant to the provisions of Article 7, paragraph (1) of the Act, a document that has been prepared according to Form No. 7-2 and a certificate of registered information of the corporation.
(変更の届出)
(Notification of Change)
第九条法第八条の規定により事業の届出事項の変更の届出をしようとする者は、様式第八による届出書を経済産業大臣に提出しなければならない。
Article 9A person who intends to make a notification of a change to any of the notified particulars with regard to a business pursuant to the provisions of Article 8 of the Act must submit to the Minister of Economy, Trade and Industry a written notification that has been prepared according to Form No. 8.
(軽微な変更)
(Minor Change)
第十条法第八条ただし書の主務省令で定める軽微な変更は、届出事業者が法人であるときの、法人の代表者の氏名の変更とする。
Article 10The minor change provided for by the order of the competent ministry as set forth in the proviso to Article 8 of the Act is a change in the name of the representative of the corporation, where the Notifying Enterprise is a corporation.
(廃止の届出)
(Notification of Discontinuation)
第十一条法第九条の規定により事業の廃止の届出をしようとする者は、様式第九による届出書を経済産業大臣に提出しなければならない。
Article 11A person who intends to make a notification of discontinuation of a business pursuant to the provisions of Article 9 of the Act must submit to the Minister of Economy, Trade and Industry a written notification that has been prepared according to Form No. 9.
(届出事項に係る情報の提供)
(Provision of Information Pertaining to Notified Particulars)
第十二条法第十条の規定により情報の提供の請求をしようとする者は、次に掲げる事項を記載した書面を経済産業大臣に提出しなければならない。
Article 12A person who intends to request provision of information pursuant to the provisions of Article 10 of the Act must submit to the Minister of Economy, Trade and Industry a document stating the following particulars:
一氏名又は名称及び住所
(i)the person's name and address; and
二請求をしようとする情報の概要
(ii)the outline of the information requested.
(基準適合義務に係る例外の届出等)
(Notification of Exception Pertaining to Duty to Conform to Requirements)
第十三条法第十一条第一項第一号の届出については第四条第一項の規定を、法第十一条第一項第二号の承認の申請については第四条第二項及び第三項の規定を準用する。この場合において、同条第一項中「第十七条第一項」とあるのは「第十七条第三項」と、「同条第二項」とあるのは「同条第四項」と読み替えるものとする。
Article 13The provisions of Article 4, paragraph (1) apply mutatis mutandis to a notification as set forth in Article 11, paragraph (1), item (i) of the Act, and the provisions of Article 4, paragraphs (2) and (3) apply mutatis mutandis to an application for approval as set forth in Article 11, paragraph (1), item (ii) of the Act.In this case, the phrase "Article 17, paragraph (1)" in paragraph (1) of the same Article is deemed to be replaced with "Article 17, paragraph (3)," and the phrase "paragraph (2) of the same Article" in the same paragraph is deemed to be replaced with "paragraph (4) of the same Article."
(検査の方式等)
(Method of Inspection)
第十四条法第十一条第二項の規定により、届出事業者は、その製造又は輸入に係る特定製品(同条第一項ただし書の規定の適用を受けて製造され、又は輸入されるものを除く。以下この条において同じ。)について、別表第一の特定製品の区分ごとにそれぞれ同表の技術上の基準の欄に掲げる技術上の基準への適合を確認するために適切と認められる方法による検査を行わなければならない。
Article 14(1)Pursuant to the provisions of Article 11, paragraph (2) of the Act, a Notifying Enterprise must inspect the Specified Products manufactured or imported (except for those manufactured or imported under the proviso to paragraph (1) of the same Article; hereinafter the same applies in this Article) by a method that is found to be appropriate for confirming the conformity of the Specified Products to the technical requirements listed in the "Technical Requirements" column of Appended Table 1 for the respective classes of the classification of Specified Products in the same table.
2法第十一条第二項の規定により届出事業者が検査記録に記載すべき事項は、次のとおりとする。
(2)The particulars which a Notifying Enterprise should state in an inspection record pursuant to the provisions of Article 11, paragraph (2) of the Act are as follows:
一特定製品の区分並びに構造、材質及び性能の概要
(i)the Classification of Specified Products and the outline of the structure, material qualities, and performance of the Specified Products;
二検査を行つた年月日及び場所
(ii)the date and place for conducting the inspection;
三検査を実施した者の氏名
(iii)the name of the person who conducted the inspection;
四検査を行つた特定製品の数量
(iv)the quantity of the Specified Products inspected;
五検査の方法
(v)the method of inspection; and
六検査の結果
(vi)the inspection results.
3法第十一条第二項の規定により検査記録を保存しなければならない期間は、検査の日から三年とする。
(3)The period during which an inspection record must be kept pursuant to the provisions of Article 11, paragraph (2) of the Act is three years from the day of the inspection.
(電磁的方法による保存)
(Keeping by Electronic or Magnetic Means)
第十五条法第十一条第二項に規定する検査記録は、前条第二項各号に掲げる事項を電磁的方法(電子的方法、磁気的方法その他の人の知覚によつて認識することができない方法をいう。第三十二条において同じ。)により記録することにより作成し、保存することができる。
Article 15(1)An inspection record as prescribed in Article 11, paragraph (2) of the Act may be prepared and kept by way of recording the particulars listed in the items of paragraph (2) of the preceding Article by electronic or magnetic means (meaning an electronic form, a magnetic form, or any other form not recognizable to human perception; the same applies in Article 32).
2前項の規定による保存をする場合には、同項の検査記録が必要に応じ電子計算機その他の機器を用いて直ちに表示されることができるようにしておかなければならない。
(2)In the case of keeping an inspection record under the provisions of the preceding paragraph, a measure must be taken so that the inspection record set forth in the same paragraph may be immediately displayed by using a computer or any other device as needed.
3第一項の規定による保存をする場合には、経済産業大臣が定める基準を確保するよう努めなければならない。
(3)In the case of keeping an inspection record under the provisions of paragraph (1), endeavors must be made to secure the standards specified by the Minister of Economy, Trade and Industry.
(法第六条第四号の措置の基準)
(Requirements for Measure Set Forth in Article 6, Item (iv) of the Act)
第十六条法第十一条第三項の法第六条第四号の措置に関し主務省令で定める基準は、届出事業者が、その製造し、又は輸入する当該特定製品の欠陥により一般消費者の生命又は身体について生じた損害を賠償することによつて生ずる損失を被害者一人当たり一千万円以上かつ年間三千万円以上を限度額としててん補することを内容とする損害賠償責任保険契約の被保険者となつていることとする。
Article 16The requirements provided for by the order of the competent ministry with regard to the measures set forth in Article 6, item (iv) of the Act as set forth in Article 11, paragraph (3) of the Act are to be that the Notifying Enterprise is insured under a liability insurance contract stipulating that losses incurred by compensating any harm to the lives or health of general consumers caused by a defect in the Specified Products the Notifying Enterprise has manufactured or imported are compensated for to a maximum amount of not less than ten million yen per victim and not less than thirty million yen per annum.
(証明書と同等なもの)
(Item Equivalent to Certificate)
第十七条法第十二条第一項に規定する同条第二項の証明書と同等なものとして主務省令で定めるものは、次の各号に掲げるものとする。
Article 17An item provided for by the order of the competent ministry as being equivalent to the certificate set forth in Article 12, paragraph (2) of the Act as prescribed in paragraph (1) of the same Article is any of those listed in the following items:
一届出事業者が輸入しようとする特別特定製品の型式について、他の届出事業者が国内登録検査機関又は外国登録検査機関から交付を受けた法第十二条第二項の証明書に係る型式と同一の型式の区分に属し、かつ、同一の製造事業者に係るものである旨の国内登録検査機関又は外国登録検査機関による確認を受けたときは、当該他の届出事業者が当該証明書の交付を受けた日から起算して特別特定製品ごとに同条第一項の政令で定める期間を経過する日までの間は、その確認を受けた書面
(i)when, with regard to the type of Special Specified Products which a Notifying Enterprise intends to import, the Notifying Enterprise receives confirmation from a Domestically Registered Conformity Inspection Body or an Overseas Registered Conformity Inspection Body to the effect that the Special Specified Products fall under the same class of the type of products as the type pertaining to the certificate set forth in Article 12, paragraph (2) of the Act which another Notifying Enterprise has obtained from the Domestically Registered Conformity Inspection Body or the Overseas Registered Conformity Inspection Body and that the Special Specified Products pertain to the same manufacturer, the document showing such confirmation, until the day on which the period provided for by Cabinet Order for the respective Special Specified Products as set forth in paragraph (1) of the same Article elapses from the day on which the relevant other Notifying Enterprise has obtained the issuance of the certificate; and
二前号に掲げるもののほか、経済産業大臣が同等なものとして特に認めるもの
(ii)beyond what is set forth in the preceding item, any item that is specially found by the Minister of Economy, Trade and Industry to be equivalent.
(法第十二条第一項第二号の主務省令で定めるもの)
(Subject Matter Provided for by the Order of the Competent Ministry as Set Forth in Article 12, Paragraph (1) of the Act)
第十八条法第十二条第一項第二号の主務省令で定めるものは、品質管理に関する事項とする。
Article 18The subject matter provided for by the order of the competent ministry as set forth in Article 12, paragraph (1), item (ii) of the Act is any particular concerning quality control.
(適合性検査の方法)
(Methods of Conformity Inspection)
第十九条法第十二条第二項の主務省令で定める検査の方法は、次の各号に掲げるものごとに、それぞれ当該各号に掲げるものとする。
Article 19The methods provided for by the order of the competent ministry as set forth in Article 12, paragraph (2) of the Act are those listed in the following items for the respective subject matter listed in those items:
一法第十二条第一項第一号に掲げるもの特別特定製品について、第三条の技術上の基準への適合を確認するために適切と認められる方法
(i)the subject matter set forth in Article 12, paragraph (1), item (i) of the Act:a method that is found to be appropriate for confirming the conformity of the Special Specified Products to the technical requirements set forth in Article 3; and
二法第十二条第一項第二号に掲げるもの試験用の特別特定製品について第三条の技術上の基準への適合を確認するために適切と認められる方法及び検査設備及び前条で定めるものについてその適合性検査に係る届出事業者の工場又は事業場における次条各号に掲げる基準への適合を確認するために適切と認められる方法
(ii)the subject matter set forth in Article 12, paragraph (1), item (ii) of the Act:a method that is found to be appropriate for confirming the conformity of the Special Specified Products for experimental purposes to the technical requirements set forth in Article 3, and a method that is found to be appropriate for confirming the conformity of the inspection equipment or the subject matter specified in the preceding Article to the requirements listed in the items of the following Article at the factory or workplace of the Notifying Enterprise pertaining to the Conformity Inspection.
(法第十二条第二項の主務省令で定める基準)
(Requirements Provided for by Order of Competent Ministry as Set Forth in Article 12, Paragraph (2) of the Act)
第二十条法第十二条第二項の主務省令で定める基準は、次の各号に掲げるものとする。
Article 20The requirements provided for by the order of the competent ministry as set forth in Article 12, paragraph (2) of the Act are those listed in the following items:
一別表第三の検査設備の欄に掲げる検査設備ごとにそれぞれ同表の検査設備の基準の欄に掲げるもの
(i)the requirements listed in the "Requirements for Inspection Equipment" column of Appended Table 3 for the respective inspection equipment listed in the "Inspection Equipment" column of the same table; and
二別表第四の品質管理に関する事項の欄に掲げる事項ごとにそれぞれ同表の基準の欄に掲げるもの
(ii)the requirements listed in the "Requirements" column of Appended Table 4 for the respective particulars listed in the "Particulars Concerning Quality Control" column of the same table.
(証明書の記載事項)
(Particulars to Be Stated in Certificate)
第二十一条法第十二条第二項の証明書の記載事項は、次の各号に掲げるものとする。
Article 21The particulars to be stated in the certificate as set forth in Article 12, paragraph (2) of the Act are those listed in the following items:
一国内登録検査機関又は外国登録検査機関の名称
(i)the name of the Domestically Registered Conformity Inspection Body or the Overseas Registered Conformity Inspection Body;
二申請者の氏名又は名称及び住所
(ii)the name and address of the applicant;
三特別特定製品の型式の区分
(iii)the classification of the types of the Special Specified Products;
四特別特定製品の製造番号及び製造期間(法第十二条第一項第一号に係るものに限る。)
(iv)the serial numbers and the manufacturing period of the Special Specified Products (limited to those pertaining to Article 12, paragraph (1), item (i) of the Act);
五特別特定製品を製造する工場又は事業場の名称及び所在地(輸入事業者にあつては、当該特別特定製品の製造事業者の氏名又は名称及び住所)
(v)the name and location of the factory or workplace manufacturing the Special Specified Products (in the case of an importer, the name and address of the manufacturer of the Special Specified Products);
六検査の方法
(vi)the method of inspection;
七法第三条の主務省令で定める技術上の基準及び法第十二条第二項の主務省令で定める基準(法第十二条第一項第二号に係るものに限る。)に適合している旨
(vii)the fact that the Special Specified Products conform to the technical requirements established in the order of the competent ministry as set forth in Article 3 of the Act and the requirements provided for by the order of the competent ministry as set forth in Article 12, paragraph (2) of the Act (limited to those pertaining to Article 12, paragraph (1), item (ii) of the Act); and
八証明書の交付年月日
(viii)the date of issuance of the certificate.

