Ministry of Justice Order No. 1 of May 8, 2019
民法（明治二十九年法律第八十九号）第四百四条第三項及び第五項の規定に基づき、民法第四百四条第三項に規定する期及び同条第五項の規定による基準割合の告示に関する省令を次のように定める。
Based on the provisions of Article 404, paragraph (3) and paragraph (5) of the Civil Code (Act No.89 of 1896), the Ministerial Order on the period prescribed in Article 404, paragraph (3) of the Civil Code and public notice of the benchmark rate under paragraph (5) of that Article is enacted as follows.
（最初の期）
(First Period)
第一条民法の一部を改正する法律（平成二十九年法律第四十四号）の施行後最初の期（民法第四百四条第三項に規定する期をいう。以下同じ。）は、令和二年四月一日から令和五年三月三十一日までとする。
Article 1The first period (meaning the period prescribed in Article 404, paragraph (3) of the Civil Code; the same applies hereinafter) after the enforcement of the Act for Partial Revision of the Civil Code (Act No. 44 of 2017) is from April 1, 2020 to March 31, 2023.
（基準割合の告示）
(Public Notice of the Benchmark Rate)
第二条民法第四百四条第五項の規定による基準割合の告示は、各期の初日の一年前までに、官報でする。
Article 2Public notice of a benchmark rate under Article 404, paragraph (5) of the Civil Code is to be issued in the Official Gazette by one year before the first day of each period.
附　則
Supplementary Provisions
第一条この省令は、民法の一部を改正する法律の施行の日から施行する。
Article 1This Ministerial Order comes into effect as of the date on which the Act for Partial Revision of the Civil Code comes into effect.
第二条民法の一部を改正する法律の施行後最初の期における基準割合の告示についての第二条の適用については、同条中「各期の初日の一年前までに」とあるのは、「この省令の施行後速やかに」とする。
Article 2With regard to the application of Article 2 to public notice of a benchmark rate in the first period after the enforcement of the Act for Partial Revision of the Civil Code, the term "by one year before the first day of each period" in that Article is deemed to be replaced with "promptly after the enforcement of this Ministerial Order".
