Regulations for Enforcement of the Act on Promoting Business Activities for Exploring and Developing Space Resources
Cabinet Office Order No. 73 of December 16, 2021
(Definitions)
Article 1The terms used in this Cabinet Office Order are governed by the definitions in the Act on Promoting Business Activities for Exploring and Developing Space Resources (referred to below as the "Act").
(Acts Prescribed by Cabinet Office Order Referenced in Article 2, item (ii), (b) of the Act)
Article 2The act prescribed by Cabinet Office Order referenced in Article 2, item (ii), (b) of the Act is the transportation of space resources.
(Application of Special Provisions on Licenses for Control of Spacecraft)
Article 3(1)A person that intends to obtain a license for exploring and developing space resources prescribed in Article 3, paragraph (1) of the Act must submit the business activities plan in Form 1, along with the application form prescribed in Article 20, paragraph (2) of the Act on Launching Spacecraft and Launch Vehicle and Control of Spacecraft (Act No. 76 of 2016; referred below to as the "Space Activities Act").
(2)The matters prescribed by Cabinet Office Order referenced in Article 3, paragraph (1), item (vi) of the Act are the financial plan and system for implementing business activities for exploring and developing space resources prescribed in item (i) of that paragraph.
(Special Provisions on Announcement Methods)
Article 4(1)The cases prescribed by Cabinet Office Order referenced in the proviso to Article 4 of the Act are cases in which a person engaging in the business activities has submitted to the Prime Minister a document that describes matters that if publicly announced would be likely to unjustly harm interests related to business activities for exploring and developing space resources, and the reasons for that likelihood, and the reasons are considered rational and valid.
(2)The matters prescribed by Cabinet Office Order referenced in Article 4, item (iii) of the Act are the date and license number of the license under Article 20, paragraph (1) of the Space Activities Act.
Supplementary Provisions
This Cabinet Office Order comes into effect as of the effective date of the Act (23 December, 2021).