(Labeling)
第二十二条法第十三条の主務省令で定める方式は、次の各号に掲げる表示を、別表第五の特定製品の区分の欄に掲げる区分ごとにそれぞれ同表の表示の方法の欄に掲げる方法により表示する方式とする。
Article 22The format of labeling provided for by the order of the competent ministry as set forth in Article 13 of the Act is the format in which the labels listed in the following items are indicated by the methods listed in the "Labeling Method" column of Appended Table 5 for the respective classes listed in the "Classification of Specified Products" column of the same table:

Chapter IV Registration of the Conformity Inspection Body
(登録の区分)
(Classification of Registration)
第二十三条法第十六条第一項の主務省令で定める特別特定製品の区分は、次のとおりとする。

(i)beds for babies and infants;

(登録の申請)
(Application for Registration)
第二十四条法第十六条第一項の規定により登録の申請をしようとする者は、様式第十による申請書に次に掲げる書類を添えて、経済産業大臣に提出しなければならない。
Article 24A person who intends to file an application for registration pursuant to the provisions of Article 16, paragraph (1) of the Act must submit to the Minister of Economy, Trade and Industry a written application that has been prepared according to Form No. 10 together with the following documents:
一登記事項証明書又はこれに準ずるもの

(登録の更新の手続)

第二十七条法第十九条第一項の規定により、国内登録検査機関又は外国登録検査機関が登録の更新を受けようとする場合は、第二十三条及び第二十四条の規定を準用する。
Article 27When a Domestically Registered Conformity Inspection Body or an Overseas Registered Conformity Inspection Body intends to have its registration renewed pursuant to the provisions of Article 19, paragraph (1) of the Act, the provisions of Articles 23 and 24 apply mutatis mutandis.
第五章 国内登録検査機関

(事業所の変更の届出)
(Notification of Change of Place of Business)
第二十八条国内登録検査機関は、法第二十一条の規定により事業所の所在地の変更の届出をするときは、様式第十一による届出書を経済産業大臣に提出しなければならない。
Article 28When a Domestically Registered Conformity Inspection Body makes a notification of a change in the location of its place of business pursuant to the provisions of Article 21 of the Act, it must submit to the Minister of Economy, Trade and Industry a written notification that has been prepared according to Form No. 11.
(業務規程)
(Business Regulations)
第二十九条国内登録検査機関は、法第二十二条第一項の規定により業務規程の届出をするときは、適合性検査の業務を開始しようとする日の二週間前までに、様式第十二による届出書に業務規程を添えて、経済産業大臣に提出しなければならない。
Article 29(1)When a Domestically Registered Conformity Inspection Body makes a notification of its Business Regulations pursuant to the provisions of Article 22, paragraph (1) of the Act, it must submit to the Minister of Economy, Trade and Industry a written notification that has been prepared according to Form No. 12 together with the Business Regulations by two weeks prior to the day on which it intends to commence the Conformity Inspection affairs.
2前項の規定は、法第二十二条第一項後段の規定による業務規程の変更の届出に準用する。
(2)The provisions of the preceding paragraph apply mutatis mutandis to a notification of a change to Business Regulations under the provisions of the second sentence of Article 22, paragraph (1) of the Act.
3法第二十二条第二項の主務省令で定める事項は、次のとおりとする。

十前各号に掲げるもののほか、適合性検査の業務に関し必要な事項

(業務の休廃止)
(Suspension or Discontinuation of Business)
第三十条国内登録検査機関は、法第二十三条の規定により適合性検査の業務の全部又は一部の休止又は廃止の届出をするときは、様式第十三による届出書を経済産業大臣に提出しなければならない。
Article 30When a Domestically Registered Conformity Inspection Body makes a notification of suspension or discontinuation of the whole or a part of a Conformity Inspection affairs pursuant to the provisions of Article 23 of the Act, it must submit to the Minister of Economy, Trade and Industry a written notification that has been prepared according to Form No. 13.
(電磁的記録に記録された事項を表示する方法等)
(Means for Displaying Particulars Recorded in Electronic or Magnetic Records)
第三十条の二法第二十四条第二項第三号の主務省令で定める方法は、電磁的記録に記録された事項を紙面又は出力装置の映像面に表示する方法とする。
Article 30-2(1)The means for displaying particulars prescribed by the order of the competent ministry as set forth in Article 24, paragraph (2), item (iii) of the Act are the means of displaying particulars recorded in electronic or magnetic records on paper or on the screen of an output device.
2法第二十四条第二項第四号の主務省令で定める電磁的方法は、次に掲げるもののうち、国内登録検査機関が定めるものとする。
(2)The electronic or magnetic means prescribed by the order of the competent ministry as set forth in Article 24, paragraph (2), item (iv) of the Act are those listed in the following, which are specified by the Domestically Registered Conformity Inspection Body:
一送信者の使用に係る電子計算機と受信者の使用に係る電子計算機とを電気通信回線で接続した電子情報処理組織を使用する方法であつて、当該電気通信回線を通じて情報が送信され、受信者の使用に係る電子計算機に備えられたファイルに当該情報が記録されるもの
(i)means which use an electronic data processing system connecting a computer used by the transmitter and a computer used by the recipient by a telecommunications line, where information is transmitted via the telecommunications line and the information is recorded onto a file stored in the computer used by the recipient; and
二磁気ディスクその他これに準ずる方法により一定の情報を確実に記録しておくことができる物をもつて調製するファイルに情報を記録したものを交付する方法
(ii)a means of delivering a file containing information that has been prepared in the form of a magnetic disk or any other item in which certain information may be securely recorded by an equivalent method.

(Books)
第三十一条法第二十八条の主務省令で定める事項は次のとおりとする。
Article 31(1)The particulars prescribed by the order of the competent ministry as set forth in Article 28 of the Act are as follows:
一適合性検査を申請した者の氏名又は名称及び住所並びに法人にあつては、その代表者の氏名
(i)the name and address of the person who has filed an application for a Conformity Inspection, and where such person is a corporation, the name of the representative thereof;
二適合性検査の申請を受けた年月日
(ii)the date of receiving the application for a Conformity Inspection;
三適合性検査の申請に係る品目及び当該品目に係る法第六条第二号の主務省令で定める型式の区分
(iii)the item pertaining to the application for a Conformity Inspection and the classification of the type prescribed by the order of the competent ministry as set forth in Article 6, item (ii) of the Act pertaining to the item;
四適合性検査を行つた特別特定製品の品名並びに構造、材質及び性能の概要
(iv)the product name and the outline of the structure, material qualities, and performance of the Special Specified Products for which the Conformity Inspection was conducted;
五適合性検査を行つた年月日
(v)the date for conducting the Conformity Inspection;
六適合性検査を実施した検査員の氏名
(vi)the name of the inspector who conducted the Conformity Inspection; and
七適合性検査の概要及び結果
(vii)the outline and results of the Conformity Inspection.
2国内登録検査機関は、前項各号に掲げる事項を帳簿に記載するときは、特別特定製品ごと及び法第十二条第一項各号に掲げるものごとに区分して、記載しなければならない。
(2)When a Domestically Registered Conformity Inspection Body enters the particulars listed in the items of the preceding paragraph in its books, it must enter the particulars separately for the respective Special Specified Products and the respective subject matter listed in the items of Article 12, paragraph (1) of the Act.
3法第二十八条の規定により帳簿を保存しなければならない期間は、記載の日から三年とする。
(3)The period during which books must be kept pursuant to the provisions of Article 28 of the Act is three years from the day of entering particulars therein.
(電磁的方法による保存)
(Keeping by Electronic or Magnetic Means)
第三十二条前条第一項各号に掲げる事項が、電磁的方法により記録され、当該記録が必要に応じ電子計算機その他の機器を用いて直ちに表示されることができるようにして保存されるときは、当該記録の保存をもつて法第二十八条(法第三十条第二項において準用する場合を含む。)に規定する当該事項が記載された帳簿の保存に代えることができる。
Article 32(1)When the particulars listed in the items of paragraph (1) of the preceding Article are recorded by electronic or magnetic means, and are kept so that the record may be immediately displayed by using a computer or any other device as needed, the keeping of record may substitute for the keeping of books in which the particulars are entered as prescribed in Article 28 of the Act (including the cases where applied mutatis mutandis pursuant to Article 30, paragraph (2) of the Act).
2前項の規定による保存をする場合には、経済産業大臣が定める基準を確保するよう努めなければならない。
(2)In the case of keeping particulars under the provisions of the preceding paragraph, endeavors must be made to secure the standards specified by the Minister of Economy, Trade and Industry.

(国内登録検査機関に係る規定の準用)
(Application Mutatis Mutandis of Provisions Pertaining to Domestically Registered Conformity Inspection Body)
第三十四条第二十八条から第三十二条までの規定は、外国登録検査機関に準用する。この場合において、第二十八条中「法第二十一条」とあるのは「法第三十条第二項において準用する法第二十一条」と、第二十九条中「法第二十二条」とあるのは「法第三十条第二項において準用する法第二十二条」と、第三十条中「法第二十三条」とあるのは「法第三十条第二項において準用する法第二十三条」と、第三十一条中「法第二十八条」とあるのは「法第三十条第二項において準用する法第二十八条」と読み替えるものとする。
Article 34The provisions of Articles 28 through 32 apply mutatis mutandis to Overseas Registered Conformity Inspection Bodies.In this case, the phrase "Article 21 of the Act" in Article 28 is deemed to be replaced with "Article 21 of the Act as applied mutatis mutandis pursuant to Article 30, paragraph (2) of the Act," the phrase "Article 22 of the Act" in Article 29 is deemed to be replaced with "Article 22 of the Act as applied mutatis mutandis pursuant to Article 30, paragraph (2) of the Act," the phrase "Article 23 of the Act" in Article 30 is deemed to be replaced with "Article 23 of the Act as applied mutatis mutandis pursuant to Article 30, paragraph (2) of the Act," and the phrase "Article 28 of the Act" in Article 31 is deemed to be replaced with "Article 28 of the Act as applied mutatis mutandis pursuant to Article 30, paragraph (2) of the Act."
(旅費の額)
(Amount of Travel Expenses)
第三十五条令第九条の旅費の額に相当する額(以下「旅費相当額」という。)は、国家公務員等の旅費に関する法律(昭和二十五年法律第百十四号。以下「旅費法」という。)の規定の例により計算した旅費の額とする。この場合において、当該検査のためその地に出張する職員は、一般職の職員の給与等に関する法律(昭和二十五年法律第九十五号)第六条第一項第一号イに規定する行政職俸給表(一)による職務の級が四級である者であるものとしてその旅費の額を計算するものとする。
Article 35The amount equivalent to the amount of travel expenses as set forth in Article 9 of the Order (hereinafter referred to as the "Amount Equivalent to Travel Expenses") is the amount of travel expenses calculated by the same rule as that under the Act on Travel Expenses of National Public Officers, etc. (Act No. 114 of 1950; hereinafter referred to as the "Travel Expenses Act").In this case, the amount of travel expenses for an official who, for the purpose of the inspection, makes a business trip to the place where the inspection is conducted is to be calculated by deeming that the official is a person who is at the fourth grade in the service of the Administrative Service (I) Salary Schedule as prescribed in Article 6, paragraph (1), item (i), (a) of the Act on Remuneration of Officials in the Regular Service (Act No. 95 of 1950).

(Location of Office Where Official Works)
第三十六条旅費相当額を計算する場合において、当該検査のため、その地に出張する職員の旅費法第二条第一項第六号の在勤官署の所在地は、東京都千代田区霞が関一丁目三番一号とする。
Article 36In the case of calculating the Amount Equivalent to Travel Expenses, the location of the office where the official works as set forth in Article 2, paragraph (1), item (vi) of the Travel Expenses Act with regard to the official who, for the purpose of the inspection, makes a business trip to the place where the inspection is conducted is 1-3-1 Kasumigaseki, Chiyoda-ku, Tokyo, Japan.
(旅費の額の計算に係る細目)
(Details Pertaining to Calculation of Amount of Travel Expenses)
第三十七条旅費法第六条第一項の支度料は、旅費相当額に算入しない。
Article 37(1)The preparation fee as set forth in Article 6, paragraph (1) of the Travel Expenses Act is not included in the Amount Equivalent to Travel Expenses.
2検査を実施する日数は、当該検査に係る事務所又は事業所ごとに三日として旅費相当額を計算する。
(2)The number of days during which an inspection is conducted is deemed to be three days per office or place of business pertaining to the inspection when calculating the Amount Equivalent to Travel Expenses.
3旅費法第六条第一項の旅行雑費は、一万円として旅費相当額を計算する。
(3)The miscellaneous travel expenses as set forth in Article 6, paragraph (1) of the Travel Expenses Act are deemed to be 10,000 yen when calculating the Amount Equivalent to Travel Expenses.
4主務大臣が、旅費法第四十六条第一項の規定により、実費を超えることとなる部分又は必要としない部分の旅費を支給しないときは、当該部分に相当する額は、旅費相当額に算入しない。
(4)When the competent minister refrains from providing the portion of travel expenses that exceeds the actual expenses or that is unnecessary pursuant to the provisions of Article 46, paragraph (1) of the Travel Expenses Act, the amount equivalent to the portion is not included in the Amount Equivalent to Travel Expenses.
5機構が、旅費法第四十六条第一項の規定の例により、実費を超えることとなる部分又は必要としない部分の旅費を支給しないときは、当該部分に相当する額は、旅費相当額に算入しない。
(5)When the National Institute of Technology and Evaluation (NITE) refrains from providing the portion of travel expenses that exceeds the actual expenses or that is unnecessary based on the same rule as that under the provisions of Article 46, paragraph (1) of the Travel Expenses Act, the amount equivalent to the portion is not included in the Amount Equivalent to Travel Expenses.
第七章 雑則
Chapter VII Miscellaneous Provisions
(立入検査の証明書)
(Identification Card for On-site Inspection)
第三十八条法第四十一条第五項の規定により機構の職員が同条第一項又は第二項の規定による立入検査をする場合及び同条第七項の規定により機構の職員が同条第三項の規定による立入検査をする場合における同条第十一項の証明書は、様式第十四によるものとする。
Article 38An identification card as set forth in Article 41, paragraph (11) of the Act when an official of NITE conducts an on-site inspection under the provisions of Article 41, paragraph (1) or (2) of the Act pursuant to the provisions of paragraph (5) of the Act or when an official of NITE conducts an on-site inspection under the provisions of paragraph (3) of the same Article pursuant to the provisions of paragraph (7) of the same Article is one that has been prepared according to Form No. 14.
(聴聞の参考人)
(Witness in Hearing)
第三十九条聴聞の主宰者は、必要があると認めるときは、行政庁の職員、学識経験のある者その他の参考人に対し、聴聞に関する手続に参加することを求めることができる。
Article 39When the presiding official of a hearing finds it necessary, the official may request an official of an administrative agency, a person with relevant knowledge and experience, or any other witness to intervene in the hearing procedure.
(聴聞の期日又は場所の変更)

第四十条行政庁が行政手続法(平成五年法律第八十八号)第十五条第一項の通知をした場合(同条第三項の規定により通知をした場合を含む。)において、当事者は、やむを得ない理由があるときには、行政庁に対し、聴聞の期日又は場所の変更を申し出ることができる。
Article 40(1)Where an administrative agency has given a notice as set forth in Article 15, paragraph (1) of the Administrative Procedure Act (Act No. 88 of 1993) (including the case where it has given a notice pursuant to the provisions of paragraph (3) of the same Article), if there is an unavoidable reason, a party may request the administrative agency to change the date or place of the hearing.
2行政庁は、前項の申出により、又は職権により、聴聞の期日又は場所を変更することができる。
(2)An administrative agency may, upon the request set forth in the preceding paragraph or by its own authority, change the date or place of a hearing.
3行政庁は、前項の規定により聴聞の期日又は場所を変更したときは、速やかに、その旨を当事者、参加人(その時までに行政手続法第十七条第一項の求めを受諾し、又は同項の許可を受けている者に限る。)及び参考人(その時までに前条の求めを受諾している者に限る。)に通知しなければならない。
(3)When an administrative agency has changed the date or place of a hearing pursuant to the provisions of the preceding paragraph, it must promptly notify the parties, intervenors (limited to those who have accepted the request set forth in Article 17, paragraph (1) of the Administrative Procedure Act or who have received the permission set forth in the same paragraph by that time), and witnesses (limited to those who have accepted the request set forth in the preceding Article by that time) to that effect.

第四十一条行政手続法第十七条第一項の規定による許可の申請については、自らを利害関係人として当該聴聞手続に参加しようとする者は、聴聞の期日の十四日前までに、その氏名、住所及び当該聴聞に係る不利益処分につき利害関係を有することの疎明を記載した書面を主宰者に提出してこれを行うものとする。
Article 41(1)With regard to an application for permission under the provisions of Article 17, paragraph (1) of the Administrative Procedure Act, a person who intends to intervene in the hearing procedure as an interested party is to file such application by submitting to the presiding official a document stating the name and address of the person, and a prima facie showing that the person has an interest in the anticipated adverse disposition pertaining to the hearing, by fourteen days prior to the date of the hearing.
2主宰者は、前項の許可をしたときは、速やかに、その旨を当該申請をした者に通知しなければならない。
(2)When having given the permission set forth in the preceding paragraph, the presiding official must promptly notify the applicant to that effect.
(文書等の閲覧の手続)
(Procedure for Inspection of Records)
第四十二条行政手続法第十八条第一項の規定による閲覧の求めについては、当事者又は当該不利益処分がされた場合に自己の利益が害されることとなる参加人(以下この条において「当事者等」と総称する。)は、その氏名、住所及び閲覧をしようとする資料の標目を記載した書面を行政庁に提出してこれを行うものとする。ただし、聴聞の期日における審理の進行に応じて必要となつた場合の閲覧については、口頭で求めれば足りる。
Article 42(1)With regard to a request for inspection under the provisions of Article 18, paragraph (1) of the Administrative Procedure Act, a party or an intervenor whose interest would be harmed by a particular adverse disposition (hereinafter collectively referred to as a "Party, etc." in this Article) is to make such request by submitting to an administrative agency a document stating the name and address of the party or the intervenor, and the title of the material the party or the intervenor intends to inspect; provided, however, that it is sufficient to make such request orally when the need for an inspection arises during the course of proceedings on the date of the hearing.
2行政庁は、閲覧を許可したときは、その場で閲覧させる場合を除き、速やかに、閲覧の日時及び場所を当該当事者等に通知しなければならない。この場合において、行政庁は、聴聞の審理における当事者等の意見陳述の準備を妨げることがないよう配慮するものとする。
(2)When having permitted an inspection, an administrative agency must promptly notify the Party, etc. of the date, time, and place of the inspection, except in the case of having the Party, etc. inspect the material on the spot.In this case, the administrative agency is to give consideration to not obstructing the Party, etc. from preparing to make a statement of opinions in the proceedings of the hearing.
3行政庁は、聴聞の期日における審理の進行に応じて必要となつた資料の閲覧の求めがあつた場合に、当該審理において閲覧させることができないとき(行政手続法第十八条第一項後段の規定による拒否の場合を除く。)は、閲覧の日時及び場所を指定し、当該当事者等に通知しなければならない。この場合において、主宰者は、行政手続法第二十二条第一項の規定に基づき、当該閲覧の日時以降の日を新たな聴聞の期日として定めるものとする。
(3)If a request has been made for an inspection of a material for which a need has arisen during the course of proceedings on the date of the hearing, and if an inspection during the proceedings cannot be permitted (excluding the case of a rejection under the provisions of the second sentence of Article 18, paragraph (1) of the Administrative Procedure Act), an administrative agency must designate a date, time, and place for the inspection, and notify the Party, etc. thereof.In this case, the presiding official is to specify a day that falls on or after the date and time of the inspection as a new date for the hearing, based on the provisions of Article 22, paragraph (1) of the Administrative Procedure Act.

第四十三条行政手続法第十九条第一項の規定による主宰者の指名は、聴聞の通知の時までに行うものとする。
Article 43(1)Designation of a presiding official under the provisions of Article 19, paragraph (1) of the Administrative Procedure Act is to be carried out by the time of giving a notice of a hearing.
2行政庁は、行政手続法第十五条第一項の書面においては、同項各号列記の事項に加えて、聴聞の主宰者の氏名及び職名を教示しなければならない。
(2)In the document set forth in Article 15, paragraph (1) of the Administrative Procedure Act, an administrative agency must include the name and the job title of the presiding official of the hearing, in addition to the particulars listed in the items of the same paragraph.
3行政庁は、職権により、主宰者を変更することができる。
(3)An administrative agency may change the presiding official by its own authority.
4主宰者が行政手続法第十九条第二項各号のいずれかに該当するに至つたときは、行政庁は、速やかに、主宰者を変更しなければならない。
(4)When the presiding official comes to fall under any of the items of Article 19, paragraph (2) of the Administrative Procedure Act, an administrative agency must promptly change the presiding official.
5行政庁は、前二項の規定により主宰者を変更したときは、速やかに、その旨を当事者、参加人(その時までに行政手続法第十七条第一項の求めを受諾し、又は同項の許可を受けている者に限る。)及び参考人(その時までに第三十九条の求めを受諾している者に限る。)に通知しなければならない。

第四十四条主宰者は、聴聞事務補助者を指名し、聴聞の期日における審理にこれを出席させ、聴聞の主宰に関する事務を補助させることができる。
Article 44(1)A presiding official may designate a hearing affairs assistant, and have the assistant attend the proceedings on the date of the hearing and assist in the affairs concerning the presiding over of the hearing.
2行政手続法第十九条第二項の規定は、聴聞事務補助者について準用する。
(2)The provisions of Article 19, paragraph (2) of the Administrative Procedure Act apply mutatis mutandis to a hearing affairs assistant.
(補佐人の出頭許可の手続)

第四十五条行政手続法第二十条第三項の規定による許可の申請については、当事者又は参加人は、聴聞の期日の七日前までに、補佐人の氏名、住所、当事者又は参加人との関係及び補佐する事項を記載した書面を主宰者に提出してこれを行うものとする。ただし、行政手続法第二十二条第二項(行政手続法第二十五条後段において準用する場合を含む。)の規定により通知をされた聴聞の期日に出頭させようとする補佐人であつて既に受けた許可に係る事項につき補佐するものについては、この限りではない。
Article 45(1)With regard to an application for permission under the provisions of Article 20, paragraph (3) of the Administrative Procedure Act, a party or an intervenor is to file such application by submitting to the presiding official a document stating the name and address of the assistant, the relationship between the assistant and the party or intervenor, and the particular to be assisted in, by seven days prior to the date of the hearing; provided, however, that this does not apply to an assistant whose appearance is intended to be on the date of the hearing which has been notified pursuant to the provisions of Article 22, paragraph (2) of the Administrative Procedure Act (including the cases where applied mutatis mutandis pursuant to the second sentence of Article 25 of the Administrative Procedure Act) and who is to assist in a particular for which permission has already been received.
2主宰者は、補佐人の出頭を許可したときは、速やかに、その旨を当該当事者又は参加人に通知しなければならない。
(2)When having given permission for the appearance of an assistant, a presiding official must promptly notify the party or intervenor to that effect.
3補佐人の陳述は、当該当事者又は参加人が直ちに取り消さないときは、自ら陳述したものと見なす。

(聴聞の期日における陳述の制限及び秩序維持)

第四十六条主宰者は、聴聞の期日に出頭した者が当該事案の範囲を超えて陳述するときその他議事を整理するためにやむを得ないと認めるときは、その者に対し、その陳述又は証拠書類等の提出を制限することができる。
Article 46(1)When a person who has appeared on the date of the hearing makes a statement beyond the scope of the case or when the presiding official otherwise finds it to be inevitable, the presiding official may restrict such person's statements or such person's production of documentary evidence, etc.
2主宰者は、前項に規定する場合のほか、聴聞の審理の秩序を維持するため、聴聞の審理を妨害し、又はその秩序を乱す者に対し退場を命ずることその他適当な措置を採ることができる。
(2)Beyond the case prescribed in the preceding paragraph, the presiding official may order a person who obstructs the proceedings of the hearing or disrupts order at the hearing to leave the room or take any other appropriate measures against such person, in order to maintain order at the proceedings of the hearing.

第四十七条行政庁は、行政手続法第二十条第六項の規定により聴聞の期日における審理の公開を相当と認めるときは、聴聞の期日、場所及び事案の内容を公示するものとする。この場合において、行政庁は、当事者、参加人(その時までに行政手続法第十七条第一項の求めを受諾し、又は同項の許可を受けている者に限る。)及び参考人(その時までに第三十九条の求めを受諾している者に限る。)に対し、速やかに、その旨を通知するものとする。
Article 47(1)When an administrative agency finds it to be reasonable to make the proceedings on the date of the hearing open to the public pursuant to the provisions of Article 20, paragraph (6) of the Administrative Procedure Act, it is to publicly notify the date and place of the hearing and the contents of the case.In this case, the administrative agency is to promptly notify the parties, intervenors (limited to those who have accepted the request set forth in Article 17, paragraph (1) of the Administrative Procedure Act or who have received the permission set forth in the same paragraph by that time), and witnesses (limited to those who have accepted the request set forth in Article 39 by that time) to that effect.

第四十八条行政手続法第二十一条第一項の規定による陳述書の提出は、提出する者の氏名、住所、聴聞の件名及び当該聴聞に係る不利益処分の原因となる事実及び当該事案の内容についての意見を記載した書面により行うものとする。
Article 48The submission of a written statement under the provisions of Article 21, paragraph (1) of the Administrative Procedure Act is to be carried out by submitting a document stating the name and address of the submitter, the name of the hearing, the fact that will be the cause of the anticipated adverse disposition, and an opinion on the contents of the case.

(iv)the names and addresses of the parties, intervenors, and their agents and assistants (hereinafter collectively referred to as "Parties, etc." in this paragraph and in paragraph (3)) and witnesses (excluding officials of an administrative agency) and the names and the job titles of witnesses (limited to officials of an administrative agency), who appeared on the date of the hearing;

2聴聞調書には、書面、図画、写真その他主宰者が適当と認めるものを添付して調書の一部とすることができる。
(2)In a record of a hearing, a document, drawing, photograph, or any other item which the presiding official finds appropriate may be attached to constitute a part of the record.
3報告書には、次に掲げる事項を記載し、主宰者がこれに記名押印しなければならない。

第五十条行政手続法第二十四条第四項の規定による閲覧の求めについては、当事者又は参加人は、その氏名、住所及び閲覧をしようとする聴聞調書又は報告書の件名を記載した書面を、聴聞の終結前にあつては聴聞の主宰者に、聴聞の終結後にあつては行政庁に提出してこれを行うものとする。
Article 50(1)With regard to a request for inspection under the provisions of Article 24, paragraph (4) of the Administrative Procedure Act, a party or an intervenor is to make such request by submitting to the presiding official of the hearing, if prior to the conclusion of the hearing, and to an administrative agency, if after the conclusion of the hearing, a document stating the name and address of the party or the intervenor, and the title of the record of the hearing or the written report the party or the intervenor intends to inspect.

第五十一条法第五十一条第一項の規定により申請をしようとする者は、様式第十五による申請書を経済産業大臣に提出しなければならない。
Article 51(1)A person who intends to file an application pursuant to the provisions of Article 51, paragraph (1) of the Act must submit to the Minister of Economy, Trade and Industry a written application that has been prepared according to Form No. 15.

第二条この省令の規定による改正後の経済産業省関係特定製品の技術上の基準等に関する省令(以下「新省令」という。)別表第一の5.携帯用レーザー応用装置(レーザー光(可視光線に限る。)を外部に照射して文字又は図形を表示することを目的として設計したものに限る。)の項の技術上の基準の欄中1(1)⑤の要件は、この省令の施行の日から三月間は、適用しない。
Article 2The requirement set forth in 1 (1) (v) in the "Technical Requirements" column of the row of "5. Portable Laser Application Devices" (limited to those that have been designed to display characters or graphics by externally emitting a laser beam (limited to a visible light beam)) in Appended Table 1 of the Ministerial Order on Technical Requirements for Specified Products Related to the Ministry of Economy, Trade and Industry after the revision by the provisions of this Ministerial Order (hereinafter referred to as the "New Ministerial Order") does not apply for three months from the day of enforcement of this Ministerial Order.
第三条この省令の施行の日から起算して一月を経過するまでの間に限り、消費生活用製品安全法施行令(昭和四十九年政令第四十八号)別表第二の二の項の上欄に掲げる特別特定製品(以下「追加特別特定製品」という。)に係る認定検査機関が消費生活用製品安全法(以下「法」という。)第二十二条第一項の届出(同項後段の変更の届出を含む。)をする場合における新省令第二十九条第一項(同条第二項において準用する場合を含む。)の適用については、同条第一項中「二週間」とあるのは、「三日」とする。
Article 3(1)Until one month has elapsed from the day of enforcement of this Ministerial Order, with regard to the application of Article 29, paragraph (1) of the New Ministerial Order (including the cases where applied mutatis mutandis pursuant to paragraph (2) of the same Article) when a certified inspection body pertaining to the Special Specified Products listed in the left column of Row 1 in Appended Table 2 of the Order for Enforcement of the Consumer Product Safety Act (Cabinet Order No. 48 of 1974) (hereinafter referred to as "Additional Special Specified Products") makes a notification as set forth in Article 22, paragraph (1) of the Consumer Product Safety Act (hereinafter referred to as the "Act") (including a notification of change as set forth in the second sentence of the same paragraph), the term "two weeks" in Article 29, paragraph (1) of the New Ministerial Order is deemed to be replaced with "three days."
2この省令の施行の日から起算して一月を経過するまでの間に限り、追加特別特定製品に係る承認検査機関が法第二十九条第二項において準用する法第二十二条第一項の届出(法第二十九条第二項において準用する法第二十二条第一項後段の変更の届出を含む。)をする場合における新省令第三十四条において準用する新省令第二十九条第一項(新省令第三十四条において準用する新省令第二十九条第二項において準用する場合を含む。)の適用については、同条第一項中「二週間」とあるのは、「三日」とする。
(2)Until one month has elapsed from the day of enforcement of this Ministerial Order, with regard to the application of Article 29, paragraph (1) of the New Ministerial Order as applied mutatis mutandis pursuant to Article 34 of the New Ministerial Order (including the cases where applied mutatis mutandis pursuant to Article 29, paragraph (2) of the New Ministerial Order as applied mutatis mutandis pursuant to Article 34 of the New Ministerial Order) when a certified inspection body pertaining to Additional Special Specified Products makes a notification as set forth in Article 22, paragraph (1) of the Act as applied mutatis mutandis pursuant to Article 29, paragraph (2) of the Act (including a notification of a change as set forth in the second sentence of Article 22, paragraph (1) of the Act as applied mutatis mutandis pursuant to Article 29, paragraph (2) of the Act), the term "two weeks" in Article 29, paragraph (1) of the New Ministerial Order is deemed to be replaced with "three days."

第二条届出事業者は、密閉燃焼式の石油ストーブであつて強制対流形のもの又は半密閉燃焼式の石油ストーブであつて強制対流形のものを製造し、又は輸入する場合においては、この省令の施行の日から一年間は、この省令による改正後の経済産業省関係特定製品の技術上の基準等に関する省令(以下「新省令」という。)別表第一の九.石油ストーブの項の技術上の基準の欄一(二)の規定を適用しないことができる。
Article 2(1)In the case of manufacturing or importing closed-combustion oil stoves with forced convection or semi-closed-combustion oil stoves with forced convection, a Notifying Enterprise may choose not to apply the provisions of 1 (2) in the "Technical Requirements" column of the "9. Oil Stoves" row in Appended Table 1 of the Ministerial Order on Technical Requirements for Specified Products Related to the Ministry of Economy, Trade and Industry after the revision by this Ministerial Order (hereinafter referred to as the "New Ministerial Order") for one year from the day of enforcement of this Ministerial Order.
2密閉燃焼式の石油ストーブであつて強制対流形のもの又は半密閉燃焼式の石油ストーブであつて強制対流形のものについての新省令別表第一の九.石油ストーブの項の技術上の基準の欄十二(三)の規定の適用については、この省令の施行の日から一年間は、同欄十二(三)中「安全に使用する上で必要となる使用上の注意事項の表示」とあるのは、「不完全燃焼防止装置を有する場合にはその旨の表示又は不完全燃焼防止装置を有しない場合にはその旨及び充分に換気をしないと死亡事故に至るおそれがある旨の表示、及び安全に使用する上で必要となる使用上の注意事項の表示」と読み替えるものとする。
(2)With regard to the application of the provisions of 12 (3) in the "Technical Requirements" column of the "9. 第三条届出事業者は、開放燃焼式の石油ストーブであつて強制通気形のものを製造し、又は輸入する場合においては、この省令の施行の日から九月間は、新省令別表第一の九.石油ストーブの項の技術上の基準の欄一(三)④及び⑤の規定は、適用しないことができる。
Article 3(1)In the case of manufacturing or importing open-combustion oil stoves with forced aeration, a Notifying Enterprise may choose not to apply the provisions of 1 (3) (iv) and (v) in the "Technical Requirements" column of the "9. Article 4(1)In the case of manufacturing or importing open-combustion stoves with an airtight oil tank, a Notifying Enterprise may choose not to apply the provisions of 11 (1) in the "Technical Requirements" column of the "9. Oil Stoves" row in Appended Table 1 of the New Ministerial Order for nine months from the day of enforcement of this Ministerial Order.

Article 2In the case of manufacturing or importing pressure cookers for home use or riding helmets, a Notifying Enterprise may, until six months have elapsed from the day of enforcement of this Ministerial Order, choose to apply the provisions prior to the revision with regard to the application of the provisions of the "3. Pressure Cookers for Home Use" row and the "4. Riding Helmets" row in Appended Table 1 of the Ministerial Order on Technical Requirements for Specified Products Related to the Ministry of Economy, Trade and Industry after the revision by this Ministerial Order.

Article 2(1)A disposition, procedure, or any other act which was made or carried out prior to the enforcement of this Ministerial Order pursuant to the provisions of the Ministerial Order on Technical Requirements for Specified Products Related to the Ministry of Economy, Trade and Industry prior to the revision by the provisions of this Ministerial Order and for which corresponding provisions exist in this Ministerial Order is deemed to have been made or carried out pursuant to the corresponding provisions of the Ministerial Order after the revision by the provisions of this Ministerial Order, unless otherwise provided for by these Supplementary Provisions.
2この省令の施行の際現に消費生活用製品安全法第十二条第二項の証明書の交付を受けている特別特定製品(同法第二条三項に規定する「特別特定製品」をいう。)に係る型式の区分及び検査設備については、この省令による改正後の経済産業省関係特定製品の技術上の基準等に関する省令別表第二及び別表第三の規定にかかわらず、当該証明書の有効期間内は、なお従前の例による。
(2)Prior laws continue to govern the classification of the type of products and inspection equipment pertaining to Special Specified Products (meaning the "special specified products" prescribed in Article 2, paragraph (3) of the Consumer Product Safety Act) for which the certificate set forth in Article 12, paragraph (2) of the same Act has already been issued at the time of enforcement of this Ministerial Order during the valid period of the certificate, notwithstanding the provisions of Appended Tables 2 and 3 of the Ministerial Order on Technical Requirements for Specified Products Related to the Ministry of Economy, Trade and Industry after the revision by this Ministerial Order.

1(1) 本体とふたの着脱は円滑であること。

(2) 本体とふたとのはめ合わせが不完全な場合、蒸気が漏れる構造を有し、この状態において加熱したとき、内部のゲージ圧力(以下「内圧」という。)が5.0キロパスカル以上にならない構造を有すること。
(2) The cooker has a structure which leaks out steam when the lid is not completely fitted to the cooker, and when the cooker is heated under such conditions, the internal gauge pressure (hereinafter referred to as the "Internal Pressure") does not exceed 5.0 kilopascals.

2 コック等の操作により蒸気を排出する減圧装置を有し、その操作をして内圧が5.0キロパスカル未満になつた後でなければ、ふたを開けることができない構造を有すること。ただし、次の各号にあつては、この限りでない。

(1) In the case of a cooker whose lid is fitted to the cooker in the form of a slide lid, the cooker has a structure whereby the lid cannot be removed from the cooker when trying to slide the lid by applying a force of 107.9 newtons to the tip of the handle, where the Internal Pressure is 5.0 kilopascals and oil is applied to the fitted part between the cooker and the lid.

3(1) 取つ手は持ちやすい形状で、本体若しくはふたとの接合が確実にされているもの又は容易に、かつ、確実にできるものであること。
3 (1) The handles are easy to hold, and they are joined to the cooker or to the lid securely, or they can be easily and securely joined to the cooker or to the lid.

6(1) 圧力調整装置及び安全装置を有し、そのノズルは目詰まりしにくく、かつ、掃除がしやすいこと。
6 (1) The cooker has a pressure-adjusting device and a safety device, and their nozzles are hard to clog and easy to clean.

(2) 圧力調整装置のおもりは、脱落しにくい構造を有すること。
(2) The weight of the pressure-adjusting device has a structure that is hard to detach.

(3) 安全装置は、作動時に直接外部に飛び出さない構造を有すること。
(3) The safety device has a structure that does not directly pop out of the cooker when activated.

7(1) 圧力調整装置は、円滑に作動すること。
7 (1) The pressure-adjusting device is activated smoothly.

(2) 圧力調整装置が作動した場合における圧力なべ及び圧力がまの最高の内圧(以下「使用最高圧力」という。)は147.1キロパスカル以下であること。
(2) Where the pressure-adjusting device has been activated, the maximum Internal Pressure (hereinafter referred to as the "Maximum Working Pressure") of the pressure cooker is no more than 147.1 kilopascals.

8 安全装置は、使用最高圧力の3倍以下の内圧(以下「安全装置作動圧力」という。)で作動し、この場合において、圧力なべ又は圧力がまの各部に異状がないこと。
8 The safety device is activated when the Internal Pressure is no more than three times the Maximum Working Pressure (hereinafter referred to as the "Safety Device Activating Pressure"), and no abnormality occurs to any part of the pressure cooker in such case.

9 安全装置作動圧力の2倍の内圧に1分間耐え、その内圧を取り去つた後、圧力なべ又は圧力がまの各部に異状がないこと。
9 The cooker is able to withstand an Internal Pressure that is twice as large as the Safety Device Activating Pressure for one minute, and no abnormality occurs to any part of the pressure cooker in such case after such Internal Pressure has been removed.

10 通常の使用状態において、取つ手の温度は室温プラス40度以下であること。また、取扱説明書にミトン等を用いて、やけどに注意する旨の事項を記載してあること。

1(1) ヘルメットの構成部品は、通常の使用状態において、経年劣化により、その性能に影響を与えるものでないこと。また、皮膚に有害な影響を与えないものであること。
1 (1) The components of the helmet do not affect the performance of the helmet through age-related deterioration when used normally; nor they have a harmful effect on the wearer's skin.

(2) 金具類は、耐食性のもの又はさび止め処理を施したものであること。
(2) Metal parts are corrosion-resistant or are subjected to rust-proof treatment.

2(1) ヘルメットの外表面は十分に滑らかであり、また、凸部又は段差については面取りがなされていること。なお、ヘルメットの外表面は、日本工業規格T8133(2007)乗車用ヘルメット3.13に定める参照平面から上方にあつては、機能的に必要な場合を除き、連続した凸曲面であり、参照平面から下方は流線型であること。

1 すれ、傷その他の欠点がなく仕上げが良好であること。

2 落下衝撃試験を行つたとき、初回にはロープの衝撃応力が、技術上の基準の欄の4(2)の表示のあるものにあつては7845.3ニュートン以下、その他のものにあつては11768.3ニュートン以下であり、2回目にはロープが切断しないこと。
2 When drop impact tests are conducted, in the first test, the impact stress on the rope is no more than 7845.3 newtons in the case of a rope having the indication set forth in 4 (2) of the "Technical Requirements" column, and no more than 11769.3 newtons in the case of any other rope, and in the second test, the rope is not cut off.

5. 携帯用レーザー応用装置
5. Portable Laser Application Devices
|
1(1) 次に掲げる要件のいずれにも該当するもの(外形上玩具として使用されることが明らかなもの及びそれ以外の形状のものであつて装置の設計上又は機能上長時間レーザー光を目に向けて照射することを目的として設計したものを除く。)にあつては、日本工業規格C6802(2005)レーザ製品の安全基準3.17クラス1レーザ製品又は3.19クラス2レーザ製品であること。
1 (1) In the case of a device that satisfies all of the following requirements (excluding a device where it is obvious from its appearance that it is to be used as a toy or a device of any other shape whose design or function has been intended for emitting a laser beam to the eye for a long time), the device is JIS C6802 (2005) Safety of Laser Products 3.17 Class 1 Laser Product or 3.19 Class 2 Laser Product.

① 全長が8センチメートル以上であること。
(i) The total length of the device is 8 centimeters or more.
|
|
② レーザー光が放出状態にあることを確認できる機能を有すること。
(ii) The device has a function that allows a user to confirm that a laser beam is being emitted.
|
|
(2) (1)のもの以外のものにあつては、日本工業規格C6802(2005)レーザ製品の安全基準3.17クラス1レーザ製品(その放出持続時間が8.4e)時間基準3)を満たすものに限る。)であること。
(2) In the case of a device other than that set forth in (1) above, the device is JIS C6802 (2005) Safety of Laser Products 3.17 Class 1 Laser Product (limited to that whose emission duration satisfies 8.4 e) Time Requirement 3)).

3(1) 外形上玩具として使用されることが明らかなもの又はそれ以外の形状のものであつて対象、位置等を指し示すために用いるものにあつては、レーザー光の放出状態を維持する機能(ただし、手動により維持する場合を除く。以下「放出状態維持機能」という。)を有さないこと。
3 (1) In the case of a device where it is obvious from its appearance that it is to be used as a toy or a device of any other shape which is to be used for pointing at an object or a position, the device does not have a function that allows the laser beam to be maintained in a state of being emitted (excluding, however, the case of maintaining such state manually; hereinafter referred to as an "Emission Maintaining Function").

(2) (1)のもの以外のものにあつては、次に掲げるすべての要件を満たす場合に限り、放出状態維持機能を有することができる。
(2) In the case of a device other than that set forth in (1) above, the device may have an Emission Maintaining Function only if it satisfies all of the following requirements.

① レーザーシステムが故障した場合には、シャッター等によりレーザー光を自動的に遮断する機能、レーザー光の放出を自動的に停止する機能等を有すること又は当該装置に割り当てられたクラスの被ばく放出限界(日本工業規格C6802(2005)レーザ製品の安全基準8.3クラス分けに対する責任に示されたものをいう。)を超えないようにレーザー光の放出量を自動的に調整する機能を有すること。
(i) The device has a function that automatically cuts off the laser beam with a shutter or the like or a function that automatically stops the emission of the laser beam in the case of a failure of the laser system, or has a function that automatically adjusts the emission volume of the laser beam so that it does not exceed the accessible emission limit allotted to the class assigned to the device (meaning such limit as indicated in JIS C6802 (2005) Safety of Laser Products 8.3 Responsibilities for Each Class).

② 使用者の操作によらずにレーザー光の放出が停止された場合において、再度レーザー光を放出するときは、スイッチを入れ直すこと等を必要とすること。
(ii) When the emission of the laser beam has been stopped but not by the operation of the user, the device requires the user to turn on the switch again or to take another action in order to emit the laser beam again.

(2) 次に掲げる注意事項その他安全に使用する上で必要となる使用上の注意事項が容易に消えない方法により適切に表示されていること。ただし、外形上玩具として使用されることが明らかなものにあつては③の注意事項を表示することを要せず、それ以外の形状のもののうち、装置の設計上又は機能上長時間レーザー光を目に向けて照射することを目的として設計したものにあつては①及び②の注意事項を表示することを要せず、カメラにあつてその焦点を自動的に調節する機能を有するもの(日本工業規格C6802(2005)レーザ製品の安全基準3.17クラス1レーザ製品(その放出持続時間が8.4e)時間基準3)を満たし、かつ、レーザー光を連続して照射する時間が3秒未満であるものに限る。)にあつては②の注意事項を表示することを要しない。
(2) The following precautions and any other precautions for use that will be necessary for ensuring safe use are appropriately indicated in such a manner whereby it does not fade easily; provided, however, that, an indication of the precaution set forth in (iii) below is not required in the case of a device where it is obvious from its appearance that it is to be used as a toy, an indication of the precautions set forth in (i) and (ii) below is not required in the case of a device of any other shape whose design or function has been intended for emitting a laser beam to the eye for a long time, and an indication of the precaution set forth in (ii) below is not required in the case of a device in a camera which has a function that automatically adjusts its focus (limited to JIS C6802 (2005) Safety of Laser Products 3.17 Class 1 Laser Product whose emission duration satisfies 8.4 e) Time Requirement 3), and which continuously emits a laser beam for less than three seconds).

6. Bathwater Circulators
|
1 浴槽用温水循環器の吸入口は、次の(1)~(6)の欄に掲げる条件において2の欄に掲げる試験を30回実施した場合、そのすべてについて測定値が20ニュートン以下となるものであること。
1 When the test set forth in column 2 below is conducted 30 times under the conditions listed in columns (1) through (6) below on the inlet of the bathwater circulator, the measurement value is no more than 20 newtons in all of those tests.

(1) 浴槽用温水循環器を設置に関する説明書に従つて設置し、通常動作に限定されたとおり水を入れること。
(1) The bathwater circulator is installed according to the installation manual, and water fills the bath in line with the restrictions specified for normal operation.

(2) 2(1)及び(2)の毛髪(以下「試験用毛髪」という。)は、50グラム及び180グラムの人間の毛髪を、直径25ミリメートルで長さ300ミリメートルの木製の棒に取り付けたものとし、その際、毛髪の固定されていない部分の長さは400ミリメートルとすること。
(2) The hair set forth in 2 (1) and (2) (hereinafter referred to as the "Sample Hair") is human hair of 50 grams and 180 grams attached to wooden sticks with a diameter of 25 millimeters and a length of 300 millimeters, and the length of the part of the hair that is not attached to the stick is 400 millimeters.

(3) 試験用毛髪は、あらかじめ2分以上浴槽内の水につけておくこと。

2 試験は、試験用毛髪を吸入口に置いた上で、浴槽用温水循環器に定格電圧を供給し、浴槽用温水循環器の動作中に試験用毛髪を一方の側から他方の側へ2.5分間にわたつて吸入口に吸い込まれるよう動かした上で、垂直の方向及び垂直より約40度の角度の方向に当該試験用毛髪が吸入口から離れるまで引つ張り、その力を測定する試験とする。ただし、試験に用いる試験用毛髪は、次の(1)及び(2)の欄に掲げる引張方向に応じ、それぞれ当該(1)及び(2)の欄に定めるものとする。

(2) 吸入口に毛髪が吸い込まれるおそれがあるので注意すること、吸入口のカバー等がゆるんだ状態又は外れた状態で運転しないこと、運転中に浴槽内に潜らないこと、子供が入浴する際には十分注意することその他安全に使用する上で必要となる使用上の注意事項が容易に消えない方法により適切に表示されていること。

1 日本工業規格S3031(2002)石油燃焼機器の試験方法通則(以下「JIS試験通則」という。)6.1.1に定める温度条件を満たした試験室(以下「JIS試験室」という。)において、JIS試験通則6.7に定める燃焼排ガス中の一酸化炭素の二酸化炭素に対する比(CO/CO2)の測定方法(以下「石油燃焼機器のCO/CO2の測定方法」という。)による測定を行つたとき、測定値が0.01以下であること。
1 When, in a testing laboratory that meets the temperature conditions specified in JIS S3031 (2002) General Rules for Test Methods of Oil Burning Appliances (hereinafter referred to as the "General Rules for JIS Tests") 6.1.1 (such laboratory is hereinafter referred to as a "JIS Laboratory"), measurement is taken by the method for measuring the ratio of carbon monoxide to carbon dioxide (CO/CO2) in the combustion exhaust gas as specified in the General Rules for JIS Tests 6.7 (hereinafter referred to as the "CO/CO2 Measuring Method for Oil-fired Water Heaters"), the measurement value is no more than 0.01.

2 JIS試験室において、JIS試験通則6.1、6.2のe)、f)及びi)に定める各部の温度上昇試験を行つたとき、次に掲げる条件に適合すること。

(3) 機器本体と一体の油タンクにあつては、油タンクの表面温度と室温との差が25度以下であること。

3 JIS試験室において、JIS試験通則17.に定める給湯温度試験を行つたとき、給湯温度が90度以下であること。また、浴槽内からふろがまに循環する水の温度は60度以下であること。また、過熱防止装置を有するものにあつては、直接加熱する熱交換器に対し、JIS試験通則15.2に定める過熱防止装置の作動試験を行つたとき、100度に達する前に消火し、自動復帰しないこと。
(3) When a hot-water supply temperature test as specified in the General Rules for JIS Tests 17. is conducted in a JIS Laboratory, the hot-water supply temperature is no more than 90 degrees Celsius. In addition, the temperature of the water circulating from the bathtub to the bath heater is no more than 60 degrees Celsius. Also, in the case of a heater having an overtemperature protection device, when an activation test of the overtemperature protection device as specified in the General Rules for JIS Tests 15.2 is conducted on a directly-heated heat exchanger, the device extinguishes the fire before the temperature reaches 100 degrees Celsius, and is not restored automatically.

4 直接加熱する熱交換器を保護する機能として、次の(1)又は(2)に掲げる条件に適合すること。ただし、直接加熱するふろがま用熱交換器にあつては、この限りではない。

5 直接加熱するふろがま用熱交換器を有するものにあつては、JIS試験室において、JIS試験通則19.2に定める耐空だき性試験を行つたとき、次に掲げる条件に適合すること。

(2) ふろがま用熱交換器内に水を入れた後、減水したとき、下部循環管下端(浴槽側)の水位に達してから10秒以内に消火すること。また、消火後、直ちに浴槽内に水を入れ、再び点火操作を行つても、給湯機の外に火炎が出たり、破損したりしないこと。
(2) When water decreases after it has been supplied into the heat exchanger for a bath heater, the fire is extinguished within 10 seconds after the water level reaches the lower edge of the lower circulation tube (the bathtub side). In addition, even if water is supplied into the bathtub and fire is reignited immediately after the fire has been extinguished, no flame is produced outside the water heater nor does the water heater break.

6 JIS試験室において、JIS試験通則29.1及び29.3に定める振動試験を行つたとき、周期0.3秒、0.5秒及び0.7秒のそれぞれにおいて、170センチメートル毎秒毎秒で加振したとき、10秒以内で消火し、消火するまでの間に異常燃焼しないこと。
6 When a vibration test as specified in the General Rules for JIS Tests 29.1 and 29.3 is conducted in a JIS Laboratory, and the heater is vibrated at 170 centimeters per second per second with each of the frequencies of 0.3 seconds, 0.5 seconds, and 0.7 seconds, the fire is extinguished within 10 seconds, and no abnormal combustion occurs before the fire is extinguished.

7 JIS試験室において、JIS試験通則52.に定める耐断火性試験を行つたとき、灯油の供給が再開されたときに、自動的に燃焼を再開しないこと。

1 JIS試験室において、石油燃焼機器のCO/CO2の測定方法による測定値が0.01以下であること。

2 JIS試験室において、JIS試験通則6.1、6.2のf)及びi)に定める各部の温度上昇試験を行つたとき、次に掲げる条件に適合すること。

(1) 浴槽内に水がないと点火できないこと。

(2) 浴槽内に水を入れた後、減水したとき、下部循環管上端(強制循環式のものにあつては下部循環管下端)の水位に達してから10秒以内(ポット式にあつては5分以内)に消火すること。また、消火後、直ちに浴槽内に水を入れ、再び点火操作を行つても、ふろがまの外に火炎が出たり、破損したりしないこと。
(2) When water decreases after it has been supplied into the bathtub, the fire is extinguished within 10 seconds (within five minutes in the case of a pot-type heater) after the water level reaches the upper edge of the lower circulation tube (the lower edge of the lower circulation tube in the case of a forced-circulation heater). 4 JIS試験室において、JIS試験通則29.1及び29.2に定める振動試験を行つたとき、周期0.3秒、0.5秒及び0.7秒のそれぞれにおいて、195センチメートル毎秒毎秒で加振したとき、次の(1)又は(2)に掲げる条件に適合すること。また、いずれの場合も、消火するまでの間に異常燃焼しないこと。
4 When a vibration test as specified in the General Rules for JIS Tests 29.1 and 29.2 is conducted in a JIS Laboratory, and the heater is vibrated at 195 centimeters per second per second with each of the frequencies of 0.3 seconds, 0.5 seconds, and 0.7 seconds, the results comply with the conditions set forth in (1) or (2) below, and no abnormal combustion occurs before the fire is extinguished.

(1) 10秒以内に消火装置が作動し、消火装置の作動後に10秒以内で消火すること。

9. 石油ストーブ

1(1) JIS試験室において、石油燃焼機器のCO/CO2の測定方法による測定値が、密閉燃焼式及び半密閉燃焼式のものにあつては0.01以下、開放燃焼式のものであつて強制通気形のものにあつては0.002以下、開放燃焼式のものであつて自然通気形のものにあつては0.001以下であること。
1 (1) The measurement value taken by the CO/CO2 Measuring Method for Oil-fired Water Heaters in a JIS Laboratory is no more than 0.01 in the case of a closed-combustion or semi-closed-combustion stove, no more than 0.002 in the case of an open-combustion stove with forced aeration, and no more than 0.001 in the case of an open-combustion stove with natural aeration.
|
(2) 密閉燃焼式のものであつて対流用送風機を有するもの及び半密閉燃焼式のものであつて対流用送風機を有するものにあつては、不完全燃焼を防止する装置(以下「不完全燃焼防止装置」という。)を有し、次に掲げる条件に適合すること。
(2) In the case of a closed-combustion stove with a circulating fan and a semi-closed-combustion stove with a circulating fan, the stove has a device for preventing incomplete combustion (hereinafter referred to as an "Incomplete Combustion Prevention Device"), and confirms to the following conditions.

① 室内に排気ガスが排出されるように機器の排気部分を外し、JIS試験通則44.1に定める不完全燃焼防止装置の作動試験の密閉試験を行つたとき、不完全燃焼防止装置の作動後20秒以内(ポット式のものにあつては5分以内)で消火し、一酸化炭素の二酸化炭素に対する比(CO/CO2)が0.01を超えないこと。ただし、排気筒外れにより消火する機能を有するものにあつては、消火する機能が作動しないようにして試験を行うこと。
(i) When the exhaust tube of the device is removed so that the exhaust gas is released into the laboratory and a close test of the Incomplete Combustion Prevention Device activation test as specified in the General Rules for JIS Tests 44.1 is conducted, the fire is extinguished within 20 seconds (within five minutes in the case of a pot-type stove) after the Incomplete Combustion Prevention Device has been activated, and the ratio of carbon monoxide to carbon dioxide (CO/CO2) does not exceed 0.01; provided, however, that in the case of a stove having a function that extinguishes fire when the exhaust tube is removed, the test is conducted in a manner that does not activate such fire-extinguishing function.
|
|
② 不完全燃焼の検知部が機能しなかつたとき、消火するものであり、かつ、容易に改造できない構造であること。
(ii) The Incomplete Combustion Prevention Device extinguishes the fire when the incomplete combustion detector does not function, and has a structure that cannot be easily modified.
|
|
③ 連続して4回を上限として不完全燃焼防止装置が作動した後は、連続して作動したことを使用者に認識させる機能(以下「不完全燃焼通知機能」という。)を有すること。
(iii) When the Incomplete Combustion Prevention Device is activated in a sequence for a maximum of four times, the device has a function that has the user recognize that the device has been activated in a sequence (hereinafter referred to as the "Incomplete Combustion Notifying Function").
|
|
④ 不完全燃焼通知機能が作動した後、連続して3回を上限として不完全燃焼防止装置が作動した後は、制御用乾電池の交換等の通常の操作により再び点火する状態にならないようにする機能(以下「再点火防止機能」という。)を有すること。
(iv) When the Incomplete Combustion Prevention Device is activated in a sequence for a maximum of three times after the Incomplete Combustion Notifying Function is activated, the device has a function that prevents the stove from being reignited when carrying out normal operation such as the replacement of dry-cell batteries in the control mechanism (hereinafter referred to as the "Reignition Prevention Function").
|
|
(3) 開放燃焼式のものであつて強制通気形のものにあつては、不完全燃焼防止装置を有し、次に掲げる条件に適合すること。
(3) In the case of an open-combustion stove with forced aeration, the stove has an Incomplete Combustion Prevention Device and complies with the following conditions.
|
|
① JIS試験通則44.1に定める不完全燃焼防止装置の作動試験の密閉試験を行つたとき、不完全燃焼防止装置の作動後20秒以内で消火し、一酸化炭素の二酸化炭素に対する比(CO/CO2)が0.003を超えないこと。
(i) When a close test of the Incomplete Combustion Prevention Device activation test as specified in the General Rules for JIS Tests 44.1 is conducted, the fire is extinguished within 20 seconds after the Incomplete Combustion Prevention Device has been activated, and the ratio of carbon monoxide to carbon dioxide (CO/CO2) does not exceed 0.03.

|
② JIS試験通則44.2に定める不完全燃焼防止装置の作動試験の給気不足試験を行つたとき、不完全燃焼防止装置の作動後20秒以内で消火し、石油燃焼機器のCO/CO2の測定方法による測定値が0.003を超えないこと。
(ii) When an insufficient air supply test of the Incomplete Combustion Prevention Device activation test as specified in the General Rules for JIS Tests 44.2 is conducted, the fire is extinguished within 20 seconds after the Incomplete Combustion Prevention Device has been activated, and the measurement value taken by the CO/CO2 Measuring Method for Oil-fired Water Heaters does not exceed 0.003.

|
③ 不完全燃焼の検知部が機能しなかつたとき、消火するものであり、かつ、容易に改造できない構造であること。
(iii) The Incomplete Combustion Prevention Device extinguishes the fire when the incomplete combustion detector does not function, and has a structure that cannot be easily modified.
|
|
④ 不完全燃焼通知機能を有すること。
(iv) The Incomplete Combustion Prevention Device has an Incomplete Combustion Notifying Function.
|
|
⑤ 再点火防止機能を有すること。
(v) The Incomplete Combustion Prevention Device has a Reignition Prevention Function.
|
|
2 密閉燃焼式のものにあつては、JIS試験室において、JIS試験通則50.に定める排気筒外れによる安全性試験を行つたとき、排気筒が外れてから30秒以内に灯油を遮断し、遮断後20秒以内(ポット式のものにあつては5分以内)に消火すること。
2 In the case of a closed-combustion stove, when a safety test removing the exhaust tube as specified in the General Rules for JIS Tests 50. is conducted in a JIS Laboratory, the heating oil is cut off within 30 seconds after the removal of the exhaust tube and the fire is extinguished within 20 seconds (within five minutes in the case of a pot-type stove) after the cut-off.

3 密閉燃焼式の燃焼用空気管及び半密閉燃焼式の燃焼用空気管にあつては、次に掲げる条件に適合すること。
3 Closed-combustion-type combustion air pipes and semi-closed-combustion-type combustion air pipes conform to the following conditions.
|
|
(1) 燃焼用一次空気管及び二次空気管にあつては、耐久性を損なう曲げ、ねじれなどがないこと。
(1) The primary and secondary combustion air pipes have no bends or twists that could affect durability.
|
|
(2) 燃焼用二次空気管を有するものにあつては、燃焼用送風機とバーナとを結ぶ燃焼用二次空気管の接続部が確実に接続されていること。
(2) In the case of a stove that has a secondary combustion air pipe, the connecting parts of the secondary combustion air pipe that links the combustion fan and the burner are securely connected.

(3) 燃焼用二次空気管の材質は日本工業規格S2031(2007)密閉式石油ストーブの表5―材料に定める金属であること。

4 JIS試験室において、JIS試験通則6.1、6.2のe)、f)及びi)に定める各部の温度上昇試験、6.4に定める温風温度の測定並びに6.5に定める熱気温度の測定を行つたとき、次に掲げる条件に適合すること。
4 When a temperature rise test is conducted for each part as specified in the General Rules for JIS Tests 6.1 and 6.2 e), f), and i), when a warm-air temperature measurement is taken as specified in the General Rules for JIS Tests 6.4, and when a hot-air temperature measurement is taken as specified in the General Rules for JIS Tests 6.5 in a JIS Laboratory, the results meet the following conditions.

(1) 機器下面の木台の表面温度が45度以下であること。ただし、密閉燃焼式のもの又は半密閉燃焼式のものであつて機器下面と置台又は床面に3センチメートル以上の間隔を設けるように設計されたものにあつては、機器下面の木台の表面温度と室温との差が65度以下であること。
(1) The surface temperature of the wooden stand below the stove is no more than 45 degrees Celsius; provided, however, that, in the case of a closed-combustion stove or a semi-closed-combustion stove which has been designed to allow a space of 3 centimeters or more between the bottom surface of the stove and the stand or the floor, the difference between the room temperature and the surface temperature of the wooden stand below the stove is no more than 65 degrees.

(2) 機器周辺の木台の表面温度と室温との差が65度以下であること。

5 開放燃焼式のもので自然通気形のものにあつては、JIS試験室において、JIS試験通則8.に定めるしん調節器最大燃焼試験を行つたとき、次に掲げる条件に適合すること。
5 In the case of an open-combustion stove with natural aeration, when a wick adjuster maximum combustion test as specified in the General Rules for JIS Tests 8. is conducted in a JIS Laboratory, the results meet the following conditions.

(1) すすを伴う煙が生じないこと。

7 密閉燃焼式のものであつて強制対流形のもの、半密閉燃焼式のものであつて強制対流形のもの及び開放燃焼式のものであつて強制通気形のものにあつては、JIS試験通則15.1に定める過熱防止装置の作動試験を行つたとき、次の条件に適合すること。

9 JIS試験室(開放燃焼式のものであつて自然通気形のものにあつては、温度が20度±5度)において、JIS試験通則29.1及び29.2に定める振動試験を行つたとき、周期0.3秒、0.5秒及び0.7秒のそれぞれにおいて、195センチメートル毎秒毎秒で加振したとき、次の(1)又は(2)に掲げる条件に適合すること。また、いずれの場合も、消火するまでの間に異常燃焼しないこと。

11 開放燃焼式のものであつて気密油タンクを有するものにあつては、次に掲げる条件に適合すること。

(1) JIS試験室において、気密油タンクに油タンク容量の1割まで灯油を入れ、機器を点火してから30分経過後、機器から気密油タンクを抜いたとき、1分30秒以内で消火する装置(以下「給油時消火装置」という。)を有すること。
